OFFICIAL PROCEEDINGS
Regular Meeting April 23, 1973
The meeting was called to order at 8:06 p.m. Roll Call: Land,
Norberg, Connor, Nawrocki - present. Heintz - absent.
Invocation was given by Councilman Norberg.,
Minutes of Last Regular Meeting.
Motion by Land, seconded by Connor that the minutes of the
regular meeting be approved as presented in writing and the
reading be dispensed with. Roll Call - All Ayes.

Payment of Bills.
A question was raised on payment to Krueger Construction Co.,
in the amount of $920.00. City Engineer Brown explained
this was for construction at the Library - new basement entrance.
The Council members asked for a report on a few small items
including a gap in the door between the door and the frame,
roughness of the interior wall, and the use of City forces
on this ~b.
Motion by Land, seconded by Connor that the following list of
bills be approved and paid out of their prol)er funds. Roll Call

Ordinance #802 - Granting a Franchise to Northern States Power.
The City Attorney reported he met with the Attorney from
Northern States Power Company and they noted a provision in the
Columbia Heights Charter, unique to our situation, on the
time-table for the franchise ordinance to become effective. He
suggested the ordinance be tabled until N.S.P. advises the
City that 60% of the communities involved have adopted this
ordinance. Motion by Land, seconded by Norberg that the 2nd
reading of Ordinance #802 be tabled indefinitely. Roll Call -
All Ayes.
Ordinance #803 Southwest Area Development, West of Main Street.
A second reading was held on Ordinance #803 on the area development
from 37th to 40th Avenue, west of Main Street N.E.
A lengthy discussion was held on the ordinance. Ken Hentges
expressed concern over the proposed land use in the ordinance,
in particular, the amount of land proposed for park purposes.
Mary Kordiak, chairman of the Southwest Development Committee,
was present and said the Committee worked hard trying to come
up with a compromise they felt would be a good proposal for
everyone, although not everyone was satisfied with the proposal.
Mayor Nawrocki said this proposal started out from the Burlington-
Northern Railroad. The Railroad took all the land over to the
alley west of Main Street, including the strip in question, and
it was through negotiation that the City acquired the ~roperty.
He said the reason the railroad gave the City this property was
the Council's insistance for a buffer strip between the railroad
facility and the residents living on Main Street N.E.
The Council talked about some park development that would ease the
noise and inconvenience of the developing railroad facilit~ies.
The proposal we are looking at seems to be a fair compromise
to accomplish several different things for the City. Under
the railroad proposal, they had ownership of the property and
the City had nothing - no buffer, no industry - just the slope
easement to the railroad yard. Now the City owns a strip of
property 1/2 block wide and three blocks long and the City has the
opportunity to provide some type of buffer for the people, a modest
park area, and ~me industrial sites.
Ordinance #803 was offered by Norberg, seconded by Connor.
Roll Call - All Ayes. Ordinance #803 was adopted.
Blasting Damage Claims.
The City Attorney reported the waiting period for filing damage
claims is now up and a letter will be sent to the claimants
shortly on the matter.
C i r-Tech Property.
Bert Foster, president of Cir-Tech was present requesting
Council consideration for an addition to the Ci r-Tech building
at 3905 California Street which he rents from the City, or if
the City would consider selling the bu[ ]ding and property to him
to allow for exoansion of his operation.
Several members of the Council indicated they would be in
favor of se] ] lng the property to Mr. Foster if a fair price
could be worked out. Councilman Norberg suggested if this were
done, that the City also consider authorizing the City Manager
to enter into negotiations on the Bjugan property, the old
City Garage site, and the Zeiss bulding, al I into one bunch.
Motion by Land, seconded by Connor to authorize the City Manager
and City Attorney to negotiate with Mr. Foster of Cir-Tech
Company for the purchase of the so-cai ]ed Cir-Tech property by
Mr. Foster, the negotiations to include besides the price, the
appropriate deed restrictions to al iow for continuing compatible
usage of that property. Roll Call: Land, Connor, Nawrocki - A~s.

