HomeMy WebLinkAboutJul 14, 1980'REGULAR MEETING OF THE CITY COUNCIL CITY OF COLUMBIA HEIGHTS, MINNESOTA ~UL~ ,14, 1980 The meeting was called to order by the Mayor at 8:10. 1.Roll Call: Logacz, Heintz, Norberg, Hentges, Nawrocki--present. 2. The Invocation was given by Councilman Norberg. 3. Motion by Hentges, seconded by Logacz to approve the minutes of the June 9th City Council Meeting; the June 23rd City Council meeting; the June 2$th Special Hearing on Downtown Development; the June 3Oth Pub]lc Hearing regarding al]ay improvements, drainage problem, and curb/gutter/sidewalk on 37th Avenue; and the June 30th Special City Counci] meeting; as presented in writing and the reading be dispensea with. 4. Ora] Petitions--None Reopening of Hearing for Backlot Drainage at 1029 42~ Ave. N.E.. This item was tabled at a previous hearing pending more information from the Bui)ding Inspector and the Engineering Department as to the requirements being met by the contractor specified in the building permit. The Bui)ding Inspector said what was requested had been done by the contractor. He had talked to the contractor by phone and was informed there was permission received by the owner of an adjoining lot to do some filling in the back of the property but no cutting in the front. This ]ot owner had been suggesting for some time that what should have been done to avoid this prob)em was cutting in front of the property. He questioned why other property owners were being asked to pay for this project when, in his opinion they are not responsib]e. ' The City Attorney advised that a project may have a public purpose even ' though it benefits only one property owner and the Council must determine whether or not a public Duroose exists in each specific instance. The Mayor said the responsibility of the water drainage belongs to a]) of those who contribute to it and on that basis the Council determined this project has a pub)lc purpose. It was adivsed that the owner of 1029 42½ Avenue N.E. should exhaust all possibilities with the contractor before the costs are passed onto the neighbors. Motion by Heintz, secorded by Norberg to deny the project. Ordinances and Resolutions First reading of Ordinance No. 920 being the ordinance conveying certaln real estate to Patrick Allen Grady and Doris Ann Grady. Motion by Heint~, seconded by Mentges that the first reading of the ordinance be considered read and the reading be dispensed with since ample ¢oples are available to the public. Roll Call: All ayes ORDINANCE NO. 920 BEING AN ORDINANCE CONVEYING CERTAIN REAL ESTATE TO PATRICK ALLEN GRADY AND DORIS ANN GRADY The City Council of the City of Columbia Heights does ordain: Section 1: The City of Columbia Heights shall convey its interest in the real estate described as follows: Lot 59, (Ex. W. 2.1 ft.) Block 65, Columbia Heights Annex, according to the map or plat thereof of record and on file with the County Recorder in and for Anoka County, Minnesota to Patrick Allen Grady and Doris Ann Grady. Section 2: The conveyance shall be rm~de by Quit Claim Deed. Section 3: The purchase price of said property is One Hundred Dollars ($100.O0). Section 4: The Mayor and City Manager are herewith authorized to execute the documents necessary to make such conveyance. Section 5: This Ordinance shall be in full force and effect from and after thirty (30) days after its passage. First Reading: July 14, 1980 First reading of Ordinance No. 921 being an ordinance pertaining to fee schedule for building and construction permits. Motion by Heintz, seconded by Logacz that the first reading of the ordinance be considered read and the reading be dispensed with !since ample copies are available to the public. Roll Call: Logacz, Heintz, Norberg, Nawrocki--aye Hentges--nay Motion fails. Councilman Hentges moved to table the reading of this ordinance until the next regular Council meeting. Six foot variance Motion by Hentges, seconded by Heintz to approve a six-foot variance on the setback of a 24' x 24' proposed garage from the street on property at 4800 6th St.N.E. due to a hardship created by the narrowness of the lot. Ten foot variance Motion by Logacz. seconded by Heintz to approve a ten-foot variance on the setback of a proposed 20' x 22' garage to be constructed off the alley due to a hardship created by the narrowness of the lot. Trafflc Commission Recommendations l.Motlon by Hentges, seconded by Norberg to approve placement of a sign at the southwest corner of Fillmore St. and 47th Avenue indicating "No Parking Here To Corner" as recommended by the Traffic Commission. Motion by Norberg, seconded by Logacz to approve authorization of three "No Parking On Sunday" signs to be placed on the mast s|de of Washington, 41st Avenue to the entrance of the parking lot north of the church as reccx~nded by the Traffic Commission. Roll Call: All ayes $.01d and New Business a. Old Business 1. Driveway problem at 1023 44½ Avenue N.E. This item was tabled from a prior Council meeting for additional information and discussion with the o~ners of the property. They were advised if the changes were approved that such