OFFICIAL PROCEEDlllGS REGULAR MEETING OF THE CITY COUNCIL CITY OF COLUMBIA HEIGHTS, MINNESOTA MAY 12, 1980 The meeting was called to order at 8:00 PM by Mayor Nawrocki. Roll Call: Logacz, Heintz, Norberg, Hentges, Nawrocki -- present NAMING OF SECRETARY Motion by Norberg, seconded by Heintz to appoint Ardelle Burr as secretary pro-rem for this meeting. Roll Call: All Ayes INVOCATION The invocation was given by Rev. Walter Wahl, pastor First Lutheran Church, Columbia Heights. MINUTES OF PREVIOUS MEETINGS Motion by Heintz, seconded by Logacz to approve the minutes of the April 28th regular meeting, the April 28th Board of Trustees meeting of the Columbia Heights Fire Department, the April 29th regular meeting, and the May 5th Board of Review meetin9 as presented in writing and reading be dispensed with. Roll Ca]]: All Ayes ORAL PETITIONS David Lucas, St. Matthews Lutheran Church was present with a request to place signs in specific locations showing people where the church is located. Motion by ltentges, seconded by Norberg that the City Council direct this matter to the Traffic Commission which meets the first Monday in June for their review. There was a brief discussion with the City Attorney. The Mayor noted this item should be discussed at the Traffic Commission meeting in regard to special rules or restrictions since some of the locations (Central Avenue and University Avenue) are state highways. Also to be discussed would be the general policy or guidelines in helping people find various churches. Roll Call: All Ayes The City Manager was instructed to see that Mr. Lucas receive a copy of the next Traffic Commission agenda. Ann Galuski, 1006 42nd Avenue N.E. was present and inquired about a hydrant on 42nd Avenue which was knocked down two years ago and needs painting. The City Manager stated that we have been painting hydrants in the past years as a project by summer youth. The Public Works Director stated it is their intention to have a program of hydrant painting and have already ordered the paint. It was suggested a letter be sent to Ann indicating if her property will be included. Roll Call: All Ayes ORDINANCE NO. 91~ BEING AN ORDINANCE AMENDING ORDINANCE NO. S53, CITY CODE OF 1977, PERTAINING TO REGULATION OF MUNICIPAL PARKING LOTS THE CITY COUNCIL OF THE C TY OF COLUMBIA HEIGHTS DOES ORDAIN: Section 1. Section 7.102 1) of Ordinance Ho. 853, City Code of 1977, passed June 21, 1977, which reads as follows, to-wit: The Council may regulate the use of streets, alleys and public ways by the owner, or by persons operating or in control of any vehicle or bicycle, provided that such regulations are not in conflict with Article 1 of this chapter. The provisions of Article 1 of this chapter shall be considered as controlling over any other provisions of this chapter that are inconsistent therewith or in conflict thereto. is amended to read as follows, to-wit: The Counci] may regulate the use of streets, al]eys, municipal parking lots, and public ways by the owner of, by person operating, or by persons in control of any vehicle or bicycle, provided that such regulations are not in conflict with Article I of this chapter. The provisions of Article I of this chapter shall be considered controlling over any other provisions of this chapter that are inconsistent therewith or in conflict thereto. Section 2. Section 7.102(2)(b) of Ordinance No. 853, City Code of 1977, passed June 21, 1977, which reads as follows, to-wit: Any public street or alley or portion thereof is subject to regulation by the Council or by the administrative service, as is necessary to prevent accidents, to eliminate traffic congestion, to provide public access to adequate parking facilities, or to otherwise promote the safety and welfare of the City, is hereafter amended to read as follows, to-wit: Any public street, alley, municipal parking lot or portion thereof is subject to regulation by the Council or by the administrative service, as is necessary to prevent accidents, to eliminate traffic congestion, to provide public access to adequate parking facilities, or to otherwise promote the safety and welfare of the City. Resolution Authorizing Anoka County to Apply for Community Development Block Grant (CBDG) Funds on Behalf of the City of Columbia Heights RESOLUTION 80-20 AUTHORIZING ANOKA COUNTY TO PREPARE A PRE-APPLICATION FOR COMMUNITY DEVELOP- MENT BLOCK GRANT FUNDS ON BEHALF OF THE CITY OF COLUMBIA HEIGHTS WHEREAS, The Housing and Community Development Act of 1974 provides Federal funds to local governments for eligible activities that meet the needs of low and moderate income people, and WHEREAS, the Board of Commissioners of Anoka County are currently considering the preparation of a Pre-Application for Community Development Block Grant funds on behalf of several communities throughout the county, and, WHEREAS, Anoka County, through a consultant, has asked the City of Columbia Heights if they desire to participate in the county-wide program, NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Columbia Heights, Minnesota, that: The City of