HomeMy WebLinkAboutSept 11, 1978OFFICIAL PROCEEDINGS REGULAR MEETING OF THE CITY COUNCIL CITY OF COLUMBIA HEIGHTS, MINNESOTA SEPTEMBER 11, 1978 The meeting was called to order at 8:25 p.m. Roll Call: Logacz, Heintz, Norberg, Hentges, Nawrocki - present. INVOCATION The invocation was given by Councilman Norberg. MINUTES OF PREVIOUS MEETINGS Motion by Heintz, seconded by Norberg, to approve the minutes of the August 28 special meeting, the August 28 regular meeting, the August 29 special meeting, the August recessed meeting, and the August 30 recessed meeting as presented in writing and reading be dispensed with. Roll Call: All Ayes PRESENTATION OF PLAQUES Mayor Nawrocki stated that one good feature of Columbia Heights is its good fire department. Many of the volunteers have served for a number of years. He stated he wished at this time to recognize the following four men who have retired from the fire department in the past few months: Mitch DeMars - 28 years with the department, Richard Gill - 21½ years, Bill Mattlon - 20 years, and Lawrence Nelson - 21½ years. Mitch DeMars stated that people choose to serve the community in many ways, he and the other fire department volunteers have chosen to serve their community in this way. ORAL PETITIONS Several Jaycees were present to ask if a ramp could be installed at the Field House to accomodate the handicapped. Mike Wickander, Jaycee president, stated that the Field House has handicapped parking spaces outside but no access to the building for the handicapped. The Mayor asked that this be brought to the Park Board as a recommendation. The Mayor noted there was interest expressed in the possibility of a half street between 41st and 42nd on the east side of Central. Earl Gustafson, Public Works Director, stated that the project is not planned because the majority of surrounding property owners do not support the half street. He added that plans were drawn up several years ago for this project but the neighbors did not support the project at a public hearing called at that time. Mayor Nawrocki noted that any decision will hinge on the wishes of the neighbors. The Mayor stated that he had a call from Mr. Martin regarding the status of some trees he questioned the Council about several meetings ago. He was told at that time that he would receive a response from the City Manager but has not to this day. The Mayor asked the City Manager to please see that Mr. Martin receives a prompt response. September l l, 1978 Page 2 A resident brought up the subject of an article in the Newsletter on not over- loading garbage cans because of resulting injury to the garbage men. He stated he has watched the garbage men loading the cans and noticed that the men do not know the proper way to lift the cans. He feels the responsibility should rest with the contractor to instruct his men in the proper method. Councilman Norberg stated he also had a call on this item from a resident who said he had seen the garbage men attempt to throw a bag about 50 feet into the truck which also could cause a back problem. Councilman Norberg stated the contractor should talk to his men about these items. ORDINANCES AND RESOLUTIONS: 1. Establishing Salary and Fringe Benefits for Police Officers The City Manager stated that this contract would cover all police officers and the dispatcher. He noted two changes in the contract. RESOLUTION 78-38 BEING A RESOLUTION ESTABLISHING THE SALARY AND FRINGE BENEFITS SCHEDULE FOR POLICE PATROL OFFICERS FOR 1978 BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS, that WHEREAS, negotiations have proceeded between Local 320 Teamsters representing Police Officers of the City of Columbia Heights and the City Council's labor consultant and management bargaining team, and said negotiations have resulted in the mutually acceptable contract, and WHEREAS, a copy of said contract is available for inspection at the office of the City Clerk and is made a part hereof by reference, NOW, THEREFORE, BE IT RESOLVED that the contract as negotiated be and is hereby established as the salary and fringe benefit program for 1978 for police officers of the City of Columbia Heights represented by Local 320 upon signing of the contract documents by both union and City representatives. BE IT FURTHER RESOLVED that the Mayor and City Manager are hereby authorized to execute this contract agreement. BE IT ALSO FURTHER RESOLVED that the reading in full of the actual contract be, and it is hereby, waived. Passed this llth day of September, 1978. Ordinances Regulating Residential Structures in Commercial Zones Motion by Hentges, seconded by Norberg, to waive the reading of the five ordinances as sufficient copies were available to the public. September ll, 1978 Page 3 Discussion followed on the reason for reading all five of the ordinances which were variations of an ordinance regulating residential structures in commercial zones. The City Attorney stated that the reason for reading the ordinances is so all five will have had a first reading, the Council can then decide