Roll Call - All Ayes Invocation was given by Rev. Henderson, People's Church. MINUTES OF LAST MEETING Councilman Norberg noted changes to be made in statements he had made at the last meeting. Motion by Heintz, Second by Logacz to approve the minutes as presented in writing with the changes as noted by Councilman Norberg and the reading be dispensed with. Westlund Co. 2,045.03 $396,901.71 September 23, 1974 BIDS ON GARBAGE SERVICE CONTRACT City Manager Watson reported on the bid opening on Thursday, September 19, 1974 for Garbage Service in the City of Columbia Heights. Four bids had been received with the two low bids coming from Woodlake Sanitation of Hamel, Minnesota and Modern Clean-Up Services, Inc. Mr. Watson discussed the method used in comparing the bids on a three year basis, as well as a projection of a four year contract. Mr. Watson stated that Modern Clean-Up Services were low on the three year contract and recommended the award to this company. Councilman Norberg had questions on the comparison of the three year contract to the four year. Fie wanted to know what the City's responsibility was to award either a three year or a four year. Attorney Kal ina pointed out that the specifications had called for either a three year or a four year bid and the City could award to either. Mr. Watson pointed out the period of transition when changing garbage contractors and the change would not be desirable. Councilman Logacz also pointed out this fact and discussed his opinion that Modern Services, who is presently contracted with Columbia Heights, should be awarded the bid and avoid the problems of a new contractor. Representatives were present from both Modern Services and Woodlake. Motion by Logacz, Second by Land to award the bid for a three year contract for garbage and rubbish pick-up service to Modern Services and the Mayor and City Manager be authorized to enter into contract for same. Roll Call -Logacz, Heintz , Land, Nawrocki -Aye Norberg Nay (bid tabulation on garbage service made a part of the attachments to the minutes) CUSTODIAL SERVICES Motion by Heintz, Second byLand to authorize the City Manager to advertise for bids on Custodial Service for the Municipal Building, Library, and Service Center to be opened Tuesday, October 15 at the regular Council meeting. Roll Call - all Ayes POST OFFICE SITE PLAN APPROVAL Mr. Ray Frisbee was present representing the Post Office. He spoke at great length on what had transpired between the POST Office and the City of Columbia Heights in the past years relating to the choice of the site for the new POst Office facility. A lengthy discussion took place between the Council and Mr. Frisbee on whether the City had been properly made aware of the choice of sites, and whether or not the City's desires for a new location for the post office had been considered. Mr. Otterson spoke on what notification had been given during 1974 and the meetings which had been held with the Planning Commission on getting the Post Office site plans approved. A discussion was held on what choices would be available at this point relating to the new Post Office facility. Councilman NOrberg in particular pointed out that 1. either the Post Office could be relocated to another regional facility, thus ving out of Columbia Heights altogether. 2. The present facility could remain as is 3. the City could approve the plans as presented for 44th and Central. He saw no choice but to approve the plans. September 23, 1974 Councilman Logacz pointed out to Mr. Frisbee that the Council did not hold him personally responsible for the choice of sites as it was finally made, but further pointed out that there had been a ]ack of cooperation by the Post Office in notifyin9 the City of the plans. Councilman Lo9acz discussed his own knowledge of what corespondance had been received on this, and stated that he could find no proof that the City had been notified of the final decision on the part of the Post Office Department. Mayor Nawrocki pointed out the dates when the City knew of what was transpirin9 with the Post Office. The site had been selected in Au9ust, ]973, without notification to the City, and actually bou9ht in December , ]973. Hr. Watson heard from a source other than directly from the Post Office that it was true that the Post Office had acquired the ]and at 44th and Central. He sent a letter to one of the Congressman early in ]974 and received a response from the Post Office in February of ]974. Official notification to the City had not been until April ]8, ]974. Mayor Nawrocki pointed this out as proof of ]ack of cooperation