The meeting was convened by Mayor Nawrocki at 8:02 pm.

Hotion by Norberg, second by Heintz to approve the minutes of the October 26th Regular
Council Meeting, end the October 27th Continuation of the Regular Council Meeting; as
presented in writing, and that the reading be dispensed with. Roll call: All ayes
~. Publlc Hearinq
The purpose of this publlc hearing is to determine whether the building at 4342 6th
street is considered to be hazardous and substandard. The City Building Inspector and
an attorney from the City Attorney's office gave the background on this matter. The
Building Inspector supplemented his testimony with pictures taken of the present con-
dition of the house. Elmer Crohn, Chief of Property Management for the Veterans Ad-
~inlstration, presented to the Council a llst of plans the VA has to bring this build-
lng up to code. Much discussion followed regarding these plans, costs and tlme needed
to make the repairs. A petition from neighbors to the house In question had been sub-
~itted prevlously. Some of these neighbors attended the meeting and spoke to the general
condition of the structure. The City Attorney advised the Council that if the repalrs
are not fully completed within 90 days, that the structure should be ',azed or removed
~ithin 120 days and these number of days were Incorporated into the Findings of Fact
and Order. Councilmen Heintz felt that the Veterans Administration has had sufficient
time to have begun some of these repairs long before now.

Pursuant to Minnesota Statutes, Section &63.15 to t63.261, the Council
of the City of Columbia Eeights, havln~ duly considered the ~atter, finds

Ordinance No.982 was offered by Heintz, second by Logacz and the roll ca1! was as follows:

Councilman Norberg's primary reason for voting against this ordinance is as follows: "With
this much money on the table, and with the potential profitability of the franchise, the fact
that there was only one bidder indicates clearly that there is something wrong somewhere and
we should reject all bidders and restart the process." The Mayor said that the franchise for
Columbia Heights is only guaranteed for ten years, unlike most all of the other franchises that
are fifteen years and considering the small service area in question this would not be consider-
ed a 'choice' area by cable companies. The Chairman of the Cable Commission cited many reasons
why the Commission was convinced that Teleprompter was a quality bidder and referred to calls
placed to innumerable cities that presently are served by Teleprompter and are finding them
very satisfactory. It was also noted by the Chairman that many other cable companies felt this
would not be an area that would ultimately result in a profitable venture because of its size
and limited number of potential subscribers. The Commission repeatedly questioned Telepromter
people on their position of profitibility in our City. They were convinced that the market is
there and since they are in a position of leadership in the business they were willing to take
a risk. Since Ordinance No.982 is very lengthy having it on display in public places would
satisfy the publication requirements.
Motion by Heintz, second by Logacz that the Council adopt the list provided by the City Manager
as being at least ten of the most public places in the City of Columbia Heights. Roll call: All
ayes. The most public places chosen are as follows: John Murzyn Hall, Anoka County License
Bureau, Northeast State Bank, Columbia Heights Library, City Hall, Parkview Villa, Heights Manor,
Senior High School, Central Middle School, Credit Union, Marquette State Bank, Anoka County
Service Center, Liquor Store (322 40th Ave.), Liquor Store (5225 University), Columbia Heights
Post Office, K-Mart and Mr. Steak Restaurant.

BEING AN ORDINANCE GIVING PRELIMINARY
'APPROVAL TO A PROJECT UNDER THE MUNICIPAL
INDUSTRIAL DEVELOPMENT ACT, REFERRING THE
PROPOSAL TO THE COMMISSIONER OF SECURITIES '
AND REAL ESTATE FOR APPROVAL, AND
AUTHORIZING PREPARATION OF NECESSARY
DOCUMENTS
The City of Columbia Heights does ordain:
1. It is hereby found, determined and declared as follows:
1.1. The welfare of the State of Minnesota requires active promo-
tion, attraction, encouragement and development of economically ~ound
industry and commerce through governmental acts to prevent, so far a~
possible, emergence of blighted lands and areas of chronic unemployment,
and it is the policy of the State of Minnesota to facilitate and encore;age
action by local government units to prevent the economic deterioration of
such areas to the point where the process can be reversed only by total
redevelopment through the use of local, state and federal funds derived
from taxation, with the attendant necessity of relocating displaced persons
and of duplicating public services in other areas.
:1.2. Technological change has caused a shift to a significant degree
in the area of opportunity for educated youth to processing, transporting,
marketing, service and other industries, and unless existing and related
industries a~e retained and new industries are developed to use the available
resources of the City of Columbia Heights (the "City"), a large part of the
existing investment of the community and of the state as a whole in
educations] and public service facLlities wi]J be lost, and the movement of
talented, educated personnel of mature age to areas where their services
may be effectively used and compensated and the lessening attraction of
persons and businesses from other areas for purposes of industry, commerce
and tourism will deprive the City and the State of the economic and human
resources needed as a base for providing governmental services and facil-
ities for the remaining populatior~ '
1.3. The increase in the amount and cost of governmental services
requires the need for more intensive development and use of land to provide
an adequate tax base to finance these costs.
1.4. A representative of The Corner Partnership (hereinafter the
~Applicant"), has advised this City Council (the "Council") that it desires to
acquire land and construct a building of approximately 16,000 square feet
and acquire and instal] equipment therefor for use as an office facility
(hereinafter referred to as the "Project").
1.$. The existence of the Project in the City will contribute to more
intensive development and use of land to increase the tax base of the City
and overlapping taxing authorities and maintain and provide for an increase

