Meeting was called to order at 8:02 p.m. Roll Call: Logacz, Heintz,
Norberg, Land, Nawrocki-present
Motion by Norberg, Seconded by Land to name Margo Emerson Secretary
for the meeting. Roll Call: All Ayes
Invocation was given by Rev. Otte, St. Matthews Lutheran Church
MINUTES OF LAST REGULAR MEETING
Councilman Norberg noted a change which he requested on page
246 of the minutes of the meeting of September 8 which would
reword a sentence in regard to what he had said about the water
tower controls. He also asked that the City Attorney verify the
accuracy of the motion on the Phase II of LaBelle Park bids
whereby the low bidder was rejected for not having filled out certain
forms. The Attorney would report later in the meeting, at which
time he stated that the motion as appeared in the minutes was correct
in that the actual forms were described in the body of the minutes.
Motion by Norberg, Seconded by Heintz to approve the minutes as
presented in writing, with the correction on page 246 as noted by
Councilman Norberg, and the reading be dispensed with.

PROCLAMATION DESIGNATING FRIDAY, SEPTEMBER 26, AS MARGARET IDZIOREK DAY
WHEREAS, the City of Columbia Heights has enjoyed the efficient
service of Margaret Idziorek for over twenty-five years, working
efficiently and conscientiously on behalf of the City in the municipal
offices serving as Deputy City Clerk-Treasurer, and
WHEREAS, Margaret has shown dedication to duty and concern about doing
the best job possible for our city throughout this time,
NOW THEREFORE, I, Bruce G. Nawrocki, Mayor of the City of Columbia
Heights do hereby proclaim Friday, September 26, 1975 as
"MARGARET IDZIOREK DAY"
and recommend to all present and past municipal employees and officials
that they visit the Council Chambers some time between 2:30 and 4:00 p.m.
on that day to personally express their appreciation to Margaret
for the quarter of a century of service that she has given, recognizing
that in times of emergency with personnel problems in the Finance
Department and the City Clerkls office Margaret has been our mainstay
showing the willingness to put in additional hours and assuming extra
responsibilities in order to keep the city operations running smoothly.

HEARING ON DELINQUENT MID-BLOCK LIGHTING BILLS
Mr. Watson reported that there are ten properties included in the list
of unpaid mid-block lighting statements, which were due on September 30, 1974.
The range in the amounts owed is from $11.80 to $15.60.
Motion by Land, Seconded by Logacz that the list of unpaid mid-block
lighting bills be certified to the County for inclusion on the taxes.

RESOLUTION #75-48 ASSESSING THE COST OF MID-BLOCK LIGHTING

BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS,
that
WHEREAS, a public hearing was held on September 22, 1975, with due
notice being given to the affected property owners, and
WHEREAS, Ordinance No. 796 Authorizes the assessment of unpaid lighting
bills against the benefitted properties pursuant to Minnesota Statute
429.10],
NOW THEREFORE BE IT RESOLVED;
1. That the assessment roll attached hereto (attachment to the Council
Minutes as well), the reading of which is waived, is hereby adopted.
2. That the said assessment roll, plus administrative fees, be
certified to Anoka County for collection with the property taxes
against the benefitted properties.
LIBRARY REMODELING
Architect and Engineer, Robert Diedrich, spoke on the plans for the remodeling
project and stated that the estimate of cost is SlT,000 for interior work,
and $27,O00 for the general remodeling. Discussion was held on when the
bid opening might be held on the project. Councilman Norberg
indicated that the Library Board would like to review the bids before the
bids go to the Council for award. Motion by Norberg, Seconded by Heintz
to authorize the City Manager to advertise for bids for the library remodeling
according to the specifications as presented with the bids to be opened
Thursday, October 23 at 2:00 p.m. with a report to the fo]lowing regular
meeting of the City Council. Roll Call: All Ayes
The library board will review the bids after they have been opened at
a specia]meeting and make recommendation to the City Council.
CUSTODIAL SERVICE BEGINNING NOVEMBER l, 1975
Motion by Land, Seconded by Norberg to authorize the City Manager to advertise
for bids for the custodial service for the municipal building, municipal
service center, and the library to be opened at 2:00 p.m. on
Tuesday, October 14 with a report to the regular Council meetin9 of that

