October 28, 1974 Mayor Nawrocki pointed out one of Mr. Gustafson's reports whi¢:h stated that the crosswalks have been painted and the pedestrian signs have been installed on 44th Avenue. A contractor who is doing painting for the County will be coming into Columbia Heights to stripe 44th Avenue when he is in this area. Mr. Gustafson also presented a lengthy report regarding alley conditions and the retaining wall in the alley north of 45th Avenue between Fillmore and Taylor Street. This had been requested by Councilman Heintz. Mr. Gustafson indicated that he will be scheduling an informal meeting with property owners along this alley to determine what should be done. Councilman Norberg questioned about the progress regarding the removal of the old house at 578 - 38th Avenue. Mr. Watson reported that it is nearly settled and informal bids for this removal will be taken shortly. Motion by Heintz, Second by Norberg to adjourn at lO:15 p.m. All Ayes BrLf~e G- -I~a'wrocki, Mayor Se c r eta rye4~ ro- tem OFFICIAL PROCEEDINGS REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 12, 1974 Meeting was called to order at 8:08 p.m. Roll Call Norberg, Land, Nawrocki - present Logacz, Heintz, Motion by Norberg, Second by Heintz to name Margo Emerson Secretary Pro-tem for the meeting. Roll Call-All Ayes Invocation was given by Rev. Shoemaker, Community United Methodist Church. MINUTES OF LAST MEETING Mayor Nawrocki asked for clarification on what had been said at the last meeting regarding whether space would be available for mounting the City antenna on the new water tower. Mr. Brown indicated that there would be. He explained that there is an access through the center of the tower. He stated that the City antenna would be the only one possible to be placed on the new water tower. Mayor Nawrocki questioned whether the specifications are made up yet. Mr. Brown stated that they were, but not yet typed. Mayor November 12, 1974 Nawrocki questioned whether there was provision in the specifications for an antenna tower He was reminded that Mr. Gustafson had stated at the last council meeting that this was not necessary, and that he would not want to have it put in the specifications. The use would be possible without specifying it. Motion by Heintz, Second by Land that the minutes of the last council meeting be approved as presented in writing and the reading be dispensed with. Roll Call-All Ayes PAYMENT OF BILLS City Manager, Malcolm Watson, stated that there was an additional bill which the City Clerk would like to have approved. This was for payment of salaries of the election judges from the last election. Motion by Norberg, Second by Heintz that the bills as listed, including $3,591.37 for salaries for the election judges, be paid out of their proper funds. Roll Call-All Ayes Councilman Norberg questioned the City Manager as to whether the City always suppl les the needed safety equipment, such as safety shoes as was listed on the bills. Westlund 1,330.05 64.22 665,422.25 At this point Councilman Logacz introduced Rick Reynolds and Jim Romanowski. These are two boys who have taken it upon themselves to "keep watch" over LaBeile Park. Councilman Logacz stated that in the past he has indicated his concern over the fact that there is so much vandal ism taking place in LaBelle Park. Following publication of these feelings, Rick Reynolds and Jim Romanowski began spending a great deal of time after school in LaBelle Park, and since that time, there has been less vandalism and littering. Mr. Logacz commended the boys for their contribution to the City. The rest of the Council also expressed their appreciation to the two. RESOLUTION #74-51 ESTABLISHING LICENSE FEES FOR 1975 A brief discussion was held on the fee schedule. Resolution #74-51 offered by Heintz, Second by Logacz Roll Call-All Ayes BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that the following list of license fees (as per attached list) be set for 1975. (I ist of fees attached to minutes hereto) TRAFFIC COMMISSION RECOMMENDATION A brief discussion was held regarding a request from Minneapolis Electric Steel Castings for two Hour Parking signs. Mr. Brown reported on the action taken by the Traffic Commission. They recommended these signs on 5th Street, but delayed action on p]aclng them on Lookout P]ace. Mayor