Regular Meeting
April 9, 1973
The meeting was called to order at 8:04 p.m. Roll Call:
Norberg, Connor, Nawrocki - present Heintz - absent.

Invocation was given by City Manager Watson.
Mayor Nawrocki introduced a young fellow doing a report on government
for a class at Grace High School who would be present for the
Council meeting to take notes and see how the Council operates.
Minutes of Lint Regular and Special Meetings.
Motion by Connor, seconded by Norberg that the minutes of the
last regular and special meetings be approved as presented
in writing and the reading be dispensed with. Roll Call - All Ayes.
Payment of Bills.
Motion by Norberg, seconded by Land to approve the bills as listed
to be paid out of their proper funds. Roll Call -All Ayes.

Award of bids on Asphaltic Materials.
The City Engineer reported bids were received on Thursday, March 29th,
at 2:00 p.m. on asphaltic materials. A tabulation of these
bids was presented to the Council with a report on the
low bids.
The report indicated L. N. Sickels Co. was low on delivered and
picked up SS1, CRS1, CRS2, and SSKH. Northwestern Refining was
low on delivered and picked up SC-250, SC~800. Richards Oil was
low on d~stributed MC-30, MC-70, MC-250, MC-800, RC-70, RC-250, and
RC-800. Jay W. Craig was low alternate on distributed
SC-70, SC-250, SC-800, MC-30, MC-70, MC-250, MC-800, RC-70, RC-250,
RC-800, SS1, CRS1, CRS2, and SSKH.
Motion by Land, seconded by Norberg that the bids be awarded
based on the tabulation and report from the City Engineer, that the
Mayor and City Manager be authorized to enter into a contract for
same. Roll Call - All Ayes.
Award of bids on Road Aggregates.
The City Engineer reported bids on road aggregates were also
received on Thursday, March 29th, at 2:00 p.m. A report on these
bids, along with a tabulation form, was presented.
It was reported A & B Aggregate, Inc. was low on picked up
Class 6, and picked up and delivered Class 3. Bryan Dresser Traprock
was low on picked up and delivered FA-4. Barton Contracting
was low bid on picked up and delivered B~-2, delivered Class 6,
picked up and delivered Class 2, picked up and delivered FA-2, and
pi cked up and delive~ sanding sand and coarse aggregate, CA-1.
Motion by Land, seconded by Connor that the bids be awarded as
recommended on the tabulation form and report from the Engineer,
that the Mayor and City Manager be authorized to enter into a
contract for same. Roll Call - All Ayes.
Award of bids on Plant Mixed Bituminous.
The City Engineer reported bids on plant mixed bituminous were
also received March 29th at 2:00 p.m. A report on and tabulation
of these bids was presented.

The low bid on picked up standard mix, fine mix and fine mix &
mineral filler was Midwest AsDhalt. The low bid on delivered
standard mix, fine mix, and fine mix & mineral filler was
Dunk!ey Surfacing. Hardrives was the low alternate on the
picked up materials.
Motion by Norberg, seconded by Land that the bids be accepted
as presented by the Engineer, that the Mayor and City Manager be
authorized to enter into an agreement for same. Roll Call -
All Ayes.
Bids on Equipment Rental.
The City Engineer also reported on the bids received on equipment
rental for 1973. He asked for authorization to utilize the ]ow
responsible bidde~ as necessary throughout the construction
season as needed. He said this was not a formal bid, but would
give the City the means to rent equipment needed.
Motion by Land, seconded by Norberg to authorize the City Manager
to utilize the bids as necessary. Roll Call - Al ] Ayes.
Anoka County Bid on Seal Coat Project.
The City Engineer reported on bids Anoka County received on seal
coat work for 1973. This work includes Reservoir Boulevard
which the County will be doing this summer. He said the
County Enqineer has asked for City Counc[ 1 concurrance in
award of the bid to H & S Asphalt.
Motion by Norberg, seconded by Connor to concur in the recommendation
for award of County bid on seal coat project to H $ S Asphalt.
Roll Call - All Ayes.
Anoka County Bid on Traffic Marking Services.
The City Engineer also noted County bids on traffic marking
service which is available to Anoka County municipalities.
The Counci 1 members asked how the City could avail itself to
this service and the City Manager was asked to research the
City joint powers agreement.
Motion by Norberg, seconded by Land to table the matter.

