Hearing on Street Improvements
July 9, 1974

Motion by Land, Second by Logacz to appoint Margo Emerson Secretary Pro
Tem for this meeting. Roll Call - All Ayes
Mayor Nawrocki began the meeting by discussing what the purpose of the
meeting was and stating what the order of business for the meeting would
be. First the Engineering Department would discuss the plans for this work.
Then the floor would be open for general questions to understand what
the proposal is about, and finally the streets would be discussed separately
in the order in which they appeared on the agenda.
ENGINEERING DEPARTMENT REPORT
Assistant City Engineer, Clayton Berg, was present to discuss the plans.
He had a map showing the areas of the City under consideration.
The condition of the streets was pointed out and what the need was for
improving them. The work would consist of scarifying, adding material
and oil and relaying and roll ing. The purpose was blade laying bituminous
plant or remixed material to correct the existing deficiencies in strength,
crown, and drainage. The estimated cost was pointed out as being 90¢ per
front foot, or 30¢ per front foot for an avenue charge. Mr. Berg showed
sketches explaining what the terminology used meant.
Approximately 30 people were present at this special meeting.
GENERAL QUESTIONS AND DISCUSSION
Mr. John Ward, 965-44½ Avenue asked for a clarification on cost. He
wanted to know if the estimates were exact and if the assessed cost would
completely pay for the project or if additional Funds would have to be
used out of the genera] maintenance fund. Mr. Berg answered that the
entire project would be billed to the homeowners. Mr. Ward, as well as
some of the others present, felt that the cost of this type of work
should continue to come out of general funds instead of billing homeowner.
Mayor Nawrocki explained this plan to him. He pointed out the fact that
people living on permanent streets had to pay for those streets and it
is not fair to have them pay for maintenance on those streets which are
not permanent. He explained how the 90¢ would be divided up. Approximately
50% would go for material and the other 50~ divided between the wage for
the operator and for the equipment used itself. Mr. Ward pointed out that
he merely wanted to know that the cost estimate was not merely an arbitrary
figure, but that it has been figured out exactly. A lengthy discussion was

held on paying for this maintenance out of general funds vs. billing back
to the homeowners. At various times throughout the meeting the discussion
returned to this and at various time angry disagreements were expressed
by those present in the audience.
Another man wanted to know why only temporary work is being considered.
He was in favor of having a permanent street put in rather than pay
for the temporary work over and over again. Mayor Nawrocki pointed
out instances in the past when people have been opposed to permanent
surfacing , so the City must consider temporary. He further pointed
out how a permanent surfacing might be accomplished. One way is for
the people in the area to sign and bring in a petition. He encouraged
those interested in this to do so. The estimated cost given on permanent
street was $12.00 per front foot.
Another gentleman asked for clarification between a street and avenue
charge. City Assessor, Mildred Carlson, explained this.
One man spoke on the work which had been done on 42nd Avenue. He felt
it has been a very poor job and if that was an indication of what
could be expected on the streets in question, then he thought they were
better off staying the way they were. City Engineer, George Brown,
discussed 42nd Avenue. He pointed out that this is one of the oldest
streets in the City. He further indicated the problems involved on this
particular street.
One gentleman spoke on what he felt was the reason certain streets are
breaking up. He stated that where a new house is put in, then the plumbers
do not do a good job in fixing the street after digging it up. He felt
that the contractor should be made to do a good job of putting the street
back in order following construction.
Certain people wanted to know l~ow long it would be before permanent
surfacing would be considered on various streets. Mr. Brown stated
that so far it had seemed that the people did not want it. One
gentleman stated that the streets should be left as they are until permanent
streets are put in.
Mrs. Kocur, on 42nd Avenue, spoke at length on various subjects related
to the street maintenance work proposed. She felt the entire City should
be able to respond on whether this work should be assessed or continue
to come out of general funds.
TYLER STREET 44th to 45th
One man at 4444 Tyler Street felt the street was just fine the way it
was. Another man on this street also agreed.
TYLER STREET 43rd to 44th
No discussion on this one.
43rd AVENUE, RESERVOIR BOULEVARD TO BENJAMIN STREET
One gentleman expressed the desire for permanent surfacing along this
avenue. Until then, he felt the street would be fine the way it is.

