REGULAR MEETING OF THE CITY COUNCIL
OCTOBER 28, 1974
Meeting was called to order at 8:26 p.m. Roll Call: Logacz, Norberg,
Land, Nawrocki - present Heintz-absent Councilman Heintz was at a
Scout meeting with his son and arrived at 9:00.
Motion by Norberg, Second by Logacz to name Margo Emerson Secretary
Pro-rem for the meeting. Roll Call - All Ayes

Motion by Land, Second by Logacz to approve the minutes of the last
meeting as presented in writing and the reading be dispensed with.

BIDS ON TELEVISION SYSTEM
A report was received and recommendation given from the Public Works
Director, Earl Gustafson, on the award of bid on the television system for
the sewer lines. A brief discussion was held regarding these bids.
Councilman Norberg was concerned about the comparison of cost of renting
vs. purchasing the equipment. Mr. Gustafson elaborated on the costs
involved. Sewer and ~/ater Superintendent, Donald Jolly, also discussed
the costs as well as the actual use of the equipment. Mayor Nawrocki
questioned how the quality of the equipment bid by the various companies
compared. Donald Jolly responded that the equipment of the low bidder is as
substantial as that of the high bidder. He further informed the Council that
he personally knew the equipment of the various companies, and that the low
bidder is responsible. Mayor Nawrocki further questioned about Cues, Inc.,
a company in Florida, who had received the invitation to bid after the bid
opening had been held. Mr. Watson explained that the Post Office is still
investigating the cause of the delayed mail delivery in this case.
He pointed out that Cues had been aware of the bid opening and could have
contacted the City prior to the opening. Mr. Gustafson further stated that

Cues, Inc. does not have a local supplier. Mr. Watson discussed communications
wi th the company.
Mayor Nawrocki questioned how much had been budgeted for this equipment,
and was told that $12,000 had been budgeted. Councilman Norberg was
concerned as to what the warranty on the equipment consisted of. Mr.
Gustafson pointed out that it includes parts and labor, but does not include
the rental for a loaner piece of equipment while the City's would be
in being repaired. Motion by Logacz, Second by Land that the Mayor and City
Manager be authorized to enter into an agreement with W.G. Jaques Company
for the purchase of television equipment with electronic footage readout,
video tape recorder with reel to reel recorder, and video tape telvision
monitor for a total of $12,956.44 in accordance with the low bid.

CHAMBER OF COMMERCE CHRISTMAS LIGHTING
Mr. Watson reported on the plans of the Chamber of Commerce to ~put up a
25 foot artificial tree in the Mini Park and have pin lites on the evergreens
in the park in lieu of lighting along the street as has been do,ne in the past.
Their request from the City was that $200 be contributed toward the lighting,
and payment of the electric bill for the lighting display, as was done in
past years. Motion by Land, Second byLogacz to grant request. Roll Call-
All Ayes The money is to come out of the municipal liquor operations.
Councilman Norberg pointed out that he considers this to be a good idea,
and suggested that something be done in the lighting display in the Mini
Park to point out that it is for the City. Mr. Watson informed Councilman
Norberg that he would inform the Chamber that the Council is interested
in having the City identified in some way.
FAIR LABOR STANDARDS ACT
Mr. Watson reported on the League of Minnesota Municipalities arid the National League
of Cities request for City contributions toward a lawsuit protesting application
of the Fair Labor Act to State and Local government. Motion by Norberg seconded
by Land that the City contribute $100 toward this suit, and the City Manager be
authorized to remit same. Roll call, all ayes.
MINNESOTA CITY MANAGEMENT ASSOCIATION TRAINING SESSION
Motion by Land second by Norberg to authorize the City Manager to attend the
Minnesota City Management Association training session at Spring Hill Conference
Center on November 21 and 22 at a cost not to exceed $50.00. Roll call, all ayes.
Mr. Watson indicated that the school and conference section of 'the City Manager
budget has no funds available, but that there is extra in the miscellaneous section
and in the salary section, and the funds for this training session would come from
the miscellaneous.
CRIME PREVENTION TRAINING COURSES
Mayor Nawrocki explained these courses as part of the Minnesota Crime Watch project.
He explained that Sgt. Jendro attended the basic course the previous year and now
would attend the advanced course. Officer Downey would attend the basic course this
year. The only cost would include meals and travel. Motion by Norberg second by
Land to grant request for Sgt. Jendro to attend the Advance Training Course November
I1 through 15, and Officer Downey to attend the Basic Course November 4 through 9.
Roll call, all ayes. Councilman Norberg suggested that the two men put together an
article for the next Newsletter regarding these two courses.

