SPECIAL MEETING OF THE CITY COUNCIL
CITY OF COLUMBIA HEIGHTS, MINNESOTA
MARCH 13, 1978
The meeting was called to order at 7:35 p.m.
Roll Call: Logacz, Heintz, Hentges, Nawrocki - present
PURPOSE OF MEETING
The Mayor noted that this was a special meeting to consider improvements for
the Cheery Heights addition.
PRESENTATION OF INFORMATION
City Manager Anderson presented the information pertaining to the development of
Cheery Heights. Mayor Nawrocki noted that this information had been presented in
writing to the Council members.
The Mayor added that Mr. Herringer and the school district have requested that they
be allowed to pay the costs as they accrue from the contractor so as to avoid the
formalities and additional costs that are inherent in the assessment process. The
City Attorney was directed to explore the possibilities of doing this and, if it is
possible, arrangements for paying for these costs should be worked out with the
affected property owners. The administration of the school district has also
asked that the Council consider paying for the curbing out of state aid funds.
The policy in the past has been to assess the curbing to the adjoining property
owners.
The City Manager read the resolution ordering improvements.
Bob Owens, Engineering Department, noted that the resolution stated a gravel base
be installed on several of the streets while it should state curb, gutter and
bituminous surfacing. The resolution was amended to include this wording.
RESOLUTION 78-7
BEING A RESOLUTION ORDERING IMPROVEMENTS
BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights:
WHEREAS, the City Council of the City of Columbia Heights, by motion on the 27th
day of February, 1978, ordered notice of a hearing to be given to property
owners, and
WHEREAS, pursuant to a notice of hearing certain residents appeared at a Council
meeting on the 13th day of March, 1978, and
WHEREAS, the Council determines to proceed with this local improvement, a portion
of the cost being defrayed by agreement with Cheery Heights Plat owner, School
District #13, and Municipal State Aid Account.

NOW, THEREFORE, IT IS HEREBY RESOLVED:
1. That: the location and extent of such improvements is as follows:
Grading and street construction of the following streets: Fillmore, 47th
to 49th Avenue, Borealis Lane, Khyber Lane, Cheery Lane, as shown on the
Cheery Heights plat in Columbia Heights, Minnesota, along with installation
of necessary city utilities including sanitary sewer, watermain and storm
drain.
2. That the materials to be used are as follows:
Concrete curb and gutter, bituminous surfacing on Fillmore Street;
placement of curb, gutter and bituminous surfacing on Borealis Lane,
Khyber Lane, and Cheery Lane; PVC sewer pipe, RCP storm drain, DIP ductile
iron pipe watermain, together with necessary utility appurtenances.
That. a careful estimate of the cost of the improvement has been made by the
City' Manager and the several lets and parcels of land fronting upon and
adjacent to such proposed improvement, which he deemed benefitted thereby,
were properly notified ef said hearings, and
4. That the City Manager shall also list the names and owners of the several
parcels so improved as nearly as can be ascertained.
5. These improvements shall also be known as Project No. 719 and 738.

RESOLUTION 78-8
RELATING TO PARKING RESTRICTIONS ON
S.A.P. 113-116-01 FROM 47th AVENUE N.E. TO 49th AVENUE N.E.
IN THE CITY OF COLUMBIA HEIGHTS
THIS RESOLUTION, passed this 13th day of March, 1978, by the City of Columbia
Heights, in Anoka County, Minnesota. The Municipal corporation shall herein-
after be called the "City"; WITNESSETH:
WHEREAS, the "City" has planned the improvement of M.S.A.S. 11.3-116 Fillmore
Street from 47th Avenue N.E. to 49th Avenue N.E.
WHEREAS, the "City" will be expending Municipal State Aid Funds on the
improvement of said Street, and

WHEREAS, said improvement does not conform to the approved minimum standards
as previously adopted for such Municipal State Aid Streets and that approval
of the proposed construction as a Municipal State Aid Street project must
therefore be conditioned upon certain parking restrictions, and
WHEREAS, the extent of these restrictions that would be a necessary pre-
requisite to the approval of this construction as a Municipal State Aid
project in the "City", has been determined.
NOW, THEREFORE, IT IS HEREBY RESOLVED:
That the "City", shall restrict the parking of motor vehicles on both sides
of Fillmore Street 113-116 at all times.
