SPECIAL MEETING OF THE CITY COUNCIL
CITY OF COLUMBIA HEIGHTS, MINNESOTA
APRIL 16, 1979
The meeting was called to order at 8:55 p.m.
Roll Call: Logacz, Heintz, Norberg, Hentges, Nawrocki - Present
PURPOSE OF MEETING
Mayor Nawrocki stated that this is a special meeting of the City Council
for the purpose of considering assessments on City projects which have been
completed.
ASSESSED PROJECT REVIEW:
1. Project 726
City Manager stated that this is the street opening, lateral sewer and water,
storm sewer, curb and mat (Columbia Court Plat). He reported that the project
was authorized in October, 1977. The estimated cost at that time was $93,125.
He noted the final cost included 15% administrative charges, for a total cost
of $106,744.84. This assessment will be charged at 8% interest for l0 years.
The assessment is .394¢ per square foot.
Mayor Nawrocki asked why 15% is being charged when it is usually 30% for
administrative costs. The City Manager explained that some of the administrative
costs were included in the salaries and fringe charges. The Mayor asked why this
project was being assessed over 10 years. Millie Carlson, City Assessor,
answered because it is quite a costly project. The Mayor asked why the developer
wasn't responsible for the costs of the project, why the City was carrying this
over a 10 year period at 8%, and why the assessment was being charged on a square
foot basis instead of a front foot basis. The City Manager answered that some of
the lots do not have a large front footage but have large square footage and
this method of assessment is more equitable. The Mayor asked why the project was
over the original estimate. George Brown, City Engineer, answered that an
extreme amount of fill was needed that added to the expense. Discussion followed
on the reasons for the assessment being on a square footage basis and the method
of paying the assessment.
Resolution 79-16

The Mayor asked the City Attorney for an opinion on the changing of the assessment
role from 10 years to 8 years. The City Attorney answered that it could be
changed. The Mayor suggested withdrawing the resolution to allow a motion to
be made changing the assessment roles.
The offerer declined to agree to the withdrawal.

Motion by Norberg, seconded by Hentges, to table consideration of the
resolution until later in the meeting.

Motion by Hentges, seconded by Norberg, to change the assessment roles for
project 726 from 10 years to 8 years as the period of time over which to
spread the assessment.
Motion by Norberg to amend the motion to 5 years from 8 years.

2. Project 742
The City Manager stated this project was the storm drain (40th Avenue, west of
Stinson through 2216 and 2217 ~Oth Avenue; also 3~60 and 3~70 McKinley; also
2217 39~ Avenue and vacant lots 8 and 9, Block 2, Apache Heights; also two lots
at 3~00 Stinson Blvd.). The project was first approved on October 15, 1978.
The estimated cost was S3,000 at S155 per parcel. The cost today is a total
of $3,252.80. He is recommending that the assessment be on a two year basis at
8~ interest.
Motion by Heintz to offer the resolution.
Mayor Nawrocki ruled that Councilman Heintz could not bring this up because he
did not vote on the prevailing side of the motion to table.
3. Project 745
The City Manager- stated that this involved storm drainage (4247 and 4253 2nd
Street). The project was authorized on August ]6, 1978 at SI00 per parcel.
The remaining amount was to be paid by the City. The total cost of the project
is $372.50, minus one-half paid by the City, plus 154 added in for administrative
costs, for a total assessable cost of $214, or $107 per parcel.
4. Project 746
The City Manager stated that this is the water main (Midland Coop site). Council-
man Norberg asked why this was recommended for a 5 year payback as it was being
paid for with a bond issue and should be paid for immediately. The City Manager
stated this is because of the size of the assessment. He added that Midland has
not yet come before the Council for approval of the sale of their industrial
revenue bonds and maybe this type of payment could be made a part of the conditions
for approval. Discussion fo]lowed on the reason for paying the assessment at
once instead of over a 5 year period.

Motion by Norberg to change the assessment roles on project 746 from 5 years
to one year.
Motion dies for lack of a second.
Councilman Norberg pointed out that if it is advantageous for Midland to pay
off the bill in one lump sum, they can.
Motion by Norberg, seconded by Hentges, to change the assessment roles on
project 746 from 5 years to 8 years.
Motion by Heintz to amend the motion from 8 years to lO years.
Motion dies for lack of a second.

Motion by Heintz to not read the resolution authorizing the projects.

Motion by Norberg, seconded by Hentges, to take from the table the resolution
adopting the assessment roles.

Mayor Nawrocki asked if the resolution can be put to a vote without having
been read. The City Attorney stated that it had to be read. The Mayor ruled
that the previous offering of the resolution was out of order.
RESOLUTION 79-16
Adopting assessment rolls according to the City Charter for the following local
improvements and determining that said improvements have been made and ratifying
and confirming all other proceedings, heretofore had: Special assessments
numbered 726, 742, 745, 746.
WHEREAS, the City Council of the City of Columbia Heights, Minnesota, met at
7:30 o'clock p.m. on the 16th day of April, 1979, in the Council Chambers, at
590 40th Ave. N.E., Columbia Heights, being the time and place set when and where
all persons interested could appear and be heard by the Council with respect to
benefits, and to the proportion of cost of making the local improvements above
described, a notice of such hearing having been heretofore duly published as
required by law, and a notice mailed to each property owner of record, stating
the proposed amount of the assessment; and,
WHEREAS, this Council has heretofore estimated and fixed the cost of such local
improvements and has prepared an assessment roll therefore,

Section 1.
That this council does hereby adopt the aforesaid assessment rolls
known and described as "Assessment Roll for Local Improvements~
numbered, 726, 742, 7a5, and 7a6.
Section 2.
That this council hereby finds and determines that each of the
lots and parcels of land enumerated in said assessment rolls was
and is especially benefitted by such improvement in an amount not
less than the amount set opposite in the column headed "Total
Assessment" And this council further finds and determines that
the proper proportion of the cost of such improvements to be
especially assessed against such lot or parcel of land is the
amount set opposite the description of each such lot or parcel
of land respectively in said assessment rolls.
Section 3.
That said assessments may be paid in part or in full without interest
on or before Hay 16, 1979, or in annual installments for a period
of from one to ten years as designated on each assessment roll,
payable on or before the }Oth day of September, annually, with 8~
interest, the first installment being due September 30, 1979, with
82 interest for 8~ months thereon. Failure to pay the annual
installment renders the same delinquent and thereafter a 102
penalty is added and the said delinquent special assessment is
certified to the County for collection with the real estate tax.
Section
That this council did hereby determine and redetermine to proceed
with said improvements, does ratify and confirm all other
proceedings heretofore had in regard to these improvements and said
improvements shall hereafter be known and numbered as Local
Improvements numbered 726, 7L~2, 7L~5, and
Section 5. This resolution shall take effect immediately upon its passage.