ROOT CUTTER
Mr. Watson explained the need for a root cutter to cut tree roots around
diseased trees to prevent the spread of the disease.
City Engineer, Mr. Brown, explained that only one company manufactures
these root cutters, but that there are several suppliers so that bids
can be taken. He reported that the estimate for this machine in 1969
was about $5,000 but that now the estimate is $8,500. Discussion was
held on the various attachments available for the machine, including the
trenching and snowplowing. Mr. Brown explained that the purchase requested
now is just the root cutter without the attachments. He explained the
use of the root cutter itself. Councilman Norberg pointed out that this
machine could not be used until next spring and perhaps the bids should
wait until then. Mr. Brown stated that the equipment would not be received
until next spring as delivery time is that long. Councilman Norberg was
concerned that the specifications be written to only include the root
saw cutter and not any of the possible attachments. Motion by Norberg,
Seconded by Logacz to authorize the City Manager to advertise for a root
cutter to be opened on October 23, 1975 at 10:00 a.m. with the bids
to be reported to the following regular meeting of the City Council.

STORM DRAIN
Mr. Watson explained the need for a storm drain on the back lot line west
of Fillmore between 42nd and 42½ Avenues. He stated that this is the only
way to pick up the back yard drainage on the properties along this area.
Motion by Land, Seconded by Logacz to authorize the City Manager to call for
a hearing on this storm drain installation to be held October 14
at the regular Council meeting. Roll Call: All Ayes
Motion by Heintz, Seconded by Land to authorize the City Manager to advertise
for bids on this storm drain installation west of Fillmore between 42nd
and 42½ Avenue to be opened Friday, October 10, at 2:00 p.m. with a report
to the following regular meeting of the City Council. Roll Call: All Ayes
WATERMAIN EXTENSION MONROE STREET, 45th to 46th
Mr. Watson explained that an agreement had been reached with the City of
Hilltop for cost sharing on the watermain extension at this location, with
an exchange of the CETA allocation to Hilltop, to Columbia Heights, being
made. Mr. Brown reported that one owner in question as to whether he would
grant all the necessary easements had granted these easements for the
watermain installation, but not for the permanent street work itself.
Motion by Logacz, Seconded by Heintz to authorize the City Manager to
advertise for bids for the watermain extension in Monroe Street,
45th to 46th, to be opened October 10 at 2:00 p.m. with a report to the
following regular meeting of the City Council. Roll Call: All Ayes

JESSE LEY, 522 SUHHIT STREET-COHPLAINTS
Hr. Ley stated that he was present at the meeting to complain that his
garbage cans are again being placed along the alley, rather than next
to his garage where his racks are located. He stated that the
garbage men have rep]aced the cans where they belong only one week and then
began just putting them along the alley again.
Hr. Watson stated that he would have it checked with the garbage contractor.
Hr. Ley also had several complaints about his neighbor's yard. He stated
that the garden is left to rot, and that the neighbor has beehives
and that the smell from the yard is terrible, and the bees are dangerous.
Councilman Heintz asked the City Attorney what can be done to eliminate
these problems. Hr. Kalina stated that the zonin9 ordinance can be changed
to make the keeping of bees illegal. Discussion
held on whether the bees actually cause a problem in the neighborhood.
Hr. Kalina reported that the health inspector, Tim Yantos, had checked
the conditions of the yard and found that there was no serious problem
with either the garden smell or the bees. Councilman Heintz expressed
his belief that if the neighbors keep their yards clean, then there is no
reason why this man shouldn't as well. Hayor Nawrocki asked that the
City Hanager have the City Attorney and Health Inspector check on this
matter further.
Councilman Heintz stated that this gentleman had agreed to a plan to have
his yard cleaned up at an earlier date, but that it had not been done.
Hayor Nawrocki stated that if the man is violating the ]aw, then it can
be taken care of, but if he is not, then the neighbors, and the city, can
not force their wi]] upon the man.
Hr. Ley also brought up the fact that this same man lets oil from his
automobile drain into the street, and Hr. Ley questioned whether this would
damage the street. Hr. Kalina stated that the new code, presently under
consideration by the City Council, makes this illegal. The Public Works
Director and City Engineer explained that over a period of time the draining
of oil unto the street would weaken the surface and cause damage.
RESOLUTION #75-47 AUTHORIZING THE SUBMITTAL OF AN APPLICATION FOR FEDERAL
ASSISTANCE TO THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT
Discussion was held following the question raised by Councilman Norberg
whether this resolution commits the City Council to the Housing Assistance
plan contained in the application. The City Attorney stated that it does
not specifically require the Council to do this portion of the application,
but pointed out that if the city should"run out" of other projects included
therein, then in a sense they would be obligated to consideration of this
item. Mayor Nawrocki explained that each item under the application would
receive individual attention before anything was done on it, and that the
Council had the ultimate decision. Councilman Heintz explained his interpretation
that this application in a sense commits the Council to a hearing only, on
the projects included, and not the actual proceeding with of these projects.

