Heintz absent. Motion by Land, seconded by Norberg that Temple Nygaard be appointed secretary pro- tern for this meeting. All Ayes. Invocation was given by Father Colon of Immaculate Conception Church. The following proclamation was read and signed by Bruce G. Nawrocki, Mayor: PROC LAMAT I ON FOUNDER'S DAY AT IMMACULATE CONCEPT ON CHURCR NOV. 18, 1973 GOLDEN JUBILEE WHEREAS, Immaculate Conception Church is commemorating the 50th Anniversary of the forming of their parish, established in 1923, and WHEREAS, Immaculate Conception Church has been involved in the spiritual growth of our community to an extensive degree over the past 50 years, and WHEREAS, such spiritual growth of a community is of vital concern to our nation and world, as well as our individual city, in these troubled times, NOW THEREFORE I, Bruce G. Nawrocki, Mayor of the City of Columbia Heights, do here- by proclaim Sunday November 18th as IMMACULATE CONCEPTION CBURCH FOUNDER's DAY and I do hereby recommend to the citizens of our community that, insofar as appropriately possible,they participate in the commemoration activities including the noon mass on Novmeber 18th to be conducted by the original pastor of the parish Rt. Rev. Nsgr. George Row]es, a dinner dance at the Sheraton Ritz on Friday December 7th, and a Jubilee Mass at noon Sunday December 9th. Congratulations are further given to all members of the parish, particularly those who have taken an active part in the growth and progress of ImmaculateConception Church. ENERGY CONSERVATION Mayor Nawrocki announced that inas much as the President has called upon all govern- mental units to do their part to conserve energy, he would suggest that the City Manager and Civil Defense Director be directed to make a study which should be im- plemented as soon as possible, as to how the City in its daily endeavors can reduce consumption of fuel; however, emergency vehicles would be given first priority. Ave. 51-53 Central Avenue will be urbanized by the State Highway £~epartment, and in connection with this improvement the City of Columbia tlleights proposes to install curb and associated drainage structures. This hearing had ll~een advertised and the property owners were notified. The estimated cost of ii, his improvement is $6 per front foot. Motion by Norberg seconded by Land th~l~t the City Manager be authorized to proceed with this project, and that the ~i~dvertisement for bids be made at the same time as the State Highway Department ~l~dvertises for its part of the complete package. Purchase of an engine analyzer Informal quotations were received from 3 suppliers, as follows: Allen Company $4155 Marquette Co. 3800 Sun Elecgric Corp. 4272 Mr. Gustafson pointed out that Marquette did not meet ~.l~pecifications in 6 items, and Allen Co. did not meet specifications in 4 items. His department recommends that the Sun Electric Corporation's engine analyzer be purchased because it meets all specifications, and several of their features are li~etter suited to the de- partment's needs. Also their service is available at ~l~ll times, wherein the other companies' service is apt to be delayed for seve!'al days. Motion by Land seconded by Norberg to purchase the engine analyzer fr~!~m Sun Electric at a price of $4372 less trade-in of $100, or a net of $4272, and! that the Mayor and City Manager be authorized to enter into a contract. Justi'l:ication of accepting the highest proposal is that Sun Electric is the only resp~!~nsible bidder in the field since this is a one-of-a-kind production. Roll call, ~l~l! ayes. Purchase of a floor sweeper-scrubber Informal quotations were requested from 3 companies, b~l~t Tennant Company is the only one that has a combination sweeper-scrubber in th,!~ required price range. World Floor Machine, Advance Floor Mach~l~e, and ClarkelFloor Machine have no combinations in the price bracket that we can justify 'iFor our needs. Instead they would sell 2 machines, a sweeper and a scrubber. The Tennant Company's machine fits our size of operation and maintenance wou!ld be on one unit instead of two. Motion by Norberg seconded by Connor that theIMayor and City Manager be authorized to enter into an agreement to purchase aicombination sweeper- scrubber from the Tennant Company in the amount of $2,607.50. Purchase of a liquid propane fueling station Mr. Gustafson has obtained informal quotations on a L.IP. fueling station from the following: Pure Power Co. 1000 gallon tank $2000 Air Neutronic 1200 gallon tank 2700 J.M.Clark Co. 1000 gallon tank 2450 These tanks are mounted on framework and are enclosed iin a chain link fence. The recommendation is to accept the lowest bid. Motio!~ by Norberg seconded by Land that the Mayor and City Manager be authorized !to enter into a contract to purchase the tank from Pure Power Co. Storm Sewer, Central Avenue, 5!-5~ The installation of this storm sewer is a part of the !