HomeMy WebLinkAboutSept 28, 1981Official Proceedings Regular Council Meeting September 28, 1981 The meeting was called to order by Mayor Nawrocki at 8:04 pm. 1. Roll call: Logacz, Heintz, Norberg, Hentges, Nawrocki-present 2. Invocation The Invocation was offered by Pastor Douglas Henderson of Peoples Chu_~ch. 3. Minutes of Previous Meetings Motion by Heintz, second by Logacz to approve the minutes of the Regular Council Meeting of September 14th, the Continuation of the Regular Council Meeting of September 15th, the Columbia Heights Fire Department Relief Association Meeting of September 15th, and the Continuation of the Regular Council Meeting of September 21st, as presented in writing, and that the reading be dispensed with. Roll call: All ayes Motion by Heintz, second by Hentges to reconsider the approval of the minutes of the Regular Council meeting of August 10th. Roll call on reconsideration: All ayes Motion by Heintz, second by Logacz to amend the approved minutes of August 10th; amend- ments to be made to the incorrectly submitted Findings of Fact and Order of the Doschadis case. Roll call: All ayes 4. Oral Petitions A representative of the Cargill Company in Columbia Heights addressed the Council regarding some of the work presently being done on 37th Avenue in the area of Cargill. Much discussion followed concerning what is planned for this area and problems Cargill has been experiencing. It was felt there were still some questions that needed answering. Motion by Logacz, second by Hentges to table this matter until the next special meeting on September 29th for additional information. Roll call: All ayes 5. Ordinances and Resolutions a. Second Reading of Ordinance No.975 being an ordinance amending Ordinance No.853, City Code of 1977, pertaining to the rezoning of certain real estate. This ordinance deals with the rezoning of the property on Peters Place where the HRA is moving a 17 unit apartment building. The City Manager gave the background on this rezoning request and the need for it. The Executive Director of the HRA, with the use of a map, showed the site where the building presently is located and where it is being moved. At the new location there will be more parking space and over ten thousand square feet of space more. Numerous residents gave opinions as to where they felt this building should be located or why it should not be placed on Peters Place. The Mayor offered many suggestions as to how the location chosen could be more acceptable. These suggestions were later formed into a motion. Councilman Norberg felt more time was needed before the building was moved to the proposed location. Motion by Norberg to table this matter until a future time. Motion dies for lack of a second. Many of the residents in attendance said they would be comfortable with ad- ditional spaces for parking and a green area with a place for children to play. It was also suggested that the number of apartments in the building be lowered from 17 to 14. Motion by Norberg to communicate to the HRA to have no more construction done on the project where the apartment building is to be moved until the Council has had a chance to act and that this hearing be continued until the second regular meeting in October. Motion dies for lack of a second. Motion by Heintz, second by Norberg to waive the reading of the ordinance there being ample copies available to the public. Roll call: All ayes Regular Council Meeting September 28, 1981 page 2 ORDINANCE NO. 975 BEING AN ORDINANCE AHENDING ORDINANCE NO. 853, CITY coDE OF 1977, PERTAINING TO THE REZONING OF CERTAIN REAL ESTATE The City Council of the City of Columbia Heights does ordain: Section 1: Ordinance No. 853, City Code of 1977, passed June 21, 1977, is herewith amended to reflect the following change, to-wit: The east 165.00 feet of the south 180.00 feet of the north 330.00 feet of Block 4, Walton's Rearrangement of Lots 33 and 34, Block 6, Reservoir Hills, Anoka County, Hinnesota which is currently zoned "CBD" Business District, is herewith rezoned to "R-3" Multiple Family Residence District. Section 2: The Official Zoning tiap is herewith amended to reflect the said rezoning. Section 3: This Ordinance shall be in full force and effect from and after thirty (30) days after /ts passage. Ask the HRA to explore the purchase of property across Peters Place, and if funds are available, to acquire that property. 2. Meet with citizens and discuss best use of property in conjunction with the project. 3. Discuss with citizens on Peters Place the pros and cons of closing off Peters Place. 4 The City Council should ask the Planning Zoning Commission to review the City's housing code with respect to rental units in the community and make recommendations to the City Council, if, in their considered judgement, it would be desireable to upgrade the housing code in the inspections to go along with it on rental units. Councilman Norberg asked to have included in the motion a request for the HRA to explore alternative locations for the building and alternatives with respect to HUD. The Mayor responded that the HRA had already spoken to alternative locations earlier in the meeting and that it has been explored. The Mayor did request that the Executive Director of the HRA discuss the concerns expressed at this meeting with HUD, particularly in the area of the number of units in the building and the intended use of the building. Second Reading of Ordinance No.965 being an ordinance amending Ordinance No.853, City Code of 1977, providing for issuance of on-sale wine licenses and providing for the regulation thereof. c. Second Reading of Ordinance No.972 being an ordinance amending Ordinance No.853, City Code of 1977, pertaining to intoxicating liquor. d. Second Reading Of Ordinance No.973 being an ordinance amending Ordinance No.853, City Code of 1977, pertaining to licensing (intoxicating liquor) All three of these ordinances were scheduled for their second reading at this meeting. The City Manager reviewed these three ordinances and their revisions. Since there had been significant interest shown in these ordinances by residents Councilman Heintz suggested that a commission be formed to investigate the content of the ordinances, formulate any recommendations that may come from this commission into one ordinance~ and give their recommendations to the Council. Motion by Heintz, second by Logacz to table the second reading of Ordinances 965, 972 and 973 until the second regular Council meeting in November and that the Mayor be authorized to appoint a committee to research these ordinances and make recom- mendations to the City Council. Roll call: All ayes RECESS: 11:55 RECONVENE: 12:10 Motion by Hentges, second by Heintz to dispense with the ll:30 rule and to continue with the agenda until 1:00 am. S.E.Thayer, 3901 Central Avenue, Conditional Use Permit This request for a conditional use permit had been denied by the Planning & Zoning Com- mission. Mr. Thayer was appealing the Commission's decision and was to present additional information at this meeting regarding this request. There was considerable discussion regarding the nature of a conditional use permit if the use of property is changed. Motion by Hentges to direct the City Attorney to research the possibility of issuing a conditional use permit with added language to revert back if the property is not being used as intended. Motion dies for lack of a second. Motion by Logacz, second by Heintz to grant the conditional use permit and the variance needed for the parking. There was further discussion regarding the primary use of the building and Mr. Thayer's intentions to lease the rest of the floor space in the build- ing. The City Planner, who originally worked on this matter, was not in attendance at the meeting. Motion by Heintz, second by Norberg to table this matter for additional information and a copy of the survey map until September 29th.
