Certificate of Appreciation.
A certificate of appreciation was presented to Mrs. Rosemary Byrnes
in recognition of her service on the Columbia Heights Housing
and Redevelopment Authority since its inception.
Bids on Graders.
Bids were considered at the last Council meeting on a new grader
and the matter was tabled for additional information.
The City Manager reported since the last meeting, he and the
City Engineer visited each of the companies that bid on the graders -

Hall Equipment Company. Seorga T. Ryan Comoany, anJ Z[ezler Company.
Based on the bids as submitted and his evaluations, recognizing
the need for fast, re] labia service, he must agree with ~he
City Engineer in the recommendation to award the bid to
Zieg]er Company on a Cat ]20.
A lengthy discussion was held on the bids, in oarticular the
hydrau]ic vs. mechanical control systems for the blade. The
specifications called -for mechanical, but the only bidder on
mechanical controls was Ziegler Comoanv. q_uestions were raised
if tile requirement for mechanical system was an essential mart
of the soecifications, and how many responsive bids were
received. Councilman Norberg said he had done some research on
the matter and doesn't agree that the mechanical system is
that important and expressed concern that the specs ,.~,er~ written

T:~e City Attorney said according to the specifications, we have
one responsive bidder and thaE is Ziegler Comoany. The Counci]
can make an award if they fee] a fully nechanica] system is
necessary because of its adaptation and suitabi ] ity to the
City's needs.
Motion by Land, seconded by Heintz, that based on the recommendation
of the City Manager and City Engineer, that the bid be awarded to
Ziegier Company in the amount of $27,~98 which includes an allowance
for trade-in wltln the option of an additional deduct for $],200
for the City to kee~ the existing scarifier and for the City to
re-mount it on the piece of equioment, that the City Attorney
has reached the determination that this equioment is indeed the
suitable system For tiaa City's particu]ar needs.
Roll Call: Land, Heintz, Connor, Nawrocki - Ayes.
Norberg - Nay. Councilman Norberg said he voted no because the
di~eerences in his opinion between these devices are trivial and
he considers this an unnecessary subversion of the ]-~'~'1 bidding
process.
Ordinance #800 Regulating the Use of Pinball Machines.
A secona reading was held on Ordinance ~800, amending #226, being
an ordinance to li'cense and regulate games of skill and orovidin~
a penalty for the violation thereof.
Mayor Nawrocki said the justification for this ordinance was to
make our ordinance sim[ ]ar to thcs._ in ot:,~r communities in our'
area. This orJ[nance as oresented would delete Section 4 of
,~.rdinance #22~ ?rohibiting anyone un~r ]:~ years o~ age to
olay such devices.

The City Attorney explained the state law does not have any
restriction on the age of the players, although the state law
covers provisions of gambling and lottery.
Gene Mady was present and explained how he controls the use of
pinball machines in his bowling alley and requested the ordinance
be amended to drop the age limit on use of the machines.
~ letter was received from the Columbia Heights DFL which
reported a resolution was passed to go on record in support of a
change in the p~nball ordinance to allow anyone of any age to
use p~nball machines in the City.
The ordinance was offered by Connor, seconded by Neintz.
Roll Call: Heintz, Connor, Nawrocki - Ayes. Land, Norberg -
Nay. The ordinance was adopted.
Councilman Land said he voted against this because he felt it
was not necessary for the younger kids to be putting money into
these machines.
Resolution on Commission on Science and Engineering.
It was reported this re~lution was tabled because Cooncilman Norberg
was unable to ~ present for a while. The Council members
indicated their desire to discuss this matter with Councilman Nor~erg
before action is taken. The matter was postponed until the
next regular meeting.
Ordinance #801 - Sale of Property.
A first reading was held on Ordinance #801 - authorizing sale
of Lot 22, Block 74, Columbia Heights An rex, to Burlington-Northern
Railroad. It was noted a second reading will not be held
on the ordinance until the 2nd reading is held on the ordinance
vacating streets and alleys for Burlington-Northern.
Resolution #73-06 on Plan Review of Highway 47.
The City Manager presented letters from the Highway Department
and from the residents, who have met and reviewed the plans for
beautification of Highway 47, and who are now in agreement with
the revised plans on the east side of University Avenue.
Resolution #73-06 was offered by Land, seconded by Heintz.
WHEREAS, the Commissioner of Highways has prepared plans,
special provisions, and specifications for the improvement of
a part of Trunk Highway Number 156, renumbered as Trunk Highway
Number 47within the corporate limits of the City of Columbia Heights
from the south corporate limits to the north corporate limits; and