~tate Highway Department project, and it will also invo!ve Fridley and Hilltop 'l/illage. It is not an assessable project. The State must prepare the agreeml~_nts, and it was moved by Norberg seconded by Land to table this matter until th~ documents are received from the State; possibly a special meeting will be called for this purpose the week of Nov. 19th. Roll call, ail ayes. Page 233 Purchase of a mini-loader There is need for this compact piece of equipment, and it is budgeted for under the sewer & water, street, and park departments. Motion by Land seconded by ,onnor that the City Manager be authorized to advertise for bids for a mini- loader, to be opened Dec. lOth at 8 P.M. Roll call, all ayes. Purchase of a power broom, and tractor cab for the Park Department The Park Department requests permission to purchase a, power broom and a tractor cab. Motion by Norber9 seconded by Land that the City Manager be authorized to 9et informal quotations and report back at the next regular meeting Nov. 26. Al ] ayes. Microfilm reader and printer for Library Motion by Norberg seconded by Land that the City Manager be authorized to obtain informal quotations on this piece of equipment, and report back at the next regular meeting Nov. 26. LaBel]e Park Bids Bids on LaBelle Park have been opened, however the City Attorney reports that the Abstract Company has not been able to furnish clear title to some pieces of property involved. Motion by Land seconded by Norberg to table the bid award until a possible special meeting sometime the week of Nov. 19. Roll call, ail ayes. Purchase of a rescue ambulance Bids were opened earlier today for a rescue ambulance.., however extensive re- view will be required before an award can be made. Motion by Norberg seconded by Connor to table this award until the next regular meeting Nov. 26. All ayes. Resolution //73-73, establishing license fees for 1974 Resolution offered by Land seconded by Connor BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that the list of license fees (as per attached list) be set for 1974. Resolution #73-74, authorizing property purchases in LaBel le Park BE ~T HEREBY RESOLVEDby the City Council in and for the City of Columbia Heights that: whereas, the City Council has determined that a public purpose exists in obtaining certain real property for park purposes, and WHEREAS said Council has, by Resolution //73-38 attached and made reference to herein, authorized the acquisition of this property, and WHEREAS, under provisions of the Uniform Relocation Assistance and the Real Property Acquisition Act of 1970, certain appraisals of said property were obtained and reviewed by a competent staff appraiser, and WHEREAS, the City Manager, acting under direction of the City Council, has established just compensation for the fol- lowing real property at: 1. Resolution #73-75 - Emergency Purchasing Powers Resolution offered by Norberg seconded by Connor WHEREIAS, The City of Columbia Heights has in the past exercised its joint powers auth¢l, rization as provided by the provisions of Minnesota Statutes 1965, Section 471 .59, and has intended to con- tinue this joint exercise of powers in 1974, specifically as it concerns the joint purchase of diesel fuel oil, heating fue~l, and gasloline and WHEREAS, Hennepin County has on two separate occasions solicited !bids for these products, and WHEREAS, on both occasions no bids were received fo~I' such requirements ex- cept for a small amount of diesel fuel and heating oil, ~which leaves the County of Hennepin and Instrumentalities for which it isl purchasing without any contractural commitment for the year 1974; NOW THEFI~EFORE BE IT RESOLVED That the City of Columbia Heights requests of Hennepin Eounty to continue this joint exercise of power and have the Hennepin County Director of Purchasing and Stores enter into any contract or contracts or to ac!.quire through emergency purchase requirements for diesel fuel oil, heating fuel,i&gasoline for the City of Columbia Heights subject to subsequent ramifica~lion by the Hennepin County Board of Commissioners under Minnesota Statute 1971.375.22. Roll call, al 1 ayes. The Mayor stated that even the above resolution may not ~be sufficient guarantee that Columbia Heights will get 100% of our needs. He sL~ggested that a separate resolution should be prepared granting emergency authority to the City Manager to purchase fuel on the open market. This resolution wi!ll be ready for the next meet i ng. Resolution #73-76, Acquiring tax forfeited properties A list of tax forfeited lands was received from the Courlty Auditor. On this list are four parcels which the City should purchase. Resollution Offered by Norberg seconded by Land .' ~ Page 235 Resolution #73-76, continued WHEREAS, the City of Columbia Heights is desirous of acquiring certain properties located within its municipal boundaries for the preservation of the health, welfare, and safety of the citizens of Columbia Heights, and WHEREAS, Anoka County has had said certain properties forfeited to ii-, and WHFREAS, it is the desire of the City of Columbia Heights that said City apply to the County Board for the acquisition of said property, and W~EREAS, the foregoing properties would be used for public purposes, IT IS HEREBY RESOLVED THAT the City acquire: 1. That portion of Lot 9 lying E of the W line of Lot 2, B1 5, Reservoir Hills, in Block 2 (subj. to an ease.for driveway purposes over and upon the 5' thereof parallel with & adjacent to Lot 8) together with an ease. over & upon the 5' of Lot 8 that are para] lei with & adjacent to lot 9, Circle Terrace (parcel #830)(plat #33311). 