ENVIRONMENTAL ASSESSMENTS AND DESIGN SEMINAR
This request was received from the Engineering Department for attendance to a
two-day seminar. Mr. Watson discussed the seminar. He explained that this
seminar would be attended in lieu of a workshop on street and traffic control
and two bituminous conferences. Notion by Norberg, second by Logacz to 9rant
request and expenses be authorized for one man to attend the seminar on November
25 and 26 for $50, and one man to attend for one day on November 26 for $30.

SUBURBAN RATE AUTHORITY
Councilman Norberg reported on the activities of the Suburban Rate Authority.
He discussed a report from the executive committee and recommendations made by
them. This report included the possible reorganization of the Suburban Rate
Authority. Councilman Norberg discussed the possibility of the Authority ex-
tending their activities into power regulation, stating that the municipalities
should have input into this area. He indicated that a request will be forthcoming
to enter into a new joint powers agreement, and that he requested the support of
the council in this agreement. Mayor Nawrocki further elaborated on the activi-
ties of the Suburban Rate Authority. Motion by Norberg second by Logacz to indi-
cate that the City Council of the City of Columbia Heights expresses its support
of the recommendations of the Suburban Rate Authority executive committee. Roll
call, all ayes.
Mayor Nawrocki requested Mr. Watson to send a letter indicating this action by
the Council .
CABINETS IN LIBRARY BASEMENT
Informal proposals had been received, and the Library Board recommended that
Cabinet Shop Inc. be contracted to install cabinets in the library. Motion by
Norberg second by Land that the Mayor and City Manager be authorized to enter into
agreement with Tom Fel]egy, Cabinet Shop Inc., to install /~8 feet of cabinet and
counters in the library basement at a total cost of $l,330, and for locks for the
cabinets at a cost of $75 based on low informal bid. Roll call, all ayes.
CARPET IN LIQUOR STORE
Mr. Watson reported on informal quotations received for carpeting in the municipal
on-sale store. The carpeting would include the lounge area, main bar, rear entry,
and front stair. The quotation includes labor, complete installation, and the
metal stripping needed. He further indicated that the actual color and pattern
of the carpet was yet to be decided. Motion by Heintz second by Logacz that the
Mayor and City Manager be authorized to enter into agreement with Carpet by Roberts
Company for carpeting in the on-sale liquor store at a total cost of $2,845.67
based on iow informal quotation. Roll call, all ayes.
Councilman Norberg questioned where the funds are to come from for this carpeting.
Mr. Watson indicated that the revenues of the liquor stores are over what was
anticipated~ and are available for such purchases.
MUNICIPAL SERVICE CENTER IMPROVEMENTS
A bid opening date had been set for November 1/~ for Municipal Service Center improve-
ments, and Mr. Gustafson asked for it to be changed to allow a longer time for
reviewal of the plans. Motion by Norberg secon by Heintz that the bid opening
be re-set for November 19, 1974 at 2:00 P.M. for improvements on the Municipal
Service Center. Roll call - All ayes.

BIDS ON WATER TOWER
A brief discussion was held on the date of opening bids for the new water
tower. Mayor Nawrocki asked what color had been decided upon for the tower,
and Mr. Watson indicated that it would be a winter blue. The Council was in
agreement that there would be no wording on the tower. Mayor' Nawrocki also
asked about antennas on the new tower. Mr. Watson and Mr. Gustafson discussed
the fact that it would not be possible for antennas to be placed on the new tower
other than for municipal purposes. They informed the Council that this pro-
vision was not necessary in the specifications. Motion by Norberg second by Land
that the bid opening on the new water tower be set for Tuesday December 10 at
2:00 P.M. Roll call, all ayes.
TRANSFER OF BEER LICENSE AT 4010 CENTRAL AVENUE
A brief discussion was held on the request for a transfer of the beer
license at 4010 Central from Robert Mclntyre to Eugene Shelton. Mayor
Nawrocki informed Mr. Shelton, and his partner, James Sannes, that the
City Council is "tough on license violations." Mayor Nawrocki indicated
that he wanted the two men to know that the Council would not hesitate
to revoke or suspend the license if laws are violated. Motion by Logacz,
Second by Heintz that the beer license at 4010 Central Avenue be transferred
to Eugene Shelton Roll Call -All Ayes
REQUEST FOR WAIVER OF SOLICITOR'S FEE FOR DISCIPLESHIP TRAINING INSTITUTE
Mr. Watson discussed this application for a solicitor's license. He
informed the Council that the Better Business Bureau had no record of
this Training Institute, known also as the Agape Force. He also
discussed his attempts to find out more about them by contacting the
Minnesota Charity Review Council who had stated that the Agape Force
had never responded to inquiries from the Charity Review Council, and
also his discussion with the Charitable Registration of the Department
of Commerce who also have been unable to get response from the Agape
Force. Mr. Watson stated that the Agape Force has an address in
Sebastopol, California and that he has written the San Francisco Better
Business Bureau asking for more information on this group.
Mr. Robert LeRoy Duran was present from the Agape Force and explained
its activities which are to help drug addicts and other people in need
of counseling. He further explained that the solicting would be
to seek funds for their cause. Motion by Heintz, Second Logacz to
grant request for solicitor's license and waiver of fee to the Agape
Force subject to confirmation from the Minnesota Charitable Registrmtion
of the Department of Commerce and the Minnesota Charity Review Council
as to their existence as a charitable organization. Roll Call- All Ayes
OTHER LICENSES
Motion by Norberg, Second by Heintz that the other licenses as listed
be granted upon payment of proper fees. Roll Call - All Ayes
PETITION OPPOSING NOISE FROM TRUCK TRAFFIC NEAR 43rd Avenue to 45th Avenue
from Main to University
Councilman Land presented a petition signed by 62 property owners in
the area. Motion by Land, SEcond by Norberg that the petition
be accepted and placed on file. Mr. Watson discussed previous
communications with a resident from that area, and brought out a copy