Councilman Logacz expressed his displeasure at a lengthy discussion on this
resolution at this time, in view of the fact that a hearing had been held
on the application, and all decisions made at that time.

Resolution #75-47 was adopted.
Norberg-abstained
WHEREAS, the City of Columbia Heights previously submitted to the Area
Office of the Department of Housing and Urban Development a pre-application
for Federal Assistance under provisions of Title I of the Housing and
Community Development Act of 1974, and
WHEREAS, based upon changes in H.U.D. policy and levels of Federal Funds
for SMSA Discretionary cities, the City requested that Housing and
Redevelopment Authority prepare a full application, with activities based
upon Community need, and
WHEREAS, a full application for Federal Assistance in the amount of $138,533
has been prepared, and
WHEREAS, two public hearings on the City's Community Development Program
and application for assistance have been held, and the Metropolitan Council
has reviewed the application pursuant totheir A-95 review responsibility.
NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Columbia
Heights, Minnesota that the Mayor be authorized to sign the application
and submit documentation as necessary to the Federal Department
of Housing and Urban Development; and
BE IT FURTHER RESOLVED, that if approved the City Council will hold public
hearings to provide citizen input into the implementation of the
Community Development Activities set forth in the applicat'ion.
RESOLUTION #75-49 TO ACQUIRE TAX FORFEITED PROPERTY

Resolution #75-49 was adopted.

WHEREAS, the City of Columbia Heights is desirous of acquiring certain
properties located within its municipal boundaries for the preservation
of the health, welfare, and safety of the citizens of Columbia Heights, and
WHEREAS, the City of Columbia Heights has studied the possibility of
using properties described herein as a possible site for a public safety
building, a rifle range, and other municipal services, and
WHEREAS, Anoka County has had certain properties forfeited to it, and

WHEREAS, it is the desire of the City of Columbia Heights that said
City apply to the Anoka County Board of Commissioners for the acquisition
of the said property, and
WHEREAS, the foregoing property would be used for public purposes,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLUMBIA
HEIGHTS:
1. That the City of Columbia Heights acquire the following described

That the Mayor and City Manager be and herein are authorized
to enter into an application to make such acquisition.
3. That the cost of said acquisition be paid from its proper fund.
COMMUNITY DEVELOPMENT APPLICATIONS
Mayor Nawrocki reported that the Metropolitan Council will have a meeting
explaining the process of evaluation on the community development
fund applications. Mayor Nawrocki informed the Council
that Columbia Heights is now third on the list for funds and unless
HUD should redo the criteria for funding, the City should receive
funds. Mayor Nawrocki listed the projects included for Columbia
Heights as follows:
1. Rehabilitation of existing housing
2. Rehabilitating of existing commercial structures and parking improvements
3. Facilitation of handicap facilities
4. The purchase of a bus to provide transportation for senior citizens
PURCHASE OF CITY PROPERTY ON RESERVOIR BOULEVARD
Mr. Watson reported on a proposal from Mr. David McNeil for the purchase
of city owned property on the corner of 39th Avenue and Reservoir
Boulevard. A brief discussion was held on the city need for this
property, and Mr. Watson explained that there are no utilities herein
as all are in the existing right-of-way. He recommended that this be
sold to Mr. McNeil to enlarge his property (Terbay's grocery).
One lady present expressed concern that this triangle of land should
be cut off to make a "square turn" on the corner rather than the
triangular piece of land. Discussion was held and
the costs for relocating the street and utilities were pointed out as being
rather high. Motion by Land, Seconded by Heintz to authorize the
City Manager to proceed with the preparation of the necessary ordinance
for the sale of this land to Mr. McNeil. Roll Call: All Ayes
SUBDIVISION REQUEST-DALE ECKMAN-1033-42nd Avenue
Motion by Land, Seconded by Norberg to approve the subdivision request
of Dale Eckman, 1033-42nd Avenue, creating three parcels with the
following legal descriptions:
1. W. 55 ft. of North 165 ft. of Lot 39 (Subj. to road and utility
easement over N. 30')
2. North 165 ft. of Lot 39 (Ex. W. 55') (Subj. to road and utility
easement over N. 30')
3. Lot 39 (Except North 165 ft.) (Ex. S. 5')
all in Block 3, Reservoir Hills Roll Call: All Ayes
Mr. Watson pointed out that there are no outstanding special assessments
against this property.