Roll Call -
Ordinance //802 - To Grant Franchise to Northern States Power Co.
A discussion was held on various sections of Ordinance //802 which
would grant a franchise to Northern States Power Company.
Motion by Norberg, seconded by Connor to table the second reading
of this ordinance until the next regular meeting. Roll Cai] -
All Ayes.

Resolution #73-27 Authorizing Contract with Consulting Architect
for LaBelle Park Development.
A letter was submitted by the City Planner and Park Superintendent
indicating their recommendation on selection of a consulting
architect for LaBelle Park, that being the firm of
Nason, Wehrman, Chapman Associates, Inc., based on interviews
with several architectural firms.
The Council members reported a poll was taken of the Park Board
members and they would have to go along with the Park Board
recommendation of the firm of Brauer & Associates. A resolution
to that effect was prepared and read.
Offered by Land, seconded by Connor.
BE IT HEREBY RESOLVED by the City Council ~ the City of
Columbia Heights, that
WHEREAS, the City of Columbia Heights is in the process of
development of LaBelle Park which development has qualified
for federal grant assistance, and
WHEREAS, it is necessary to properly proceed with said
development to have a qualified architectural firm to handle the
detailed plans, design and inspection thereof, and
WHEREAS, the City Council and the City Park Board have interviewed
various landscape architectural firms regarding said development
and have submitted their recommendation for selection,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Columbia Heights, that the Mayor and City Manager be and they
are hereby authorized to enter into an agreement with Brauer and
Associates, to serve as the architect for LaBelle Park development.
Roll Call - All Ayes.
Side Yard Waiver for Garage at 4337 Main Street.
A request was received from John Astgen for a side yard waiver
to build a garage 2' from property line at 4337 Main Street,
on a 40' lot. This was recommended by the Planning & Zoning
Commission. Motion by Connor, seconded by Norberg that the
waiver be granted to allow placement of the garage 2' from the
side lot line in lieu of 3' Roll Call - All Ayes.
Fence Height Waiver, 4323 - 3rd Street.
A request was received from Roland Deming, 4323 Third Street, to
place a 5' chain link fence around his house which sets to the
rear of his property near the highway right-of-way. A petitbn
was signed by Mr. Deming's neighbor indicating no objections to
the fence. The waiver was recommended by the Planning Commission.
Motion by Norberg, seconded by Land to grant the waiver. Roll
Call - All Ayes.

Special Use Permit for Travel Trailers at 4955 Central.
Mr. Osterhus was present requesting a special use permit and
a ]icense to rent travel trailers at the Ske] ]y Station which
he proposes to re-open at 4955 Central . He presented a sketch
of the property noting there wou]d be room for approximately 15
trailers. The request was reviewed by the Planning Commission
who recommended the licenses be granted. Motion by Norberg,
seconded by Land that the special use permit be granted, and
that no more than ten trai lets be parked along the rear ~operty
line as indicated on the sketch. Roll Call - All Ayes.
Fence and Garage Waivers, 1912 42nd Avenue.
Waiter Rasmussen, new owner of 1912 - 42nd Avenue, was present
with a request for ~ ivers to construct a garage and fence in
front of his home, in 1 ine with the house next door at ]906 - 42nd Avenue.
The fence is proposed to be 7' high alternating board fence which
would extend from the garage along his driveway to within ]0' of
the front lot ][ne.
A letter was received from Ronald Laliberte, neighbor at 1906 42nd,
in opposition to the proposal. The letter indicated at the time
the Planning Commission reviewed this and recommended approval,
he misunderstood the proposal and after he had a chance to review
more carefully, found it objectionable for several reasons.
A lengthy discussion was held on tlne matter. The Council members
indicated they normally 1 [ka to get a written statement from the
neighbors stating no objections to granting waivers of this kind,
It was suggested that the matter be tabled until the next meetinq
to give the neighbors a chance to work out a solution to the
problem and come back with an agreement.
Motion by Norberg, seconded by Land to table the request until the
next regular City Council meeting with the hopes that the two
affected property owners can work out an amicable solution.