Nawrocki indicated that he would hope that Minneapolis Electric Steel would notify their employees that the police wi]] be more strict on the parking limits on these streets, and encourage them to park in the emp]oyee parking lot. Mr. Vern Johnson was present from Minneapolis Electric Steel and agreed to post notice for the emp]oyees. Motion by Heintz, Second by Norberg that "Two Hour Parking" signs be p]aced on 5th Street between Lookout Place and 38th Avenue as recommended by the Traffic Commission. Roll Call-All Ayes CONDITIONAL USE PERMIT DUNKIN DONUT 5001 CENTRAL AVENUE A lengthy discussion was held regarding the proposed Dunkin Donut Shop at 5OO1 Central Avenue. Councilman Norberg, in particular, expressed his concerns as to what access would be available to the properties to the north of this property. Discussion centered around this proposal in relation to the Central Avenue urbanization p]ans. A representative from Dunkin Donut was present and discussed their operations. He had pictures with him of the Dunkin Donut stores. Mayor Nawrocki questioned whether the City would be required to grant this conditional use permit. Attorney Kalina stated that the Council would be so required unless they could find that this proposal would be detrimenta] to the health, safety or welfare of the community. A discussion Noye~o~e? 12~ 1974 was held on the development of Central Avenue in a "piece meal" fashion. The Council generally agreed that this was not desired. Following further discussion, motion by Land, Second by Logacz to grant the conditional use permit to Dunkin Donut, 5001 Central Avenue, based on the recommendatlon of the Planning and Zoning Commission. Roll Call-Logacz, Helntz, Land, Nawrocki -Ayes Norberg-Nay SIDE YARD VARIANCE - MINNEAPOLIS ELECTRIC STEEL CASTINGS Mr. Vernon Johnson, Minneapolis Electric Steel Castings, explained their plans for expansion of their building. A brief discussion was held. Motion by Heintz, Second by Land to grant request for a side yard waiver to Minneapolis Electric Steel Castings as recommended by the Planning and Zoning Commission. All Ayes a RECESS was called at 9:10 p.m. Meeting reconvened at 9:35 p.m. SUBURBAN RATE AUTHORITY - ORDINANCE #828 A discussion was held on the proposed joint powers agreement for' the Suburban Rate Authority, and their relation to rates of the power company. A first reading was held on Ordinance #828 Relating to Northern States Power Company operations within the City. Motion by Norberg, Second by Heintz that the City of Columbia Heights join in the joint powers agreement with the Suburban Rate Authority. All Ayes Along the same lines, Mayor Nawrocki at this time informed the Council of a meeting to be held on Saturday, November 23 at 10:00 A.M. at the St. Paul Hotel. This meeting is for the purpose of discussing the advantages and disadvantages of the different approaches to utility rate regulations related to the Suburban Rate AuthoMity. Mayor Nawrocki discussed a letter from the League of Minn. Municipalities to all cities served by N.S.P. listing three possibilities to approaching an N.S.P. rate increase. These are: 1. Do nothing 2. Affected cities act individually and present written or oral testimony before the Public Service Commision. 3. Cities join rogether in an effort and offer testimony on behalf of every City served by N.S.P. Mayor Nawrocki further informed the Council that this rate increase by Northern States Power Company will be the first rate filing handled by the Public Service Commission. He also stated that he would be chairing the joint meeting of the municipalities regarding this filing on Nov. 23. Mayor Nawrocki encouraged the Council to attend this meeting. METRO DISTRICT WATER SCHOOL City Manager Watson discussed a request by the Sewer and Water Superintendent to send some of the men in his department to a Metro District Water School, on November 21, 1974. Mr. Watson indicated that the cc. st is $2.50 for registration, $5.00 for the examination at the end of the day, plus meals and transportation. He discussed the topics which would be discussed at the school. Motion by Heintz, Second by Land to authorize three people from the Water Department to attend the Metro District Water School on Nov. 21, 1974 at an approximate cost of $10.00 per person. Roll Call-All Ayes