LIST OF ELECTION JUDGES
Motion by Land, Seconded by Norberg to approve the list of election
judges for the Primary and General Election, October 14 and November 4,
1975. Roll Call: All Ayes (list made a part of the attachments
to the minutes hereto.)
RECESS called at 9:30 p.m.
LETTER OF RESIGNATION FROM FIRE CHIEF, FRAN BASSETT
Mr. Watson reported that a letter of resignation was received from
Fire Chief, Fran Bassett, announcing his plans to retire as of January
31, 1976. Motion by Logacz, Seconded by Heintz to accept with the
regret the resignation of the Fire Chief, effective January 31, 1976,
and that his letter be placed on file. Roll Call: AIl Ayes
At this time Mayor Nawrocki noted the passing of the Police Chief,
Merle Glader, due to a heart attack, on the preceding Saturday,
September 20. Mayor Nawrocki reported that he has appointed
Sgts. Lohse and Hedblad to take over the duties of police chief
until the Police and Fire Civil Service Commission can appoint
a new one.
A w~ry brief discussion was held on the future possibility
of reorganizing the police and fire departments under one public
safety director. It was pointed out that this should be discussed
at another time, and not this evening. Ken Hentges, a member of the
Charter Commission, stated that this would demand a charter change
by referendum vote. He stated that the Charter Commission was meeting
on Wednesday evening, September 24, and this may be discussed at
this time.
Mayor Nawrocki also noted, in relation to the Charter Commission,
that Lynette Thomson had resigned from that commission.
REMOVAL OF OLD WATER STANDPIPE
Report was made on three informal bids received as follows for the removal
of the old water standpipe: Alttech Engineerin9 $ 4,720

Recommendation was made to award the bid to the low bidder, A]ltech
Engineering. Breif discussion was held on the bids and when the tank

low bidder, Alltech Engineering, in the amount of $4,720 and the
Mayor and City Manager to enter into a contract for same with the
contract to include a performance bond and certificate of insurance

Mayor Nawrocki asked to be notified when the old tank is to be taken
down as he would like to see what the existing metal looks like.
Motion by Heintz, Seconded by Norberg to authorize the acceptance
of the deduct in the contract with Chicago Bridge and Iron for the
removal of the old water standpipe in the amount of $10,000.

The City Engineer also asked for authorization to negotiate the
elimination of the tower site restoration from the Chicago Bridge
and Iron contract for a credit or deduct of approximately $2,000
and issue a change order to accomplish the same. The Council indicated
that this contract change with regard to site restoration should be
handled directly by the City Engineer, since it is a deduct request.
PROCLAMATION DECLARING MARATHON DAY FOR IMMACULATE CONCEPTION SCHOOL
Mayor Nawrocki read the following proclamation:
WHEREAS, the Immaculate Conception School in the City of Columbia
Heights is sponsoring a Marathon as a special demonstration in support
of Immaculate Conception School on Saturday, October ll from 10:O0 a.m.
to 2:00 p.m. and
WHEREAS, the school has provided our community with an institution
of learning for many of our citizens, and
WHEREAS, this private school has been a help to all the taxpayers
by reducing the need for additional school facilities, particularly
during the years of rapid expansion in our City, and
WHEREAS, the purpose of this Marathon is to help raise funds to support
this school and all its worthwhile activities,
NOW, THEREFORE, I, Bruce G. Nawrocki, Mayor of the City of Columbia
Heights, do hereby proclaim Saturday, October Il, as "Marathon Day"
and urge all of our citizens to support the people who will be walking,
biking, jogging, or running on the ten mile route by pledging a certain
amount of money per mile to the various students who will be distributing
pledge cards throughout the community. These pledge cards may also
be obtained by calling the school office at 788-8119.
RABIES VACCINATION CLINIC
Mr. Watson reported that Dr. Art Johnson, 5100 Central Avenue, will
schedule a special rabies vaccination clinic October 6-10, between the
hours of 9:00 a.m. and 12:00, and 3:00 p.m. and 6:00 p.m. plus
Wednesday evening from 7:00 to lO:O0, and Saturday morning, 9:00 - 12:00.
The regular price is $7.50 and the special price will be $4.00.

