Roll Call: Logacz, Heintz, Norberg, Hentges, Nawrocki--present Motion by Heintz, second by Norberg to appoint Jo-Anne Student, secretary pro-tam. 2.Discussion with City staff and City Attorney regarding proposed amendments and proposed by-law changes to the Volunteer Fire Department Relief Association The City Manager explained that the Council members had copies of the by-laws as prepared by the City Attorney with the proposed changes, specifically changes in benefit levels and the definition of disability. He was advised by Chief Johnson that the membership of the Board of Examiners, after reading the material, voted for the changes in the by-laws. The City Attorney spoke to the content of the proposed resolution. He advised the Council that a sixth member was added to the Board of Examiners. He will be a retired volunteer firefighter who wi)l be an ex-officio member with voting privileges. His being made a member of the Board of Examiners had been at the request of the retired volunteers. The City Attorney continued his reviewal of the proposed amendments to the by-laws advising the Council of the changes and making points of clarification. He spoke specifically to the changes in the definition of disability. For determination of disability one wou)d be referred to the section that deals with the Typical Duties Performed by a Firefighter in the Rules and Regulations of the Fire Department manual. Although the Fire Chief has the prime responsibility of changing the Rules in the manual he does not make the determination as to a firefighter's d,)sability. The City Attorney also included an optional lump sum benefit a retiring volunteer firefighter may collect instead of the monthly benefit plan. This item was an action for correcting a requirement of the first set of by-laws that had not been met. Further discussion dealt with benefits that would be received by a disabled firefighter who was injured while on duty versus one who was injured off- duty. The effective date for these changes is May 1, 1980. Motion by Heint~, second by Logacz to dispense with the reading of the resolution there being ample copies available to the public. Roll Call: All ayes Motion by Heintz, second by Logacz on behalf of the Board of Trustees to adopt the proposed resolution and recommend to the City Council that the by law changes be approved. Roll Call: All ayes Meeting adjourned at 12:05 AM, BOARD OF TRUSTEES MEETING--VOLUNTEER FIREFIGHTER RELIEF ASSOCIATION August ll, ]980 page 2 BEING A RESOLUTION AUTHORIZING AMENDMENTS TO THE BY LAWS OF THE COLUMBIA HEIGHTS FIRE DEPARTMt2CI Ri-LIEF ASSOCIATION, VOLUNTEER DIVISION BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLUMBIA ~EIGHTS, that WHEREAS, the Columbia Heights City Council may provide for an increase in benefits paid to members of the Volunteer Division; and WHEREAS, the proposed increase in benefits and amendments to the BY LAWS complies with Laws of Minnesota for 1977, Chapter 374, sections 38 to 60; and WHEREAS, the City Council has obtained and given consideration to an actuarial survey demonstrating that such increase in benefits to members of the Volumteer Division and such increase in funding of the Volunteer Division special fund shall not create a deficit in the Volunteer Division special fund, the amortization of which, together with the amortization of the existing deficit in the Volunteer Division special fund, exceeds 20 years from the date such increase in benefits is authorized. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Columbia Heights herewith approve the attached Resolution of the Board of Trustees of the Columbia Heights Fire Department Relief Association, Volunteer Division.
