Motion by Norberg, Second by Land to appoint Margo Emerson Secretary
Pro Tem for the meeting. Roll Call - All Ayes

MINUTES OF APRIL 8 MEETING
Motion by Heintz, Second by Norberg to approve the minutes as
presented in writing with one change as outlined by Mr. Watson
on the wording of what he had said in regard to the second reading
of the new zoning ordinance and with the correction of a typographical
error on page 61 as pointed out by Councilman Norberg, and the reading
be dispensed with. Roll Call - All Ayes

AWARD OF BIDS ON CURBS AND PAVING
This work includes the state aid curb, gutter, and surfacing on 38th Avenue
from the alley west of University to Main Street, and on Third Street from 37th to
38th Avenue. This also includes the curbs and surfacing on Third Street from 38th
to Edgemoor. The low bid came in considerably lower than the engineering estimate
of $96,272.00. A discussion was held on this fact. Mayor Nawrocki asked for
clarification on the estimate. He wanted to know if this bid will be keeping
within the figures given at the hearing on this project, and was informed that
it does. Councilman Norberg expressed concern as to whether the company will be
able to get the materials needed. Motion by NOrberg, Second by Heintz to award
the bid on this project to H. & S. Asphalt Company, the low bidder, in ~e amount
of $75,431.67. and the Mayor and City Manager be authorized to enter into contract
for same. A discussion followed pointing out the fact that the bids had been tied
with park court area paving and that although Dunkley Surfacing had the low bid for
this section of the work, H. & S. Asphalt had the low total bid. The motion
included the park construction work so no separate action was necessary.

Discussion was held regarding the fact that the bids were lower than anticipated
based on the appraised value. Motion by Norberg, Second by Heintz that the bids be
turned over to the City Manager for tabulation with a report back and recommendation

ORDINANCE #819--0N THE ISSUANCE OF $450,000 of BONDS FOR MAINTAINING
THE CITY'S PERMANENT IMPROVEMENT REVOLVING FUND
A lengthy ,discussion was held regarding this ordinance. Mr. Watson
reported on communications with Congressman Fraser and Senator Humphrey
regardin9 the possibility of any Federal Funding on the project. He was
told that there are none available in the near Future. Congressman Fraser
indicated that Columbia Heights will be eligible For public works Funding
under the new Housing and Urban Development Act which is working its way through
Congress, but no Fundin9 would be available under this act until at least
January l, 1975. A discussion followed on whether we will be able to 9et
any Funding very soon after that.
Mr. Watson further reported on communications with the Pollution Control
Agency on possible funding for this storm sewer project (Sth Street
between 35th and B7th Avenue). Columbia Heights is low on the priority
list.
Further discussion was held on whether this ordinance is urgent or not.
Mayor Nawrocki asked about the bond isuue debt service. Mr. Watson stated
that beginning in ]976 in would be approximately 65 or 70 thousand
dollars per year over a period of ten years.
Councilman Land expressed his opinion that the City should go ahead with
this bond issue. He pointed out the real need for the storm sewer construction
and stated that he feels that there is no sense in stalling any longer. There
are simply no federal funds available, and so there is no alternative.
Further discussion followed. The matter was finally tabled until more
information could be given at a later date.
ORDINANCE #820 TRANSFER OF TITLE TO BARRY C. ROSCH
Second reading was held on this ordinance which deeds a triangle of land
in the S.W. corner of McKinley and 40th to the adjoining property owner.
It was a matter of clearing title. Offered by Land, Second by Norber9
Roll Call All Ayes Ordinance #820 was adopted.
RESOLUTION #74-23 ADOPTING LAND USE AND CONTROL MEASURES IN FLOOD PLAIN
AREAS
Offered by Land, Second by Logacz
WHEREAS, The City of Columbia Heights had adopted and is enforcing
the Uniform Buildin9 Code; and
WHEREAS, Section 301a of the Uniform Building Code prohibits any person,
firm or corporation from erecting, constructing, enlarging, altering,
repairing, improving, moving or demolishing any building or structure
without first obtaining a separate building permit for each building or
structure from the Bui]din9 Official; and
WHEREAS, the Building Official must examine all plans and specifications
for the proposed construction when application is made to the Building Official
for a bui}din9 permit.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
COLUMBIA HEIGHTS: 1. That the Building Official shall review all
building permit applications for new construction or substantial
improvements to determine whether proposed building sites will be
reasonably safe from flooding. If a proposed building site is in a
location that has a flood hazard, any proposed new construction or
substantial improvement (including prefabricated and mobile homes)
must: a. be designed (or modified) and anchored to prevent
flotation, collapse, or lateral movement of the structure, b.. use
construction materials and utility equipment that are resistant to
flood damage, and c. use construction methods and practices that
will minimize flood damage; and
2. That the building official shall review subdivision proposals and
other proposed new developments to assure that a. all such proposals
are consistent with the need to minimize flood damage, b. all public
utilities and facilities, such as sewer, gas, electrical, and water
systems are located, elevated, and constructed to minimize or eliminate
flood damage, and c. adequate drainage is provided so as to reduce
exposure to flood hazards; and
3. That the Building Official shall require new or replacement water
supply systems and/or sanitary sewage systems to be designed to minimize
or eliminate infiltration of flood waters into the systems and
discharges from the systems into flood waters, and require on-site
waste disposal systems to be located so as to avoid impairment of them
or contamination from them during flooding.

