Meeting was called to order at 9:05 p.m.
Land, Nawrocki-present Norberg-absent
Roll Call: Logacz, Heintz,
Motion by Heintz, Seconded by Logacz to name Tim Yantos Secretary
Pro-tem. Roll Call: All Ayes
Mayor Nawrocki questioned whether proper notice had been given of the
meeting, and the City Manager assured him that proper notice was given.
REPAIR OF LIBRARY ROOF
Brief discussion held on low informal bid on the repair of the library
roof, which was in the amount of $752.00. Mayor Nawrocki questioned
what the previous bid of approximately $5,000 had included and the
City Manager explained that this was for complete replacement and the
bid of $752.00 is for necessary repairs as outlined by the building
inspector. Motion by Land, Seconded by Heintz to authorize the expenditure
of $752.00 for Library roof repairs. Roll Call: All Ayes
GLOVER CASE JUDGMENT
Mayor Nawrocki reportedon the background surrounding the Glover Case
near Sullivan Lake, and also reported briefly on the judgment recently
made in court.
Ronald Kalina, City Attorney, also reported on the Glover Case and explained
the court procedures on paying back taxes. He pointed out that no action
is needed by the City Council pertaining to this judgment. He also
stated that in many ways the judgment is probably a favorable settlement
for Columbia Heights and he recommended that the city not appeal the
decision. He stated that there is nothing else for which the city can
be held responsible, as this represents the final action. He stated that
the city pays to the court and the court distributed the money accordingly.
Mayor Nawrocki pointed out that although the city has to pay the
approximately $281,000, the city receives the land.
Mr. Ken Hentges, councilman elect, was present and stated that he felt
that revenue sharing money should be used to pay for the judgment.
Ronald Kalina advised that the city stay away from Revenue Sharing Funds
in this case.
Councilman Land asked how the City of Fridley came out in the ultimate
decision and Attorney Kalina stated that Fridley's attorney would be
disclosing this information to the Fridley City Council shortly and that
until that time the information should not be given out.

RESOLUTION #75-61 Offered by Land, Seconded by Logacz Roll Call:
All Ayes Resolution #75-61 Amending Adopted 1976 Budget and
Levying Taxes, was adopted.
BE IT HEREBY RESOLVED by the City Council of the City of Columbia
Heights that:
WHEREAS, the Anoka County District Court has determined on November 13, ]975
that the City's use of certain property within its corporate limits,
commonly described as the Sullivan Lake area, constituted a taking
of said property, and
WHEREAS, the said District Court has entered a money judgment against
the said City on November 13, 1975, and
WHEREAS, the City recognizes that a special levy is permissible to satisfy
judgments against it rendered by a court of competent jurisdiction,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Columbia Heights that the total levy for tax purposes as adopted on
September 25, 1975 be and herein is increased and amended to add a
total of $]O0,O00.O0 to the Sl,329,510.00 previously indicated as the
amount to be levied by virtue of Resolution #75-50 dated September
25, 1975. Said increase shall be used for the purpose of satisfying the
judgment referred to herein. ~