Ordinance #804 - Sale of Property.
A request was received from Thomas H. Oh]enkamp to purchase a
22' x 50~ piece of tax delinquent property behind his building
at 4653 Central Avenue. The City Manager met with him and
prepared an ordinance for a first reading which would se] 1 the
property to Mr. Ohlenkamo for
The City Manager reported a letter along with a map showing
the piece of property was sent to the property owners in the
area informing them of this proposed sale.
A first reading was held on Ordinance //804 for sale of Lot Five (5),
Block Three (3), Sheffie]d's Second Subdivision, Anoka County,
Minnesota (Except East 83.33') (Subject to easement for alley
purposes over the North Fifteen feet (]5') of above description
and over that part of said Block lying between the extension of
North and South tines of Lots Five (5) and Twenty-six (26) of
said Fifteen (]5') foot strip.
The suggestion was made that another letter be sent to the property
owners in the area before the second reading is held on this
ordinance, asking if anyone might be interested in purchasing
this property, as it could be available to the highest bidder.
New Zoning Ordinance.
CityPlanner Otterson presented the new Zoning Ordinance, as
recommended by the Planning & Zonin9 Commission. The Council
members suggested this ordinance be tabled until Counci ]man Heintz

could be present at which time a meeting could be set up between
the Council members and the Planning Commission members for
review of the ordinance.
Resolution #73-30 - Revocation of State Aid Designation.
Offered by Land:, seconded by Connor.
WHEREAS, 37th Avenue N.E., between Main Street and the west
corporate limits of the City of Columbia Heights is presently
designated as a Municipal State Aid Street, #13-101-01, and is
designated jointly with the City of Minneapolis, and
WHEREAS, because of the construction of certain railroad yards
lying ~mmediately west of Main Street, the City of Columbia
Heights and the City of Minneapolis deem this designation is
no longer necessary,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Columbia Heights that that portion of the foregoing street
#13-1Ol-O1 lying between Main Street and the west corporate limits
of the City of Columbia Heights be deleted from the state aid
system.

The meeting reconvened at 10:25 p.m.
Solicitors License.
A solicitors license application was received from Charles Schultz
to sell burglar alarms and smoke detectors in the City of
Columbia Heights. A letter was submitted from the Police Chief
which stated there was no record on Mr. Schultz and the Better
Business Bureau had received no complaints on the company.
Motion by Land, seconded by Norberg that the license be granted
upon payment of proper fees. Roll Call All Ayes.
Request to Purchase Sod for Park Department.
It was reported informal bids were taken by the Park Superintendent
for purchase of sod. The bids were from North Lexington Landscaping, Inc.
in the amount of 25¢ per yard, and from W. & G0 Rehbein Bros., Inc.
in the amount of 24¢ per yard. Because of the quality of the
sod, ~ was the Park Superintendent's recommendation to purchase
the sod from North Lexington.
Motion by Connor, seconded by Land that the City Manager be
authorized to spend up to $3,000 for sod at the rate o~ 25¢
per yard from North Lexington Company and that the informal
quotations be made a part of the record. Roll Call - Al ] Ayes.
Petitions in Oonosi tion to Various Approved Construction Projects.
The City Manager presented a report and tabulation on the
petitions received in opposition to approved construction
work in the southwest section of Columbia Heights. He said in
particular, 2nd Street from BBth to Bgth Avenue, where 19 owners
out of 50 had signed the petition. He reported discussions
held with various staff members on the situation and methods
discussed of easing the burden of the costs on iow income
residents in the area.
Motion by Land, seconded by Norberg that the petitions be placed
on file. Roll Call All Ayes.
Several Council members indicated because so many people on
2nd Street had signed the petition, they would be in favor of
holding another hearing on the project for consideration of
possib]y dropping that section from the construction program.
Motion by Norberg, seconded by Connor that the [nearing be
re-opened on curb, gutter and surfacing of 2nd Street from
38th to Bgth Avenue N.E. , hearing to be held at the next regular
City Council meeting, May ]4th, and that notices be sent to
all signatures of the petitions, and to al I residents on 2nd
Street from 38th to Bgth Avenue N.E. Roll Call - All Ayes.
Board of Review.
The City Manager reported the date for Board oF Review in Columbia
Heights has been scheduled for Wednesday, May BO, 1~7B as
set by the County Assessor.
Old City Garage.
The City Manager reported receivi~ numerous requests for either
a lease arrangement or purchase of the o]d City Garage and
adjoining property, when it becomes vacant. Motion by Norberg,
seconded by Land that the City Manager be authorized to secure
an appraisal on the o]d City Garage and property. Roll Call -
All Ayes.
Artistic Screening Building.
The City Manager reported a letter was received from John Remes,
an Attorney for the Bjugan's who lease the Artistic Screening
building from the City requesting consideration of transferring
the lease to another party. Motion by Connor, seconded by

Norberg that the City Manager be authorized to pursue the
request for a transfer of the lease for the Artistic Screening
property and to discuss with the prospective lessee their
interests in possibly buying the property, and be authorized
to secure such appraisal assistance as may be desirable. Roll

Newsletter.
Tim Yantos presented a report to the Council on publishing a
quarterly newsletter. He reported on two ways of handling
the work on this and cost estimates including printing, and
mailing costs. The Council members asked that they be allowed
more time to review the matter and more discussions will be
held before the newsletter is prepared.
Annual Fire School.
A request was received from the Fire Chief to allow two members
from his department to attend the Minnesota State Fire School
May 8, 9, 10, and 11 to be held in Minneapolis. Registration
fee is $30.00 per member. Motion by Land, seconded by Norberg
to grant the request. Roll Call - All Ayes.
Alley Lighting, West of Reservoir, from 40th to Gould.
Motion by Norberg seconded by Land that based on a petition, the
City Manager be authorized to advertise for a hearing on mid-block
lighting west of Reservoir Boulevard, between 40th and Gould Avenue,
hearing to be held at the next regular Council meeting, May 14th.