RATE INCREASE ON CAB SERVICE
Mr. LaMont, Owner of the Columbia Heights Cab Company, was present
to present his request. He said that this request was due to the
increased costs of gas which make it impossible to operate at the
present rates. His request for increasing the Meter Rate to
70¢ on the flag over the present rate of 65¢ and the mileage rate
be increased to 60¢ (present rate is 45¢) was discussed.
Discussion was held on what determines if the rates are fair. Mayor
Nawrocki asked for clarification from the City Charter. Attorney Kalina
stated that the charter requires only that "reasonable rates" be
established. Motion by Heintz, Second by Norberg to table this item
until the next regular meeting. Roll Call - All Ayes.
Mayor Nawrocki indicated that prior to the next meeting, the Minneapolis
and St. Paul cab companies will be asked as to what their fares are.
Also the cab driver union in Minneapolis should be contacted for their
opinions. In addition, the books of the Columbia Heights Cab Company
will be looked at to help determine whether the increase is needed on the
basis of profit or loss. The Cities of Minneapolis and St. Paul will
be consulted as to how they determine the fairness of a rate increase.

REQUEST FOR SIGN PURCHASE
Mr. Brown explained this proposal. The request is to purchase approximately
$5,000 worth of signs to conform with the mw uniform traffic control
device manual. The federal government will pay 90% of the cost of materials
and labor of making the change-over to the uniform signing. Discussion
held on the need for taking bids; whether they had to be formal. Decision
to take three informal bids and see if they will exceed $5,000 and if so,
formal bids will be taken. Councilman Norberg indicated that the City
should consider possible joint purchasing with neighboring communities.
Motion by Land, Second by Heintz to authorize the request for a sign
purchase of approximately $5,000 worth of signs, 90% of the
cost to be paid by the federal government, leaving approximately $500
for the City share: To authorize the City Engineer to serve as the official
to implement the program, and To authorize that informal bids be taken
from at least three suppliers. Roll Call - Logacz, Heintz, Land, Nawrocki - aye
Norberg nay. Mayor Nawrocki indicated that the staff should investigate
possible joint purchasing.
A recess was called at 9:37 p.m. The meeting reconvened at 9:55 p.m.
LOT SUBDIVISION - lOlO-43rd Avenue
Mr. Watson displayed the survey of this property. Motion by Land,
Second by' Heintz to grant lot subdivision to Mr. Carl J. Swanson for
lOIO-43rd Avenue N.E. Roll Call All Ayes
REQUEST TO PURCHASE THREE POLICE CARS
The Police Chief requested authorization to proceed with the purchase of
three police cars through the joint purchasing with Anoka County.
A lengthy discussion was held regarding the size of the cars. Mayor
Nawrocki indicated that he would like to have the opinion of Mr. Tom
HOsch of the City Garage on these cars. Motion by Heintz, Second by Land
to authorize Mayor and City Manager to enter into an agreement to purchase
three police cars. Roll Call - All Ayes Mayor Nawrocki stated that they
would check with Mr. Hosch before the purchase is made.