change will be the final driveway grade. Motion by Hentges, seconded by Heintz to authorize the City staff to make additional changes in the driveway grade at 1023 44½ Ave. N.E., subject to the approval of the property owners with the funding from the Public Improvements Fund. Motion to amend by Norberg, that the property owners be responsible for any damages to the street that may result. Motion dies for lack of second. RESOLUTION NO. 80-32 I, Anna Birosh, estate, by Andrew N.Birosh,Jr. hereby request a split of Plat No. 34416, Parcel No. 1690 legally described as: East 50' of Lot 32, Block 2, Reservoir Hills {Subj. to rd. and Uti). Request for Approval of Plat for Franchise Associates This was a public hearing with al1 of the affected parties and land- owners having been notified. Presentations of information were made by the City Planner including materials from the Engineering Dept. and the Planning and Zoning Commission. Legal counsel for Franchise Associates, Dick Nowlin, reviewed plans for the project with maps and graphs. He answered questions from the Council and staff as to landscaping, traffic, parking and other requirements previously stated by the City Planner. Considerable discussion was generated concerning signs, drainage and landscaping. The representative of the nursery doing the landscaping was present at the hearing and explalned, in detail, what kinds of plantings were going to be used. These plantings will be guaranteed for a year. Numerous questions were asked as to ordinances, regulations and requirements from the staff. The Council suggested there were still too many items that couldn't be spoken to with enough information. The Council felt that the City Attorney should gather more material outlining necessary requirements. Motion by Logacz, seconded by Helntz to continue this hearing until the meeting of Ju]y 28, 1980 at 8:00. Ro]i Call: Logacz, Heintz, Hentges, Nawrockl--aye Norberg--nay Motion carries Award of Towing Contracts Motion by Norberg, seconded by Hentges to authorize the Mayor and City Manager to enter into a contract with Shorty's, Inc. for towing services for the period of August ), 1980 to July 31, 1981. Roll Call: All ayes Request to Authorize Payment on Project # 7903 Motion by Hentges, seconded by Logacz to authorize the payment of $6,453.20 to Ideal Enterprises,Inc. adjusting the Contract Change Order to read that the work can be completed in six hours. Roll Call: All ayes 6.Request to Authorize Payment of Project # 8012 Motion by Hentges, seconded by Heintz to approve payment of $8,7~.11 to the Halvorson Construction Co. for miscellaneous concrete construction. Ro11 Call: All ayes Motion by Norberg, seconded by Hentges to grant a ten-day extension to the contract with the Halvorson Construction Co. for additional work the City has provided. Request Authorization for Payment of $2,721.75 on Project # 8015 ~ltotlon by Hentges, seconded by Heintz to authorize payment of $2,721.75 to Slama Brothers,Inc..This project involves cleaning the bituminous hockey rink surfaces at McK~nna Park and K~yes Park. Roll Call: All ayes 8.Petition to Stop Project #8008 for the Alley Behind the 2000 Block on Fairway Drive. A petition was received by the Council signed by six of the h~owners on the al)ay. In that petition they stated they are no longer interested in the project , primarily because of the cost. The Mayor advised them the costs that were quoted them were done quickly at their urging. Me told them the staff prefers not to give out estimated costs without proper preparation time and the staff had expressed an hesitancy in doing this in this case. The Mayor requested the staff make an effort to include this project in an addendum as an 'option item' rather than part of the package thereby not changing the bids. Mayor Nawrocki advised the residents that to cancel this project the same procedure must be employed as was used to initiate it; the public hearing process. Motion by Hentges, seconded by Heintz to reopen the public hearing on Project # 8008, the alley behind the 2000 block on Fairway Drive on August ll, 1950 at 7:00. ~oll Call: All ayes RECESS: ll:O0 RECONVENE: 11:15 b. NEW BUS)NESS 1. ,~nendment to the Suburban Police Recruitment System Agreement Motion by Logacz, seconded by Helntz to authorize the Mayor and City M,)nager to sign the first amendment to the Suburban Police Recruitment System Cooperative Agreement. Discussion followed on the amendments to the agreement and the reasons for the changes. It was suggested that this item be tabled for further information. The City Attorney advised he had looked over all of the information available and there would be nothing more to report. Joint Negotiations for Police Contract Notion by Neintz, seconded by Logacz to authorize approval of NANA to serve as the representative in police negotiations with Local # 320. Notion to amend by Norberg, seconded by Hentges to include the words, 'With the understanding that there will be no separate negotiations on the local level". Roll Call on the amendment: Logacz, Heintz, Nawrocki--nay Norberg, Hentges--aye Notion fails. Roll Call on main motion: Logacz, Heintz, Nawrocki--aye Norberg, Hentges--nay Motion carries 3. Water Shut-Off Protest for Property at 4054 Central Ave. N.E. The Mayor, through the Staff, informed the Councll that Mr. Nyberg, owner of the property, was contacted and the problem was handled administratively. 