Columbia Heights hereby authorized Anoka County to submit a Community Development Block Grant pre-application to the Department of Housing & Urban Development which would include funds for the City of Columbia Heights; 2. This authorization is conditioned upon the following: a) That the application, or any selected activities in the application, which target funds for the City of Columbia Heights be for Home Improvement Loans or Grants or an activity approved by the City Council. c) That the administration of these funds preferably be handled by the City's Housing & Redevelopment Authority. If local administra- tion of the City's share of this county-wide grant is found to be unacceptable to the Department of Housing & Urban Development, then the HRA will make all decisions in regard to the implementation of this program within the City of Columbia Heights. That the City Council and HRA Board of Commissioners have the opportunity to review and comment on this pre-application before submission to the Department of Housing & Urban Development. Ron Naegele, Chairman of the Cable TV Advisory Committee was present to explain their recommendation to se]ect Cable Television Information Center to provide consulting services to Columbia Heights and Hi]ltop. Motion by Norberg, seconded by Heintz to authorize the Mayor and City Manager to enter into an agreement with Cable Television Information Center for con- suiting services on cable communications. Franchise Associates, 1500 South Lilac Drive, Golden Valley Pre- liminary Plat Review, Arby's Restaurant, southwest corner of K-Mart Three representatives for Arby's were present, Mr. Robert Hoffman, Attorney for the Franchise, Mr. Douglas Kennedy, representing Arby's, and ~lr. Bill McHale, representing Malan Construction. Also present was Mr. Allen Carlson, City Planner. The purpose was to have the preliminary plat reviewed by the City Council and then referred to the Planning and Zoning Commission again and they will then make a recommendation at that time. This presentation was made by Mr. Robert Hoffman with a lengthy discussion following. Motion by Norberg, seconded by Hentges that the City Council refer the matter to the City Engineer for further study, and after his review, refer it to the Planning and Zoning Commission for a recommendation. Roll Call: All Ayes This item had been presented to the Traffic Commission at their May 5th meeting at which time they made a motion that they had reviewed and found no fault with the circulation plan for the pro- posed lot with the easement road and use of existing accesses and found that the subdivis on will not have adverse traffic impact on Central Avenue and 47th Avenue. RECESS: 9:46 PM RECONVENE: 10:07 PM May ]2, ]980 Page 6 OLD BUSINESS: Agreement on 37th Avenue Additional information was presented to the City Council by the City Manager and the Public Works Director; a clarification of expenditures from the City of Minneapolis and a summary of the sidewalk survey. There was discussion on the staff's recommendation to approve the amendment of estimated preliminary engineering costs. The preliminary engineering agreement was signed in October, 1978, by the City of Columbia Heights and the City of Minneapolis to plan the construction of 37th Avenue N.E., Central Avenue to Main Street. The City of Minneapolis was to perform the engineering services, with the cost of these services to be shared on a 50/50 basis. The estimated cost to each city was to be $]9,000. The City of Minneapolis had notified George Brown, City Engineer that they now estimate the cost of engineering services to be $26,000 to each city. In addition the estimated cost of construction had been SS00,O00. These estimates have now risen to $35,000 in preliminary engineering costs for each city and an estimated construction cost of $705,000. The Mayor noted there had been no commitment by the Council on the construction costs and the policy is to hold hearings prior to a letting. The Mayor asked if the Council is going to be shown the plans. The Public Works Director stated he had already asked the same question, but so far has to get approval from the Columbia Heights City Council to proceed with the project. The Mayor recommended that we do authorize the additional cost for preliminary engineering and would like to see the plans. Motion by Heintz, seconded by Logacz to authorize the additional cost, however, that the City of Minneapolis furnish our Engineering Department with copies of the preliminary plans, and that such plans be subject to Columbia Heights' City Council approval. It was pointed out that the motion should include the dollar amount. The Public Works Director noted that this is not a bill, but a tabulation of costs. They will have to submit costs before payment is approved. He is expecting to receive the preliminary plans this week. Amended motion by Heintz, seconded by Logacz to authorize the amendment of estimated preiiminary engineering costs from S19,000 to S~5,000 and further- more, that the City Manager advise the Minneapolis City Council of this action. Roll Call: Logacz, Heintz, Hawrocki -- Aye Norberg, Hentges -- Nay Motion carries The City Manager asked about curb and gutter in the plans. At that time, the Manager also indicated what Lhe result of the survey on sidewalks was. The Council felt that curb and gutter should be included, but not sidewalk. The handling of assessments would be as provided in the past by City policy. The City Manager asked if there was a relationship with reconstruction of 37th Avenue and the drainage problem eminating from Minneapolis Water Department. May 12, 1980 Page 7 The City Manager also indicated that the drainage situation is creating problems with existing roadways at 46th and Johnson. The Council is still interested in inquiring a road easement from Minneapolis Water Department and that the drainage should be dealt with at the same time. The Mayor indicated he is still going to contact the Minneapolis City Council regarding these issues. OTHER OLD BUSINESS Councilman Norberg stated that he hadn't been asked to sign an affidavit in regard to #35613 (3M). NEW BUSINESS 1. Request to hold a Block Party on 6th Street between 48th Avenue and 49th Avenue Motion by Heintz, seconded by Hentges to authorize permission for a block party to be held on 6th Street between 48th Avenue and 49th Avenue on June 28 between 1:00 PM and 12:00 PM. Roll Call: All Ayes 2. Recommendation on New Hires Motion by Heintz, seconded by Norberg to approve the recommended hourly rates as listed in the agenda. Roll Call: All Ayes 3. Mini-Audit Grant Application A memo from Tim Yantos was presented explaining the Mini-Audit program. Motion by Heintz, seconded by Hentges to approve the submission of the grant application for the Minnesota Energy Agency Mini-Audit (Energy Audit). Roll Call: All Ayes 4. Wayne Protection Agency The Park Board at their meeting April 23, 1980, passed a motion that additional funding be provided to cover the costs of court appearances by the hired park patrol officer. There was discussion on the staff's recommendation that this .item be denied and any further increases for Wayne Protection Agency not be considered until the 1981 budget becomes effective. Motion by Norberg, seconded by Hentges to defer action on this matter and be considered at the time of the 1981 budget. There was further discussion and the motion was amended by Heintz, seconded by Hentges to refer this item back to the Park Board as to how they intend to pay for it. Roll Call: Heintz, Norberg, Hentges, Nawrocki -- Aye Logacz -- Nay OTHER NEW BUSINESS Ann Galuski, 1006 42nd Avenue N.E. stated that school was soon to be out and May 12, 1980 Page 8 she would like to see a policeman go to every school and give a little talk to remind the children not to destroy property in city parks. The Mayor stated we have an ongoing program working with elementary schools and vandalism is covered. The Police Chief stated they would try to emphasize the parks. There was further discussion on vandalism. REPORTS The City Manager reviewed his report and there was considerable discussion on the use of the Kodak copy machine by the Council and staff. Councilman Norberg also mentioned the Volunteer Fire Department Relief Association issue. He had had some discussion with them and the fellows that haven't been in ten year-s are not [nterested in anything but service connected disability. The problem is that the definitions are vague and need to be worked out. LICENSES Motion by Heintz, seconded by Hentges that the licenses as listed be approved upon payment of proper fees except that the Columbia Heights Hockey Fee be waived. Roll Call: Logacz, Heintz, Norberg, Hentges, Nawrocki -- present Motion by Heintz, Seconded by Hentges to appoint Mildred V. Carlson as Secretary Pro-tem for this meeting. Rolt Call: All Ayes STATEMENT OF PURPOSE OF MEETING City Manager, Robert Bocwinski, stated that the purpose of this meeting was the continuation of Board of Review. INTRODUCTION OF STAFF Present were: Mildred Carlson, City Assessor and Gordon Starkey, Chief Deputy Assessor of Anoka County. PRESENTATION OF INFORMATION. by MRS. CARLS.O.N.,_ .C.I.T.Y..A.SS.ES.~9~R Mrs. HansenIs property at 3733 Reservoir Blvd. has been reviewed and comparables presented to her. No change recommended. Merlin Arney property at 3911 Hayes has been reviewed. The excess land at the rear of his property is filled with water and cattails. I recom- mend the land value be reduced $4,500 and the building value remain the same. Vernon Olson property at 910 - 4Otb Ave. was reviewed. I recommend a reduction in building value of $6,500 and the land value remain the same. Casmir Hutera of 3904 Hayes was contacted by letter and by telephone and does not wish to make an appointment, so no change is recommended. Ronald Cadieux was sent a letter asking him to call for an appointment before May 12th, and I had no response. I was unable to contact him by telephone. I recommend no change. Michael Grigoni property at 4150 Central was contacted; and after viewing the building I can recommend that he be granted 30% homestead.