OAKWOOD SCHOOL
A letter had been received from School District #13 asking the City
Council if the City had any interest in purchasing the property on which
Oakwood School is located. A short discussion was held on any possibilities
for this. It was decided that the City would not be interested in this land.
A letter wi]] be sent to School District #13 informing them of the Council's
decision.
SULLIVAN LAKE FLOWAGE AREA
Report was made that the appraiser bill for evaluations made on the Sullivan
Lake flowage area of all parcels of land surrounding Sullivan Lake last
April 22, 1974
October totaled $ 14OO. Fridley has agreed to pay one-half of this bill.
Motion by Land, Second by Logacz that the City pay $700 as their half of
the appraiser services. Roll Call - All Ayes
CONFERENCE ON STREET CLEANING AND MAINTENANCE
Motion by Land, Second by Heintz to authorize one registration in the
amount of $65 for the street cleaning and maintenance conference April 30
and May 1 sponsored by the American Public Works Association to be held
in Bloomington. Roll Call - All Ayes
BOARD OF EQUALIZATION
Motion by Heintz, Second by Land that the Board of Equalization meeting
be scheduled for 8:00 p.m. Thursday, May 23rd subject to concurrence by
the County Assessor's Office. Roll Call - All Ayes
CHANGE ORDERS ON LaBELLE PARK
Mr. Otterson explained the requested change orders on LaBelle Park in
great detail. A discussion was also held on the Brauer and Associates
contract as far as costs. Concern was expressed by the Council that charges
are running above those which had been authorized. Further discussion
was held on the change orders. Norberg expressed the fact that he didn't
agree with the change order to delete all planting. Mr. Otterson indicated
that rather than let a contract which would include the actual planting
besides the necessary supply of trees, shrubs, etc., he is checking with
city service organizations for their help in making the planting a city-
wide operation and thereby save costs. Motion by Heintz, Second by Land
to authorize the following change orders:

to bring the adjusted contract price to $ 182,057.10.
PROCLAMATION
Mayor Nawrocki read the following proclamation:
WHEREAS, the Congress of the United States through the House of
Representatives has declared April 30, 1974 as a day of National
Humiliation, Fasting, and Prayer in response to concern for
the welfare of our nation in these uncertain times, and
WHEREAS, the various churches of our community have been informing
their parishioners of the desirability of showing concerns for our National
government specifically on that day by varuous means such as fasting and
prayer,
NOW, THEREFORE, I, Bruce G. Nawrocki, Mayor of the City of Columbia
Heights, do hereby proclaim Tuesday, April 30, 1974 as a day of fasting
and prayer for our National government and recommend that our citizens
participate in the activities recommended by their respective churches
and seek the guidance of Almighty God to support the leaders of our nation
in the determinations they must make to guide the United States into the
paths of peace and prosperity in accordance with the precepts of our
founding fathers.

