Special Meeting
April 4, 1973
The meeting was called to order at 8:09 p.m. in the Field House.
Roll Call: Land, Norberg, Heintz, Connor, Nawrocki - All Present.
A number of residents from the affected area were present for this
meeting.
Mayor Nawrocki reported this special meeting was called for the purpose
of hearings on public improvement projects which have been recommended
by the City Engineering Department in the area south of 40th Avenue,
west of University Avenue. The purpose is to expose the
proposed projects to the people involved with them, to hear comments,
criticisms, and opinions to help the Council determine what projects
should go ahead.
Clayton Berg from the City Engineering Department made the
presentation, using the over-head projecter for visual aids:
Storm Sewer Proposal:
Mr. Berg reported the proposed storm sewer work is necessary to
complete the storm drainage system in the area from 37th to 40th Avenue,
2nd Street to University Avenue. He showed the existing storm
sewer, and what is proposed. He pointed to the boundaries of
the proposed assessment and reported the proposal on the
assessment is a maximum of 2¢ per square foot with credit to
be given for anything paid in the past.
A question and answer session was held and residents voiced
their opinions on the project.
Moron by Norberg, seconded by Land that the City Manager be
authorized to proceed with the storm sewer project, as presented.
Roll Call - All Ayes.
Curb, Gutter, Base and Mat, as Follows:
38th Avenue, California to University:
Mr. Berg presented the proposal to construct 38th Avenue,
from California Street to University Av~que. He said 38th Avenue,
from Main Street to 3rd Street is covered under the state aid
system and would ~ constructed 45' wide back to back on
the curb. Under state aid, the assessment would be
for the curb and gutter only, at $5.50 per assessable front foot.
He said the remainder of 38th Avenue, from California to
Main ~reet, and from 3rd Street to University, would be handled
as a normal residential type street and is proposed at 33'
back to back at an assessment of $13.00 a foot.

Residents present objected to the work involved in the 1/2 block
area from Cai ifornia Street to Main Street.
Motion by Heintz, seconded by Land that the City Manager be
authorized to proceed with the project on 38th Ave nde from
Main to 3rd Street under state aid, and from 3rd Street
going east under residential . The area from Cai ifornia
to Main Street was dropped from the project.
Roil Call - All Ayes.
2nd Street from 38th to 39th Avenue:
2nd Street is proposed as a residential design, 33' back to
back on the curbs. The assessment is estimated at S13 Der
assessab!e front foot.
Motion by Land, seconded by Norberg that the City Manager be
authorized to proceed with construction on 2nd Street from
38th to 39th Avenue. Roll Call - All Ayes.
39th Avenue, California Street to 2nd Street:
39th Avenue, from Cal ifornia to 2nd Street is also proposed
as residential design, 33' back to back at a cost estimate of
$]3.00 Der assessable front foot.
Residents present objected to the proposal stating their
reasons For objecting as ]itt]e traffic, they do not feel
curb and gutter is essential, and many of the property owners
al ready have large assessments on other projects which
should be oaid up first.
Motion by Heintz, seconded by Land that the project be denied.
Roll Call - All Ayes.
3rd Street, 37th to Edgemoor:
3rd Street ~om 37th to 38th Avenue is proposed under the state
aid system, and 38th to Edgemoor is proposed under the
residential type design street. Cost estimates were given
at $5.50 per foot on the state aid, and $13.00 per foot on
the residential section.
Residents oresent complained about the Dory trucking operation
on 3rd Street and asked that something be done on the dusty
conditions on the street created by Dory. The matter wi 1 ] be
checked by the staff.
Motion by Heintz, seconded by Norberg~hat the City Manager
be authorized to proceed with construction of 3rd Street from
37th to 38th Avenue under state aid, and ~rom 38th to
Edgemoor under residential . Roi ] Cal 1 ~ Al ] Ayes.

Edgemoor Place, 2½ Street to 40th Avenue:
It was reported E~emoor from 2½ to 40th Avenue serves basically
as an alley. Only one property fronts on it.
Residents were not in favor of complete construction of
curb, gutter and surfacing, or even a modified alley plan.
A petition was ~ceived signed by many of the residents in
opposition to the proposal.
Motion by Heintz, seconded by Land to accept the petition and
place it on file. Roll Call - All Ayes.
Motion by Heintz, seconded by Norberg to deny the oroject.

Resolution #73-25 Authorizing Storm Sewer Project:
Offered by Norberg, seconded by Land.
BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights,
WHEREAS, the City Council of the City of Columbia Heights by
motion on the 12th day of March, 1973 ordered notice of a hearing
to be given to property owners, and
WHEREAS, pursuant to a notice of hearing certain residents
appeared at a Council meeting on the 4th day of April, 1973, and
WHEREAS, the Council det~mines to proceed with this local
improvement, a portion of the cost being defrayed by special
assessments under Charter provisions.
NOW, THEREFORE, IT IS HEREBY RESOLVED:
t.That the location and extent of such improvement is
Storm Sewer in the following area:
University to Alley between Main and 2nd 'Street N.E., from
37th to 40th Avenue;
Lots 10 thru 26, Block 50, Columbia Heights Annex between
Main and 2nd Street N.E. north of 40th;
The W.160' of Lot 7, Block2, Rearrangement of Block D,
North of 40th and east of 2nd Street N.E.
2. That the materials to be used are as follows: Reinforced
concrete pipes and manhole and catch basins in accordance
with specifications governing same.

That a careful estimate of the cost of the improvement has
been made by the City Manager and the severe] lots and
parcels of land fronting upon and adjacent to such
improvement, which he deemed benefited thereby, were
properly notified of said hearings, and
That the City Manager sha]] also i [st the names and owners
of the several parcels so improved as nearly as can be ascertained.
5. These imorovements sha]I also be known as Project No. 6]4.

Resolution #73-26 authorizing Street Improvementsi

BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights,
WHEREAS, the City Council of the City of Columbia Heights by
motion on the ]2th day of March, ]973 ordered notice of a
hearing to be given to property owners, and
'4HEREAS, pursuant to a notice of hearing, certain residents
appeared at a Council meeting on the 4th day of Aori], ]973,
and
WHEREAS, the Council determines to proceed with this local
improvement, a oortion of the cost being defrayed by SDecial
assessments under Charter orovisions.
NOW, THEREFORE, IT IS HEREBY RESOLVED:
That the location and extent of such improvement is as
follo,.~s: Curb, gutter, base and mat on:
38th Avenue N.E., Main Street to the alley west of University.
2nd Street N.E., 38th to 39th Avenue N.E.
3rd Street N.E., 37th to Edgemoor Place.
2. That the materials to be used are as Follows:
Concrete and Asphalt.
That a careful estimate of the cost of the improvement has been
made by the City Hanager and the several lots and parcels
of ]and fronting upon and adjacent to such proposed
improvement, which he deemed benefited thereby, were
properly notified of said hearings, and

That the City Manager shall also list the names and owners of
the several parcels so improved as nearly as can be
ascertained.
5. These improvements shall also be known as Project No. 676.
Ordinance #803 on Southwest Development.
A first reading was held on Ordinance #803 on the southwest
development proposal. A lengthy discussion was held on the
ordinance. Bert Foster, from Cir-Tech, was present and answered
questions from the Council members on the matter. He asked the
Council to let him know whether the City would be agreeable to
sell the Cir-Tech property to him.
It was proposed the second reading of the ordinance and the
public hearing be held at the April 23rd Council meeting
at which time a proposal could be worked out.
Motion by Land, seconded by Connor to adjourn at ll:17 p.m.
