Nawrocki, Mayor Secretary ~ro-tem OFFICIAL PROCEEDINGS SPECIAL MEETING AUGUST 13, 1974 Meeting was called to order at 8:00 p.m. Roll Call - Logacz, Heintz, Norberg, Land, Nawrocki present Motion by Norberg, Second by Heintz to name Margo Emerson Secretary Pro-tem for the meeting. Roll Call - All ayes Mayor Nawrocki began by explaining the purpose of the meeting. This meeting was set up following hearings on temporary street surfacing. Indications had been made by people from certain streets that they would favor consideration given to permanent surfacing, curb, and gutter. This special meeting was for the purpose of holding hearings on those streets. Clayton Berg and George Brown from the City Engineering Department explained the proposals for each of the streets. Mr. Berg displayed a map of the streets to be considered. He had sketches showing the conditions of the various streets, and further, showing the type of curbing which would be proposed. He explained what the surfacing would consist of. A cost breakdown on the various projects was discussed. The cost estimate would be $12.00 per front foot for curb, gutter, and permanent surfacing. Some of the people in the audience had questions on various aspects of the proposed projects. One lady wanted to know how long the permanent surfacing lasts. Mr. Brown estimated 20 years wearing time. A further explanation of the costs involved was needed. Approximately 40 people were present at this hearing. August 13, 1974 HEARING ON EACH STREET McKinley Street, 39th to 40th Mr. Brown discussed the need for completing a sanitary sewer line on this street prior to any permanent street construction. He stated that an estimated cost of $lO.00 per front foot on McKinley to the vacated 39th Avenue would be assessed. He further stated that the cost for street, curb, and gutter would run $12.00 per front foot bringing a total assessment of $22.00. A discussion followed his explanations. Mr. Herringer, who owns property on this street, questioned the need for the sanitary sewer related to his property. He felt his needs were already met. He asked how wise it was to construct the street between 39 and 39½ when no development is on it at this time. Mr. Brown further discussed the need to complete the sanitary sewer. Mr. Herringer asked for an explanation on how the drainage is handled in this area. Councilman Norberg asked for further explanation of how the sewer lies. Mr. Lee expressed his desire that the sewer be completed. He stated that a future date he would need it, and so would want to see it put in. Other people from the area expressed their opinions as well. Mr. ~/agamon, 3960 McKinley Street, wanted to know what his exact assessments would consist of. Mrs. Hanson, from the Assessment Dept, answered these quest ions. CLEVELAND STREET, 39th to 40th A petition had been received on this street favoring permanent street surfacing, curbs and gutters, which ll of the 15 property owners had signed. A discussion was held on whether the $12.00 estimated cost included resodding of the individual properties. Mr. Brown stated that it does not, but it does include driveway repair on damages caused by the construction on the street. One gentleman was concerned whether these estimates of cost had taken inflation into account. It had been indicated that the work would not be done until the next construction season. Mr. Brown indicated that inflation had been considered and these estimates reflected that fact. One lady wanted to know how much sod would be removed. Mr. Berg indicated that it varied with different locations. 39½ Avenue, Cleveland Street to ~lcKinley Street A petition had been received on this street favoring permanent street surfacing which 50% of the property owners had signed. One individual asked whether any sewer lines were planned for this street, and was told that there were not. ~lo other discussion was held on this street. August 13, 1974 169 46th Avenue, Monroe Street to Jefferson Street Mr. Berg discussed the extreme grade problems along this street. He explained that some driveways will have to be cut back. It was pointed out that this street would be done in conjunction with Monroe Street, 45th to 46th. It was also pointed out that this street would not be a full 30 feet but rather had been estimated at $10.00 for a 20 foot and between $10.00 and $12.O0 for a 25 foot one. The lesser cost was due to the fact that less blacktop would be needed. A discussion was held on how the corner would be designed. Some of the people desired a square corner. Mr. Berg explained what the rounded corner design would consist of. A discussion was held on the size of the street and on the size of the corner, and how much area would be involved in regards to vehicles turning the corner. One gentleman indicated that he would like a step back after his driveway on the south side of 46th and Jefferson. Further discussion was held on various aspects of this street. Some of the people present were concerned about an extrance and exit out of the trailer court. Mayor Nawrocki informed those present that Monroe Street was vacated between 46th and 46½ so no traffic should be traveling there. Columbia Heights had received permission from Hilltop for a walkway through the trailer court so that children on their way to school could walk through. Mr. Brown indicated that a I~ole will be erected near the walkway so that no cars could travel on this. Monroe Street, 45th Avenue to 46th Avenue This street would include permanent surfacing, curb and gutter, as well as a water