November 12, 1974 BOOM TRUCK Mr. Watson discussed plans for purchasing a boom truck. He explained that it would have a fifty foot reach and therefore would be adequate for any needs the City would have for reaching the tops of trees. He discussed the need for this truck. Motion by Heintz, Second by Land to authorize the City Manager to advertise for bids for a boom truck to be opened on November 25 at 2:00 p.m. with a report to the City Council at the regular meeting that evening. Roll Call-All Ayes Councilman Norberg asked that Mr. Watson have a breakdown on the number of trees on City property throughout the City, and the number of those trees which are 50 feet tall. HEARING DATE FOR CENTRAL AVENUE URBANIZATION Motion by Heintz, Second by Logacz that the hearing date for the Central Avenue Urbanization be set for Monday, January 6, 1975 at 8:00 p.m. Roll Call-Logacz, Heintz, Land, Nawrocki -Ayes Norberg Nay PURCHASE OF ROCK SALT Mr. Watson discussed purchasing rock salt for winter use. Motion by Heintz, Second by Logacz to authorize the City Manager to purchase up to 80 tons of rock salt at a cost not to exceed $I1.50 per ton. Roll Call-All ayes PROCLAMATION - MILLIE KORDIAK DAY Mayor Nawrocki read the following proclamation: "WHEREAS, Millie Kordiak through love, devotion, and dedicated effort has provided Albert Kordiak with a cheerful, relaxing home life that has enabled him to concentrate so much time and effort in the service of his community, and WHEREAS, Albert Kordiak has served the citizens of our community these past many years, devoting time and effort far beyond the call of duty, and WHEREAS, such dedicated effort would not have been possible without the equally dedicated effort of a loving and understanding wife to back him up. NOW, THEREFORE, I, Bruce G. Nawrocki, Mayor of the City of Columbia Heights, do hereby proclaim Friday, November 8, ]974 as: "MILLIE KORDIAK DAY" and on behalf of the citizens of our community who are so ably served by Commissioner Albert Kordiak, do hereby express our heartfelt appreciation to Mil]ie Kordiak for her efforts in the support of her husband. November 12, 1974 LETTER FROM SISTER AVITA Mayor Nawrocki related to the City Council the receipt of a letter from Sister Avita from Immaculate Conception School thanking the City Council for their help in the Marathon Day activities. POLICE AND FIRE RESCUE RESERVE DINNER Mayor Nawrocki asked for the Council approval to take the Poi ice and Fire Rescue Reserve to the Chanhasen Dinner Theater. He indicated that it appeared that this would be held on December 6 at an approximate cost of $1200. Motion by Norberg, Second by Heintz to grant request to take the Police and Fire Reserve members to the Chanhasen at an approximate cost of $1200. Roll Call-All Ayes OPEN MEETING LAW Mayor Nawrocki asked that a formal procedure be set up for notifying the public of any meetings, informal or formal, held by the City Council to comply wi ~n the State Open Meeting Law. Motion by Norberg, Second by Heintz that the following procedure be adopted as the formal procedure to be followed for notification of any formal or informal meetings held by the City Council: 1. Posting on a public bulletin board outside the Municipal Building 2. The switchboard operator will be notified of this meeting so that any individual calling and asking when the Council will be meeting can be so informed. 3. Notify the newspaper who normally covers meetings of the City Council, and a record be kept of such phone call to the newspaper office. Roll Call-All Ayes LICENSES Motion by Heintz, Second by Norberg that the licenses as listed be granted upon payment of proper fees. Roll Call-All Ayes OLD BUSINESS Councilman Norberg asked about the old Lively House on 38th Avenue. Mr. Watson informed him that as of Friday, November 15 the court action for removal of the house becomes effective, and that informal bids for tearing the house down are being taken. NEW BUSINESS Mayor Nawrocki informed the Council of a letter from the Insurance Service of Minnesota informing the City that on Fire Service the rating had been changed from //6 to #5. Mayor Nawrocki indicated that this signifies that our fire service is improving. He stated that this will not mean any great change in insurance rates. November 12, 1974 Mayor Nawrocki also told