of a letter to that resident regarding communications with Burlington-Northern
which indicated that the problem should be taken care of by November 1.
Motion by Land, Second by Heintz that this item be placed on the traffic
commission agenda for the meeting November 4. Roll Call-All Ayes
Councilman Land noted that the traffic commission meeting would be the following
Monday, and indicated that this may not be enough time to gather ample information.
He indicated that the people having signed the ptition should be made aware
of the fact that it would be discussed at the Traffic Commission meeting.
He further noted that Burlington-Northern would probably have to respond to
inquiries of the people, as well as the Police Department.
A recess was called at 9:45 p.m. Meeting Reconvened at 9:55 p.m.
CITY MANAGER REPORTS
Mr. Watson requested authorization to make a single purchase of $1,467.46
for maintenance parts from Paper, Calmenson, explaining that these parts include
steel blades, runners, etc for the winter season. These items are supplied
exclusively by Paper, Calmenson. Motion by Norberg, Second by Heintz to
authorize the City Manager to purchase maintenance parts from Paper, Calmenson
in the amount of $1,467.46 in view of the fact that these are proprietary
items and are not subject to competitive bidding. Roll Call All Ayes
STREET OPENING 42nd AVENUE AND CLEVELAND STREET
Mr. Watson and Mr. Gustafson briefly reported on action taken on a petition
received requesting the opening of the street at the above location.
Mr. Gustafson presented a written report stating that one individual has indicated
a desire to acquire all available interior ]and by options. He indicated
that this request should be delayed pending the acquisition of some of the land
and thus creating fewer ]and owners to be affected,
CITY ATTORNEY REPORTS
Mr. Kalina requested that an informal meeting be set up with the Council and
himself regarding the ordinance recodification. A meeting was set up for
Monday, November 4 at 7:00 p.m.
PUBLIC WORKS DIRECTOR REPORTS
Mr. Gustafson presented several reports in writing, which were noted at this
time. One report concerned the sidewalk condition near the Shell Oil Station,
which had been pointed out by Councilman Land at a previous Council meeting.
Mr. Gustafson stated that the repairs are the responsibility of the Minneapolis
Water Department resulting from digups made for the purpose of cement lining the
large water mains for Minneapol is. Mr. Gustafson pointed out that the unusual
sidewalk settlement that has accurred north of the temporary bituminous
patch is still being investigated.

Mayor Nawrocki pointed out one of Mr. Gustafson's reports which stated
that the crosswalks have been painted and the pedestrian signs have
been installed on 44th Avenue. A contractor who is doing paintlng
for the County will be coming into Columbia Heights to stripe 44th
Avenue when he is in this area.
Mr. Gustafson also presented a lengthy report regarding alley conditions
and the retaining wall in the alley north of 45th Avenue between Fillmore
and Taylor Street. This had been requested by Councilman Heintz.
Mr. Gustafson indicated that he will be scheduling an informa! meeting
with property owners along this alley to determine what should be
done.
Councilman Norberg questioned about the progress regarding the removal
of the old house at 578 - 38th Avenue. Mr. Watson reported that it is
nearly settled and informal bids for this removal will be taken
shortly.

MINUTES OF LAST MEETING
Mayor Nawrocki asked for clarification on what had been said at the last
meeting regarding whether space would be available for mounting the City
antenna on the new water tower. Mr. Brown indicated that there would be.
He explained that there is an access through the center of the tower.
He stated that the City antenna would be the only one possible to be placed on
the new water tower. Mayor Nawrocki questioned whether the specifications are
made up yet. Mr. Brown stated that they were, but not yet typed. Mayor
