COLUMBIA HEIGHTS CITY COUNCIL
OCTOBER 27, 1980 REGULAR MEETING
The meeting was called to order by Mayor Nawrocki at 8:05 pm.
i. Roll Call: Logacz, Heintz, Norberg, Hentges, Nawrocki--present
2. The Invocation was given by Councilman Norberg
3. Motion by Heintz,second by Hentges to approve the minutes of the October 14th
City Council meeting as presented in writing, and that the reading be dispensed
with. Roll Call: All ayes
4. Oral Petitions--None
5. Ordinances and Resolutions
The City Manager reviewed the five ordinances that deal with parking in the City.
a. Second Reading of Ordinance No.928 being an ordinance amending Ordinance No.853,
City Code of 1977, relating to overtime parking. This ordinance removes the limi-
tation of five permits per month. The ordinance was read by the City Manager.
Motion by Norberg,second by Logacz to table this item for further consideration
until later in the meeting. Roll Call: Logacz, Norberg, Nawrocki--aye Heintz
Hentges--nay ,
b. Second Reading of Ordinance No.929 being an ordinance amending Ordinance No.853,
City Code of 1977, relating to boulevard parking. This ordinance allows boulevard
parking and sets standards of control.
Motion by Norberg,second by Heintz to waive the reading of the ordinance there being
ample copies available to the public. Roll Call: All ayes
Discussion followed on certain sections of the proposed ordinance. Councilman Heintz
felt one section should be deleted that spoke to limiting the number of permits
allowable in any calendar month. Councilman Norberg felt this section should be
retained as it affords a means for review by the Police Department. He felt that
without this the City could be faced with potential legal ramifications.
Motion to amend by Heintz,second by Logacz to strike from the proposed ordinance
that section dealing with the limit of the number of permits issued in a calendar
month. Roll Call: Logacz, Heintz, Hentges, Nawrocki--aye Norberg--nay
Motion to amend by Hentges, second by Norberg to replace the word "issued" with the
word "valid", and to change the date of "April 15th" to the date of March 31st in the
eighth section of the proposed ordinance. Roll Call: All ayes
Motion by Norberg,second by Heintz to add to section iv the words,"in any 24 hour
period" and to include an additional section that reads, "All permits shall expire
on March 31st of each year" Roll Call: All ayes
This ordinance with the amendments was again carefully reviewed by the Council and
the staff.
ORDINANCE NO. 929
BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE
OF. 1977, RELATING TO BOULEVARD PARKING
The City Council of the City of Columbia Heights does ordain:
Section 1: Section 7.202(6) of Ordinance No. 853, City Code of 1977, passed
June 21, 1977, which currently reads as follows, to-wit:
"No person shall park or stand any vehicle on a boulevard or &llow

(a) When authorized by the Chief of Police on an emergency basis, or
(bi When permitted by action of the Council during repairs of adja-
cent streets."
is herewith amended to read as follows, to-wit:
"No person shall park or stand any vehicle on a boulevard or allow
a vehicle to remain on a boulevard within the City, except:
(a) When authorized by the Chief of Police on an emergency basis;
(b) When permitted by action of the Council during repairs of adja-
cent streets;
(c)
When issued a permit by the Chief of Police. The Chief of Police
may only issue such permits to applicants meeting the following
conditions:
(ii
The Chief of Police, upon advice of the Zoning Administra-
tor, determines that the applicant cannot park at any other
place on the property on which his residence is located
without violating the zoning laws relating to permitted
offstreet parking;
(ii)
The Chief of Police determines that permitting such parking
will not impede the plouing, removal or storage of any snow,
ice or waste from the public right of way;
(iii) The Chief of Police determines that permitting such parking
will not obstruct the normal flow of pedestrian traffic
from adjoining properties and will mot obstruct the deliver)'
of emergency services to the affected property or any other
property;
(iv) The permit will only allow the parking of vehicles at such
location as is designed by the Chief of Police;
(vi
The permit may be revoked by the Chief of Police if the Chief
of Police later discovers that the subject vehicle will im-
pede the plowing, storage or removal of snow, ice or waste
from or at the location of the vehicle; provided, however,
that the Chief of Police shall give notice of such revocation
by posting a notice to that effect on the subject vehicle for
not less than two {2) hours;
(vi) No permit shall be valid for a period in ecxess of ten (I0)
hours in any 24 hour period;
(vii) No permit shall be valid u~less clearly displayed upon the
permitted vehicle;
(viii) No permit shall be valid except between November 1 of any
year and March 31 of the next succeeding year;

