Columbia Heights City Council Meeting
August 24, 1981
The meeting was called to order by Council President Heintz at 8:00 pm.
i. Roll Call

2. Invocation
The Invocation was offered by Associate Pastor Richard Mork of the First Lutheran
Church.
3. Minutes of Previous Meetings
Motion by Hentges, second by Logacz to approve the minutes of the Regular Meeting
of July 27th; the Board of Trustees Meeting of duly 27th; and the Regular Meeting
of August 10th, with additions as recommended by the City Attorney regarding the
minutes of August 10th, as presented in writing; and that the reading be dispensed
with. Roll call: All ayes
Mayor Nawrocki joined the meeting at 8:03 pm.
3a Proclamation
Mayor Nawrocki proclaimed August 25, 1981 as GRASSLANDS DAY in the City of Columbia
Heights and briefly explained what the GRASSLANDS project in Anoka County is.
4. Oral Petitions
There were no oral petitions.
Ordinances and Resolutions
a. Second reading of Ordinance No.963 being an ordinance amending Ordinance No.853,
City Code of 1977, pertaining to arcades.
The second reading of this ordinance had been continued from the meeting of August 10th
at which time members of the Council requested the City Attorney to incorporate into
the ordinance some of their concerns regarding arcades. At this meeting the City At-
torney presented two additional versions of the ordinance for Council consideration.
He explained the differences in the three versions, the original amended version,
and version a and version b. Considerable discussion followed concerning arcades.
Motion by Norberg, second by Logacz to waive the reading of the revised version a and
revised version b of Ordinance No.963. Roll call: [ogacz, Norberg, Hentges, Nawrocki--
aye Heintz--nay Motion fails. An unanimous vote is necessary to waive the reading
of an ordinance.
Motion by Hentges to waive the second reading of Ordinance No.963. Motion fails for
lack of a second.
Motion by Hentges to read Ordinance No. 963. Motion dies for lack of a second.

RESOLUTION 81-46
RESOLUTION APPROVING THE INFILTRATION/INFLOW
CONTRACT BETWEEN THE CITY OF
COLUMBIA HEIGHTS AND PROFESSIONAL SERVICES
GROUP, INC., ENGINEERING CONSULTANTS
WHEREAS, the City of Columbia Heights has been designated the authority to ad-
minister the Infiltration/Inflow Joint Study for the City of Columbia Heights
and the City of Hilltop by virtue of a joint powers agreement between the com-
munities; and
WHEREAS, the City of Columbia Heights did request engineering proposals to com-
Plete an Infiltration/Inflow Study of the respective sewer systems; and

WHEREAS, the City Council of the City of Columbia Heights did review said pro-
posals and awarded conceptual approval of the proposal submitted by Professional
Services Group, Inc. on July 27, 1~81; and
WHEREAS, Professional Services Group, Inc. has submitted a contract proposal to
the ~ity of Columbia Heights based upon its conceptual j>roposal; and
WHEREAS, the contract has been reviewed by the City Council of the City of Colum-
bia Heights,
WHEREAS, the United States Environmental Pollution Agency will fund 75~ of the
study cost and the State of Minnesota will contribute 15% of the study cost
under a matching grant f'und.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Columbia Heights
that:
]. The proposed contract in the a~unt not to exceed $~,340 is approved.
2. The City of Columbia Heights will not authorize Professional Services
Group, Inc. to proceed with the contract and no a~unt of ~ney shall
be due to Professional Services Group, Inc. pursuant to the contract
unless the contract, including the amounts to be paid by the Metro-
politan Waste Control Commission and Environmental Protection Agency
have been approved by the Metropolitan Waste Control Commission, the
Minnesota Pollution Contro]'Agency, am the Environmental Protection
Agency. Upon Professional Services Group, Inc.'s providing pr~f of
the fulfillment of the terms of paragraph two of this resolution, the
city shall make payments to Professional Servlces Group, Inc., pursuant
to the terms of the above contract.
3. That an estimated ceiling price of $5,500 for City Force Account Work
be included in the grant request, resu]ting in a final total estimte
of $104,840 to conduct the I/I Analysis.
4. That the Mayor and City Manager be authorized to execute said contract
with Professional Services Group, Inc. and Suburban Engineering, Inc.
upon approval of the Metropolitan Waste Control Commission and Minne-
sota Pol]ution Control Aoencv.

