HomeMy WebLinkAboutOct 10, 1978OFFICIAL PROCEEDINGS REGULAR MEETING OF THE CITY COUNCIL CITY OF COLUMBIA HEIGHTS, MINNESOTA OCTOBER 10, 1978 The meeting was called to order at 8:08 p.m. Roll Call: Logacz, Heintz, Norberg, Hentges, Nawrocki - present INVOCATION The invocation was given by Councilman Norberg. MINUTES OF PREVIOUS MEETINGS Motion by Hentges, seconded by Logacz, to approve the minutes of the September 25 and October 2 meetings as presented in writing and the reading be dispensed with. Roll Call: All Ayes ORAL PETITIONS Mr. Doug Jones of the St. Anthony Jaycees was present regarding their joint proposal with the League of Minnesota Cities to reduce the speed limit from 30 MPH to 25 MPH in all urban districts. He asked the Council to consider a resolution in support of the proposal. RESOLUTIONS: 1. Resolution Certifying Delinquent Utility Charges Mayor Nawrocki asked whether the people who have delinquent bills were notified of the meeting. The City Manager stated that everyone on the list was sent a postcard with the date and time of the meeting. RESOLUTION 78-44 CERTIFICATION OF DELINQUENT UTILITY CHARGES BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS, That: WHEREAS, all utility users have been sent a pink card reminder that their bill was delinquent, and WHEREAS, all said users were further notified by letter from the Utility Department that all unpaid delinquent utility bills as of August 30, 1978 would be certified to the County Auditor to be included on 1979 tax statements. BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that the County Auditor be, and he is hereby, directed to levy the delinquent utility charges on the properties in the City of Columbia Heights as submitted on the attached sheets, totalling $6,675.90, pursuant to Minnesota State Statute 444.075 Subd. 3. BE IT FURTHER RESOLVED that the foregoing amounts shall be included in the individual real estate tax statements and identified thereon as I'Delinquent Utility Charges." October 1 O, 1978 Page 2 SAID LEVIES shall be enforced and collected in the manner provided for the enforcement and collection of state and county taxes under and in accordance with the provisions of the general laws of the state. All assessments with penalties and interest as indicated thereon paid to the County Treasurer shall belong to the City of Columbia Heights and shall be turned over to the City Treasurer in the manner provided by the City Charter and Ordinances. Resolution Certifying Delinquent Special Assessments RESOLUTION 78-45 CERTIFICATION OF DELINQUENT SPECIAL ASSESSMENTS BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS, that THE County Auditor be, and he is hereby directed, to levy the delinquent special assessments on the properties in the City of Columbia Heights as submitted on the attached sheets and filed in the Assessment Book for i978, totaling $4],]79.59. BE IT FURTHER RESOLVED that the foregoing amounts shall be included in the individual real estate tax statements for the current year and identified thereon as ~Specia] Assessments~' SAID LEVIES shall be enforced and collected in the manner provided for the enforcemen and collection of State and County taxes under and in accordance with the provisions of the genera] laws of the State. All assessments with penalties shall belong to the City of Columbia Heights and shall be turned over to the City Treasurer' in the manner provided by the City Charter and Ordinances. THE CITY OF COLUMBIA HEIGHTS shall accept payments on these levies until November 15, 1978. Upon receipt of said payments the County will be notified to remove this levy from the tax rolls. Resolution regarding Partial Cancelling of an Assessment Levied in Error RESOLUTION 78-46 PARTIAL CANCELLING OF AN ASSESSMENT LEVIED IN ERROR WHEREAS, the property known and described as the south half of lot ll and all of lot 12, block 19, Columbia Heights annex, Plat 33365, Parcel 934, was assessed $30].25 for Hazardous Sidewalk Replacement, and, October 10, 1978 Page 3 WHEREAS, 4412 5th Street should have been assessed for 96 square feet, but was mistakenly assessed for 163 square feet, BE IT THEREFORE RESOLVED, by the City Council of the City of Columbia Heights, that the City Clerk be and is hereby authorized and directed to reduce the Hazardous Sidewalk Replacement assessment charged against the south half of lot 11 and all of lot 12, block 19, Columbia Heights annex, Plat 33365, Parcel 