4. In accordance with Minnesota Statutes, Section 474.01, Subdivision

STATUTES, CHAPTER 474
WHEREAS, the Minnesota Municipal Industrial Development Act, Minnesota
~tntutes, Sections 474.01 et seg. (the "Act"), authorizes the issuance o~ revenu~

WHEREAS, the term "project" is defined by Section 474.02, subdivision
of the Act to include "any properties, real or personal, used or useful in eormection

WHEREAS, a representative of The Corner Partnership (the "Developer-)

WHEREAS, the Developer has requested that the City ~esolve to issue
revenue bonds pursuant to the Act to finance the Project and has presented to the
City a form of preliminary ordinance concerning such issuance wftb a request that
Asuch preliminary ordinance, attached hereto as Exhibit A, be eonsidared for
(~adoption by the City Council of the City; and
WHEREAS, Section 474.01, subdivision ?b, of the Act provides that the City
Council must conduct a public hearing on any proposal to undertake and finance &
project; and
WHEREAS, Section 474.01, subdivision ?b, of the Act provides that notice of
the time and place of such public hearing and stating the general nature of ~
project and an estimate of the principal amount of bonds or other obligatiorm to be
issued to finance the project must be published at least once not less than fifteen
(15) days nor more than thirty (30) days prior to the date fixed for the public
hearing in the official newspaper of the City and a newspaper of general
circulation in the City; and
WHEREAS, Section 474.01, subdivision ?b, of the Act provides that the
notice must state that a draft copy of the proposed application (the "Application")
to the Commissioner of Securities and Real Estate of the Securities Division of the
Department of Commerce of the State of Minnesota for approval of the Project~
together with all attachments and exhibits, is on fLle with the City and avaLtable
for public inspection; and
WHEREAS, the Developer has presented to the City a form of public notice,
attached hereto as Exhibit B, with a request that the City CouncLl establish a date
for a public hearing on the proposal to undertake and finm~ce the Project and to
authorize publication of the form of public notice provided by the Developer)
NOW, THEREFORE, BE IT RESOLVED THAT:
1. The City Council 'of the City will conduct a public hearing on the
proposal to undertake and finance the Project on the 27th day of November, 1981.
2. The City Manager is hereby authorized to cause a public notice,
substantially in the form of the notice attached hereto as Exhibit B, to be published
in the official newspaper of the City and a newspaper of general circulation in the
City. ·
3. The City Manager is hereby authorized and directed to have available
for public inspection in the offices of the City a draft copy of the proposed
Application, tocether with all attachments and exhibits thereto.

"The request is being made to operate a restaurant et 2301-A 37th Avenue which is present-
ly Daniel's Family Deli. The Planning & Zoning Commission felt the restaurant would not
have an adverse parking effect on surrounding businesses. Hr. Abboud planned on having ·
sufficient seating to accommodate 48 persons. The Council discussed concerns it had with
not meeting the parking ordinance requirements et considerable length. It wes determlned
that if the seating accommodations were decreased to 36 persons If ~ould be liveable,

RESOLUTION ESTABLISHING A SPECIAL MUNICIPAL ELECTION
WHEREAS: a petition was presented to the Columbia Heights Clty Council
requesting repeal of Ordinance No.975, and,
VHEREAS: said petition has been examined and found to bear sufficlent
verified signatures to support the request, and,
VHEREAS: the members of the Columbia Heights City Council have voted
to decline to repeal Ordinance No.975 and to reaffirm their adherence
to Ordinance No.975
THEREFORE, BE IT RESOLVED, that a special municipal election will be
held on Tuesday, December 15, 1981, and that the monies for this election
up to $4,500 be transferred from the General Fund Unallocated Fund
Balance to the Election Fund.