~HEREAS, said plans are on file in the office ~ the
Deoartment of Highway, Saint Paul, Minnesota, being marked,
labeled and identified as S.P. 9202-42 ~ S.?. 2726-40 (47-156)~ and
WHEREAS, said special provisions are on file in the office of
the Department of Highways, St. Paul, Minnesota, beinq marked,
labeled and identified as S.P. 0205-42 and S.P. 2726-40
(47-156) which, together with the Minnesota Department of
Highway Soecifications for Highway Construction, dated
January 1, 1972, on file in the office of the Commissioner of
Highways, constitute the soecifications for said im?rovement of
Trur~k ~ighway Numb~ 156, renumbered as Trunk !.[ighway 47; and
:JHEREAS, copies of said olans and soecial provisions so marked,
labeled, and identified are also on File in the office
of the City Clerk; and
VHEREAS, the term "said plans and special provisions" as
hereinafter useJ in the body of this resolution shall be
deemed and intended to mean, refer to, and incorporate the
plans and special provisions in the foregoing recitals
pa~icularly identified and described, and in accordance with
the letter dated February 9, 1973 from Assistant
District Engineer, W. M. Crawford, referring to additional
shrubs and vines for screening on the east side oF
University Avenue as a~oroved by the oroperty owners on the adjoinin
properties.
NOW, THEN, BE IT RESOLVED that said olans and soecia]

renumbered as Trunk Highway 47, within the ]imits of the
City of Columbia Heights be and hereby are aooroved.
5E IT FUffHER RESOLVED that the elevations and qradas as

hereby aoproved and consent is hereby given to any and all
changes in grade occasioned by the construction of said
Trunk Highway Number ]56, renumbered as Trunk Highway 47, in
accordance with said plans and special provisions.

Resolution #73~)7 authorizing Joint Powers Agreement with St. Antimony
Vii lage for Fire Protection.
Offered by Norberg, seconded by ~eintz.
BE IT RESOLVED by the City Cou~cil of the City of Columbia Heights,
Anoka County, Minnesota, as roi lows:
.,.,.EREAS, the City of Columbia Heights an(] the Village ~f St Anthony
adjoin each other for a substantial distance; and

WHEREAS, both the City of Columbia Heights and the Village of
St. Anthony maintain a municipal fire department; and
WHEREAS, it is in the mutual interests of both communities to
provide maximum fire protection for all properties within both
municipalities; and
WHEREAS, it would be in the best interests of the properties
within the municipalities to have both fire departments available
in case of a major fire;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Columbia Heights authorizes its Mayor and City Manager to enter
into a joint powers agreement with the Village of St. Anthony,
which agreement would authorize the fire departments of each
community to be available on a first alarm joint fire department
response to designated properties within the two municipalities.
BE IT FURTHER RESOLVED that the City Council of the City of
Columbia Heights authorizes its Chief of the Fire Department to
act in conjunction with the Chief of St. Anthony Village Fire
Department to designate those properties within the two
municipalities which will be subject to the joint agreement.
Said authority also authorizes the Chiefs of the two municipalities
to amend list from time to time as would appear to be in the best
interests of their respective communities.

Resolution #73-08 Agreement for Engineering Services from the Highway
Department.
Offered by Land, seconded by Norberg.
BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights that pursuant to statutory authority, the
City Engineer for and on behalf of the City of Columbia Heights
is hereby authorized to request and obtain from the Minnesota
Department of Highways, needed engineering and technical services
during the year of 1973, ~r which payment will be made by the
City upon receipt of verified claims from the Commissioner of
Highways.

