SPECIAL MEETING OF THE CITY COUNCIL
CITY OF COLUMBIA HEIGHTS, MINNESOTA
DECEMBER 3, 1979
The meeting was called to order' at 7:35 p.m.
Roll Call: Logacz, Norberg, Nawrocki - Present
PURPOSE OF MEETING
Mayor Nawrocki stated that the purpose of the meeting was to consider
assessments for the permanent improvement projects which were completed during
last year's construction season.
PRESENTATION OF INFORMATION
The City Manager showed slides of the method of paying the assessment, time
allowed for payment, interest rates, and penalties. He pointed out the
difference between street assessments and avenue assessments.
1. Projects 729 and 730
Slides were shown of the parcels benefitting from project 729, curb and gutter
on 5th St., 37th Ave. to 40th Ave.; and project 730, curb and gutter on 38th
Ave., University Ave. to 5th St.
Mr. Pierson, owner of property on 38th, asked why he was being charged street
and avenue assessments. George Brown, City Engineer, answered that the property
benefitted from both improvements and so was being charged for both as were
other properties in the area.
The City Manager stated the cost of the project and the amount to be assessed
which is less than the estimated costs given at the original hearing when the
projects were authorized.
Mr. Bob Kaponen~ 3930 Johnson St., asked what was included in the 15% admini-
stration cost. The City Manager answered that the administrative costs include
personnel, advertising, supplies, etc.
Motion by Norberg, seconded by Logacz, that the assessments be established as
recommended by the City Manager on project 729 based on the corrected figure of
$26,681.52.

recommended by the City Manager' on project 730.

2. Project 744
Slides were shown of the lots included in the assessment of the project and the
costs of the project, the storm drain, Buchanan Street and Linco]n Street,
37th Ave. to 39th Ave.
The total cost of the project is S14,692.80. The Council had previously agreed
that the City would pay a portion of this cost. As a result, $10,466.80 will
be transferred from the General Fund to reduce the amount to be assessed to
property owners to $4,860.00 or Si80.O0 per parcel for the 27 benefitting
parcels.
Motion by Logacz, seconded by Norberg, that the assessments be established as
recommended by the City Manager on project 744 in the amount of S4,860.00.
Councilman Norberg repeated his objection to the idea that the balance is being
paid ,out of the General Fund. Mayor Nawrocki stated that the cost being assessed
is in line with the general policy of assessing 2¢ per square foot for storm
sewer work.

Project 750
Slides were shown of the general area to be assessed for the alley opening,
blacktop and storm drain, 3931 to 3947 Polk Street and 3928 and 3940 Johnson
Street. The cost of the project is $$,133.84.
Mr. Dudziak, 3943 Polk St., asked why a tree was cut from his property when
the alley was paved. Tom Madigan, Assistant City Engineer, answered that the
tree was in the City's right of way and had to be removed to work in the alley.
The ownerls wife was notified that: the tree had to be removed several days
before it was cut and the wood was left for the property owner.
Motion by Norberg, seconded by Logacz, that the assessments be established as
recommended by the City Manager on project 750 in the amount of S8,133.84.

4. Project 752
These items were previously billed to the property owners and are outstanding
and considered to be delinquent bills. The projects include mid-block lighting,
weed control, tree removal, and sidewalk repair. The assessment amount is
$859.6o.
The City Manager noted a change in one assessment for tree removal.
Motion by Logacz, seconded by Norberg, that the assessments be established as
recommended by the City Manager on project 752 in the amount of $859.60.

Motion by Norberg, seconded by Logacz, to waive the reading of the resolution
adopting the assessment rolls as sufficient copies were available for the
public.

RESOLUTION 79-51
Adopting assessment rolls according to the City Charter for the following
local improvements and determining that said improvements have been made
and ratifying and confirming all other proceedings, heretofore had: Special
assessments numbered 729, 730, 744, 750, and 752.
WHEREAS, the City Council of the City of Columbia Heights, Minnesota, met at
7:30 p.m. on the 3rd day of December, 1979, in the City Council Chambers,
590 - 4Oth Ave. N.E., Columbia Heights, Minnesota, being the time and place
set when and where all persons interested could appear and be heard by the
Council with respect to benefits, and to the proportion of the cost of making
the local improvements above described, a notice of such hearing having been
heretofore duly published as required by law, and a notice mailed to each
property owner of record, stating the proposed amount of the assessment; and,
WHEREAS, this Council has heretofore estimated and fixed the cost of such
local improvements and has prepared an assessment roll therefore,
THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS HEREBY RESOLVES:
Section l:
That this council does hereby adopt the aforesaid assessment rolls
known and described as "Assessment Roll for Local Improvements'l
numbered 729, 730, 744, 750, and 752.
Section 2:
That this council hereby finds and determines that each of the
lots and parcels of land enumerated in said assessment rolls was
and is especially benefitted by such improvement in an amount not
less than the amount set opposite in the column headed ~'Total
Assessment". And this council further finds and determines that
the proper proportion of the cost of such improvements to be
especially assessed against such lot or parcel of land is the
amount set opposite the description of each such lot or parcel
of land respectively in said assessment rolls.
Section 3:
That said assessments may be paid in part or in full without interest
on or before January 2, 1980, or in annual installments for a
period of from one to ten years as designated on each assessment
roll, payable on or before the 3Oth day of September, annually, with
8% interest thereon. Failure to pay the annual installment renders
the same delinquent and thereafter a 10% penalty is added and the
said delinquent special assessment is certified to the County for
collection with the real estate tax.

Section
That this council did hereby determine and redetermine to proceed
with said improvements, does ratify and confirm all other
proceedings heretofore had in regard to these improvements and
said improvements numbered 729, 730, 7~, 750 and 752.
Section 5: This resolution shall take effect immediately upon its passage.

Helen Kocur, 1213 42nd Ave., asked about the curbing on 42nd Ave. and several
other ]ocations. She feels a poor job was done and asked what has become of
her previous complaints about it. The City Manager was directed to look into
the situation.
Mrs. Kocur stated her objection to the water, sewer and garbage rates. The Mayor
explained why the City had a minimum charge, including the upkeep of the lines and
routine maintenance.
A lengthy discussion was held on the history of the problem and the progress of
the work being done on 42) and ~" Avenues.