2. Roll call, a 11 ayes. Justification for acquiring these parcels of property are as follows: 1. This parcel is a small triangular piece of land on the dead end of the alley west of Reservoir Blvd. just north of 40th Avenue. The area is used as a part of the public alley for turning snow plows in the winter and graders in the summer. 2. This parcel is also a triangular piece of land lying on the dead end of 41st Avenue, west of Reservoir Blvd., and is used as a cul-de-sac on the maintenance of 41st Avenue. 3. This is a narrow parcel of land adjoining Gauvitte Park north of the old Prymos estate which we are acquiring. It is logically a part of the park. 4. This piece of land is Pierce St., and apparently was described as an exception from the lands that were being developed as the street rather than a dedication for street purposes. Resolution #73-77 Ordering improvements on Central Aw~.., 51-53 Resolution offered by Land seconded by Connor BE IT HFREBY RESOLVED by the City Council of the City of Columbia Heights WHEREAS the City Council of the City of Columbia Heights by motion on the 23rd day of October 1973 ordered notice of a hearing to be given to property owners, and WHEREAS, pursuant to a notice of hearing certain residents appeared at a Council meeting on the ]2th day of November ]973, and WHEREAS, the Council determines to proceed with this local improvement, a portion of the cost being defrayed by special assess- ments under Charter provisions, NOW THEREFORE IT IS HEREBY RESOLVED: ]. That the location and extend of such improvements is as follows: Concrete curb installation and associated drainage structures to be installed in conjunction with an urbanization plan for Trunk Highway #65 (Central Ave. N.E.) between 5l and 53 Ave. N.E. Page 236 That the materials to be used are as follows: Concrete That a careful estimate of the cost of the imll~rovement has been made by the City Manager and the several lots~and parcels of land fronting upon and adjacent to such proposed i~lnprovement, which he deemed benefitted thereby, were properly n,i)tified of said hear- ings, and 4. That the City Manager shall also list the nam.i~s and owners of the several parcels so improved as nearly as can be ascertained 5. These improvements shall also be known as Pr,l~ject #688. Roll call All ayes Park Board's policy regarding weed cutting John Moneta was present. He is the owner of land on tlhe northwest corner of 4Oth and University, and feels that there are inequitiles in the billing he received for weed cutting, as compared with his neighblor's bill, and as compared with the amount of his bills from previous yelars. It was pointed out to Mr. Moneta that everyone would be happy if he ~lould cut his own weeds, but when a cutter is hired the city accepts his~ billing, and charges the amount to the property owners. However the City Manager was directed to check into the matter and see if there are any obvi~ous discrepancies in the time spent. Complaint about Shoppers City's vat Mr. Paul Lobash, 4400 Jackson Street, is dissatisfied ~with the placing of the garbage vat at Shoppers City, and also with the amountl of noise coming from their auto repair shop on 44th Avenue. No action was taken by the Council, but it was suggested that a short length of fence could s¢i. reen the vat. The Health Inspector is to contact Shoppers City to see if this titan be done, and also he is to check the sound levels from the garage, with the doors open and closed, and report to the next meeting. A 15 minute recess was called at lO:15. The meeting ~!'econvened at 10:30. Resolution #73-78, Authorizing police radio purchase from Federal Revenue Sharing The Police Department requests authorization to purch~i~se 6 4-channel walkie talkie radios at the price of $884.73. This i.~i~ a bid price that Anoka County received from General Electric for the County II~ommunication system. They are receiving 3 walkie talkies as our portion of the system. However additional vehicles should be equipped. Resolution #73-78 Offered by Land seconded by Norberg BE IT HEREBY RESOLVED BY THE CITY COUNCIL THAT, WHEREAS the Police Department )f the City of Columbia Heights must acquire communication equipment consist I~g of 6 walkie-talkie radio units, and WHEREAS said equipment purchase was ~ot included in the 1973 Police budget, and WHEREAS, Project Prevent, instituted to improve protection to our citizen~, funded through Federal Revenue Sharing NOW THEREFORE BE IT RESOLVED that the City Manager be, and he is hereby a~thorized and directed to purchase 6 4-channel walkie talkie radio units at the bid price of $884.73 apiece, said price being the price bid and accepted by Anoka County from General Electric Company, and BE IT FURTHER RES( _VED that said purchase be made from the Federal Revenue Sharing allotment. Roll call, all ayes Apeco Copier for Police