It was the consensus of the Council that Ordinance No.931, Ordinance No.937 and
Ordinance No.939 that dealt with the parking ban need no further consideration.
c. Resolution No. 80-67 Subdivision Request Mr.& Mrs. Stan Guzik, 29 Rice Creek Way
The City Manager and the City Planner reviewed this resolution and its background.
This request iA for a lot split that will result in two parcels. This lot split is in
conformance with the City's zoning requirements. The Planning and Zoning Commission
forwarded this item to the Council without recommendation. This item was considered
by the Rice Creek Watershed District at its meeting of October 22nd. The Planning
and Zoning Commission was not in a position to make a recommendation as it did not
know what would be required by the Rice Creek Watershed District. The City Planner
detailed what was required by the Rice Creek Watershed District of the owners of
the property. The primary concern of the Watershed District is with the drainage
and the rate of water discharge on the property. The owners of the property did
make a permit application for land development as required by the Watershed Dist-
rict and received preliminary approval. The concern of the Watershed District lies
with how the property is developed more than with how it is subdivided.The City
Planner gave some details of the requirements to be met in this development as
specified by the Rice Creek Watershed District. They are as follows; avoidance of
any erosion or sedimentation during or after the building process, the setback or
location of a building relative to the shoreline of Silver Lake, and minimum
basement-opening elevation. The Board of Review will again consider this matter
at their meeting of November 26th. Councilman Norberg noted that this lotsplit
will result in two lots with irregular shapes and may result having some of the
same difficulties that have been experienced in the past with such things as assess-
ments and problems of that nature.

BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE
OF 1977, RELATING TO OVERTIME PARKING
The City Council of the City of Columbia Heights does ordain:
Section l:
Section 7.205(13)(a) of Ordinance No. 853, City Code of 1977, passed
June 21, 1977, which currently reads as follows, to-wit:
"(al No more than five (5) such requests in any calendar month
may be made for the same address except as provided hereafter
is herewith amended to read as follows, to-wit:
"(al Permits in excess of five (5) in any calendar month shall
not be granted unless the Chief of Police determines that
the applicant cannot park on the property upon which his
residence is located without violating the zoning laws re-
lating to permitted offstreet parking areas or that the ap-
plicant cannot reasonably or legally drive the subject ve-
hicle to any other place on the property where his residence
is located without violating the zoning laws relating to off-
street parking.

d. Second Reading of Ordinance No.935 being an ordinance amending Ordinance No. 853,
City Code of 1977, pertaining to the sale of certain real estate on 43rd Avenue
N.E. to Marvin B.O'Donnell and Joan M. O'Donnell.
Motion by Hentges,second by Logacz to waive the reading of the ordinance there being
ample copies available to the public. Roll Call: All ayes
There was some discussion on the selling price of the parcel. Councilman Hentges felt
that the price was too high considering how much money has to be spent by the purchasers
to make the lot buildable.
Motion to amend by Hentges to change the selling price to $1500. Motion dies for lack
of a second.
Councilman Norberg feels there are a number of alternatives that should be explored
for making this parcel buildable that would be much less expensive. He thinks that
the selling price may be too low.

The City of Columbia Heights Does Ordain:
Section l:
The City of Columbia Heights shall sell and convey unto Marvin B. O'Donnell
and Joan M. O'Donnell, husband and wife, the real property described as
follows, to-wit:
Lot 6, Block 3, Reservoir Hills, Anoka County, Minnesota, except
the West 110 feet thereof and except the South 165 feet thereof.
(Reserving and subject to a roadway and utility easement over

Second Reading of Ordinance No.936 being an ordinance amending Ordinance No.853,
City Code of 1977, pertaining to the sale of certain real estate on 42½ Avenue
to David M. Szurek and Marlaine J. Szurek.
Motion by Hentges,second by Logacz to waive the reading of the resolution there being
ample copies available to the public. Roll Call: All ayes
Councilman Heintz was hesitant to approve this sale before the purchasers had com-
pleted the arrangement with the City for their property which is located in the
Downtown Development area.
Motion by Heintz,second by Norberg to table this matter until the next regular meeting.

Motion by Hentges,second by Logacz to waive the reading of the resolution there being

Councilman Norberg questioned the fee for family dwellings. He felt, that since the
inspection of houses being sold wilt probably be a requirement within two years, this
should be given consideration as a service of the City.

its ordinance with regard to Certificate of Code Compliance
for dwellings;
NOW THEREFORE BE IT RESOLVED that the City of Columbia
Heights City Council does hereby adopt the following

