OFFICIAL PROCEEDINGS RECESSED MEETING OF THE CITY COUNCIL CITY OF COLUMBIA HEIGHTS, MINNESOTA NOVEMBER 10, 1976 Meeting was called to order at 9:47 p.m. Roll Call: Logacz, Heintz, Norberg, Hentges, and Nawrocki--present. It was noted that Karen DeBruin would continue as secretary. RESOLUTION ON LICENSE FEES FOR 1977 Councilman Heintz asked about the increase in staff salaries in comparison with what is being charged for licenses. Councilman Hentges noted that this was his point in proposing changes to the fees. RESOLUTION #76-57 SETTING LICENSE FEES FOR 1977 BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that the following list of license fees (as per attached list) be set for 1977. Roll Call: Logacz, Heintz, Hentges, Nawrocki---aye Norberg---nay Motion Carries Councilman Norberg noted that he would like to discuss various points in the Ordinance at an informal meeting. RESOLUTIONS DEDICATING EASEMENTS FOR URBANIZATION Mr. Watson noted that these properties were presently owned by the City, but must be dedicated for easement purposes by a resolution. Motion by Norberg to table consideration of this matter until all the nec- essary easements have been acquired. Motion dies for lack of a second. Motion by Norberg, seconded by Hentges, to table the matter until such time as acquisition of other easements are obtained. Roll Call: All Ayes RESOLUTION #76-58 ORDERING STORM DRAIN IMPROVEMENTS BEING A RESOLUTION ORDERING IMPROVEMENTS BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, WHEREAS, the City Council of the City of Columbia Heights by Motion on the 25th day of October, 1976 ordered notice of a hearing to be given to prop- erty owners, and WHEREAS, pursuant to a notice of hearing certain residents appeared at a Council Meeting on the 8th day of November, 1976, and WHEREAS, the Council determines to proceed with this local improvement, a portion of the cost being defrayed by special assessments under Charter provisions. NOW, THEREFORE, IT IS HEREBY RESOLVED: 1. That the location and extend of such improvements is as follows: 39½ to 4Oth Ave., From Cleveland St. East about 500 feet November lC, 1~76 2. That the materials tc be used are as follows: Standard 3. That a careful estimate of the cost of the improvements has been made by the City Nanager end the several lots and parcels of land front- ing upon and adjacent to such proposed improvements, which he deemed bene- fited thereby, were properly notified c;f said hearings, and 4. That the City Nanager shall also list the names and owners of the several parcels so improved as nearly as can be ascertained. These improvements shall also be known as Project No. 717. Offered by: Logacz Seconded by: Hentges Roll Call: A11 Ayes RESOLUTION REGARD NG LENGTti OF COUNCIL HEETINGS Councilman Norberg read a resolution he had composed proposing that no official business be taken up at a Council mee::ing after 11:45 p.m. and that one-half hour be set aside ear]y in the meeting for puposes of screen- lng agenda items. Motion by Hentges, seconded by Heintz, to table until the next regular meeting. Ro]i Call: All Ayes It was suggested that the Council r-eceive copies of the proposed resolution. RESOLIjTI©N RE-DESIGNATING FAU ROUTES The proposed resolution was reed [.y ~r. Watson. Bob Owens of the Engineer- ing Department ncted that these re-designations would allow the City to apply for funds. Mayor Nawrocki ncted that the City had never asked to take 37th Avenue off the FAU system. Hayer Nawrocki asked how these changes tied in with the comprehensive plan of the City of Columbia Heights. Herren by Hentges, seconded by Norberg, to table. This motion was not recognized by the Chair. There was further discussion on the comprehensive plan and FAU changes. November 10, 1976 -410- Mayor Nawrocki then dictated the following resolution: RESOLUTION #76-59 BE IT HEREBY RESOLVED BY THE CITY COUNCIL of the City of Columbia Heights that, WHEREAS 37th Avenue between University and Central Avenue was orginally on the FAU system as a minor arterial classified street, and WHEREAS such designation was removed from said street without the concurrence or knowledge of the City Council; BE IT HEREBY RESOLVED that the City Council does hereby request the Transportation Advisory Board to re-instate 37th Avenue between University Avenue and Central Avenue as an FAU classified minor arterial street as to provide a continuous minor arterial street from University Avenue to Intestate Highway #35. Offered by: Hentges Seconded by: Heintz Roll Call: All Ayes TRAFFIC COMMISSION RECOMMENDATIONS: REQUEST TO PLACE STOP SIGNS FOR NORTH AND SOUTH BOUND TRAFFIC ON 2½ STREET AT 38TH AVENUE Motion by Hentges, seconded by Logacz, to concur in the Traffic Commission recommendation. Roll Call: All Ayes RECOMMENDATION TO PLACE "NO U-TURN" SIGNING AT THE NORTH END OF JEFFERSON STREET MEDIAN AT 47TH AVENUE Council Hentges noted that the hearing was not held on this item because tEet'~ Traffic Commission did not feel it was necessary to hold a hearing for something that was ultimately governed by ordinance. Mayor Nawrocki noted that the hearing should have been held to notify the people that u-turns would be