LEASE AGREEMEI~T-ARTISTIC SCREENING-CITY PROPERTY-3755 California Street
Mayor Nawrocki at this time brought up the fact that the lease for
extension of the lease to Artistic Screening has been prepared and
came tohim for signature without any discussion on it on the part of the
City Council. Mr. Watson explained that their present lease
allows for a two year extension, and this lease represented that option.
Councilman Heintz questioned whether Acorn Vending, the other tenant
at 3755 California Street, were going to renew their lease, and
Mr. Watson stated that they were not, and the City will have to
advertise for a new leasee. At this point the discussion turned
to the possible sate of this property. The contract under consideration
for Artistic Screening would commit the City to that tenant for another
four years (two years initial lease and two year optional renewal)
and Councilman Heintz pointed out that this might be undesirable if
the City should want to sell the building.
Discussion held on a possible alternative to the two year lease with
another two year extension. Councilman Heintz asked that the city give
them an indefinite time extension, with the promise of ample time
to be given for them to move if the city should decide to sell the land.
The City Attorney pointed out that the city is not committed to
giving any certain length of time to Artistic Screening since they
did not make known their wish to renew the lease until after the date
set for that purpose.
The Mayor asked each councilman what they felt about the property.
Mr. Heintz indicated that he wishes to sell. Councilman Logacz said
that it would be desirable to sell if a good offer comes along.
Councilman Land indicated the sale of the land if it can be sold to
the 'lright person~'. Discussion held on how much time would be needed
by Artistic Screening to find another place, etc. if the city should
decide to sell. Mr. Hentges was present and expressed his feelings
that from personal experience ninety days is not enough time, but
rather something along six months to a year would be more practical.
Motion by Norberg, Seconded by Heintz to authorize the Mayor and City
Manager to enter into a month to month tenancy leasehold arrangement
with Artistic Screening with a 180 days notice provision to vacate premises,
at a rental of $290.00 per month. Roll Call: Logacz, Helntz, Norberg,

LICENSES
Motion by Heintz, Seconded by Norberg to approve the licenses as
listed upon payment of proper fees. Roll Call: All Ayes
OLD BUSINESS
Councilman Norberg mentioned the possibility of discussing "bumps" in
streets. The rest of the Council indicated that this would better
be discussed informally first by the Council sometime in the future.

Councilman Norberg reported, under New Business, that one city in
North Dakota has an ordinance against exhibition driving and this
is something worth looking into as a control of speed. It was pointed
out that this is similar to the unlawful acceleration laws the city has.
Mr. Ken Hentges stated that this month, the 4th Wednesday at noon,
The Chamber of Commerce meeting will have a speaker in defense
of municipal liquor, and that the next month would have a speaker on
the pros of split liquor.
CLEVELAND STREET, 39th to 40th
Brief discussion on the conditions of the work done on this street
regarding the thickness of the asphalt and certain weaknesses in the
street. The City Engineer reported on what was being done in relation
thereto. He stated that the only weaknesses are near the gutter line,
but that the center of the street is hard.
JACKSON POND CLEANING
Mayor Nawrocki asked what the progress is on cleaning tires, grocery
carts, debris, etc. out of Jackson Pond, when it will be dredged,
and the weed growth on the banks of the pond, when they will be taken
care of. Mr. Watson stated that this was referred to the Park Dept.
TREE TRIMMING
Mayor Nawrocki asked when tree trimming will be done on Reservoir
Boulevard, pointing out that one man felt that the last work that was
done was not done as it should have been. Mr. Brown reported that this
would be done as normal winter work. Mayor Nawrocki asked for a report
on tree trimming plans for the year.
CITY MANAGER REPORTS
Mr. Watson reminded the Council of the public hearing onthe 1976
Budget scheduled for Thursday, September 25 at 8:00 p.m.
Councilman Heintz reported briefly on the fact that the Park Board is
interested in a tree planting program to replace trees as they are
removed due to disease, etc.
BACK WATER VALVE INSTALLATIONS
Mr. Brown reported that ll back water valves have been installed,
there are two left to do, one who had previously indicated they wanted
it has decided not to and one will do it himself.

Mr. Brown also reported that there would be three quotes available
by October 6 on a noise meter.
Mr. Brown reported that the sealcoating would be finished the day
following the Council meeting, Tuesday, September 23, with the sweeping
to start immediately thereafter.