ARTICLE X CERTIFICATE OF CODE £OMPLIAN:E FEES
Fees Required. The Director of Inspections, before issuing any certificate
of code compliance or making any prerequisite inspection, sha)l require the
payment by the applicant for such certificate of code compliance of the fees
in the amounts herein set forth.
One-and-Two Family Dwellings. The fee for a one-or-two family dwelllng
shall be one hundred dollars ($100.O0).
Multiple Dwellings. The fee for multiple dwellings such as apartment
houses, tenement houses, rooming houses, boarding houses, dormitories,
fraternity and sorority houses, any building containing combinations of
the above types of occupancy, and other similar type buildings shall be one
hundred dollars (SlO0.O0) for the first dwelling, tenement or rooming unit,
plus twenty dollars ($20.O0) for each additional dwelling or tenement
unit, and three dollars ($3.O0} for each additional rooming units.
Hotels. The fee for hotels sha)! be one hundred dollars ($1OO.O0) for
the f'irst dwelling rooming unit or hotel sleeping room, plus ten dollars ($10.00)
for each additional dwelling unit; three dollars ($3.00) for each rooming unit
or hotel sleeping room; and seven dollars and fifty (S7.50) for each one
thousand (1,O00) square feet of floor area, or fraction thereof of public rooms or areas
(dining rooms, ballrooms, bars, lobbies, etc.}
Commercial or Industrial Buildings. The fee for commercial or industrial
~uildings shall be seventy-five dollars ($75.00) for the first one thousand (1,O00)
~quare feet, or fraction thereof, of floor area plus five dollars ($5.00) for
each additional one thousand {1 000) square feet of floor area, or fraction
thereof. '

WHEREAS, negotiations have proceeded between the Minnesota
Teamsters Public and Law Enforcement Employees' Union, Local No. )20,
representin~ Sergeants of the City's Police Department, and members of
the City negotiating team, and said negotiations have resulted in a
mutually acceptable contract, for the calendar years 1980 and 1981,
NOW, THEREFORE, BE IT RESOLVED, that the contract agreement
as negotiated, be and are hereby established as the salary and fringe
benefit program for calendar years 1980 and 1981 for Sergeants of the
Columbia Heights Police Department.
BE IT FURTHER RESOLVED, that the Mayor and City Manager be
authorized to execute this agreement.

7. Old and New Business
a. Old Business
1. Heating, Air Conditioning, and Ventilation System-City Hall
Bob Diedrich, the engineer who installed the heating and ventilating systems
for the remodeled and renovated areas of City Hall, detailed the systems for
the Council. He made a number of suggestions as to why the systems are not
working properly at this time. Discussion followed as to how best diagnose
the problem and find solutions. Mr. Diedrich feels that the whole system needs
some on-sight management, such as an operating engineer. This person would be
able to monitor the system on a regular basis, unlike the present situation,
in which the system gets attention only when it is malfunctioning.
Motion by Norberg to authorize the City Manager to secure proposals for a
heating, air conditioning, and ventilation consultant to evaluate the system
in City Hall. Motion dies for lack of a second.
Motion by Hentges that the control in the Police Dispatch area be relocated to
a more appropriate spot in the City Hall and for the heat to be ventilated
differently. Motion dies for lack of a second.
Motion by Logacz,second by Heintz to authorize the City Manager to expend up
to $1,OO0 to retain the services of a consultant to do a study of the problem,
the funds coming from the Government Building Fund. Roll Call: All ayes
Motion by Norberg,second by Nawrocki to authorize the City Manager to take
proposals for the venting of the excess heat from the electronic equipment in
the Police Department office and to expend up to $500 to vent same. Roll Call:

Some discussion followed as to how the lights in the hallway on the second floor
of City Hall are controlled. It was advised that the time-switch that controls
these lights be reset with the seasons, two or four times a year.
2. Cooperative Agreement with the City of Minneapolis Regarding Reconstruction
of 37th Avenue
Motion by Logacz,second by Heintz to authorize the Mayor and City Manager to
execute the amended cooperative agreement with the City of Minneapolis regarding
the reconstruction of 37th Avenue from Central Avenue to Main Street.
Considerable discussion followed regarding a major point of interest in the
agreement. This point was; "change orders in excess of 10% of Columbia Heights'
portion of construction will be referred to the City, for prior approval". The
Council discussed various problems with this point and offered several solutions.
The Mayor proposed the establishment of a contingency fund in the amount of
$18,250 or 5% of the estimated cost for Columbia Heights of the project. It this
dollar amount were to be exceeded the change orders would have to be brought
before the Council. This contingency fund would be administered by the Engineering/
Public Works Departments.

3. 1981 Recreation and Community Services Commission Budget
An additional dollar amount of $3,500 for this budget was authorized by the
Council contingent on the School Board's authorization of a commensurate
amount. The School Board had indicated a willingness to consider an increase
in this budget, but for a lesser amount.
Motion by Heintz,second by Logacz to amend the request that the City and the
School District provide an additional $3,500 to the 1981 Recreation Commission

Park Board Vacancies
Motion by Heintz,second by Hentges to accept the resignation of Gordon $chelde
from the Park Board. Roll Call: All ayes
There are two vacancies on the Park Board, the resignation of Mike Farrell having
been accepted at a prior time.
Motion by Hentges,second by Norberg to appoint John Starcevic to fill the unexpired
term of Mike Farrell and Pat Hofer to fill the unexpired term of Gordon $chelde.
Motion to amend by Logacz,second by Heintz to substitute the name of Jim Fowler
for the name of Pat Hofer to fill the unexpired term of Gordon $chelde. Councilman
Norberg felt there should be a geographical balance and the complexion of this
board should reflect this.
Roll Call on the Amendment: Logacz, Heintz, Nawrocki--aye Norberg, Hentges--nay
Motion by Norberg to substitute the name of Pat Hofer for John $tarcevic. Motion
dies for lack of a second.

Councilman Logacz inquired as to when the light on Peters Place and Reservoir
Boulevard would be installed. The City Manager said that NSP indicated it would
be from three to six weeks.
6. Councilman Heintz asked what was the weight al]olwable on the contents of a garbage
can and was advised it was 75 pounds.
b. New Business
Hennepin County Vehicle Auction Results
The City ~f Columbia Heights will receive a net amount of $5,762.96 for the
various vehicles and equipment sold at this auction. This was an informational
item.
Increase in Utility Rates
The City Manager requested that some work sessions be scheduled to discuss utility
rates as he felt this item would require considerable time.

The City Manager felt some of the time at these work sessions could be spent
on the Comprehensive Plan, Transportation Plan and the Housing Plan.
Purchase of Police Vehicles
These three vehicles are being purchased from the Hennepin County Cooperative
Purchasing bid.
Motion by Hentges,second by Logacz to authorize the purchase of three 1981
Chrysler-Plymouth LeBarons plus one parts manual and one service manual for
a total purchase of $22,407.65, based upon low competitive bid. Roll Call:

Authorization to Expend Funds for Replacement of Street Sweeper Parts
The Public Works Director has advised that both street sweepers are in need of
repair, in particular, replacement of worn conveyor parts.
Motion by Hentges,second by Heintz to authorize the City Manager to expend $896
for the purchase of street sweeper conveyor parts from Seal Methods,Inc., based
upon low, informal quotations. Councilman Norberg felt this item should be

5. Southern Police Institute
The 1981 budget includes monies for the attendance of the Police Chief at the
Southern Police Institute. The Mayor explained that because an item was budget-
ed, it doesn't authorize the Chief's attendance, and asked the Council to take
this action. He was making the request at this time because this program requires
a competitive exam be taken and an application be made before acceptance is
determined. The deadline for these procedures is in five weeks.
Motion by Helntz,second by Logacz to authorize the attendance and expenses of
the Police Chief at the Southern Police Institute. Roll Call: All ayes
6. Survey of Sullivan Lake
Specific boundaries of Sullivan Lake Park must be established and assigned a
legal description as required in our grant application for development funds
for this Park.
Motion by Heintz,second by Logacz to authorize the City Manager to retain
Kurth Surveying Company in an amount not to exceed $600 for the purpose
of surveying a boundary and preparing a legal description of City property
lying westerly of Tract A, Registered Land Survey No.63 and on the northerly
side of Sullivan Lake, for the purpose of deducting the land described as
park property, the retention of Kurth Surveying Company is based upon low,
informal quotation. Roll Call: All ayes
7. Purchase Materials for Repairs to Liquor Store # 2
The floor at Liquor Store # 2 is in need of repair. These repairs can be done
by City personnel.
Motion by Heintz,second by Hentges to authorize the City Manager to purchase
various flooring materials from Central Tile & Linoleum in the amount of
$860.60, based upon low, informal quotation. Roll Call: All ayes
8. Authorization to Purchase Uniforms for Public Works Employees (as per Local
49 Contract)
Motion by Hentges,second by Heintz to authorize the City Manager to purchase
uniforms from American Linen based upon low, informal quotations and to be
purchased and distributed in compliance with the uniform policy. Roll Call:

9. DNR Hearings on the Waterways of the City of Columbia Heights
This was an informational item. The DNR has placed certain designations on
bodies of water in the City. In the opinion of the Mayor these waters should
continue to be maintained on a local level. He suggested the City Manager
and the City Attorney make an effort to see that someone from the City ap-
pear at these hearings to voice opposition to these designations. The members
of the Council shared the view that opposition to this plan of the DNR
be presented.

of the items in the report.

The City Attorney advised the Council that the deadline had passed and the
