HomeMy WebLinkAboutNov 24, 1981'Official Proceedings Columbia Heights City Council Special Meeting November 24, 1981 The meeting was called to order by Mayor Nawrocki at 7:30 pm. Roll Call: Logacz, Heintz, Norberg, Hentges, Nawrocki--present Purpose of the Meetin~ To consider assessments for five projects: Project # 735, curb, gutter and asphalt mat Project # 747, curb and gutter, Project # 762, seal coat, Project # 76~concrete curb and Project # 768, Miscellaneous delinquent bills The City Manager explained the particulars of each project to be assessed and gave the breakdown of the costs of each. Discussion followed concerning Project # 735 which dealt with assessments for owners of property on 42½ Avenue and 44½ Avenue. The City Manager, City A. ttorney, Mayor and members of the City Council all gave the specifics of the arbitration that was involved with the contractor for this project. The resident at 1334 42½ Avenue advised the staff that he had cracks in the driveway approach and questioned if they were going to be repaired. It was noted that he had not voiced his concern before to any one on staff and the Mayor suggested this property be viewed by someone in the Public Works Department. John Kruse, 1038 44½ Avenue, wanted to insure that the contractor was not given credit for laying sod as this was not'included in the project. He was given assurances that this would not be done. Helen Kocur, who resides in the area, had general questions regarding the people who were directly involved in the arbitration and the costs of the arbitration. She requested that a list of all of the personnel involved in the arbitration for the City, the identity of the arbitrators and witnesses, and those who were involved in the pro- ject as it was being don% be drawn up. Ms. Kocur would like a copy of this list, as would Jack Ashlin, 1034 42½ Avenue. She also requested a list of the costs which would include who was responsible for payment. Ms. Kocur advised the Council that she had experienced a crack in her driveway. The remaining four projects were reviewed individually by the City Manager. He spoke specifically to the period for payment and the rate of interest. Councilman Hentges inquired of the City Assessor why Project # 747 had only a one year payment period. He was advised that the majority of the lots involved in this project were forty feet and this was standard policy on lots of this size. Adoption of the Resolution Resolution 81-70 being a resolution adopting assessment rolls according to the City Charter for the following local improvements and determing that said improvements have been made and ratifying and confirming all other proceedings,, heretofore had: Special Assessments numbered 735, 747, 762, 766 and 768. Motion by Heintz, second by Logacz to waive the reading of the resolution there being ample copies available to the public. Roll call: All ayes Motion to amend by Hentges, second by Norberg that the payment period for Project # 747 be changed to five years. Roll call: Norberg, Hentges--aye Logacz, Heintz, Nawrocki-- nay Motion to amend fails. Motion to amend by Norberg, second by Hentges that the payment period for Project # 735 be changed to ten years. Roll call: Norberg, Hentges--aye Logacz, Heintz, Nawrocki-- nay Motion to amend fails. Motion to amend by Heintz, second by Logacz that the payment period for Project # 747 be changed to two years. Roll call: Logacz, Heintz, Norberg, Nawrocki--aye Hentges--nay Columbia Heights City Council Special Meeting November 24, 1981 page 2 Councilman Norberg voiced his continuing objection to the City paying part of Project # 735. Mayor Nawrocki expressed an objection to the legal fees incurred with the arb- itration process on this project. Councilman Hentges wanted it recorded that the City Council can supercede the City Charter for assessments from ten years to fifteen years. R E S O L U T I O N NO. 81-70 Adopting assessment rolls according to the City Charter for the following local improvements and determining that said improvements have been made and ratifying and confirming all other proceedings, heretofore had: Special Assessments numbered 735, 747, 762, 766, and 768. WHEREAS, the City Council of the City of Columbia Heights, Minnesota, met at 7:30 o'clock p.m. on the 24th day of November, 198), in the City Council Chambers, 590 - 40th Avenue N.E., Columbia Heights, Minnesota, being the time and place set when and where all persons interested could appear and be heard by the Council with respect to benefits, and to the proportion of the cost of making the local improvements above described, a notice of such hearing having been heretofore duly published as required by )aw, and a notice mai)ed to each property owner of record, stating the proposed amount of the assessment; and, WHEREAS, this Council has heretofore estimated and fixed the cost of such local improvements and has prepared an assessment roll therefore, THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS HEREBY RESOLVES: Section 1. Section 2. Section 3. That this council does hereby adopt the aforesaid assessment rolls known and described as "Assessment Ro11 for Local Improvements" numbered, 735, 747, 762, 766, and 768. That this council hereby finds and determines that each of the lots and parcels of land enumerated in said assessment rolls was and is especially benefitted by such improvement in an amount not less than the amount set opposite in the column headed "Total Assessment". And this council further finds and determines that the proper proportion of the cost of such improvements to be especially assessed against such lot or parcel of land is the amount set opposite the description of each such lot or parcel of land respectively in said assessment rolls. That said assessments may be paid in part or in full with- out interest on or before December 24, 198), or in annual installments for a period of from one to fifteen years as designated on each assessment roll, payable on or before the lSth day of September, annually, with 8% interest thereon. Failure to pay the annual installment renders the same delinquent and thereafter a lO~ penalty is added and the said delinquent special assessment is certified to the County for col)action with the rea) estate tax. That this Council did hereby determine and redetermine to proceed with said improvements, does ratify and confirm all other proceedings heretofore had in regard to these improvements, and said improvements shall hereafter be known and numbered as Local Improvements numbered 735, 747, 762, 766, and 768. This resolution shall take effect immediately upon its passage. Passed this 24th day of November, l~81.