Front Yard 'daiver, 4842 Stinson Boulevard.
A request was received from V~arren Anderson, 4842 Stinson Boulevard,
for a waiver to erect a "New 0rleans'~ balcony across the front
of his home. This would be a 20 x l0 balcony above the tuck-under
garage. The two neighbors have signed statements indicating no
objections to the proposal and the request was recommended by the
Planning Commission. Motion by Norberg, seconded by Connor to
grant the request. Roi ] Cai 1 Al 1 Ayes.

Special Use Permit, 3710 Th[rd Street.
A request was received from the members of Alcohol[cs Anonymous
that the special use permit they have for a club room at 4301 - 5th Street
be transferred to 3710 Third Street. They have rented a house
at 3710 Third Street, owned by Wagamon Bros. Engine Rebuilders
who have an industrial building across the street. The parking
facilities at Wagamon Bros. would be available to the AA members.
Motion by Land, seconded by Norberg that the special use permit
be granted, based on the Planning Commission recommended, and that
there be no additional fee for 1973. Roll Call - All Ayes.
New Zoning Ordinance and Map.
The City Manager reported to the Council the Planning & Zoning
Commission has now completed their work on the new zoning ordinance
and the map and they will be forthcoming to the Council at the
next regular meeting.
Recess was called at 9:45 p.m.
The meeting reconvened at I0:00 p.m.
Left Turn Lanes, 44th and 45th Avenues at the Intersection of Central.
A recommendation from re Traffic Commission was received that a
request be made of the State Highway Department for consideration of
left turn lanes at 44th and Central, and at 45th and Central.
Motion by Land, seconded by Norberg that the City Manager be
authorized to contact the Highway Department and request a
feasibility study of those intersections. Roll Call - All Ayes.
School Crossing Signs.
A recommendation was also receded from the Traffic Commission to
complete the school crossing signing program. Motion by Land,
seconded by Norberg that the City Manager be authorized to spend
up to $1,000 for purchase of school crossing signs. Roll Call -
All Ayes.
Revenue Sharing Funds.
Mayor Nawrocki presented his proposals on the use of federal
revenue sharing funds. Included tn the proposals were as follows:
A fire sprinkler system, fire detector system for the new senior
citizen housing project, estimated at $65,000.
In the Police Department, an accelerated crime prevention program
at $20,000. $7,000 to be committed to the purchase of two new squad
cars. A $6,000 commitment to buy five walky-~lkyradios.

