Resolution Adjusting 1978 Budget to Projected Annual as Recorded in the 1979 Budget Document Motion by Hentges, seconded by Heintz, to adopt the resolution. Councilmen Hentges and Heintz withdrew their motion. Motion by Heintz, seconded by Norberg, to waive the reading as sufficient copies were available to the public. Roll Call: All Ayes RESOLUTION 78-70 ADJUST 1978 BUDGET TO PROJECTED ANNUAL AS RECORDED IN 1979 BUDGET DOCUMENT WHEREAS, the City Council of the City of Columbia Heights has reviewed projected annual 1978 expenses in conjunction with the 1979 budget, and WHEREAS, the City Treasurer has reviewed each General Fund object classification after passing of the bills approved by Council on December 11, 1978, and allowing for year-end accruals, and WHEREAS, several departments in total will approximate their approved 1978 Budget NOW THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that the following departmental budgets be increased or (decreased) with a balance to the General Fund Contingency: Mayor-Council $ 2,500 Finance-Clerk 2,500 Assessing 3,400 Elections 300 Legal (20,000) Planning (10,4OO) General Government Buildings ( 3,1OO) Police (13,200) Fire ( 7,500) Inspections 7,500 Animal Control ( 1,2OO) Engineering 12,3OO Streets (19,5OO) Street Lighting ( 4,000) December 27, ] 978 Page 2 Traffic Signs Tree Trim & Dutch Refuse Collection Parks Insurance 7,4oo) 58,235) 38,000) 9,800 13,ooo) Increase Contingency $ 157,235 AND, the City's ]978 share for Funding the Recreation Fund be transferred from the General Fund 205 in the amount of $67,850. Resolution Designating Depositories for Funds of the City of Columbia Heights Motion by Norberg, seconded by Heintz, that reading be waived as sufficient copies were available for the public. Roll Call: All Ayes RESOLUTION 78-71 DESIGNATING DEPOSITORIES FOR FUNDS OF THE CITY OF COLUMBIA HEIGHTS FOR THE YEAR 1979 The City, Council of the City of Columbia Heights, HEREBY RESOLVES, that the Marquette State Bank of Columbia Heights, the Fidelity Bank and Trust Co., the Third Northwestern National Bank, and the Northeast State Bank be hereby designated as the depositories for moneys of the City of Columbia Heights for a period of one year beginning the first day of January, 1979, and the Treasu, er of this City is hereby directed to deposit moneys of this City in said Banks, and the Marquette State Bank of Columbia Heights, the Fidelity Bank and Trust Co., the Third Northwestel'n National Bank, and the Northeast State Bank are hereby author,zed and directed to honor and pay any checks or orders, when signed by the City Treasurer for the withdrawal or transfer of funds o~ c:eposit in said banks in whatever form. BE IT FURTHER RESOLVED, that in case such deposit shall at any time exceed the sum for which its deposits are insured under the acts of Congress of the United States relating to insurance of bank deposits, said depository shall immediately furnish bonder securities in lieu of bond according to the ]aw, and the Marquette National Bank for the Marquette State Bank of Columbia Heights, the Federal Reserve Bank for Fidelity State Bank, the Third Northwestern National Bank, and Northwestern National Bank for the Northeast State Bank are hereby designated as the places for the safe- keeping of all securities furnished in lieu of such bond. Resolution Regarding Technical and Engineering Assistance Agreements Resolution Regarding Mn/DOT Agency Agreements The City Manager stated that these resolutions take the form of agreements with the State for technical and engineering services. Motion by Hentges, seconded by Norberg, to table these resolutions until the next regular meeting. George Brown, City Engineer, described several circumstances where the agreement would be of help to the City. Roll Call: Hentges - Aye Heintz, Norberg, Nawrocki Nay Motion fails. RESOLUTION 78-72 BE IT RESOLVED, that pursuant to Section 161.39, Subdivision 1 through 6, Minnesota Statutes, 1978, the Columbia Heights Municipal Engineer for and on behalf of the Municipality of Columbia Heights is hereby authorized to request and obtain from the Minnesota Department of Transportation, needed engineering and technical services for which payment will be made by the Municipality upon receipt of verified claims from the Commissioner of Transportation. This authority is to remain effective until rescinded by either party. Passed this 27th day of December, 1978. Offered by: Norberg Seconded by: Hentges Roll Call: All Ayes RESOLUTION 78-73 BE IT RESOLVED that pursuant to Section 161.36, Subdivision 1 through 6, Minnesota Statutes, 1978, the Commissioner of Transportation be appointed as agent of the City of Columbia Heights to let as its agent, contracts for the construction of portions of Municipal Streets, and the Mayor and City Manager are hereby authorized and directed for and on behalf of the City Council to execute and enter into a contract with the Commissioner of Transportation prescribing the terms and conditions of such contracts in the form as set forth and contained in "Minnesota Department of Transportation Agency Agreement Form No. 30774" a copy of which said form was before the Council, assuming on behalf of the City all of the obligations therein contained. Setting Salary of the Recreation Director RESOLUTION 78-74 BEING A RESOLUTION