934, in the amount of $123.85, and that this amount be reimbursed to the owner, Mr. J. Resolution Confirming the Tax Levy by the HRA for 1979 RESOLUTION 78-47 CONFIRMING TAX LEVY BY THE HOUSING AND REDEVELOPMEHT AUTHORITY FOR 1979 BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS, that WHEREAS, the Housing and Redevelopment Authority of Columbia Heights, Minnesota has adopted a budget as shown on their attached resolution, and WHEREAS, said Authority has also resolved that a special tax to be levied of $24,200 upon all taxable property, both real and personal, in the City of Columbia Heights, and WHEREAS, Section 462.545, Subdivision 6, of the Minnesota Statutes requires approval by the governing body of the municipality in and for which said Authority was created. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Columbia Heights approves and consents to the levy of $24,200 upon all taxable property, both real and personal, in the City of Columbia Heights, by said Authority, as special taxing district, for use for the purpose of the redevelopment provisions of Section 462.711 of the Minnesota Statutes. Offered by: Logacz Seconded by: Hentges Councilman Norberg stated he had asked for a copy of the HRA budget supporting this levy several times but had not received it. He added that he thought it was a very loose way to operate and was not happy at being asked to authorize a budget he had not seen. Roll Call: Logacz, Heintz, Hentges, Nawrocki - Aye Norberg - Nay October 10, 1978 Page 4 PLANNING AND ZONING COMMISSION RECOMMENDATIONS: 1. David Everett, 3830 Buchanan Street Request for Subdivision Motion by Heintz, seconded by Hentges, that the subdivision be granted at 3830 Buchanan Street on the recommendation of the Planning and Zoning Commission. Mr. Fisher, 3836 Buchanan Street who is interested in purchasing this section of property from Mr. Everett, stated that his attorney will draw up a deed to put the triangle of property on the same tax base as the rest of his property. Millie Carlson, City Assessor, stated that when Mr. Fisher records his deed he can request the County Auditor to attach this property to his existing property as one parcel. Councilman Norberg suggested the following be added to the motion: "make this split conditional upon the joining of the two properties for tax purposes.'~ The maker and seconder of the motion accepted this addition. The new motion reads as follows: Motion by Heintz, seconded by Hentges, that the subdivision be granted at 3830 Buchanan Street on the recommendation of the Planning and Zoning Commission and that this split be conditioned upon the joining of the two properties for tax purposes. James Novotny, 4102 6th St. Appeal from Denial Motion by Heintz, seconded by Logacz, to grant the variance of 8~ to allow a garage to be placed within ]5' of the alley at 4102 6th St. Councilman Norberg asked how the Council could do this as the Planning and Zoning Commission found no hardship involved and denied the request. Councilman Heintz stated that the property across the alley was allowed a variance of this same type last year and did not understand how the Council could deny this request. Councilman Logacz stated that the Council shouldn't kick this around when the man simply wants to improve his property. Roll Call: Logacz, Heintz, Hentges, Nawrocki Norberg Nay Aye 3. Douglas Jones, 4615 Tyler St. Request for Variance A1 Carlson, Assistant Planner, stated that Mr. Jones wants to add an efficiency apart- ment to his four-plex at 4615 Tyler. To do this four variances are required: 1) lot size variance of 2,320 sq. ft.; 2) two foot side yard variance on setback on the south side; 3) five foot side yard variance on both side yards; and 4) ten foot variance on lot width requirement. Councilman Hentges asked about the number of parking spaces required by ordinance. Mr. Jones stated that ]0 parking spaces will be provided, five in garages and five behind the garages as required. Councilman Heintz stated that the Building Inspector had inspected the building the past week and there were several items not in accordance with existing ordinances. Mr. Jones stated he will take care of all the October 10, 1978 Page 5 required changes in the building. Councilman Heintz stated that before any permits are allowed the Inspection Department should go through the building and make sure all the required changes are made. Motion by Norberg, seconded