Minnesota Manager's Conference.
The City Manager requested authorization to attend the annual
spring institute of the Minnesota Manager's Association to be
held May lO-11 in Hill City, Minnesota. Motion by Land, seconded
by Connor that the request be granted. Roll Call: Land, Norberg,
Connor- Ayes. Nawrocki Abstained.
Contract on Water Standpipe Maintenance.
A request was received from Sewer & Water Superintendent Jolly
to take bids on a contract for inspection, recommended repair
work and annual maintenance on the water standpipe.
Motion by Norberg, seconded by Land that the City Manager be
authorized to secure proposals for complete inspection, refurbishment
and maintenance contract for the water tower, to be opened
May 24th, and report at the May 29th regular Council meeting.

Purchase of Fire Hydrants.
A request was received from Sewer & Water SuoerintendentJo] ]y
to purchase ten fire hydrants and sewer castings. Motion by
Norberg, seconded by Connor to authorize the City Manager to
purchase ten ~aterous fire hydrants from the ~aterous Company
and up to $],454 worth of castings from Ad]er, based on
low informal quotations. Roll Call - All Ayes.
Proclamation for Fire Service Recognition Day.
Mayor Nawrocki read the Col]owing Proclamation:
WHEREAS, the fire service of the State of Minnesota is among the
most important services rendered to the residents of this State,
and
WHEREAS, the hundreds of fire fighters in the State of Minnesota
are faced with the inherent and extreme hazards of fire-fighting,
and thus do hourly risk injury and death in their given tasks
of saving 1 ives, fighting fires and protecting properties, and
\~HEREAS, the count]ess unclaimed instances of deeds of heroic
and epic ] ire saving and fire-fighting that they perform exempl i fy
their great sense and spirit of dedication and devotion to duty
and service to their fei low man.
NOW, THEREFORE, I, Bruce G. Nawrocki, Mayor of the City
of Columbia Heights, Minnesota, do hereby oroclaim Saturday,
May 12, 1973 as
~'FIRE SERVICE RECOGNITION DAY''
in the City of Columbia Heights, Minnesota, and urge that all
citizens make proper recognition of their most nob]e, heroic
and hazardous pursuit.
Resolution #73-3] - setting Date for Council Meetings.
Offered by Connor, seconded by Norberg.
BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights, that
the City Council of the City of Columbia Heights meets regularly
on the 2nd and 4th Mondays of each month at eight o'clock p.m.
That when such regular meeting shall fal] on a National Ho] ]day,
such regular meeting sha]] instead be held on the
Tuesday at eight o'clock p.m. after the Monday on which such
regular meeting would have otherwise been held.

Drainage Problems.
The City Engineer reported there are two drainage problems
where hearings on storm drain installation should be scheduled.
One area is between Lincoln and Buchanan Street north of 37th
Avenue, and 43rd to 44th Avenue, 7th to Washington Street.
Motion by Norberg, seconded by Land that the City Manager be
authorized to advertise for hearings on storm drain, hearings
to be held at the regular Council meeting, May 29th.

Bids on Project #7301.
City Engineer Brown reported bids will be receLved on
April 30th at 2:00 p.m. on project #7301 which includes
relocation of Lookout, curb replacement on 41st Avenue, park
improvements, a drainage facility, etc. He asked that a
special City Council meeting be scheduled sometime that week
to consider award of the bids.
Motion by Land, seconded by Connor that a special meeting of the
City Council be scheduled for Tuesday, May 1st, at 6:30 p.m. in
the City Council Chambers to receive a report and consider
awarding the bids on project #7301. Roll Call - All Ayes.
Licenses.
Motion by Land, seconded by Connor that the licenses as listed
be approved upon payment of proper fees. Roll Call - All Ayes.
Street Sweeping.
Mayor Nawrocki said he asked for a report on the street
sweeping operations and said after reviewing the report, he
was not happy with the program to date. He asked for a
report on an improved program, possibly what a private contractor
could do for theCity on this.
Motion by Norberg, seconded by Connor to adjourn at l:lO a.m.