from the Post Office. Further discussion followed. Councilman Norber9 expressed his opinion that this location was better than nothing at all and better than the present facility. Councilman Logacz pointed out the time spent on the part of the Planning and Zoning Commission in working out details of the plans with the Post Office and he felt that at this point they should be approved. City Hanager Watson discussed written communication with the Post Office and havin9 received confirmation that the SAC char9es on the construction would be paid. Motion by Land, Second by Norber9 that the site plan for the new post office facility at 44th and Centra] be approved as approved by the P]annin9 and Zonin9 Commission and the Traffic Commission Roll Call-All Ayes SUBDIVISION REQUEST 4646 - 6th Street Mr. and Hrs. James Hixson were present askin9 for a subdivision to make four lots on the south side of 47th Avenue between 5th and 6th Street. Motion by Heintz, Second by Norber9 to 9rant subdivision request to Mr. and Mrs. James Hixson. Roll Cai] - Ali Ayes DRAINAGE PROBLEM The Council received a letter from John D. Miller, owner of the property leased to Twins Laundry, Bob's Barber, and Galaxy Auto near 53rd and University, requesting consideration of something to be done to el iminate drainage problems behind this property. A discussion was held on what might be done. Public Works Director, Earl Gustafson, indicated that the problem would only be solved by paving the alley. A discussion was held on the desirability of paving this alley. It was pointed out that this subject had been discussed at an earlier Council meeting. Councilman Heintz pointed out another alley where consideration has been asked for in the past and no hearin9 ever set up for it located between Fillmore and Taylor Street, 45th to 46th Avenue. He stated that the people in this area apparently want thework done, but seem to be unable to 9et a hearin9 on it. The people near the alley bein9 discussed at this council meetin9, behind 53rd and University, do not want the alley pavin9 done. September 23, 1974 Councilman Heintz compared these two, and felt that no hearing should be held considering thatthe people in the area have in the past indicated they were not in favor of it. Councilman NOrberg expressed the opinion that the letter be placed on file. Counci lman Logacz expressed the desire that a hearing be held. Motion by Norberg, Second by Heintz that the improvement on the alley would not be considered at this time. Roll Call - All Ayes Mayor Nawrocki pointed out that the history of attempts to have this alley paved in the past be reviewed with Mr. Miller and he should be encouraged to approach his neighbors with a petition and get their agreement that the work should be done. HEIGHTS ALANO CLUB Mr. Hutchins from A.A. was present to discuss a request for a license to hold A.A. meetings at 3960 Central Avenue. They presently hold their meetings' at 3710 3rd Street but must find a new location. They were told they needed a license because such a club organization is not allowed under the New zoning code at this location. Attorney Kal ina reviewed the Zoning Code and found that clubs are listed as a use in that zone, and so the Heights Alano Club would not need a special license to hold their meetings. No action needed to be taken. A recess was called at 10:OO p.m. During the recess, those present reviewed architectural plans presented by Mr. Robert Diedrich on a proposal to build a new Police facility near the Municipal Service Center on 38th Avenue. Meeting reconvened at 10:30 p.m. SECOND READING ORDINANCE #827 AMENDING ZONING CODE, ORD. #818 A second reading was held on Ordinance #827 which relates to the NOISE section of the New Zoning Code. It amended it to include parts which had inadvertently been left out when the Zoning Code had been adopted. A discussion was held on the New standards of the Environmental Protection Agency. Councilman Norberg noted changes to be made in the ordinance to completely conform with the regulations outlined. Ordinance #827 offered by Norberg, Seconded by Land. Roll Call - All ayes Ordinance #827 was adopted. Mayor Nawrocki asked that a copy of the ordinance be sent to Mr. A1 Perez of the State Pollution control Agency to see how this ordinance relates to the State regulations. Councilman Norberg pointed out that Columbia Heights is the first municipality to pass an ordinance based on the state documents. ORDINANCE #828 RELATING TO UNLAWFUL CONDUCT ON SCHOOL PROPERTY School District #13 had requested consideration by the City Council of an ordinance