by Hentges, to refer this matter to the Planning and Zoning Commission for their formal action on the new plan and a review of the questions raised by the Building Inspector. Councilman Logacz stated that he believed these conditions can be attached to the motion and approved tonight. Councilman Hentges stated that there is no hardship involved with the request. Councilman Heintz stated that the Planning and Zoning Commission did have this plan before them at their meeting, it is not a new plan. Mayor Nawrocki stated he would be reluctant to vote for the additional unit because there is congestion in that area already and sending the request back to the Planning and Zoning would be an unnecessary delay. He added he believes a decision should be made tonight. He asked what the reason is for having five units in the building. Mr. Jones answered that there is an area in the building that is already heated and insulated which will be used for the apartment. He will use the rent money from the apartment to improve the rest of the building. Councilman Hentges stated that every four-plex in that area will want to put in a fifth apartment and this will be setting a precedent. Councilman Norberg stated he would withdraw his motion and substitute a motion to deny the request. Mayor Nawrocki stated that the motion before the Council is that the Council refer the matter back to the Planning and Zoning Commission. Roll Call: Norberg, Hentges - Aye Logacz, Heintz, Nawrocki - Nay Motion fails. Motion by Norberg, seconded by Hentges, to deny the request for variances. Roll Call: Norberg, Hentges, Nawrocki - Aye Logacz, Heintz - Nay Request is denied. 4. Paul Bona, 612 40th Ave. Request for Variance A1 Carlson stated that Mr. Bona is requesting a variance to construct a 12' by 26' addition to the rear of his house. The house is in a limited business district and non-conforming. The Planning and Zoning Commission recommends the variance be granted because it will increase the livability of the house. Councilman Norberg asked whether the property can be rezoned back to residential so Mr. Bona could build a new house which was his original request. The City Attorney responded that this would take time and is difficult to do for one lot. Discussion followed on the basement height at present and what would be required of the addition. Motion by Heintz, seconded by Hentges, to grant the variances to allow the construction of a 12' by 26' addition to the rear of the property at 612 40th Avenue to improve the livability of the house. Letter from Barb Hughes Metro Clean Air Committee The Council received copies of a letter from Ms. Hughes who is scheduled to speak at the next regular meeting (October 23) regarding deve]opments under the new Clean Air Act which pertain to Columbia Heights. 2. Letter from Arthur Roemer Commissioner of Revenue The Council received copies of a letter from Mr. Roemer describing an upcoming meeting for assessors and mayors to review tax procedures. Letter of Resignation Mary Wolverton Motion by Heintz, seconded by Hentges, to accept the resignation of Nary Wolverton from the Human Services Commission. Roll Call: All Ayes OLD BUSII~ESS: 1. Insurance Settlement on Water Damage to City Hall The City Manager reported that at the last meeting the Council referred this to the City Attorney for comments. The City Attorney responded that this is in line with the value of the damage. Motion by Hentges, seconded by Norberg, that the proposed settlement for water damages to City Hall in the amount of $4,4~] be accepted based on the recommendation of the City Attorney and staff. Councilman Norberg asked whether there were any grounds under which the City could make a claim against any other insurance company. The City Attorney answered that he had not looked into this yet but he would. Roll Call: All Ayes 2. Other' Old Business Response to Complaints - Counci]man Hentges stated that several people have told him they had called City Hall with questions or requests and hadn't received replies. The City Manager stated that if a person asks for a response, the staff does ca]] back. Not everyone asks to be called back. Councilman Norberg stated that people are expecting to get an answer to their questions. He feels this is very important in governmental situations. The City Manager asked for a motion setting policy. The Nayor stated he didn't think this had to be put into writing. Councilman