LATE REQUESTS
A proposed ordinance regarding on-site sewage disposal systems was
discussed. Mr. Hutchison, Director of Environmental Services for Anoka
County, had presented this proposed ordinance for consideration. The
public works director and City Manager stated that this proposed ordinance
had little effect on Columbia Heights since we had very few properties
that were not connected to the sanitary sewer system. The City Manager
was directed to notify the County that we are complying with the requirements
for handling sewage properly and wish to be excluded from consideration
in regard to the ordinance.
Mr. Brown presented a claim from Ron-Co Sewer and Water, Inc. for extra
work done when installing a service at 1910 Fairway Drive and for a 'ldig
up" to turn on the water for 4732 Stinson Boulevard. These were in June
and July 1968. The billing was for $500.00. Mr. Brown and Attorney
Kalina reported on meetings with Mr. Neff of Ron-Co Sewer and Water.
An agreement was reached in the amount of $300.00 if the council authorized
payment. Mr. Brown further explained the background of this claim.
MOtion by Land, Second by Logacz to authorize payment of the 5300.00
to Ron-Co Sewer and Water, Inc. Roll Call - Logacz, Heintz, Land,
Nawrocki - Aye Norberg - Nay
A discussion was held on whether or not to send anyone from the City
to the Minnesota College Government Council's Annual Spring Conference
on May 1 at the Ambassador Resort Motor Hotel. The theme for this
conference is "Developing Government Employment Opportunities for
Minorities and Disadvantaged." Motion by LOgacz, Second by Norberg to
refer this to the Human Rights Commission in order that they might
send one of their members to this convention. Roll Call-All Ayes
SOLICITORS LICENSE - UNIFICATION CHURCH
This is a request for a Solicitor's license to raise contributions for
Christian Youth Work. They are licensed in Minneapolis, Bloomington,
St. Louis Park, Golden Valley and other communities. Councilman Norberg
expressed concern about whether the City should know who each of the individual
solicitors will be. He stated that a similar license had been denied
in the recent past, and that part of the reason had been because the
individual solicitors would not be identified but only the organization as
a whole. Mr. Watson stated that before the license is issued the applicant
must present a complete list of who will be soliciting. This is standard
proceedure. Motion by Logacz, Second by Heintz to grant request for a
solicitor's license to the Unification Church of South Minneapolis and that
the fee be waived. Roll Call - Logacz, Heintz, Land, Nawrocki - Aye

LICENSES
Motion by Heintz, Second by Norberg that the list of license applications
be approved upon payment of the proper fees. Roll Call - All Ayes
OLD AND NEW BUSINESS
An evening for interviewing applicants for boards and commissions was set
April 22, 1974
up for the following evening, April 23 beginning at 6:30 p.m. Applicants
will be telephone during the day to make appointments. A further
discussion on the second reading of the zoning ordinance will also be held
that evening.
Mayor Nawrocki asked about disability insurance for the two patrol
officers whose situation on pension benefits in in question. He asked
whether they are being covered by a private plan. Mr. Watson reported on
having contacted Miner-McAlpin and they are arranging for such insurance
for these two men. Motion by Norberg, Second by Heintz that the City
Manager be authorized to purchase disability insurance for the two officers
Hickey and Fries under a plan comparable to that offered by a private
pension plan. Roll Call - All Ayes
CITY ATTORNEY REPORTS
Mr. Kalina reported on the Michael E. Parkos case in which Mr. Parkos
hit a fire hydrant last October 29 and the City is still trying to collect
on it. Mr. Brown further discussed this. He explained about the background
in this case. Mr. Kalina indicated that Mr. Parkos is in a poor financial
situation. His attorney has indicated that Mr. Parkos may have to file
bankruptcy, in which case, the City would collect little or none on
its claim. Re total of the claim is $ 1,131.85. Mr. Parkos attorney
has offered to settle this claim for $250.00. The City Council discussed
this matter. They decided to take no action on this at this time but
father to wait and see what develops in the future.
PUBLIC WORKS DIRECTOR REPORTS
Mr. Gustafson reported on the situation on the water standpipe. He
indicated that the high estimate on repair costs for the present standpipe
may indicate the need to replace it. Mr. Gustafson has contacted Larson
Tank Company for a comparative estimate on the cost of repairs. They
will examine the standpipe inside and out and verify the conditions which
exist. Mr. Gustafson is planning on obtaining estimates on a new tank
installation. He further indicated that he is contacting "Fire Underwriters"
to determine their recommendations for tank type and size.
Councilman Heintz asked whether the street sweepers had been received
yet. He was told that it should arrive sometime the week of the 20th of
May.
Mayor Nawrocki presented a Citizen's League newsletter and reported on
league figures on property valuations. He pointed out that Columbia Heights
is again on the high side compared to other communities. He specifically
pointed out the low percent of value in Spring Lake Park and Ramsey
Township.

Mayor Nawrocki asked Mr. Gustafson about cooling water being drained into
the storm sewer by Minneapolis Electric Steel Castings. This has been
checked into and does not create a problem in the drainage system.
Mayor Nawrocki asked Mr. Watson on the situation on county N.Y.C. and State
Youth Programs. Mr. Watson indicated that he would be meeting with
Pat Wahl and Patrick McFar]and from the County at noon the next day
regarding availability of help.