which one of the five they favor, and then only that one will have a second reading at the next regular meeting. The Planning and Zoning Commission has recommended ordinance 897. Councilman Norberg stated that all these ordinances addressed themselves to the commercialization of residential property and don't address the problem of controlling the residentialization of commercial property. He suggested dealing with this subject. Roll Call: All Ayes ORDINANCE 894 BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977, PERTAINING TO REGULATION OF RESIDENTIAL STRUCTURES IN COMMERCIAL ZONE The City Council of the City of Columbia Heights does ordain: Section 1: Section 9.403(11) of Ordinance No. 853, City Code of 1977, passed June 21, 1977, which is currently reserved shall hereafter read as follows: "9.403(11) No structure within any commercial zone used for dwelling purposes at the time of passage of this Ordinance or thereafter may be converted to or used for any purpose other than as a dwelling without an alteration permit granted pursuant to this section. Applications for alteration permits shall be treated procedurally in the same manner as an application for a variance. All applications for altera- tion permits shall be accompanied by the same fee required for an applica- tion for a variance. Additionally, an applicant for an alteration permit may be required before approval thereof to submit such plans as would or- dinarily be required for issuance of a building permit and for application for site plan approval. In recommending approval of the site plan, the Board of Appeals and Adjust- ments must make the following findings: (a) All structures, the site; and the use of the site will conform to the district requirements for the use proposed after completion of the alteration in all.respects under this Chapter. The applicant must meet the prevailing zoning, building, fire, safety and other Codes for new construction as contained in this Chapter. (b) The proposed alteration will totally destroy the residential appear- ance of the structure. In making this determination, the City Coun- cil or the Board of Appeals and Adjustments, with the consent of the City Council, may employ architects and other experts to provide re- ports or testimony to assist in making such determination. The re- view shall consider the appearance of the proposed site plan as well as both the interior and exterior of the proposed altered structure. September ]l, 1978 Page 4 Section 2: The Board of Appeals and Adjustments may grant variances in recommending an alteration permit only if such variance meets the criteria contained in Section 9.503(4) and only if the Board makes findings in accordance therewith. Section 6.701(1) of Ordinance No. 853, City Code of 1977, passed June 21, 1977, which reads as follows: Section 3: "No person, firm or corporation shall remodel, reconstruct, add to, or otherwise alter any residential building now existing in any com- mercial zone for commercial use." is herewith amended to read as follows: "No person, firm or corporation shall remodel, reconstruct, add to, or otherwise alter any residential building now existing in any com- mercial zone for commercial use without having first obtained an altera- tion permit granted pursuant to Section 9.403(11)." This Ordinance shall be in full force and effect from and after thirty (30) days after its passage. September ll, 1978 Page 7 ORDINANCE NO. 897 BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977, PERTAINING TO REGULATION OF RESIDENTIAL STRUCTURES IN COMMERCIAL ZONE The City Council of the City of Col,,mhia Heights does ordain: Section 1: Section 9.403(11) of Ordinance No. 853, City Code of 1977, passed June 21, 1977, which is currently reserved shall hereafter read as follows: "9.403(11) No structure within any commercial zone used for dwelling purposes at the time of passage of this Ordinance or thereafter may be con- 'verted to or used for any purpose other than as a dwelling unless the said structure is so altered as to conform to the standards re- quired for.new construction in the zone in which such structure is located. The altered structure must meet the prevailing zoning, building, fire and safety codes contained in this Code." Section 2: Section 6.701(1) of Ordinance No. 853, City Code of 1977, passed June 21, 1977, ~hich reads as follows: "No person, firm or corporation shall remodel, reconstruct, add to, or otherwise alter any residential building now existing in any commercial zone for commercial use." is herewith amended to read as follows: "No person, firm or corporation shall remodel, reconstruct, add to, or otherwise alter any residential building now existing in any com- mercial zone for. commercial use except as permitted by Section 9.403(11). No person, firm or corporation may occupy such building for other than dwelling purposes until all the requirements of Sec- tion 9.403(11) have been met." Section 3: This Ordinance shall be in full force and effect from and after thirty (30) days after its