authorizing Police surveillance of School Property. A first reading was held on Ordinance #828 relating thereto. A discussion was held on the ordinance. September 23, 1974 Councilman Logacz discussed the problems being encountered with juveniles in the LaBel le Park. He asked if there was any control over public property regarding liquor. He spoke of the fact that juveniles are making a mess of LaBelle Park and he feels that there is nothing an individual can do to force these people out of the park when they are defacing it in any way. Mayor Nawrocki asked that the City Manager discuss this problem with the Poi ice Chief and ask that a close watch be kept on the park. RESOLUTION ON FIRE DEPARTMENT CONTRACT FOR 1974 Motion by Norberg, Second by Land to table consideration of this resolution until the next regular or special meeting. Roll Call - All Ayes SCHOOLS AND CONFERENCES State Chiefs of Police Association: Motion by Norberg, Second by Heintz to grant request for Police Chief, Merle Glader, to attend the fall meeting of the Minnesota State Chiefs of Poi ice Association on October 4 at Luverne, Minnesota with the necessary expenses paid. Roll Call -All ayes Mayor Nawrocki indicated that he would want to talk to Chief Glader about this meeting prior to registration. Seminar on "Anticipating the Future in Employee Relations": Motion by Land, Second by Heintz to authorize the City Manager to attend a seminar on Anticipating the Future in Employee Relations October 17, 1974 at the Marriott Inn in Bloomington at a cost of $55 sponsored by the University of Minnesota School of Business Administration. Roll Call - All Ayes. WOrkshop on Fair Labor Standards Act: Mr. Watson asked that he and Mr. Schedler be allowed to attend this workshop. He pointed out the need to know what the Act involves in relation to who is affected by it. Mayor Nawrocki questioned the need for two people to attend. It was pointed out that the need is such that more than one person in the City should know what this law relates to directly. Motion by Norberg, Second by Logacz to grant request for two people to attend the "Workshop on Fair Labor Standards Act'l at the Thunderbird Motel, in Bloomington, on NOvember 13 at $25.00 each. Roll Call - All ayes. SCHOOL DISTRICT REQUEST ON SILVER LAKE SCHOOL SITUATION Mr. Watson discussed a meeting with representatives of the school district on a request from them for consideration of a storm drain extension and catch basin on the north side of 40th Avenue into the Silver Lake School property at the approximate cost of $600. Mr. Gustafson spoke on other solutions to the problems that the Silver Lake School has. He was directed to contact the appropriate school officials and work out a mutually satisfactory solution to the problem. September 23, 1974 NATIONAL LEAGUE OF CITIES Mayor Nawrocki asked for authorization to attend a National League of Cities convention October 11 and 12 in Chicago with expenses paid. Motion by Heintz, Second by Land to grant request. Roll Call - Ail Ayes LICENSES Motion by Heintz, Second by Norberg that the licenses as listed be approved upon payment of proper fees. Roll Call - All ayes HILLTOP Councilman NOrberg questioned whether any more action had been taken by Hilltop toward obtaining easements for the street construction on Monroe, 45th to 46th. Mr. Gustafson reported that a meeting is being set up for this purpose. CITY MANAGER REPORTS Mr. Watson reported on a meeting to be held September 30 from 9:30 a.m. to 3:00 p.m. in Anoka County regarding property taxes and assessments, for all local assessors, town board chairman and mayors. Mr. Watson encouraged attendance by any member of the Council that might be able to attend. Mr. Watson also pointed out meetings for the week. On Tuesday an informal budget session would be held at 7:00 and also on Wednesday if it were needed. The Public Hearing on the 1975 Budget is set for September 30, 1974 at 8:00 p.m. in the Council chambers. CITY ATTORNEY REPORTS Mr. Kal ina reported that hopefully one of the sections of the new ordinance code would beavailable at the next council meeting. PUBLIC WORKS DIRECTOR REPORTS Mr. Gustafson reported on communications with homeowners along 45th Avenue east of Chatham Road regarding poor water flow. Mr. Gustafson particularly discussed complaints from Wayne Northfield at 2221 45th Avenue on low water pressure at his house. Mr. Gustafson informed the Council that he felt that Mr. Northfieid and his neighbors were convinced of the circumstances at their homes which indicate that there is adequate pressure and flow to each household.