main extension. The question was raised whether Hilltop would share in costs. Mr. Berg indicated that he had attended the last Hilltop Village Council meeting and that they had indicated that they are in favor of having the work done if their individual property owners are in favor. Mr. Berg discussed the plan for this street. He stated tht if the street does no go in at this time then there would be no need for the watermain at this time. A discussion was held on the present piping. Mr. Brown indicated that it was very unpredictable how long it would last as it is very old. A discussion was held on whether the water main would serve Hilltop. Mayor Nawrocki indicated that there had been some discussion with Hilltop on this, but at present time, there were no plans. He described the water system in Hilltop. Discussion was held on who would own the line if it is placed on the Hilltop side of the street, as it would be. The answer was given that Columbia Heights would still own it and would have to get an agreement with Hilltop on using the land. Mr. Brown indicated that the estimated cost would amount fo $10.00 per front foot. The question was brought up whether this includes the Hilltop property. It was stated that it does. Discussion was then held on who pays the extra $10.O0 per front foot if Hilltop does not pay for their half. Indication was made that it would come out of the general Water fun~i. 17o August 13, 1974 The discussion turned to the street construction itself. Mr. Berg indicated that the proposed street wou!d be 20 feet wide, but that there had been some indication that a 25 fc~ot street might be considered. This was explained as meaning that 12½ feet on either side of the center line of the street would be divided , west half to Columbia Heights and east half to Hilltop. A discussion was held on the fence located on the Hilltop side. Further discussion was held on the design of the corner on the north end of Monroe. A show of hands by the residents in that area indicated that they preferred a square corner instead of the round one. A lengthy discussion was held on this street in general. Further questions were asked regarding Hilltop sharing the cost. Mr. Johnson and Mr. Pster, who own the majority of the property on the East side of Monroe street in Hilltop indicated that they would share the cost of the street construction as they were also in favor of having it done. 42nd Avenue, Ma in Street to 3rd Street Mr. Berg described the plans for this street. He pointed out that a storm sewer connection v~)uld have to be made on this street, but since the property owners have paid an assessment for this in the past, they would not be assessed for it at this time. He pointed out some specific problems on this street. The location of the street as it is presently driven on is wrong aod would require extensive adjusting in some locations. He presented a drawing showing where the street would be located. He further discussed the lack of right-of-way in front of Mr. Moneta's property which without and easement would make it impossible to construct the street. A petition was presented to the Council in opposition to the improvement. Approximately 50% of the affected property owners signed the petition. Motion by Heintz, Second by Norberg that the petition be placed on file. Roll Call -All Ayes A ]engthy discussion was held on the proposal for this street. of the property owners present spoke against the plans. Many Mayor Nawrocki at this point brought forth a letter from Mr. and Mrs. Victor Maehren, 669-46th Avenue, in opposition to any work being done on 46th Avenue. Motion by Heintz, Second by Logacz that the letter be placed on file. Roll Cai] - All Ayes The Councilmen expressed their feelings on the various streets and whether or not the work should proceed. A recess was called at 10:37 p.m. Meeting reconvened at 10:58 p.m. August 13, 1974 RESOLUTION #74-38 PERMANENT STREET SURFACING, CURB AND GUTTER Offered by Land, Second by Logacz Roll Call - All Ayes BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, that WHEREAS, the City Council of the Cityof Columbia Heights by Motion on the 1st day of July', 1974 and on the 9th day of July, 1974 ordered notice of a hearing to be given to property owners, and WHEREAS, pursuant to a notice of hearing certain residents appeared at a Council meeting on ~e 13th day of August, 1974, and WHEREAS, the Council determines to proceed with this local improvement, a portion of the cost being defrayed by special assessments under Charter provisions. NOW, THEREFORE, BE IT HEREBY RESOLVED: 1. That the location and extent of such improvements is as follows: McKinley Street, 39th to 4Oth Cleveland Street, 39th to 4Oth 39½ Avenue, Cleveland Street to McKinley Street 46th Avenue, Monroe Street to Jefferson Street Monroe Street, 45th Avenue to 46th Avenue 2. That the materials to be used are as follows: Concrete Curb and Gutter, additional base as necessary and A.C. Bituminous Surfacing. 3. That a careful estimate of the cost of the improvement has been made by the City Manager and the several lots and parcels of land fronting upon and adjacent to such proposed improvement, which he deemed benefited thereby, were properly notified of said hearings, and 4. That the City Manager shall also list the names and owners of the several parcels so improved as nearly as can be ascertained. 5. These improvements shall also be known as Project No. 691 RESOLUTION #74-39 WATER MAIN EXTENSION Councilman Norberg questioned about Hilltop sharing the costs on the street surfacing and water main extension. Mayor Nawrocki stated that if Hilltop does not agree in regard to the water main, then the City must decide where the other ha]f of the cost will come from. In regards to the streets, 46th Avenue (to be done in conjunction with Monroe), and Monroe Street 45th to 46th, whether they will actually be done or not is contingent upon an agreement with Hilltop that they will pay part of the project. If no agreement is reached, then the project could not proceed. Resolution #74-39 Offered by Land, Second by Logacz Roll Call - All Ayes BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, that WHEREas, the City Council of the City of Columbia Heights by Motion on the 1st day of July, 1974 ordered notice of a hearing to be given to property owners, and WHEREAS, pursuant to a notice of hearing certain residents appeared at a Council Meeting on the 13th day of August, 1974, and WHEREAS, the Council determines to proceed with this local improvement, a portion of the cost being defrayed by special assessments under Charter provisions. August 13, 1974 NOW, THEREFORE, IT IS HEREBY RESOLVED: ~. That the location and extent of such improvements is as follows: Monroe Street, 45th Avenue to 46th Avenue and 200 feet west of Monroe Street on 46th Avenue 2. That the materials to be used are as follows: New 6 inch Ductile Iron Pipe and Appurtenances. 3. That a careful estimate of the cost of the improvement has been made by the City Manager and the several lots and parcels of land fronting upon and adjacent to such proposed improvements, which he deemed benefited thereby, were properly notified of said hearings, and 4. That the City Manager shall also list the names and owners of the several parcels so improved as nearly as can be ascertained. 5. These improvements shall also be known as Project ~1o. 692. It was noted that the sanitary sewer on McKinley Street could not be approved at this time because no hearing notice had been published. Motion by Logacz, Second by Heintz that a hearing be held on September 9 at the regular meeting of the City Council on the sanitary sewer on McKinley Street, 39th to 40th. Roll Call -All Ayes 42nd Avenue, Main to 3rd A discussion took place on what should be done. The Council members agreed that since the people did not want permanent surfacing at this time, it would not be approved. Motion by Norberg, Second by Heintz to deny the curb, gutter, permanent surfacing, and storm sewer connection on 42nd Avenue, Main Street to 3rd Street, that major maintenance on this street be approved. Roll Call - All Ayes Mayor Nawrocki pointed out that a letter should be sent to all the residents of that area telling what the decision of the Council had been in regard to 42nd Avenue. He wanted it to be clear to them that the alternative to permanent work was the temporary work. One resident was concerned that the other people have some input on whether or not the temporary work should be done. Most of the people who had been present for hearing had left by this time. Mayor Nawrocki directed that the information letter be sent to all the residents affected by the decision. RESOLUTION #74-40 OFFERED BY LAND, SECOND BY HEINTZ. Roll call - All Ayes BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, that WHEREAS, the City Council of the City of Columbia Heights by Motion on the 10th day of June, 1974 and on the ]st day of July, 1974 ordered notice of a hearing to be given to property owners, and WHEREAS, pursuant to a notice of hearing, certain residents appeared at a Council meeting on the 1st day of July, 1974 and on the 13th day of August, 1974, and WHEREAS, the Council determines to proceed with this local improvement, August 13, 1974 a portion of the cost being defrayed by special assessments under Charter provisions. NOW, THEREFORE, IT IS RESOLVED: 1. That the location and extent of such improvements is as follows: 42nd Avenue, Main Street to 3rd Street 2. That the materials to be used are as follows: Street Oil and Aggregate 3. That a careful estimate of the cost of improvement has been made by the City Manager and the several lots and parcels of land fronting upon and adjacent to such proposed improvement, which he deemed benefited thereby , were properly notified of said hearings, and 4. That the City Manager shall also list the names and owners of the several parcels so improved as nearly as can be ascertained. 5. These improvements shall also be known as Project No. 690. ORDINANCE #826 SALE OF LAND This sate concerns a 20 ft. X 20 ft. parcel of land behind Mr. Misik's house at 4301 - 2nd Street next to Gauvitte Park. This ordinance had been tabled from the regular meeting of August 12 for further information. Mr. Schedler informed the Council that no record of the sale of this land to the City was available from the County. He stated that the term of the sale should be $50.00. The question was still raised by Attorney Singer, whether this land was for park purposes or not. No one was certain of this at this time. The Council indicated that no action could be taken until this information was available. A subdivision request for a strip of land next to this square which was being considered for sale was also related to this and was to be discussed at this meeting. Motion by Norberg, Second by Heintz to table Ordinance #826 and the subdivision request be tabled until the regular council meeting on August 26 pending further information Roll Call -All Ayes Motion by Heintz, Second by Norberg to adjourn at 11:26 p.m. Rol Call - All Bruce G.