4. Final Payment to Anerican Appralsal Co. The City Finance Director presented an invoice for the work done by the American Appraisal Co. and spoke to the content of a letter he sent to the Councll regarding an additional fee of $150.00 for some new facilitles added to the appraisal after the specs were written. Motion by Heintz, seconded by Hentges that final payment be made to the American Appralsal Co. including compensation of $150.00 for new facilities added after the specs were written. Ro11 Call: All ayes 5. Schools and Conferences a. Request for Tom Rejzer to attend Park and Recreation School and Park Planning and Maintenance School. Motion by Helntz, seconded by Logacz to authorize the attendance of Tom Rejzer, Park Department Superintendent, at the Park Planning and Maintenance School, August 24-27; and Park and Recreation Safety School, August 28-29; in Colorado Springs, Colorado. Request for authorization for Arden Hovland to attend the 58th annual conference on education and code development in Albuquerque New Mexico. ' July 14, 1980 page 8 Motion by Heintz, seconded by Norberg to authorize the attendance of Arden Hoviand, Building Inspector, at the 58th Annual Conference on Education and Code Deve)opment in Albuquerque, New Mexico, September ;!1-26, 1980. Councilman Norberg inquired if this item had been budgeted for and was told it had. Roll Call: All ayes c. Request for Stuart Anderson to attend a school entitled "Managing Agencies with Fewer Dollars" in Houston, Texas. Motion by Logacz, seconded by Heintz to authorize the attendance of Stuart Anderson, Police Chief, at the "Managing Agencies with Fewer Dollars", September 23-26, in Houston, Texas. Councilman Norberg inquired if this was a budgeted item and was told it was not. Roll Call: Logacz, Heintz, Hentges, Nawrocki--aye Norberg--nay 6. Request for Authorization to Call for Bids for Electrical Work. Motion'by Heintz, seconded by Logacz to authorize the City Manager to call for bids for electrical changes required to bring the emergency generator up to full utilization. Bids to be opened August 20, and recommended award to be presented to the Council August 25, )980. 7. Establishing Salaries for Employees Motion by Logacz, seconded by Hentges to establish salaries for the following employees: a. Keith Masuda, Administrative Assistant, at a salary of $1,441 per month effective July 7, 1980. b. James Kapala, to Police Sergeant at $l,860 per month effective July 26, 1980 per 1979 agreement. Sergeants have not settled 1980 wages. c.Tom Johnson, Police Officer, at a salary of $l,138 per month effective July 7, 1980. Roll Call: All ayes 8.Request for Block Party-Il29 42½ Ave. N.E. Motion by Hentges, seconded by Logacz to approve the request for a block party on the west end of 42½ Ave. on August 16, 1980 from 4:00 P.M. to ):00 A.M. providing only the west 300 feet of the street is blocked off on the recommendation of the Acting City Manager. Roll Call: All ayes 9.Request for Driveway Improvement at 657 47th Ave. N.E. Request withdrawn. July 14, 1980 page 9 lO. Railroad Crossing Signal at Stinson Boulevard Motion by Norberg, seconded by Hentges to authorize the Mayor and City Manager to enter into a joint powers agreement with the City of St. Anthony for the purpose of construction of a new railroad signal with gates to be installed on Stinson Boulevard. Project would be financed with 90% federal money and 10% local money. The local funds coming from Unallocated General Funds. Roll Call: All ayes 9. REPORTS Report of the City Manager was submitted in writing. Stuart Anderson, the Acting City Manager requested this report be discussed at the work meeting of July 15, 1980. ADDITIONAL NEW BUSINESS Motion by Hentges, seconded by Logacz to authorize a line of credit of the sum of one-hundred thousand dollars from General Unallocated Funds at 8% interest, available as needed, on request of the HRA Board to the Council until the proceeds from the Bonds are received. The Mayor wondered why the Council didn't receive a formal letter of request from the HRA. Norb~rg requested from the Finance Director as to how much interest would be lost from the General Unallocated Fund on this loan to the HRA. The Finance Director quoted the figure of $1750. Motion to amend by Norberg to change the rate of interest from 8% to the prime rate. Motion dies for lack of second. Roll Call: Logacz, Heintz, Hentges, Nawrocki--aye Norberg--nay 10. LICENSES Motion by Heintz, seconded by Logacz that all licenses as listed be approved upon payment of proper fees with the exception of the license application for a fresh food establishment at 1034 4Otb Ave. N.E., upon recommendation of the Assistant Building Inspector and the Fire Chief that it be denied; and to waive the license fee for Immaculate Conception Church.