6. Communications
a. Burger King, 3939 Central Avenue Privacy Fence
Burger King is appealing the Planning and Zoning Commission decision to deny a permit
for a privacy fence to run across the rear of their property. The fence was constructed
approximately two months ago without a fence permit. This fence will have to be removed
to allow access of the 17 unit apartment building on the vacant lot behind Burger King.
The fence as it stands meets all the requirements of the fencing ordinance.
Motion by Hentges, second by Norberg to direct the City Manager and HRA to arrange to
negotiate partial removal of the fence, and to restore it to its original condition after
the apartment building has been moved. Roll call: All ayes

c. League of Minnesota Cities--Policy on the Percentage of Votes to Adopt or Amend a
rter
The League study committee on general legislation is developing a policy on the percentage
of votes that should be required to adopt a charter or a charter amendment. The League
is requesting that each member city indicate a preference regarding the percentage.
Motion by Hentges, second by Logacz to recommend the percentage of 51% needed to adopt
or amend a charter to the League of Minnesota Cities. Councilman Norberg noted that the
charter is a p~allel to the Constitution and it takes considerable effort to change the
Constitution. Councilman Heintz concurred.

d. Redistricting of Anoka County
The City Manager spoke to a letter he had received from the Anoka County Board of Com-
missioners advising the Council that the County has been redistricted into seven districts.
7. 01d and New Business
a. Old Business
1. Electronic Typewriter for Library
The Library Director provided examples of material which would be generated at the Library
by the use of this typewriter. She also presented additional information regarding how
much time will be saved with the use of this machine and how the additional staff time
will be spent. Using graphs, the Director showed the Council the comparative results of
timed typing tests and she spoke to how this typewriter accommodates the needs of the
Library in a much superior fashion compared to other typewriters considered.
Eotion by Logacz, second by Norberg to authorize the City Manager to purchase one Olivetti
T 221 Electronic Typewriter from Calc-Type,lnc. in the amount of $1,755 based upon low,
informal quotation; and, furthermore, that the Mayor and City Manager be authorized to
execute a service agreement in the amount of $189 per year.
Motion by Heintz, second by Hentn~ to table this matter until the Library supplies formal
quotations that meet specs. Roll call: Heintz, Hentges--aye Logacz, Norberg, Nawrocki--

2. Library Building Roof
The City Manager gave the background on the roof'presently on the Library and what firms
have been contacted regarding their recommendations for specific repairs. He also contacted
TKDA who is conducting the maxi-energy audit with regards to what they would recommend
or services they would perform to repair the roof. TKDA advised the City Manager that the
maxi-energy audit would not specifically define whether or not the roof should be replaced.
Motion by Norberg, second by Logacz to authorize the City Manager to amend the contract
with TKDA to investigate and specify the work of repair or replacement of the roof of the
Library. Councilman Hentges feels the roof should be patched now to avoid any further risk
of leaks damaging the inside of the Library. Roll call: Logacz, Norberg, Nawrocki--aye

3. License Request for Amusement Machines Located at Heights Theatre
ction on this request was delayed pending additional information regarding the proposed
inance on arcades. The request in its original form was for the machines to be accessible
to the public during those times when a film was not being shown in the theatre. This plan
has been altered so that the game room would be open only when a film was being shown
and a person must purchase a ticket to the film to gain entrance to the game room. The City
Attorney said since this plan has been altered the game room would be considered an accessory

use of the facility and not the primary use. At this point in ti~ the game room ~ould
not be considered an arcade therefore, would not be subject to the proposed arcade ordi-
nance. This may change in the future. Legal counsel for the Cinemaland Corporation add-
ressed the Council and explained that his client is asking for the licensing of the
machines and not for the licensing of a game room. Councilman Hentges raised the question
of games of skill being 200 feet from the nearest church and whether the placement of
these machines in the theatre would be in violation of that ordinance requirement. The
City Attorney f~t they would and will check this out.
Motion by Heintz, second by Hentges to deny the license request since the ordinance is
not being complied with. The attorney for Cinemaland requested that the license applicat-
ion be tabled at this time rather than denied.

