Dear Sir:
E~closed is a petition requesting a reconsideration of
City Council action as taken on June 30, 1980 on the Klley
paving project #8008 and/or PIR757.
This project is for the paving of the alley on the 2000 and
2100 blocks of Fair~ay Drive.
The original petition to have this project started was signed
by sewn of the eight property owners involved. At that ti~e,
the cost for this project as given by the City of Columbia
Heights Engineering Department would be at $600.00 per property
owner. Upon presentation at the time of the project approval
on June 30th, this cost bad risen to $759.00 plus~ or a cost
imcrease of 26 3/4%. Bids for this project have not yet been
obtained.
Due to this high cost increase, the property o~uers as signed
on the enclosed petition request the favorable reconsideration
be given this project for it full cancellation.
Is it at all possible for this matter to be placed on the
agenda of the July 14, 1980 Council Meeting?

We the undersigned as legal and present residents and owner of properties
scheduled for Alley Paving ou the 2000 aud 2100 block of Fairway Drive
by the City of Colnmia Heights project #8008 and/or PIR757 do hereby
request that said project be cancelled and abandou~ed by the City of Columia
Heights.
Reconsideratiou is requested by .reason of the large cost increase from the
originally presented $600.00 per resident to a new cost increase of 26 3/4%
to $760.00.

The meeting was called to order at 7:35
Roll Call: Logacz, Heintz, Hentges, Nawrocki--present -
Norberg--absent
Purpose ~f the hearing: To review various proposed improvements
concerning alleyways, back)or drainage, and street construction.
).Alleyway improvement-Alley which extends west of Chatham Road
and south of Fairway Drive.
The City Manager stated that there had been a petition signed by
seven residents presented to the City requesting this improvement.
He explained the two alternatives from which to choose for this
improvement. The first being a ten-foot concrete alleyway the
length of the alley totalling an assessment to each lot owner of
$39.88 per assessable foot. The total project would be in the amount
of $1,994.00 per owner. The second consideration was for a twelve-
foot bituminous covering whose costs would be $15.19 per assessable
foot or a total assessment of $759.50 for each owner.Since each
lot on this alley is the same measurement the total for each owner
would be the same.
Nawrocki questioned if those figures are based on firm bids or cost
estimates. The City Manager said they were cost estimates. Nawrocki
informed the residents present that prices could be subject to
change as they were not firm bids. If the firm bids reflect a
change upwards from the estimates the hearing will be reopened.
If there is a drop in monies on the firm bids from the cost estimates
there would be no need to reopen the hearing.
Mt. Fred Swan, 2106 Fairway Drive, questioned since the City has an
easement from the City of Minneapolis, can this easement be improved
upon. Fred Salsbury, Director of Public Works, responded that it
could since it is considered a "perpetual easement" and the use
of the property is not being altered.
Mildred Carlson, the City Assessor, was questioned as to whether
the property at 2108 Fairway Drive was included in the assessment
since the owner has no use for the alle~ "'
.It was advised that all properties abutting the alley would
be assessed.
The City Assessor explained how the total costs could be paid depending
on the recommendation of the Council.She suggested that five years
would probably be the time extension limit. If more than thirty
is taken to pay this assessment there would be an interest charoe
as set by the Council. In the past this interest figure has been
set at 8% on the unpaid balance.
The City Manager made the point that in the citizen petition the
request was for a bituminous covering. He reminded the residents that
the figures used tonight were estimates, not bids. Bids are not
taken until the project has been approved. He had hoped to get the
bids early as the City would like to get started this year, if
approved.
The Public Works Director said the project would take about a
month from the time the contract is signed and the residents would
be without access to their garages from the alleyway for about a
week. The Police Chief advised the people to inform the Police
Department during that time so they are permitted on-street parking.

Motion by Heintz, seconded by Hentges to authorize the City
Manager to proceed with alleyway improvements west of Chatham
Road, south of Fairway Drive, using bituminous materials.

The City Manager stated there had been a petition presented to the
City for this improvement signed by eight of the fifteen resident-
owners who file Homestead.
Resident comments supported their agreement that the whole alley
should be done not just part of it. Many of the people have water
trouble. The Public Works Director assured the audience that the
work anticipated would solve water drainage problems and avoid
any more breakage of the surface of the alley.
The City Manager advised that this project must be done in con-
junction with the 37th Avenue construction.
The cost breakdowns for the three types of construction under
consideration are: twelve-foot blacktop the entire length of the
alley with grading and some concrete repair would be $5.60 per
assessable foot; twelve-foot blacktop for 273 feet of the alley
and the remainder seal-coated would be $2.52 per assessable foot;
ten-foot concrete surface the entire length of the alley way would
be $18.46 per assessable foot.
Motion by Heintz, seconded by Hentges to authorize the City Manager
to proceed with alley improvements, the alley being 2½ Street N.E.
to 3rd Street N.E. from 37th Avenue N.E. to 38th Avenue N.E. using
blacktop for the resurfacing and covering the entire length of the
alley.

3. Alley--Monroe Steet N.E. to Madison St.N.E. from 4Oth Avenue N.E.
to 41st Avenue N.E.
The City Manager stated there had been no petition on this improvement
but the City Engineering Department's recommendation was based on
complaints of the residents of this area.
Fred Salsbury presented the alternatives for this project explaining
each in detail and answering any questions of affected residents
at the hearing. The costs of the three alternatives he presented are:
cut and repave the entire alley with blacktop, $10.66 per assessable
foot; cut, regrade and repave with some replacement of the storm
sewer, $17.45 per assessable foot; concrete construction for the
entire project, $24.52 per assessable foot.
Time for completion of the project is a~out two weeks according to
the Public Works Director. He felt there would probably be some
evenings that the residents would not have access to their garages
and would have to park on the street. Again, they were advised to
contact the Police Department when this occurs.