He did not want anything done on it until such time as permanent
surfacing could be done. Another man also felt this way.
The gentleman at 2]00 - 43rd Avenue was concerned about who is responsible
for deciding which streets need work done on them. The City Engineer
responded that the Street Superintendent indicates to the Engineering
Department which streets he feels need work. The Engineering Dept.
examines these streets and then recommends which ones should be considered.
The opinion was expressed that most of the people along this street
did not want the work done.
POLK STREET, 41st Avenue to 43rd Avenue
Only one man spoke on this street and he did not feel the work was
needed to be done.
44½ AVENUE BETWEEN CENTRAL AND McLEOD STREET INCLUDING ENTRANCES
Mr. Ward felt that there are too many trucks traveling on this street
which would continue to break up the street. He felt no major
maintenance should be done. He further felt that the street is strong
enough the way it is and he believes that other people along the street
were in agreement with him. As long as it involved a charge to the people
along the street, he thought it should not be done.
42½ AVENUE BETWEEN CENTRAL AND McLEOD INCLUDING ENTRANCES
The gentleman at 1001-42½ Avenue was strongly opposed to any work on
this street. He feels that new homes are causing the break up on this
street. If the contractors would put street back in order, then the
street wouldn't break up.
Mrs. Kocur asked about signs stating the Axle weight allowed on streets.
Nayor Nawrocki pointed out that there are laws governing the weight
allowed on residential streets and so this is usually not posted.
MCKINLEY STREET, 39th to 40th
One man living on the corner of McKinley and 39th wanted permanent
surfacing to be put in rather than the maintenance w, Jrk. The gentleman
at 3930 McKinley also desired permanent surfacing.
CLEVELAND STREET 39th to 40th
A petition was received requesting permanent surfacing on this street.
Mayor Nawrocki indicated that a hearing on permanent surfacing would
probably be held along with other hearings on August ]3.
39~ AVENUE FROM CLEVELAND STREET TO MCKINLEY STREET
One man requested that permanent surfacing be considered. He felt that
other people along this street would also be in favor of permanent surfacing.
One lady brought up the fact that trucks from Penny's Supermarket are
traveling on McKinley Street and that this should be stopped.
Mayor Nawrocki indicated that the City Manager be instructed to contact
Penny's Supermarket to inform them that trucks are not al lowed on the
residential streets.

46th AVENUE EXTENSION
The City owns all the property along this, so no hearing would be necessary.
Further general discussion followed. One man asked that a Stop sign
be placed on the entrance street of 42nd Avenue to 42½ Avenue by LaBelle
Park. Mayor Nawrocki requested that Mr. Brown have this on the agenda
for the next traffic commission meet. A discussion followed on Stop
signs in general throughout the City.
Motion by Logacz, Second by Land to hold a continued hearing on McKinley
Street, 39th to 40th; Cleveland, 39th to 40th; and 39½ Avenue from Cleveland
Street to McKinley Street to consider curb, gutter and permanent surfacing
at the special meeting on August 13, 1974 at 8:00 p.m. Roll Call - All Ayes
Motion by Land, Second by Logacz that the petition received on permanent
surfacing on Cleveland Street be accepted and placed on file. Roll Call-All Ayes
Each of the councilmen expressed their views on the other streets.
Councilman Land felt that since the people did not seem to want the major
maintenance work done, and that they felt the streets were fine the way
they were, then nothing should be done at all to their streets.
A heated discussion followed this. Some of the people did not feel
this attitude was correct. They thought potholes, etc. should still be
maintained as before but only, no other major reworking be done.
Councilman Land further stated that the remaining streets be denied for
the major maintenance as proposed.
Councilman Logacz agreed that no work be done on the remaining streets.
One man in the audience stated that just because the people did not want
the work done this year, that it does not mean that they never want
the work done. He felt that perhaps next year the streets would need it,
and then it could be done, but this year it was not necessary.
Another man stated that this did not mean that they were opposed to any
work, ever. He stated that in a few years perhaps permanent work would
be desi red.
Motion by Land, Second by Logacz that no major maintenance as proposed
be done on the following streets:
Tyler Street, 44th to 45th
Tyler Street, 43rd to 44th
43rd Avenue, Reservoir Boulevard to Benjamin Street
Polk Street, 41st Avenue to 43rd Avenue
44½ Avenue between Central and McLeod Street including entrances
42½ Avenue between Central and McLeod including entrances.

Motion by Land, Second by Logacz to adjourn the meeting at 10:40 p.m.