In the Park Depatment, a $20,000 exoenditure for a beautification
program for the oarks. 1/2 the cost for trees and shrubs, and ]/2
the cost for the labor involved.
In the Public Works Department, the OSHA equipment estimated at
$3,000~ and a grader estimated at $28,000.
In the Fire Department, replacement of an emergency vehicle estimated
at $]5,000.
In the Library, $5,000 to be committed to a collection of
cassette taoes and recorders, the tapes to be borrowed out ]ike
Library hocks. Also in the ]ibrary, $] ,000 commitment for a
partition wa] 1 by the check-out desk to cut down the noise into
the adult reading section.
$15,000 was oroposed for the remodeling plans for the City Office.
Two other possibilities were a street sweeper at SIS,000 and a new
bandstand for the Park Department estimated at $5,000.
Mayor Nawrocki said these were his suggestions and asked for some
type of concurrance or commitment from the Council immediately on
one particular oroject, that being the fire detector system for
the senior citizen bui ]ding. He said the City Attorney would have
to explore our legal capabil i ties on any of these exoenditures.
The Counci] members expressed concern over the proposal.
They indicated they Rd their own ideas on the use of the
revenue sharing funds. Councilman Norberg brought up his own
ideas and the costs involved. Councilman Land asked what the
rush was on the fire sprinkler system and asked why the other
Council members were not notified of the rush on this item before
the meeting.
Mayor Nawrocki said they have been working with the federa] people
trying to get some money from them for this system to no avail.
If we can't get a commitment from the Council on this system,
the only alternative would be to cut off one story from the building
and decrease the number of dwel] ing units to 88.
Motion by Norberg, seconded by Connor to commit the City to
providing funds for this sorinkler system and/or fire detector
system in any way that the City Attorney deems legal. Roll Call -
All Ayes.
It was suggested an informal meeting of the Counci ] members be
held on Friday evening to discuss the other possible uses and
proposals for the revenue sharing funds.

Appointments to Boards and Commissions.
Motion by Norberg, seconded by Land to reappoint Gordon Schelde to
the Park Board for a five year term, to reappoint Donna Ingvarsson
to the Library Board for a three year term, to reappoint
John Pappas to the Merit Commission for a five year term, to reappoint
John Nelson to the Traffic Commission for a 4 year term. Roll Call -
All Ayes.
International Chiefs ol-' Police Association Conference.
A request was received from the PoliceChief to attend the International
Chiefs of Police Association Conference in San Antonio, Texas
September 22-27. Motion by Norberg, seconded by Connor to grant
the request. Roll Call - All Ayes.
Recreation Commission Expenditure.
A request was received from the Recreation Commission to allow
an expenditure of $1,600 to subsidize the School Recreation Center
Fund. Motion by La~d, seconded by Connor to grant the request. Roll
Call - All Ayes.
Community Planning Seminar.
A request was received for authorization for up to five people to
attend a Community Planning Seminar at North Hennepin Junior
College, April ll, 18, and 25th. The fee is $10 for each
registrant. Motion by Norberg, seconded by Land that three people
be authorized to attend the seminar. Roll Call - All Ayes.
Card Catalog for Library.
It was reported the Library received informal quotations from
three suppliers for a card catalog for the Library. The recommendation
was an expenditure of $654.00 for the purchase from the Demco
Company. Motion by. Land, seconded by Norberg to authorize the
expenditure. Roll Call - All Ayes.
Purchase of Agricultural Crush Lime for Park Department.
A request was received from the Park Department to purchase
agricultural crush lime for use in park areas. Informal.
quotations were received from two companies and the Park
Superintendent requests the bid from Bryne Rock Products, low
bidder, in the amount of $2.00 per ton picked up and $3.75 per ton
delivered be accepted. Motion by Land, seconded by Connor that
the City Manager be authorized to spend up to $1,500 for agricultural
crush lime based on the informal bids. Roll Call - All Ayes.