4. Passenger Waiting Station--4Oth Avenue and Central
Motion by Hentges that the Council approve of the Traffic Commission's recommendation
to relocate the bus shelter presently at 40th and Central to a new proposed location
north of the Dragon House Restaurant, but on Anoka County property Motion dies for
lack of a second. ·
5. 42½ and 44½ Avenues Funding of Arbitration Award and Other Costs
The City Manager gave alternative ways to finance the arbitration award. They are as
follows: an additional assessment; an appropriation from the General Fund. Much dis-
cussion followed concerning the dollars involved and some of the specifics of the
arbitration award.
Motion by Hentges, second by Logacz to assess the property owners 10% more of the
project and the balance to come out of the General Unallocated Fund. Roll call: Logacz,
Hentges, Nawrocki--aye Heintz, Norberg--nay Motion carries.

ving Fund (PIR). Councilman Norberg feels all of the costs for the repairs or replacements
should be paid by the homeowners who ask for them. Councilman Heintz feels none of the costs
should be assessed back to the homeowners, but should be paid out of the General Unall-

6. Fire Cadet Recognition
Motion by Norberg, second by Hentges to authorize the expenditure of an amount not to
exceed $295 for recognition of participants in the Fire Cadet Progra%funds to be
taken from the General Unallocated Fund balance. Roll call: All ayes
7. Joint Powers Agreement regarding Transfer of Parking Lot Located South of 40th Avenue
on Van Buren Street
The City Manager reviewed the details of the agreement and the responsibilities of each of
the parties to the agreement regarding costs and maintenance. The Council had some concerns
with parts of the agreement and questioned if that part of the lot that is adjacent to
Cental Avenue was included in the agreement.
Motion by Logacz, second by Heintz to table this matter until the next regular meeting.

Motion by Hentges, second by Logacz to approve merit adjustment to Jackie Niccum in the

3.Authorizations to Purchase
a. Pipe for Storm Sewer Project for Huset Park--Field # 5
Motion by Heintz, second by Norberg to authorize the City Manager to purchase 300 lineal
feet of 8" PVC-SDR-35 pipe from Goodwin Company of St. Paul in the amount of $2.00 per
lineal foot (amounting to a total of $600) based upon low, informal quotation. Roll call:

b. VARDA Portable Alarm
Motion by Hentges, second by Logacz to authorize the City Manager to purchase one VARDA
portable alarm from Northland Security Systems in Bemidji, Minnesota, in the amount of
$1,170. This is a proprietary item. Roll call: All ayes
c. Fencing--Huset Park
Motion by Logacz, second by Hentges to authorize the City Manager to expend funds for
encing and installation of fencing on ballfield # 5 and a practice area for the east
nnis courts from Cyclone Fence- U.S. Steel of St. Paul in the amount of $3,097, based
upon iow, informal quotation. There was some discussion whether this area would continue
to be used as a practice area for the tennis courts or if the use of this area would be
designated for some other use. Roll call: Logacz, Nawrocki--aye Heintz, Norberg, Hentges-
nay Motion fails.
d. Asphalt Work on Projects 7900 and 8120
Motion by Heintz, second by Hentges to award the asphalt work on projects 7900 and 8120
in the sum of $3,500 to Plehal Blacktopping of Shakopee; and furthermore, that the Mayor
and City Manager be authorized to execute an agreement for same. Project 7900 is the
asphalt work on 42½ Avenue and 44½ Avenue. Project 8120 is the asphalt work on the access
road from 50th Avenue into Columbia Court. This access road had previously been included
in a project that had been denied except for the access road. Since the proposal is much
higher than the original estimate staff was seeking Council approval on this specific
project by itself. Costs are higher on this project because it is being presented by its-
elf and not part of a larger package. Roll call: A11 ayes
4. Authorization to Retain Electrical Engineer for Design of LaBelle Park Lighting
The intent of this request is to get authorization to retain an engineer to design a more
effective lighting system in LaBelle Park and one that would be less vulnerable to van-
dals. Councilman Hentges felt this project should not go ahead until the moving of 41st
Avenue is completed, as well as, construction of the condominiums.
Motion by Hentges, second by Heintz to table this matter for further consideration and
to direct the City Manager to contact P. J. Gaughan, the developer of the condominiums
to explore lighting that would be most desirable and effective in this area. Roll call:
