Motion by Norberg, Seconded by Heintz to appoint Vicki Maternowsky Secre- tary for this meeting. Roll Call: All Ayes STATEMENT OF PURPOSE OF MEETING Mayor Nawrocki began by stating the purpose for this meeting is to consider storm drain installation in the area of 42nd Avenue and 2nd Street and on 43rd Avenue from 2nd Street to Main Street. He informed the audience that these are two separate projects. Mr. Watson further explained the purpose for the storm drain and plans for construction. Mr. Watson also informed the audience that at this time permanent surfacing for either street is not being considered but will be proposed as a future project after the trenches have settled. At this time, there would be no special assessment against the property owners for this work, but the cost of catch basins and leads will be held separately, and at such time when the streets are curbed and paved, the property owners will be assessed for these basins and leads. He informed the people that the work will involve an inconvenience to them. ENGINEERING DEPARTMENT PRESENTATION Clayton Berg from the Engineering Department presented transparencies showing the design of the proposed storm drain for both projects. Mr. Gustafson, Public Works Director, pointed out that the storm sewer on 43rd is intended to intercept some of the water charging down 2nd from 42nd. To this, Mayor Nawrocki asked if the City had to dig into Main Street and into 2nd Street for this line. Mr, Berg stated the City would have to dig about eight feet out from the curb line on Main Street. Relative to this, Councilman Heintz asked what kind of insurance would there be that the street would be put back in the same condition after digging. Mr. Gustafson assured him that the street could be put back in the same condition using the same kind of material that was there before. Discussion held on blacktopping and sealing the portion that was dug up so as to prevent breakage the following spring. GENERAL DISCUSSION Mr. Kotzer, 4201 2nd Street, asked if there is a storm drain at 44th Avenue and Main Street. Mr. Gustafson stated there was. Mr. Kotzer then asked why the water runs about five feet away from the drain. Mr. Gustafson stated that there could be a grade problem with the street. He further stated that the County will be notified, and if there is a problem, it will be corrected. Idr. Smieja, 4305 2nd Street, asked how long after the storm sewer is put in on 42nd Avenue will the curbing and paving be done. Mr. Gustafson replied that it is the intention to do the underground work first and then follow it next year with a hearing for the surfacing. Mr. Smieja felt that it didn't make sense to wait and let the dirt gather in front of his home, which was his main concern regarding this project. He further felt that the proposal for the storm drain and permanent paving should be considered at the same time. He further stated that if the people are against surfacing at the time of that hearing and the project is denied, then the problem with the dirt will become worse. Therefore, why complete the storm drain job if there is no authority to finish it with surfacing? Mr. Berg stated that the problem in front of Mr. Smieja's house will be alleviated somewhat in that the regrading and lowering of gutters at 42nd and 2nd will prevent large volumes of water from passing his house thereby resulting in less dirt. Councilman Hentges stated that the only problem with having the surfacing done now is that some people are currently paying for two assessments. Discussion held. Mr. Watson reported that when the surfacing project is proposed, it is the intention to surface 42nd Avenue from Main Street to 3rd Street and on 43rd Avenue from Main Street to 2nd Street. This means that the people half:way between 41st and 42nd all the way up to a point halfway between 43rcl and 44th will be assessed on an avenue basis for curb and surfacing. Having the surfacing done in 1977 would mean that the people would begin paying for this in 1978 and that the assessment they are paying for now will have been paid by that time. Brief discussion held on why 41st Avenue and 2nd Street, where the road was dup up to drain that corner into the swamp, was not included for storm drain. Councilman Hentges asked how wide the right-of-way is on 42nd Avenue from 2nd Street to 3rd Street. Mr. Gustafson stated that without the Moneta property there is a 30 foot right-of-way. Councilman Hentges then asked that in order to have the road surfaced the City would have to acquire 30 more feet. Mr. Gustafson stated that eventually this would have to happen. Councilman Hentges pointed out that surfacing probably could not be done next year as the City probably wouldn't be able to acquire that 30 feet from Mr. Moneta. -149- One gentleman asked why the route for the storm drain was changed. It was found that this alternate route was more practical for the purpose of providing drainage to the low area south of 42nd Avenue between 2nd Street and 3rd Street. Further discussion held on the assessment schedule for street surfacing. In relation to Mr. Smieja's comments, Councilman Heintz stated that the problem with having a hearing for both is that the estimates given for street surfacing may not be the same the following year when the surfacing would actually be done. On a major excavation such as this, it is best to let the soil settle for a year before doing any permanent surfacing. Therefore, should the cost estimates change another hearing would have to be held. However, he did agree that this should be considered as a con- tinuous project and that a year after the storm drain is in, it should be followed with curb and gutter and a new mat surfacing. Mr. Smieja again stated that if the street is torn up, he would like to get some assurance as to when the total job will be completed. Mayor Nawrocki stated that the only commitment the Council can give tonight is that after construction the street will be restored as closely as possible to its original condition. The Council cannot guarantee tonight that the street will be permanently surfaced as that is the subject of another hearing. The gentleman from 4232 3rd Street spoke on the problem of the water not being directed to the catch basins located at the park entrance on 3rd Street. Mr. Gustafson reported that because of the excessive grades, the water is out of control when it finally reaches the park area~ and that part of this proposed project will intercept some of that excessive flow. Also, when 3rd Street is paved and curb and gutter put in, this problem will be taken care of. Mr. Misik, 4301 2nd Street, asked what the cost of the catch basins would be to the homeowner. Mr. Watson explained that for this year the cost of the drain structure may run from $1.00 to $1.50 of the total estimated $14.00 per front foot street cost and on an avenue basis it may be about $0.50 a foot. He further stated that an estimated $4,000 or $5,000 of the total project cost will be used for these extensions. At the time the street paving is done the property owner will pay the 1976 cost for the extensions and not what it would cost the year construction is done. Mr. Gustafson commented that a single catch basin and lead should not exceed $500. Brief discussion. Mr. Jurek, 4206 2nd Street, asked if a storm drain wasn't put in a few years ago on 42nd Avenue. Mr. Berg replied that project was for water main installation. Motion by Heintz, Seconded by Logacz that the projects be approved. As a matter of clarification~ Mayor Nawrocki stated that the total esti- mated cost for these projects is $33,000 with approximately $5,000 to be assigned to the catch basins and leads. Restoration of the street will be done as closely as possible to the existing condition, and that -150- no guarantee can be made that the street will be paved next year or any other year. If and when this area is proposed for street construction another hearing would have to be held. Mayor Nawrocki asked if the estimated $27,000 being paid out of the sewer fund balance is coming from the storm or sanitary sewer fund. Mr. Watson replied that these two funds have been combined into one sewer fund. To his understanding, Maycr Nawrocki thought that the money in this fund was to be used for the Central Avenue Urbanization Project. Mr. Watson stated that over $50,000 of the $250,000 in this fund would be used for that pro- ject. Councilman Heintz again stated the City should do this storm drain work this year and take a serious look at finishing this next year with curb and gutter and surfacing. Councilman Hentges concurred with Councilman Heintz~ however, he does not want to see the people who are currently paying for two assessments have to pay for another assessment. He further stated that according to the letter there would be no assessment, yet now there is an assessment for catch basins and leads. Mr. Watson stated that at this time there is no assessment for the work. He also read an excerpt from the letter to the property owner on the anticipated cost to them. Mayor Nawrocki further clarified that the approximate cost of the catch basins and leads is about $5,000 and that money is going to be paid now, but in effect will be financed out of the PIR fund. If and when a hearing is held for the street work and if it is approved, then that cost will be assigned to the cost of those paving projects. If the street project is not approved then that money will have to be paid from somewhere and if it is not from the project itself then the ultimate source would be from the general fund taxes. Discussion held. One gentleman asked who would be paying for the footage along the school property behind 42nd and 3rd. Mr. Watson stated that the school will be assessed for lines adjacent to their property at this time, and that they will have to pay for all future extensions to service their vacant property when and if it is developed. Roll Call on Motion: All Ayes RESOLUTION #76-18 BEING A RESOLUTION ORDERING IMPROVEMENTS BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, that WHEREAS, the City Council of the City of Columbia Heights by Motion on the 23rd day of February, 1976 ordered notice of a hearing to be given to property owners, and WHEREAS, pursuant to a notice of hearing certain residents appeared at a Council meeting on the 29th day of March, 1976, and ~151- WHEREAS, the Council determines to proceed with this local improvement, a portion of the cost being defrayed by special assessments under Charter provisions. NOW, THEREFORE, IT IS HEREBY RESOLVED: 1. That the location and extent of such improvements is as follows: Catch basins and leads from 42nd Avenue and 2nd Street to 42nd and 3rd Street and on 3rd Street north 280 feet, more or less, to the existing storm drain. Also, 43rd Avenue from 2nd Street to Main Street 2. That the materials to be used are as follows: Concrete, BCCMP (Bituminous Coated Corrugated Metal Pipe), PVC Pipe That a careful estimate of the cost of the improvements has been made by the City Manager and the several lots and parcels of land fronting upon and adjacent to such proposed improvements, which he deemed benefitted thereby, were properly notified of said hearings, and That the City Manager shall also list the names and owners of the several parcels so improved as nearly as can be ascertained. 5. These improvements shall also be known as Project No. 712 Offered by Heintz, Seconded by Norberg. Roll Call: All Ayes Resolution #76-18 was adopted.