SETTING THE SALARY OF THE RECREATION DIRECTOR BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS that the salary of the Recreation Director shall be increased by two percent effective on the nearest annua] anniversary date of the Recreation Director. This Resolution shall be in full force in effect upon such date as is provided in the agreement between the City of Columbia Heights and Independent School District No. 13. Offered by: Heintz Seconded by: Hentges Councilman Hentges asked why the Council didn't get a copy of the employee's evaluation and stated he felt the increases in salary over the past few years amounted to too much. Thc City Manager read a motion by the Recreation Commission recommending the pay increase. Roll Call: All Ayes ORDINANCES: The City Manager distributed copies of proposed ordinances pertaining to the honor system food sales and food vending machines. These will be considered for a first reading at the next regular meeting. PLANNING AND ZONING RECOMMENDATIONS: 1. Mr. Miskowiec, 4055 Monroe St. N.E. Request for Variance Motion by Heintz, seconded by Hentges, that variances be granted upon recommendation of the Planning and Zonin9 Commission because of the topographical hardship. Roll Call: Ail Ayes LETTER FROM SUN NEWSPAPER The City Manager asked that this item regarding the designation of an official City newspaper be held until the next meeting. The City Attorney recommended rebidding again this year or getting letters from other papers stating that they are not interested in being the City's official newspaper. Motion by Norberg, seconded by Heintz, that the City Manager be authorized to call for bids for an official newspaper, bids to be opened on January ]9 at 2:00 p.m. Roll Call: All Ayes LETTER FROM EDA A letter was received from the U.S. Department of Commerce, Economic Development Administration, informing the City that funds will not be a]]ocated to Columbia Heights for construction of a parkin9 ramp facility in the downtown development area Mayor Nawrocki stated he will have a meetin9 next week with Congressman Sabo to present the situation to him. He will also continue to follow up with local and state people. December 27, 1978 Page 5 OLD BUSINESS: 1. Authorization to Fill Positions Included in 1979 Budget Discussion was held on the part time janitor's position in the Park Department. Motion by Heintz, seconded by Hentges, to authorize the City Manager to fill those positions budgeted for in 1979, these positions to be filled upon termination of currently employed CETA people, or upon termination of the CETA program. Discussion continued on how positions could be split between departments, whether employees could be retained after the CETA program runs out, and whether the employees should be part time or full time. Councilman Norberg suggested deleting the two recreation employees from the request and voting on them separately because the City doesn't hire them. The City Attorney stated that the City does have the authority to hire for the positions with the Recreation Department and these positions should remain in the motion. Roll Call: All Ayes Councilman Hentges asked the City Manager to inform the department heads as to which people will be kept after the CETA program runs out. Further discussion on several of the CETA positions. Councilman Hentges asked the Council if they would like to look into hiring more full time personnel where needed and would the Council consider transferring funds to keep some full time employees. 2. City Hall Addition, Renovation, and Remodeling Payment of Leverette Weekes - The City Manager asked that a payment of $26,300.50 be authorized reflecting a reduction of the retainer from 10% to 5%. Motion by Heintz, seconded by Norberg, to authorize the release of up to 1/2 the retainer on the Leverette Weekes contract. Roll Call: Heintz, Norberg, Nawrocki - Aye Hentges - Abstain Holes in Police Garage Roof - Discussion on what material would be used to fill in the hole. Change Orders - One was previously acted upon, the other three are within the amounts the City Manager can approve, the last one (change order #10) is for items which are requested for the Fire Department berthing area. Councilman Heintz noted that some of these things were originally deleted from the contract to keep the cost down and now the City will pay a premium to get them put into the building. Motion by Heintz, seconded by Hentges, to authorize change orders 6 through 10. Roll Call: All Ayes RECESS at 9:25 p.m. RECONVENE at 9:35 p.m. December 27, 1978 Page 6 NEW BUSINESS: ]. Northeast Senior's Building The City Manager stated that the City has been holding a check from Va1Michelson, building contractor, as a bond on work that had not been completed. The work has now been completed and they are asking to have $1500 paid to them. Motion by Hentges, seconded by Norberg, to concur with the City Manager's recommendation to reduce the bond withheld from $2,000 to S500. Roll Call: All Ayes 2. Street Names for Cheery Heights The City Manager noted that these streets have been named. Councilman Norberg stated his point is that if the Council would want to do anythin9 about the names, now is the time to do it. He thought it would be a nice way to recognize an historical name or event in Columbia Heights. No action was taken. Minor