RECESSED MEETING OF THE CITY COUNCIL
CITY OF COLUMBIA HEIGHTS, MINNESOTA
JUNE 16, 1977
The Meeting was called to order at 7:08 p.m.
Roll Call: Heintz, Norberg, Hentges, Nawrocki--present
LogaczI-absent
Motion by Heintz, Seconded by Hentges to name Judy LaPointe secretary
pro-rem for the meeting. Roll Call: All Ayes
Councilman Logacz arrived at 7:12 p.m.
INFORMAL QUOTATIONS ON PICNIC TABLES, STEEL LIGHT POLES AND GUARD RAIL POSTS
John P. Murzyn, Superintendent of Parks, presented information on the
informal bids received for picnic tables, steel light poles and guard
rail posts. Mr. Murzyn and the Park Board were recommending award of bid
to the low bidders on the steel light poles and guard rail posts; and to
the high bidder on the picnic tables.
There was some discussion on the reason for recommending the high bidder.
Mr. Murzyn reported that the high bidder was the only bidder to meet
specifications; in effect, they were the only responsible bidder.
Councilman Norberg commented that the least expensive picnic tables should
be purchased due to vandalism. More general discussion followed.
Motion by Heintz, Seconded by Logacz to award the informal quotations as
follows: Sterling Electric in an amount of $1,652.00 for steel po~,es,
G. M. Stewart in an amount of $883.20 for guard rail posts and Miracle
Jamison in an amount of $1,134.O0 for picnic tables and the Mayor and
City Manager be authorized to enter into contract for same.
Motion by Hentges, Seconded by Norberg to divide the question and take a
separate roll call on each bidded item.
Roll Call on Sterling Electric's bid.- Logacz, Norberg, Hentges, Nawrocki--aye
Heintz--nay
Councilman Heintz noted that he voted nay because he felt the bids should
be considered together, not with separate roll calls. He was not opposed
to awarding the bid on poles to Sterling Electric.

There was further discussion on the picnic tables. Councilman Heintz
stated that he felt the Park Board recommendation should be considered.
Councilman Hentges suggested purchasing somethin9 that will not be
easily broken. Councilman Logacz noted that he supported the Park
Board recommendation on an experimental basis. Councilman Norber9
suggested the tab]es be permanently and irrevocably labeled "City of
Columbia Heights"
Roll Call on Miracle Jam]son's bid: Logacz, Heintz, Nawrocki--aye
Hentges, Norberg--nay Motion carries.
There was discussion on the City's bidding and purchasing policies.
BIDS ON LABELLE PARK IMPROVEMENTS, LIGHTING AND LANDSCAPING
It was reported that bids had been received on light]n9 and landscaping
for LaBelle Park. The Park Board recommended re-bidding the section
on lighting and award]n9 the bid on landscaping to Mickman Brothers
Landscaping in an amount of $]0,450.00.
Motion by Logacz, Seconded by Hentges to award the bid on landscaping
to Micl~man Brothers in an amount of $10,450.00 based on low responsible
bid and the Mayor and City Manager be authorized to enter into contract
fo r same.
Roll Call: All Ayes
Motion by Heintz, Seconded by Norberg to reject the bids for lighting
for LaBelle Park.
There was some discussion on lighting alternatives for the Park.
Councilman Heintz stated that perhaps the distance between lights
could be stretched to el iminate the need for some of the lights.

SECOND READING OF ORDINANCE NO. 853 -- CODIFICATION OF ORDINANCES
No action was taken on this item.
FIRST READING OF AN ORDINANCE ON LEGISLATIVE BILL REGARDING PUBLIC SAFETY
PFRSONNEL PENS IONS
Motion by Hentges, Seconded by Norberg to table Housefile 411 for
consideration until the next regular Council meeting.
Roll Call: All Ayes
It was noted that the Council had not received copies of information
related to this item.

OLD AND NEW BUSINESS
The Council began discussing a letter received from Mr. Watson regarding
a storm drain that was constructed on 43rd Avenue west of Arthur Street.
Some discussion had been held on this item in the past; there was a
question as to whether or not this storm drain was actually authorized.
Communications had been received several times from a Mr. Darryl Olson.
Mr. Olson had stated that the storm drain had been deleted by the Council
from the rest of the construction and he wanted to know who authorized
the reinstatement.
After much discussion Mayor Nawrocki stated that he did not feel the
error had been a willful, self-serving act on the part of the Staff.
He noted that he would send an explanation letter to Mr. O]son.
Mr. Dick Martin was present at the meeting and asked why several
hazardous sections of sidewalk in the City have never been replaced.
Mayor Nawrocki suggested that Mr. Martin meet with a member of the
Engineering Department to discuss the matter. He also stated that a
report should go to the Council on this item.
Councilman Logacz brought up the subject of diseased tree removal and
replacement. Mayor Nawrocki stated that the staff should prepare a
plan of action in this regard. He asked for a report on the possibility
of the availability of funds for this program.
Mr. Martin asked about trees at 525 - 529 Mill Street which had been
removed. He felt they were good, healthy trees. Mayor Nawrocki asked
for a report on this from the City Staff.
Councilman Norberg stated that he was proposing a project called "Quiet
SummerI'. This would involve having people anonymously call and report
noisy cars. The Mayor indicated that this was a good idea but perhaps
not ~ery practical as this is a difficult thing to control. He
suggested putting an article in the next newsletter to remind people
that there are sound control levels which must be met.
Councilman Logacz brought up the subject of the proposed liquor warehouse.
He stated that some action should be taken soon. There was some discussion
on this, with Councilman Hentges pointing out that problems still exist
with the proposal. No action was taken.
Building Inspector Arden Hovland reported on the proposed retaining wall
for Winchell Donut. He stated that there were a couple of plans on this
and gave a brief description of each.
LICENSES
There was some discussion on the solicitor's license and how it should be
handled.