l.ogacz suggested that people calling should be asked if they want a written or verbal response to their questions. October lO, 1978 Page 7 Turning Lane at 53rd & Central - Councilman Norberg questioned the situation with the right turn lane from Central east on 53rd. The State had agreed that signs and striping would be installed. He noted that this section of the urbanization project is almost done and nothing has been done about the signs. Earl Gustafson, Public Works Director, stated the signs do exist but the man running the job didn't put them up. Mr. Robinson of the Highway Department stated the signs will be put in soon. Signals at 40th & Central - Councilman Logacz asked when the new signals would be installed at 40th & Central. Tim Yantos, Administrative Assistant, stated that the signals at this intersection will be installed in the next few weeks. Tax Forfeit Property at 5020 7th St. - This item was tabled at the last meeting. The Mayor asked the justification for the price the appraisers came up with. The City Manager answered that the total value of the two strips of land was $3,000 based on the market value of lots in the residential area. There are three potential buyers. The City Manager stated he had sent letters to owners on either side of the property asking if they were interested in buying the property. The Mayor stated that he followed up the matter with the neighbors and they do not want to buy the property, only Mr. Brunkow at 5020 7th St. is interested. Discussion followed on the value of the property. Councilman Norberg suggested that the Council make it a requirement of the sale that the property be incorporated into the existing piece of property. Motion by Heintz, seconded by Hentges, to sell the land to Mr. Brunkow of 5020 7th St. for $582 which is the amount of outstanding taxes and past due special assessments with the condition that the two strips be legally incorporated into their existing lot. Councilman Logacz stated that since the City has already spent some money on the appraisal, and staff time, the City would be losing money if they sold the land for $582. The City should recover the minimal cost. Motion by Logacz to amend the motion to read $1,000 instead of $582 as the selling price. Motion dies for lack of a second. Councilman Norberg suggested that a desirable alternative would be to defer the matter and request the City Manager to continue his negotiations and he may be able to achieve a better price. Councilman Hentges stated he feels a fair price would be the taxes, assessments, and cost of the appraisal. Councilman Heintz suggested that the matter be deferred until later in the meeting and asked the City Attorney to draft an ordinance for a first reading at that time. The ~avor stated that the motion authorizing the sale answers the question of whether the Council wants to make the sale, establishes a selling price, and gives the staff the authority it needs to draft the required ordinance. He added he believes this should be handled expeditiously. Roll Call: Logacz, Heintz, Nawrocki - Aye Norberg, Hentges - Nay October 10, 1978 Page 8 RECESS at 10:03 p.m. RECONVENE at ]0:20 p.m. Motion by Logacz, seconded by Norber9, to reconsider the last motion on the sale of the property at 5020 7th St. Councilman Logacz stated he had misunderstood the motion made and ~assed before the recess, Roll Call: Logacz, Norberg, Hentges Heintz, Nawrocki Nay Aye Motion by Logacz, seconded by Hentges, that the sa]e of the property should be contingent on the recovery of all costs. Roll Call: Logacz, Norberg, Hentges - Aye Heintz, Nawrocki - Nay NEW BUSINESS: 1. Cable Television The City Manager reported that he had submitted a memo to the Council with a number of enclosures and attachments outlining the procedures involved with establishing cable TV. He had also talked with a representative of General TV who was present to discuss the proposal. The City Manager stated he would like to have a presentation from the Cable Communications Commission on October 23 and on November 13 have an ordinance ready for the Council's consideration regarding the cable TV franchise. He summarized the material he had forwarded to the Council. Mr. Girard, representative from General TV, gave a presentation on cable TV. Discussion followed on the proposal, acceptance of cable TV in Fridley, and the timin9 of the installation. Motion by Norberg, seconded by Hentges, to