passage. ORDINANCE NO. 898 BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977, PERTAINING TO REGULATION OF RESIDENTIAL STRUCTURES IN COMMERCIAL ZONE The City Council of the City of Columbia Heights does ordain: Section 1: Sections 6.701(1) and 6.701(2) of Ordinance No. 853, City Code of 1977, passed June 21, 1977, which read as follows: "6.701(1) No person, firm or corporation shall remodel, reconstruct, add to, or otherwise alter any residential building now existing in any commercial zone for commercial.use." and September 11, 1978 Page 8 Section 2: "6.701(2) The City Building Officer, City Manager, City Planner, or City Attorney shall have the power to apply to a court of competent jurisdiction on behalf of the City to abate, restrain, or enjoin any such violation of 6.701(1) without prior Council approval." are hereby repe~led. This Ordinance shall be in full force and effect from and after thirty (30) days after its passage. The Mayor noted that the second reading, which takes place at the next regular Council meeting, will constitute a hearing. Amendments can be made at that time. Motion by Norberg, seconded by Heintz, to direct the City Attorney to propose some ordinance to the Council dealing with the residentia]ization of commercial property for the next regular Council meeting. Roll Call: Logacz, Heintz, Norberg - Aye Hentges, Nawrocki - Nay PLANNING AND ZONING RECOMMENDATIONS: 1. Richard Caron, B & B Radiator, 4201 Central Request for Conditional Use Permit, Variance, Site Plan Approval Motion by Hentges, seconded by Logacz, to concur with the Planning and Zoning recommendation. The Mayor ruled that this was not a proper motion. Motion by Hentges, seconded by Logacz, that the Council concur with the Planning and Zoning Commission for the 10 foot side yard variance, the conditional use permit, and the site plan. Councilman Norberg stated he would like the record to show that the variance is being granted on the hardship of the narrowness of the tot, Roll Call: All Ayes 2. Cir-Tech, Inc., 3900 California St. Request for Site Plan Approval A1 Carlson, Planning staff, reported that Mr. Foster of Cir-Tech appeared at the Planning and Zoning Commission meeting to request a permit for an addition. The Planning and Zoning Commission felt the parking problem should be looked into and denied the request. There are 59 parking spaces presently but only 30 are conforming. A total of 49 parking spaces would be required with the addition to the building. Discussion followed on the parking and how it complies with the current ordinance. Mr. Foster stated he is proud of the work his company had done in the area. He is asking the Council to consider continuing the variance he received with the building September ll, 1978 Page 9 when it was first built. He stated he has more than enough parking spaces because the addition will be storage and will not result in additional employees. He stated what rules he has made for his employees to stop some of the problems the neighbors have had~ Councilman Norberg stated that the Council entered into the agreement with Cir-Tech at the time the building was approved and to discount the parking spaces on 39th would be a breach of faith at this point. Motion by Norberg, seconded by Hentges, that the request for variance be granted on the grounds that the parking is adequate for the situation, on the hardship of existing structures on the property, and renew the variances previously granted. Councilman Heintz noted that the Planning and Zoning Commission found there was no hardship. Motion withdrawn by maker and seconder. Motion by Heintz, seconded by Hentges, to grant the variance for the construction of the building and also to grant the variance for parking on 39th Avenue and also on California to Cir-Tech. Roll Call: Logacz, Heintz, Hentges, Nawrocki - Aye Norberg - Abstains 3. Richard Stoeckmann, 3853 VanBuren St. Request for Variance A1 Carlson reported that the garage would be set back 12 feet instead of the required 20 feet. Motion by Heintz, seconded by Norberg, that the variance be granted as recommended by the Planning and Zoning Commission based on the topography of the land. Roll Call: All Ayes 4. Thomas Miesen, 4034 4th St. Request for Subdivision A1 Carlson stated that this would transfer the south five feet of 4034 4th St. to 4028 4th St. Motion by Heintz, seconded by Hentges, that the lot subdivision be granted. Roll Call: All Ayes 5. John Marchiniak, 4233 Jefferson St. Request for Special Purpose Fence A1 Carlson stated that the fence is required because Mr. Marchiniak plans to install a swimming pool. Motion by Heintz, seconded by Norberg, that the request be granted for a special purpose fence based on the recommendation of the Planning and Zoning Commission. Roll Call: All Ayes September 11 , 1978 Page 10 6. Gilbert Bartylla, 4009 Reservoir Boulevard Request for Variance This variance is to allow construction of an attached garage. Motion by Heintz, seconded by Hentges, to grant the variance as requested. Councilman Norberg noted that