Motion by Hentges, seconded by Logacz to authorize the City
Manager to proceed with alley resurfacing Monroe St.N.E. to
Madison St.N.E. from 40th Avenue N.E. to 41st Avenue N.E. using
blacktop materials. -

4. Backlot drainage problem at 1029 42½ Avenue N.E. Area includes
parts of Lot 11, 12, Block 3, Reservoir Hills.
This particular problem was brought to the attention of the City
by an affected citizen. The City Manager presented the recommendation
for correcting the problem. He specified that two areas would be
cut an filled £o eliminate a low area and allow for drainage into
the street and to direct the water to the catch basins.There would,
also, be some sodding, grading and replacement of two trees that
would have to be removed to complete this work. Total cost of this
project would be $4356.00, with an assessment cost of $.08 per
square foot. This would be charged to all property owners in the
assessment district.
The Mayor read two letters received by the Council regarding this
drainage problem. One was authored by four co-owners of adjacent
property and the other came from owners of neighboring property
who were unable to attend the hearing.
A spokesman for Rosemary Woxman, owner of the property at 1029 42½
Avenue N.E.,presented pictures to the City Council showing flooding
from last year and this spring. He felt the pictures clearly
showed that the property in question was not the cause of the
water problem but the lots around it manifested the problem by
their water runoff.
The City Engineer indicated to the Council that he and the City
Building Inspector went to the property for an inspection. He then
advised the contractor what needed to be done before a building
permit was authorized. The contractor agreed to these necessary
provisions.
The City Attorney was asked what the City's liability would be if
the contractor had not complied with the requests of the City
Engineer and the requirements of the building permit.

The City Attorney reviewed the requests of the City Engineer to
the contractor and felt the City would bear no responsibility.
The City Attorney was then asked if the contractor had met the
requirements of the building permit. He requested more time to study
the permit. Nawrocki asked the City Manager, if, in his opinion,
these requirements had been met. From the information he had gotten
he felt that they had, but, he did not have a copy of the permit
with him. Heintz felt the Council was being asked to make a decision
without enough information.
Motion by Heintz, seconded by Logacz to continue this hearing on
the backlot drainage problem at 1029 42½ Avenue N.E., pending more

information from the contractor, City Building inspector and the
staff, at the next Council meeting on July 14, 1980at 8:00.

5. M.S.A.S. construction of 37th Avenue N.E. Central Avenue to Main
Street.
This action results from an agreement that the City of Columbia
Heights and the City of Minneapolis entered into in the repair of
37th Avenue N.E. from Main Street to Central Avenue. The roadway
construction would be paid for from state aid funds. No assessment
would be made when curb, gutter and sidewalk already exist. No
assessment would be made for replacement of sidewalk.
The City Manager explained that the assessments for curb and
gutter would be assessed 100~ and the s~dewalk would be assessed
40% to the benefitting owners. The remaining 60% assessment w~uld
be paid out of state aid.
The City Manager, with the assistanceiof the City Assessor and the
City Engineer, explained the assessments rates for both avenue
assessments and street assessments giving dollar amounts for each
type of improvement; curb, gutter and sidewalk. Nawrocki requested
a total dollar amount of each assessment, block by block. The City
Public Works Director gave this breakdown so each resident present
could be informed as to just ~hat his particular costs would be.
A more specific cost breakdown was given by the City Manager. The
total cost for the curb and gutter is $31,693.75. The rates for
the curb and gutter per assessable foot is $8.25 at the street
rate, $2.75 at the avenue rate. The total cost for the sidewalk
is $31,536.96. The rate for the sidewalk per assessable foot is
$3.60 at the street rate, and $1.20 at the avenue rate. The street
is totally paid for by the state aid funds per the City Council
policy. Forty percent of the sidewalk costs are assessed to the
benefitting residents and sixty percent is paid from state aid
funds as per the Council policy. Avenue rates include property
owners to the midway point on the block.
QUESTIONS AND COMMENTS
The resident at 3705 Second St.N.E. asked if there had been a
petition circulated for the sidewalk. The Mayor answered there
had not but it was proposed because 37th Avenue N.E. is a major
thoroughfare and there is concern for pedestrian traffic. He
suggested the grocery store and bus lines generated considerable
pedestrian traffic.
The resident at 583 37th Avenue N.E. requested the results of a
survey done questioning affected residents as to their feelings
toward having a sidewalk. The Mayor responded that the majority
did not want the sidewalk. Many citizens expressed they felt the
sidewalk on the Minneapolis side of 37th Avenue N.E. would be
sufficiient to protect the safety of the pedestrians. This avenue
will continue to be a truck route as it has in the past.
The Public Works Director gave the timetable for the ~roject

to be completed. If the bids for the work are let in the near
future and Minneapolis completes its underground work, he is
hopeful that the major portion of the work would be completed
by this fall. The entire project should be completed by next
spring.
Robe_r~t Guzy, whose office in on Central Avenue at 37th Avenue
N.E., thinks the project is long overdue and supports it. He
feels the energy crisis may result in more people using public
transportation, therefore, there would be more pedestrian traffic.
He would like to see the Council investigate the use of more
state aid funds for the curb and gutter assessments,thereby,
making the assessments for sidewalks more affordable for the
residents involved.
Motion by Logacz, seconded by Nawrocki to authorize the City Manager
to proceed with the project as presented by the Engineering Department
to include curb, gutter and sidewalks.
Motion to amend offered by Heintz, seconded by Hentges to remove
from the main motion the inclusion of sidewalks where they do
not exist, just for replacement where they need it.
Heintz withdrew his motion to amend.
Hentges withdrew his second on the motion to amend.