direct the City Manager and City Attorney to prepare a cable communication franchise ordinance for presentation to the Council at the first meeting of November and schedule a presentation from the Cable Communications Board at the October 23 meeting. Discussion followed on the fact that this may be moving too fast. The City Attorney stated he: couldn't have an ordinance ready by the first meeting in November. Councilmen Norberg and Hentges withdrew their motion and offered the following substitute: Hotion by Norberg, seconded by Hentges that the State Cable Communication Commission make a presentation at the Council meeting of November 27. Roll Call: All Ayes ORDINANCE PERTAINING TO REGULATION OF RESIDENTIAL STRUCTURES IN COMMERCIAL ZONE The Mayor noted that at the last meeting there was a lengthy discussion on this matter. He asked the attorney to take the ordinance previously recommended by the Planning and Zoning Commission and to modify it to strengthen some controls and October 10, 1978 Page 9 rewrite it so that the final authority will not rest with the Planning and Zoning but with the Council. A redraft of the ordinance has been presented to the Council. The City Attorney stated that the ordinance combines some of the items Councilman Norberg was interested in as well. VOLUNTEER FIREFIGHTER RELIEF ASSOCIATION REGARDIIIG RALPH VOLKMAN Because several of the volunteer firefighters were present, the Mayor asked that this item from the agenda be discussed at this time. The City Manager asked the Council to hold off any action until the next meeting to allow the City Attorney to meet with representatives of the Volunteer Relief Association to review the claim which was submitted by Mr. Volkman for an injury to him in January. It would also give the ~Jolunteer Relief Association a chance to review their claim. He doesn't feel he is prepared at this point to bring the matter before the Council. Motion by Hentges, seconded by Norberg, to direct the City Manager and City Attorney to meet with the Volunteer Relief Association and review and discuss the matter with their representatives and report back to the next regular meeting. Discussion followed on the nature of the claim. Roll Call: All Ayes ORDINANCE ON RESIDENTIAL STRUCTURES (Cont.) The Council returned to the discussion on the proposed ordinance on regulation of residential structures in commercial zone. Councilman Norberg stated that the one thing this ordinance didn't seem to do is take into consideration the use of the adjoining property, if it would be a park or a street. He would like this addressed. Motion by Heintz, seconded by Logacz, to refer this proposed ordinance back to the Planning and Zoning Commission for their consideration and recommendation. Councilman Norberg asked that the Planning and Zoning Commission be directed to make a recommendation on what to do about the adjoining property. Roll Call: All Ayes ORDINANCE ON FLOOD PLAIN MANAGEMENT The City Attorney stated that this ordinance changed the regulatory flood protection elevation to one foot above the elevation of the regional flood from the six inche levei approved in the ordinance adopted July 24, 1978 to be in line with federal regulations. The City Attorney stated that the City Manager had received a letter from the federal government stating that the previous ordinance, which they had accepted, was now unapproved by them because of the improper six inch elevation. Motion by Hentges, seconded by Logacz, to waive the reading as sufficient copies were available to the public and the ordinance be considered as read. ORDINANCE NO. 894 BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977, PASSED JUNE 21, 1977, PERTAINING TO FLOOD PLAIN MANAGEMENT October 10, 1978 Page 10 The City Council of the City of Columbia Heights does ordain: Section ]: Section 9.302(3) of Ordinance No. 853, City Code of 1977, passed June 21, 1977, which reads as follows: "9.302(3) Regulatory Flood Protection Elevation The Regulatory Flood Protection Elevation shall be an elevation no lower than one-half foot above the elevation of the regional flood plus any increases in flood elevation caused by encroachments on the flood plain. (a) The regulatory flood protection elevation within the Floodway and Flood Fringe Districts shall be established by adding one-half foot to the Base Flood Water Surface Elevations with Floodway listed in the Floodway Data Table contained in the