this is a reconstruction and not a further encroachment. Roll Call: All Ayes 7. Roger Fisher, 4531 Madison St. Request for Special Purpose Fence Motion by Hentges, seconded by Heintz, that the request for a special purpose fence be granted for a 48'* chain link fence. The fence has already been installed. Councilman Norberg stated he would rather have the person get a permit for the fence before installing it. Councilman Heintz noted that the owner was just changing the height of an existing fence. Roll Call: All Ayes TRAFFIC COMMISSION RECOMMENDATIONS: 1. Stop Sign at Polk Place & Pierce Terrace Stu Anderson, Police Chief, stated that the Traffic Commission had a public hearing in response to a petition from residents near the intersection of Polk Place and Pierce Terrace requesting a stop sign at that intersection. The Traffic Commission is recommending a compromise of placing a stop sign on Pierce Terrace at the intersection of Buchanan Street, changing the yield sign on Polk Place to a stop sign, and to stop Pierce Terrace traffic coming down the hill in a northeasterly direction. Discussion followed on the placement of the signs. Motion by Hentges, seconded by Norberg, to concur with the Traffic £ommission to place stop signs on Pierce Terrace at the intersection of Polk Place, to remove the yield sign on Polk Place and replace it with a stop sign, place a stop sign on Buchanan to stop westbound traffic, and that two signs will be placed indicating a curve and recommending speeds of 20 miles per hour. Roll Call: All Ayes 2. Fairway and 49th Residents in the area have stated people are having difficulty identifying which street names go with which streets. The Traffic Commission recommends changing the location of the street name signs. No action needed from the Council. 3. Truck Traffic on 38th & 3rd Streets Several residents have complained about the truck traffic at 38th and 3rd. The Traffic Commission recommends that the staff place 15,000 gross weight limit signs in the area. September ll, 1978 Page 11 4. Alleyway between 51st and 53rd West of Central The Traffic Commission recommends a two-way alley, 24' wide be placed between 51st and 53rd on the west side of Central. 5. Intersection of 42nd and Central A brief discussion was held on the problem of entering Central from westbound 42nd because the traffic lane on Central is now next to the curb and a building obstructs the view of the traffic. The Mayor stated the State planned the urbanization and the City cannot change the width of the lanes. COMMUNICATIONS: 1. Letter from Richard Springer Councilman Norberg stated he believes that the City has taken the proper action in denying the request of Mr. Springer for reimbursement of charges incurred for thawing his frozen water line in February. Councilman Heintz stated the City's policy for many years has been that the pipe from the main to the house is the owner's responsibility. Motion by Norberg, seconded by Heintz, to direct the City Manager to write a letter to Mr. Springer stating that the Council has reaffirmed its policy. Roll Call: All Ayes 2. Memo from Metropolitan Council The memo was in regards to a public hearing on revisions to its Operating Procedures and Review Criteria Manual. This was for the Council's information. 3. September 25 Council Meeting Mayor Nawrocki noted that there are two Councilmembers who will not be able to attend the September 25 meeting. He asked if the Council wished to change the date of the meeting. The City Attorney stated the procedure would be to have someone appear on September 25 and state that the meeting cannot be called because a quorum is not present and declare the meeting will be held on October 2. OLD BUSINESS: 1. Para-Transit Program The City Manager stated that an application has been presented indicating the type of service recommended for the City. The recommended fare is 25¢ for children under 12 and for senior citizens and 75¢ for all other riders. The Council should consider whether these fares are appropriate. The hours of operation were recommended as 6:00 a.m. to 8:00 p.m. Monday through Friday and 8:00 a.m. to 6:00 p.m. on Saturday and Sunday. The total budget is estimated to be $150,000. Projected revenue is $25,000. The net amount that the City would provide would be $12,496. September ]1, 1978 Page ] 2 Councilman Norberg asked how much latitude the Council would have to change the program from the one being presented. He also asked whether the City can enter into a joint agreement with Frid]ey ~f Frid]ey approves a program. The Mayor stated that it will take a minimum of six to seven weeks to get approval from Mn/DOT and Metropolitan Council for the program, if all things go we]]. Discussion followed on who would administer the program and the City's share of this cost. RESOLUTION 78-39 AUTHORIZING THE CITY MANAGER TO SUBMIT APPLICATION FOR GRANT PROPOSAL FOR PARA TRANSIT FACILITIES IN THE CITY OF COLUMBIA HEIGHTS NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS, MINNESOTA, THAT: Authorization is hereby given to the City Manager of the City of Columbia Heights, Minnesota to submit application to the Minnesota Department of Transportation for grant proposal for para-transit facilities in the City of Columbia Heights. BE IT FURTHER RESOLVED THAT: The City of Columbia Heights pay ]0~ of the net cost of said program not to exceed SlS,OOO. Passed this llth day of September, 1978. Holding of Public Meetings on Election Days Nemo from Charles Lefebvre, Anoka County Auditor, setting guidelines for holding meetings on election day. This was for the Council's information. 