the Council that he had received a letter from Bank Shares, Incorporated, informing him that they were seeking alternate financing for the new bank building and would not be asking further for the issuance of industrial revenue bonds by the City. NINE MONTHS LIQUOR REPORT Councilman Norberg questioned Mr. Watson on certain items on the nine months report on the liquor stores from City Treasurer, John Sched]er. Mr. Watson indicated that this would have to be discussed with Mr. Schedler some time when he is available. CITY MANAGER REPORTS Mr. Watson informed the Council of a proposal to be received for the purchase of 3801 California Street by RonIs Ice House. He indicated that he hoped to receive this proposal in the near future. He also told the Council that informal bids were being received on the repair of the building. MEETING DATES Mr. Watson reported that the following meetings were scheduled for the next week: Thursday, November 14 at 7:00 p.m. to discuss items to be discussed with Hilltop Village Council. Monday, November 18 at 7:00 a meeting with the Hilltop Village Council on proposed interconnection to the Columbia Heights water system. Informal meeting on Tuesday, November 19, at 8:00 p.m. Councilman Norberg asked that a meeting be set up with the Library Board. A brief discussion was held on when such a meeting might be held and it was decided that this matter be delayed until a later meeting sometime in December. PUBLIC HEARING ON SPECIAL ASSESSMENTS Mr. Watson reminded the Council that the public hearing on the projects to be assessed this year is scheduled for November 25 at 7:00 p.m. PROGRAM ON COMMUNICATION SKILLS Mr. Watson discussed plans of the Labor Relations Associates to hold a training session development and improvement of communication skills. He proposed that Sgt. Jendro and Sgt. Marchiniak along with Mayor Nawrocki, Mr. Watson, Earl Gustafson, and Tim Yantos attend this session. He discussed the costs involved and informed the Council that the actual plans have not yet been completed. Councilman Norberg discussed the costs November 12, 1974 and related them to those of schools and training sessions which he is familiar with, and informecl the Council that he felt the fees being asked were entirely too high. Motion by Norberg to deny request died for lack of a second. Motion by Norberg to table matter until further information is available also dies for lack of a second. Motion by Heintz, Second by Land to grant request for six people to attend training session on communication skills sponsored through the Wilson Training Institute and the Labor Relations Associates at a total of $1200. Roll Call-.Logacz, Heintz, Land, Nawrocki-AYE Norberg - Nay CITY ATTORNEY REPORTS Mr. Kallna asked when the Council would be interested in meeting on the recodification. He was told that they could discuss this following the meeting scheduled on Thursday on the Hilltop water system, and also following a DFL meeting also scheduled for that evening. Mr. Kal ina reported on the various court cases which the City is involved in. SUIT AGAINST RECREATION COMMISSION DISCRIMINATION Mr. Kalina reported on a hearing scheduled with the State Human Rights Commission on the charge of discrimination against girls in the hockey program of the Columbia Heights Recreation Commission. He indicated that an extended hearing has been requested and would probably be granted. A discussion was held on the Council's views as to how the Recreation Commission should proceed. Councilman Heintz indicated that the Commission follows a separate, but equal, policy between girls and boys when it involves contact sports such as football and hockey, and that this is what the State Human Rights Commission is challenging. Motion by Norberg, Second by Heintz that the City Council supports the Recreation Commission in its defense of its policy being challenged by the State Human Rights Commission. Roll Call-Logacz, Heintz, Norberg, Land - Ayes Nawrocki- abstained. PUBLIC WORKS DIRECTOR REPORTS Mr. Gustafson was not present at this meeting, but City Engineer, George Brown, was present in his place. Mr. Brown presen, ted a few reports in writing. A question was raised on mention of a new car for the meter reader relating to use such a car would receive, and further information was requested.