Flood Insurance Study. Regulatory flood protection elevations between cross-sections shall be interpolated. (b) The regulatory flood protection elevation within the General Flood Plain District shall be calculated by a qualified registered pro- fessiona] engineer in accordance with procedures in 9.3]](4)(f)." shall hereafter be amended to read as follows: "9.302(3) Regulatory Flood Protection Elevation - The Regulatory Flood Protection Elevation shall be an elevation no lower than one foot above the elevation of the regional flood ptus any increases in flood elevation caused by encroachments on the flood plain. Roll Call: Logacz, Norberg, Hentges, Nawrocki - Aye Heintz - Nay NEW BUSINESS: 2. 1979 Joint Police Negotiations Motion by Norberg, seconded by Logacz, to authorize the City Manager to enter into an agreement for representation in joint police negotiations for the contract year beginning 1979 with Teamsters Local 320. Discussion followed on the negotiations, who they would be with, and what they included. Roll Call: All Ayes 3. Informal Quotations on AC/DC Welder Motion by Hentges, seconded by Norberg, to authorize the expenditure of up to $1,525.00 for the purchase of an AC/DC welder from the H. R. Toll Company on the basis of low, informal bid received. Roll Call: All Ayes 4. Informal Quotations on Overlay Motion by Norberg, seconded by Heintz, to authorize the expenditure of up to $4,765.00 for overlay at Prestemon and Southwest Park Basketball Courts and the north end of the Ostrander Park Hockey Rink and award the bid to Bituminous Roadways Inc. based on low informal quotation and that the Mayor and City Manager be authorized to enter into contract with same. Roll Call: All Ayes 5. Wage Adjustments Four employees' wage adjustments were submitted. Discussion followed on several of the recommended adjustments. Motion by Norberg, seconded by Hentges, that the City Manager be directed to suspend any action on the four proposed merit increases until the next regular Council meeting. Roll Call: Logacz, Norberg, Hentges - Aye Heintz, Nawrocki - Nay 6. Award of Bids for Police Department Motion by Norberg, seconded by Heintz, to award the bid for lockers and benches to Hauenstein and Burmeister in the amount of $1,591.00 (including installation), based on low informal quotation received and Mayor and City Manager be authorized to enter into contract for same. Roll Call: All Ayes October 10, 1978 Page 12 Motion by Norberg, seconded by Heintz, to award the bid for wardrobes to General Office Products in the amount of $484.00 based on low informal quotation received and Mayor and City Manager be authorized to enter into contract for same. Roll Call: All Ayes 7. Other New Business: Liquor Store Wine Coolers - The City Manager indicated that the vendor of the wine coolers will pay for 50% of the shipping charges but the City's cost will be more than the amount the Council authorized previously for the coolers. Motion by Logacz, seconded by Hentges, that one half the freight cost on the wine coolers be authorized. Roll Call: Logacz, Norberg, Hentges, Nawrocki - Aye Heintz Abstains Mayor Nawrocki noted that it was now 12:00. Motion by Hentges, seconded by Norberg, to continue until 12:15. Roll Call: Logacz, Norberg, Hentges, Nawrocki - Aye Heintz - Nay LICENSES Motion by Hentges, seconded by Norberg, that all licenses as listed be granted upon payment of the proper fees. Roll Call: All Ayes PAYMENT OF BILLS Motion by Hentges, seconded by Logacz, that bills as listed be paid out of their proper funds. The City Manager stated he had a resolution prepared that would alleviate the problem of recurring bills being withheld by Councilman Norberg to be approved by separate resolution at every meeting. This resolution deals with the contracts with these specific companies. Councilman Norberg asked that it be noted that bill #26971 to Acro doesn't need to be let for informal bids although over $500, because Acro is the County buyer. He noted the travel vouchers were authorized at ]5¢ per mile and asked that this authorization be verified. Motion by Norberg, seconded by Logacz, to amend to extract bills #27054 and #27058 from the list. Roll Cai]: Logacz, Norberg - Aye Heintz, Hentges, Nawrocki - ~ay October 10, 1978 Page l 3 Mayor Nawrocki stated he will not vote for any more resolutions that put on the Council the responsibility of determining that the price paid was the lowest obtainable.