Repairs to Tema House The City Manager stated that this was brought to his attention by Malcolm Watson who requested that some minor repairs be done to the Tema house, which is being used by SACA~ to include painting, repairing windows, and possibly insulation. Council- man Norberg stated that he is not interested in seeing the house established as a permanent facility for anything and is not for anything that would promote this. He thinks, however, that if the City is paying the gas bill, the house should be insulated. The cost of this insulation could be saved over the next few years in heating bills. Motion by Norberg, seconded by Hentges, that the City be authorized to spend up to $500 to do the necessary improvements as described. Motion by Heintz, seconded by Nawrocki, to change the dollar amount to S750. Roll Cai] on motion to amend: Heintz, Hentges, Nawrocki - Aye Norberg - Nay Roll Call on amended motion: All Ayes Award of Bid on Custodial Services Contract The City Manager stated there were three bidders on the custodial contract to include the City Hall, Library, and Public Works building. Rodrigue Maintenance was the ]ow bidder and he recommends awarding the bid to them. Motion by Hentges, seconded by Heintz, that the bid for custodial services be awarded to Rodrigue Maintenance in the amount of $900 per month based on the iow competitive bid and the Mayor and City Manager be authorized to enter into contract for same. December 27, 1978 Page 7 Discussion followed on how to determine an amount to be withheld for work that doesn't get done and on cleaning work that hasn't been done by Rodrigue under their present contract. Roll Call: All Ayes 5. Establishing Work Sessions The City Manager is asking that work sessions be established to cover several items including the employee performance evaluation program, wage compensation program, personnel policy manual, and the performance evaluation of the City Manager. Meetings were set up for Wednesday, January 3 at 7:30 p.m.; Monday, January 15 at 7:00 p.m.; and Tuesday, January 16 at 7:00 p.m. 6. Wage Adjustments Mayor Nawrocki stated he has done a review of the Council Secretary's job performance, however, he discovered that he had not set a range as yet, which was indicated would be done at this time. He recommended at this time that a salary range be set during one of the Council's work sessions in January and an adjustment be made at that time, the increase to be retroactive to the employee's anniversary date. 7. Municipal State Aid Proposed Five Year Construction Program Discussion was held on the municipal state aid proposed five year construction program, which streets it includes, what materials will be used, and when the work will be done. Councilman Norberg suggested removing 7th St. from the state aid list and adding Washington instead. Motion by Heintz, seconded by Hentges, that the Council adopt the program as submitted by staff. Roll Call: Heintz, Hentges, Nawrocki - Aye Norberg - Nay Motion by Norberg, seconded by Nawrocki, that the City Manager and City Engineer be instructed to present a plan next year on alternative location of the two segments of 51st from University to 7th St., and 7th St. from 51st to 53rd. Councilman Norberg stated the Council should actively look at these things rather than just sit on them. Roll Call: Norberg, Nawrocki - Aye Heintz, Hentges - Nay Motion fails. 8. Other New Business Motion by Heintz, seconded by Hentges, that the Police Chief be authorized to attend the Police Executive and the Law workshop in San Diego from January 29 to February 1 and expenses be authorized. December 27, 1978 Page 8 Roll Call: Heintz, Hentges, Nawrocki - Aye Norberg - Abstain CITY MANAGER'S REPORT The City Manager reviewed the contents of his written report to the Council. He added that a lawsuit is being brought against the City by Peter Kotzer regarding damage to his property. Mr. Moneta is appealing his sewer and water assessment. LICENSES Motion by Heintz, seconded by Hentges, that licenses as listed be approved upon payment of proper fees, to include the waiving of fees for the Jaycees and HRA. Councilman Norberg stated he believes all requests for waiving of fees should be given special attention and inserted in the minutes of the meeting. Roll Call: Heintz, Norberg, Nawrocki - Aye Hentges - Nay PAYMENT OF BILLS Motion by Heintz, seconded by Hentges, that bills as listed be paid out of their proper funds. Councilman Norberg questioned bill ~28043 to Fire Instructors Association in the amount of S345.00. Motion by Norberg, seconded by Hentges, that bill #28043 be excluded from the list of bills for further back up information. Roll Call: Norberg, Hentges, Nawrocki - Aye Heintz - Nay Roll Call on amended list of bills: Norberg, Hentges, Nawrocki - Aye Heintz - Nay Mayor Nawrocki stated he attended the National League of Cities meeting and chaired the session on Small Cities Development. The next meeting of the Small Cities Advisory Committee is in Kansas City and there will be an annual meeting in Washington D.C. in the spring. He asked for authorization from the Council to attend the meetings. Motion by Hentges, seconded by Heintz, to authorize the Mayor's attendance and expenses at Small Cities Advisory Committee meetings. The cost of the meetings will be approximately $1,000.