Motion by Heintz, Seconded by Logacz that the licenses as listed be
9ranted upon payment of proper fees.
Motion by Norberg, Seconded by Hentges to approve the licenses as
listed with the exception of the solicitor's license. This motion
was not recognized.

Mayor Nawrocki instructed the City Manager to be sure that the proper
procedure was followed regarding the solicitor's license.
RESOLUTIONS AND AGREEMENTS REGARDING CENTRAL AVENUE URBANIZATION
There was general discussion on the plans for Central Avenue Urbanization
including some estimates on costs.

RESOLUTION 77-34
CENTRAL AVENUE URBANIZATION
At a special meeting of the City Council of the City of Columbia Heights,
duly held on the 16th day of June, 1977, the following Resolution was
offered by Hentges, Seconded by Heintz, to wit;
WHEREAS, the Commissioner of Highways for the State of Minnesota has
caused to be prepared: plans, special provisions and specifications for
the improvement of Trunk Highway No. 5, renumbered as Trunk Highway No. 65,
within the corporate limits of the City of Columbia Heights to the North
corp limits of Columbia Heights; and,
WHEREAS, said plans are on file in the Office of the Department of
Highways, St. Paul, Minnesota; being marked, labeled and identified as:
S.P. 0207-36-37 (65=5); and,
WHEREAS, said special provisions are on file in the Office of the
Department of Highways, St. Paul, Minnesota; being marked, labeled and
identified as: S.P. 0207-36-37 (65=5), and which, together with, the
Minnesota Department of Highways Standard Specifications for Highway
Construction, dated January 1, 1972, as amended by Minnesota Department
of Highways Supplemental Specifications for Highway Construction, dated
April 1, 1976, will govern, and which are on file in the office of the
Commissioner of Highways, constitute the specifications for said
improvement of Trunk Highway No. 5, renumbered as Trunk Highway No. 65; and,
WHEREAS, copies of said plans and special provisions as so marked, labeled
and identified are also on file in the Office of the City Clerk; and,

WHEREAS, the term, said plans and special provisions, as hereinafter used
in the body of this Resolut|on will I~e deemed and ~ntended to mean, refer to
and incorporate the plans and special provisions in the foregoing recitals
particularly identified and described; and,
WHEREAS, the Commissioner of Highways desires in the interest of public
safety that any and all parking of vehicles, if such parking is permitted
within the corporate 1Tmits of the City of Columbia Heights, on said
Trunk Highway No. 5, renumbered as Trunk H~ghway No. 65, will be paralled
with the curb adjacent to the highway and w~ll be at least 20 feet from any
crosswalk.
NOW, THEN, BE IT RESOLVED that said plans and special provisions for the
improvement of Trunk Highway No. 5, renumbered as Trunk Highway No. 65,
within the corporate limits of the City of Columbia Heights, be and hereby
are approved.
BE IT FURTHER RESOLVED that the City of Columbia Heights does hereby agree
to require the parking of all vehicles, if such parking is permitted within
the corporate limits of said City, on said Trunk Highway No. 5, renumbered
Trunk Highway No. 65, will I~e parallel with the curb adjacent to the
highway, and at least 20 feet from any crosswalks on all public streets
intersecting said trunk highway.
BE ~T FURTHER RESOLVED that the elevations and grades as shown in said
plans and special provisions are hereby approved and consent is hereby
given to any and all changes in grade occasioned by the construction of
Trunk Highway No. 5, renumbered Trunk H~ghway No. 65, in accordance with
said plans and special provisions.
Upon the call of the roll, the following Councilmembers voted in favor of
the Resolution: Heintz, Hentges, Nawrocki
and, the following Councilmember voted against the adoption of the
Resol ut ion: Norberg
whereupon the Mayor and/or the presiding officer declared the Resolution
adopted.
Councilman Norberg noted he voted against the Resolution because he felt
some room should be !eft for any changes that the Council still wanted to
make.
RESOLUTION 77-35
CENTRAL AVENUE URBANIZATION
BE IT RESOLVED that the City of Columbia Heights enter into an agreement
with the State of Minnesota, Department of Transportation, for the
following purposes, to-wit:
June ]6, 1977
To revise the existing traffic control signals with street
lights and to interconnect the signals on Trunk Highway No.
65 (Central Avenue) at 49th, 47th, 45th and 44th Avenues
Northeast in accordance with Agreement No. 58]90, a copy
of which was before the Council.
BE IT FURTHER RESOLVED that the proper City officers are hereby
authorized to execute such agreement and thereby assume for and on
behalf of the City all of the contractual obligations contained therein.

RESOLUTION 77-36
CENTRAL AVENUE URBANIZATION
BE I'T RESOLVED that the City enter into an agreement with the State of
Minnesota, .Department of Transportation for the following purposes, to-wit:
to provide for payment by the City to the State of the lump sum amount of
$80,554.00 as the City's full and complete share of all construction and
construction engineering costs incurred in connection with the state
contract construction of Trunk Highway No. 65 improvements under State
Project No. 0207-36 (T.H. 65=5).
BE IT FURTHER RESOLVED that the Mayor and City Manager be and they are
hereby authorized to execute such agreements. (Cooperative Construction
Agreement No. 58429)

A special meeting was ca] led for Tuesday, June 21, 1977 at 7:00 p.m. to
discuss the proposed EDA Grant, Recodification, and the Resolution
regarding Public Safety Personnel Pensions.
Motion by Heintz, Seconded by Hentges to adjourn at 12:O8 a.m.