restricted. He noted that many people assume it is possible to make a u-turn at this location. Councilman Hentges noted that a hearing would be held on another subject with the residents in this area, and the u-turn restriction could be re- ported at that time. Motion by Hentges, seconded by Logacz, to table further consideration of this request until after a public hearing by the Traffic Commission. It was noted that the Council would go on tc. the next item and come back when they received a drawing of the proposed subdivision. REPORT ON LABELLE PARK PL4N Mr. Watson reported that the Civil Engineer with Wclverton Engineering would like to make a presentation to the Council on ?ovember 22nd on what is being discussed regardin9 LaDe]lo Park. Mayor Nawrocki asked if the Park Board had reviewed the proposed '~liq- uor in parks" ordinance. He noted that the he had sent out a letter to the other communities in Anoka County to gauge their interest in this type of ordinance, but the response had been minimal. He also noted that he would like a recommendation from the Park Board on this ordin- ance. REQUEST EXTRA ALLOCATION TO CCVER COST OF RETAINIHC- WALL STAIN Mr. Watson reported that ~r. Gustafson informed him that the initial authorization to expend up to S150 for stain fc)r the Jefferson Street retaining wall should be raisect to SZ~O0. Motion by Heintz, seconded by Lo~acz, to, authorize an increase in the -412- November 10, 1976 maximum amount to be expended for stain on the median materials for Jefferson Street to $400. Roll Call: All Ayes AUTHORIZATION TO PURCHASE EASEMENTS SOUTH OF 53RD AVENUE WEST OF CENTRAL AVENUE Mr. Watson noted that the Highway Department wanted all the necessary easements before they would proceed with the Central Avenue Urbaniza- tion. Mr. Hovland, who had left the meeting to get the drawing of the propos- ed subdivision for Winchell Donut House, came back and noted that the plans were not available. No action was taken. It was explained that the easements were appraised, and that the owners found the appraisal agreeable; but they were not anxious to enter into an option to purchase agreement. It was re-iterated that the Highway Department had made it clear that they would not proceed on the Central Avenue Urbanization project until they had all the necessary easements. It was noted that the easements would cost approximately $3.00 per square foot. Councilman Heintz noted that this price was close to what would be charged for land on an open market. He questioned whether this was common practice in acquiring easements. There was some discussion on the State Aid fund. Motion by Hentges, seconded by Logacz, to table this item until the Spec- ial Meeting on Monday, November 15, 1976. Roll Call: Logacz, Hentges, Nawrocki---aye Norberg, Heintz---nay Motion Carries Mayor Nawrocki noted that the Council was in receipt of more information regarding the proposed Community Service Officer for the Police Depart- ment. Councilman Norberg asked for a detailed job description on this position. It was noted that this would be done. Councilman Norberg asked if the MELSA contract could be put on the next regular Council agenda. There was general discussion on the tree planting which was currently underway on Jefferson Street. Councilman Henrges brought up the fact that a curb cut had been placed in What he felt was an unsatisfactory place on the northwest corner of 40th Avenue and Jefferson Street. He reminded the Council that this location had been discussed before when it was decided to widen the street to 44 feet near the corners at 4Oth Avenue. Mayor Nawrocki noted that this should have been presented to the Council. -k13- November 10, 1976 Councilman Norberg suggested referring the subject to the Traffic Commission for review. Motion by Norber9, seconded by Heintz, to refer the matter of the curb cut on the northwest corner of Jefferson Street an/ LOth Avenue to the Traffic Commission. Roll Call: All Ayes Councilman Hentges asked Hr. Watson if the resident of 4723 ~.th Street cou]d park on the boulevard since there was no other available off- street parking. Mr. Watson replied that it could not ]ega]]y be lowed. It was noted that perhaps the Mayor could inform the Police Dep.artment of the matter. Motion by Hentges, seconded by Heintz, to refer the parking problem at z~723 6th Street to the City Hanager for reviewal and recommendation, Roll Call: All Ayes L I(:~ENSES It was noted that there were no !iccnse applications for consideration. BIDS ON HOUSE AI~iD GARAGE AT 547 MILL SI'REET Mr. Watson reported that one bid was received cm the house at 547 Mill Street. This was from W.J. Mecl in an amount of $2,368. One bid had ~ ~ ill Street from Lucy Ann also been received on the garage at ~4, M Bec:kwe]] in an amount of S~O.O0. Mot:i'on by Hentges, seconded by Heintz, to acceFt the bid of W.J. Mecl in an amount of $2,~68 for the house at 547 Mill Street. Motion by the Chair, seconded by Norberg, to table the matter until the next meeting for the purpose of inquiring on the intended disposition of the house. Attorney Kalina reported that he would like to meet with the Council on the proposed Code.