Department The Police Department has in its budget an amount to cover a new copy machine. They request permission to buy an APECO copier for a total price of $995.00 (which includes 12 months service contract). Mr. Watson explained that the old copy machine could be sold to the Engineering Department for $150. The pur- chase of the new machine is more than justified beca~se accident reports are sold for $2 each, and an efficient machine is a must. Mo~ion by Land seconded by Connor to approve this purchase. Page 237 Drop-In Center A proposal has been made to establish a Drop-In Center for teen-agers in a ]itt]e-used area of the Field House (the back portion of the walk-out base- ment). With some remodeling it would be very adequate. Mr. Murzyn, Park Superintendent, submitted a plan. Financing this remodeling will require assistance from organizations interested in young people. Motion by Norberg seconded by Land to authorize the City Manager and the Park Department to secure cost estimates for the necessary work. Roll call, ail ayes Time Management and Time Delegation session The City Manager requests permission to take advantage of a Time Management and Time Delegation session, offered by the University of Minnesota on Nov. 29th. However there are no waivers necessary in this subdivision. (As a matter of record, the soil is such that pilings will be necessary, but Mr. Wakiriak understands this.) Motion by Land to grant the subdivision request, and to divide the $3514.05 special assessments against the benefitted property. Nawrocki passed the gavel to Norberg and seconded the motion. Roll call - Ayes Nawrocki, Land, Norberg. Nay, Connor. The subdivision request was granted., and Nawrocki assumed the chairmanship again. Mid-Block and a]ley lighting, 2nd St., 43 - 44. Petitions were received for the above described lighting, signed by over 50~ of the abutting property owners. Motion by Norberg seconded by Connor to call for a hearing to be held December lOth. Sewer Cleaning Chemicals The City Manager asks authorization to exercise the option on purchasing sewer cleaning chemicals from Oxford Chemical Co. for the year 1974 on the basis of the bids presently in effect. These bids were made in ]970, and this is the last year the prices can be extended. Purchases are made as needs require. Motion by Land seconded by Connor to grant the necessary authoriz,,tion. Roll call, al ] ayes. MELSA (Metropolitan Library ~ervice Area) Motion by Land seconded by Norberg that the Mayor and City Manager be authorized to continue our agreement with MELSA whereby the City is a participant in MELSA with ail rights except voting, and would be allowed to keep our present borrow- ing arrangement with the City of Minneapolis. Ail ayes. Portable Warming House Discussion followed concerning a portable warming house which is available from Cl iff Industries and could be used at the Mini-Park in the winter, and also for recreation activities in the summer. The type of construction aad Insulation Page 238 was questioned. The trailer could be paid for out of unallocated general expense. The product should be investigated, and also it should be de- termined whether or not other such structures are available. The City Manager will report at a later meeting. Columbia Heights Motors, 4849 Central Ave. Mr. William Farmer was present to appeal the denial of the Planning Com- mission for permission to erect 2 "temporaryI' structur.~s, 16 x 20, and 12 x 20, on asphalt slabs, for storage of little-used materials and equip- ment. Although at one time they had intended to construct an addition to their present building, the economy at the present time does not make this feasible. Members of the Council studied the request, but were re- luctant to reverse the decision of the Planning Commission. Motion by Norberg seconded by Connor that the request be denied. Roll call, all ayes. CHANge Order on Cronstroms contract It has become necessary foi: Cronstroms to change an exhaust fan discharge duct on the Municipal Building air conditioning system, due to an unexpected beam which blocks the area where they had planned to c:~t in. It will now be necessary to go through the roof with the duct. Motion by Land seconded by Connor to approve this $143.00 change order. All a>,es. Purchase of a blue print machine Mr. Gustafson requested a replacement of the Engineering Department's blue print machine. The one they have is 8 years old and H. A. Rogers would allow $100.00 for it. The net purchase price will then be $745.00. There is money in the 1974 budget for this expenditure. Motion by Norberg seconded by Land to approve the purchase. All ayes. Tabor Bushnell sound level tests The City Attorney reported that he has not received a report of the sound level tests that were made at Tabor Bushnell, 716 - 39th Avenue. H. P. Droher & Sons, final payment on Municipal Service Center Mr. Gustafson, Public Works Director, reports that H.P.Droher and Sons have completed the items on the IIpunch listI' of items which needed to be corrected. Motion by Norberg seconded by Land to approve their bill for payment. Roll call, all ayes.