5. Brooklyn Center Housing Awareness Seminar Further information was received from Brooklyn Center on the housing awareness seminar scheduled for Saturday, September 16. This was for the Council's information. OLD BUSINESS: 2. Waiving of License Fees This item was informational. The Park Board will consider it further at their meeting on September 20. September ll, 1978 Page 13 3. Policy on Damage to Private Property The City Manager stated he had asked the City Attorney to prepare an appropriate motion for the Council's consideration. The City Attorney's memo was distributed to the Council. Mayor Nawrocki stated he doesnlt understand what the motion would change. Discussion followed on the Council's previous action on this matter and the Attorneyls current proposal. Motion by Heintz, seconded by Norberg, that all claims against the City as a result of damage to private property resulting from water main breaks, sanitary sewer backups and/or storm drain ruptures be reviewed on an individual basis. The appropriate action on such claims shall be based upon the merits of each claim. Roll Call: All Ayes 4. Report on Liquor Operations The City Manager stated his report was sent to the Council in their packet. He added a complete report will be made to the Council in October based on information gathered in September. 5. Hearings on Storm Drain Problem Areas The City Manager stated that a public hearing can be called on any of the five areas specified in his report. Additional information will be furnished to the Council before the hearing. Councilman Norberg stated that he doesn't believe a hearing should be held on the trapped water at the rear of properties facing 39th Avenue between Hayes and Arthur, back lot drainage north of 37th Avenue between Buchanan and Lincoln Streets, or drainage in alleyway south of 39th Avenue between Quincy and Jackson. Councilman Heintz stated he feels the back lot drainage north of 37th Avenue between Buchanan and Lincoln Street should be included at a hearing. Mayor Nawrocki stated that opposition to some of this work will be strong and the Council should expect it. Motion by Heintz, seconded by Logacz, to call for a public hearing for street flooding at 40th and McKinley, storm drainage on 2nd St., and back lot drainage north of 37th Avenue between Buchanan and Lincoln St. for Monday, October 16 at 7:00 p.m. to authorize the City Manager to advertise for the hearing. Roll Call: Logacz, Heintz, Norberg, Nawrocki - Aye Hentges - Nay 6. Sullivan Lake Property Proposal Letter from Counselor Realty regarding their interest in the Sullivan Lake property. This was for the Council's information. 7. Prestemon Park Building The Park Board is recommending the bid go to Leverette Weekes if the Council will make up the difference in the fund of $29,300. The City Manager recommends that the Council reject the bids and rebid the building in January. The bids received are 30% over the estimate. He does not feel this is reasonable. September ll, 1978 Page 14 Motion by Norberg, seconded by Hentges, to reject all bids and direct the City staff to rebid the project in the early part of 1979. Mayor Nawrocki asked why the City Manager thought better bids could be obtained next year. He stated he doesn't think the City will get a better bid in the rebidding process. Lighting of Basketball Courts at Prestemon Park Motion by Heintz, seconded by Logacz, to award the bid for lighting the basketball court at Prestemon Park to Heights Electric Company based on low, responsible bid in an amount of S9,200 and Mayor and City Manager be authorized to enter into contract for same. Dual Purpose Courts Resurfacing The City Manager received a letter from the City of North Mankato stating their repeated unsuccessful attempts at resurfacing a dual purpose court. This was for the Councills information. A letter from the City Attorney recommended paying the bill to NDH for surfacing of the courts. Motion by Hentges, seconded by Logacz, to concur with the City Attorney's recommendation to pay the money held in excrow to NDH for the balance of the work on the tennis court project. September 11, 1978 Page 15 Councilman Norberg asked if every bit of work was done to the City's satisfaction. He suggested that no money be paid until all the work is done. Discussion followed on how much is owed to NDH. Maker and seconder of the motion changed the motion to "to pay the contractor the money owed him except 10% plus $500 for work to be completed."