Petition on Alley Lighting, West of Reservoir, 4Oth to Gould.
A petition was received for ins~ lation of an alley light west of
Reservoir Boulevard, from 40th to Gould Avenue. Motion by
NorberBseconded by Connor that the petition be accepted, turned
over to the City Manager for tabulation and investigation with a
report back at the next regular Council meeting. Roll Call - All Ayes.
Proclamation on Postal Week.
The fo!lowing P~3clamation was read:
WHEREAS, Columbia Heights, Minnesota, is linked to the
nation and the world by our National mai] service; and
WHEREAS, the welfare of every citizen, every business, on every
street and across the countryside, is dependent upon this vast
communications network, available to all our people the year around,
at a price everyone can afford; and
WHEREAS, by law, your Postal Service--and the men and women who
operate it--is obligated to serve our community and the nation
on a non-profit basis, with courtesy and care, and to keep Postal
costs in balance with postal revenues; and
WHEREAS, to do this, the mai] service needs the informed understanding,
cooperation, support, and constructive suggestions of every citizen
of our community;
NOW, THEREFORE, I, Bruce G. Nawrocki, Mayor of the City of
Columbia Heights, do hereby proclaim the week beginning April 29, 1973,
as "POSTAL WEEK" in the City of Columbia Heights, and call upon all
citizens to join in the occasion for recognition of the vital
responsibilities assigned to the mail service and its employees
and to take stock of the challenges which must be jointly met by
Postal people and the citizens of Coiumbia Heights who depend upon
the mai] as an essential part of their personal and business lives.
Petitions in Opposition to Approved Construction Work.
The City Manager reported following the hearings last week on
street improvements in the southwest section of Columbia Heights,
four petitions were received signed by affected residents in
opposition to the approved work. Motion by Norberg, seconded by Land
that the petitions be turned over to the City Manager for tabulation
and investigation with a report back to the Council at the next
regular meeting. Roll Call All Ayes.

Resolution #73-28 Rega~ng Police and Fire Pension Plans.
Offered by Land, seconded by Norberg.
BE IT HEREBY RESOLVED by the City Council of the City of Columbia
Heights, that
WHEREAS, private pension plans were established by agreement with
the Police and Fire Departments where the City agreed to levy up
to 1½ mills per year for each department with the members of these
pension associations administering the pension program setting
benefits consistent with the avail alJe funding, and
WHEREAS, in 1969 a legislative session abolished this private
agreement by the 1969 Guidelines Act necessitating taxpayers
con tributions far in excess of the 1½ mill tax ceiling pensions
originally established and has caused a pension program system which
has worked a hardship on the taxpayers, and
WHEREAS, during the collective bargaining process with these
respective Police and Fire Departments, accord was reached wherein
the employee representatives agreed not to oppose the placement of
new employees in the Public Safety P.E.R.A. pension system and
agreed upon a fixed salary base upon which pension contributions
and computations would be calculated, and
WHEREAS, the Hewitt plan which has been proposed merely delays but
does not reduce the fiscal import to the taxpayers of the City of
Columbia Heights, and
WHEREAS, it is essential that the Council be fiscally respons~ble
to the taxpayers they represent, and, in order to do so, appropriate
legislation must be enacted authorizing fair and equitable procedures
in pension administration,
NOW, THEREFORE, BE IT RESOLVED that the City of Columbia Heights
urges the Legislature to support the following legislation:
Increase the insurance rebate on automobile insurance policies
from one(l) percent to two (2) percent to help finance police
pensions.
2. H.F. 1468 (S.F. 1709) as amended.
BE IT FURTHER RESOLVED, that if the Legislature does not support item
number two (2) above, that the Legislature support private legislation
for the City of Columbia Heights recognizing the validity of the 1972
Charter Amendment in which newly employed Police Officers would be
members of the Public Safety P.E.R.A. pension system and
recognizing the negotiated salary level as a base for pension purposes.
That said private bill should set standards that would provide fiscal
relief to the taxpayers of the City of Columbia Heights.

BE IT FURTHER RESOLVED that the City Council of the City of
Columbia Heights urges the Legislature not to SUDOOrt the Hewitt
plan.
BE IT FURTHER RESOLVED that the Legislature support a Bill for an
Act relating to Do] icemens relief association in the City of
Columbia Heights and membership of certain 0o] ice oersonne] in
the Public Employees Pol ice and Fire Fund attached hereto as
Exhibit A and made a part hereof.
BE IT FURTHER RESOLVED that the City Manager and those which he
chooses to employ be, and they hereby are, authorized and directed
to assist our Legislators in the implementation of the
foregoing on behalf of the City of Columbia Heights.