Resolution #73-09 Authorizing Joint Powers Agreement for Legislative
Liaison.
Offered by Norberg, seconded by Heintz.
BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights that the Mayor and City Manager be authorized
to enter into a joint powers agreement for services of a
legislative representative on behalf of certain Anoka County
communities.

Resolution #73-10 Supporting Amendment to H.F. 295 and S.F, 365 on
Public Emoloyees Labor Relatior-:s Act.
Offered by Heintz, seconded by Land.
BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights, that
WHEREAS, a bill has been introduced in the Legislature
designated as House File 295 and Senate File 365 which is so far
reaching in its effect as to effectively olace oowers in the
hands of an arbitrator far exceeding any similar granting of
powers in the private sector, and
WHEREAS~ the League of Hinnesota Hudcinalities i~as submitted
amendments to this b[]] embodying the princim]es ~ndorsed by
our municipal i ties,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the Cit,/ of
Columbia Heights official ],/ endorses the amendments to
H.F. 295 and S.F. 3~ as set forth by the Leaque of Minnesota
Hunicioa] ities and that copies o~ this resolution be forwarded
to the committee members in the House and Senate Labor
Management Relations Commi tree.

Side Yard Waiver for Attached Garage, 47]2 Stinson.
A request was received from John aendricks, 47]2 Stinson Boulevard,
for permission to build a 12' garage attached to his home, within 3~
from the side lot i ine in front and 2' from the lot line in
the back of the garage. This comes with the recommendation
from the Planning and Zoning Commission. A letter signed by
the neighbors indicating no objections to tine oroDosa] was
presented.
Motion by Land, seconded by Heintz to grant the request.

Roll Call -
Home Occupation Permit, 1325 - 43rd Avenue.
A request was received from Thomas Dwyer, ]325 - 43rd Avenue, for
a home occupation permit to conduct a mai] order business from
his home. He presented a letter si~ned by the neighbors
indicating no objections to the proposal . There wi] ] be no
advertising signs and the Planning Commission recommended granting
this on the ~nJition there be no signs or excessive del iveries

Motion by Heintz, seconded by Connor to grant the request.

Special Use Permit, 710 - 40th Avenue.
A request was received from James J. Ruvelson for a special use
permit for the property at 710 - 4Otb Avenue where he plans
to conduct a business of designing signs. It was indicated
this wasstrictly drafting and clerical type work and would not
involve any construction. Since the building's wings encroach
on to City rig t~'-of-way, proper insurance will have to be carried
to cover any potential liability of the City.
Motion by Heintz, seconded by Norberg that the special use permit
be granted, as recommended by the Planning Commission, with
the stipulation that the insurance certificates be filed with the
City. Roll Call - All Ayes.
Waivers to Build Garage at 3935 Polk Street.
A request was received from Steven Kulyas, 3935 Polk Street, ~or
waivers to build a garage 2' from the alley and 2' of the side lot
line. He said he was informed he could ask the Council for more
of a waiver to put the foundation up to the alley line since
there was a very minute possibility of the platted alley ever
being opened. The City Engineer said there is water service
in there now and he could not recommend the garage be built in
the a11ey.
Motion by Norberg, seconded by Land that the request for waiver for
side and alley clearance be granted in accordance with the
recommendation of the Planning Commission, which is to come
within 2' of the alley lot line. Roll Call - All Ayes.
Claim for Towing Charge for No Registration of Vehicle.
The City Attorney reported Steve Junker, 4636 Taylor Street, was
present earlier in the meeting, but had to leave and requested
the Council not consider this claim tonight unless they would act
favorably. Apparently the request is for reimbursement for
a towing charge of $14.60. Mr. Junker found stolen license
plates on his automobile one day so he came to the Columbia Heights
Police station and reported it at which time the plates were
impounded. He asked the dispatcher how he could drive his
car and the dispatcher told him he could drive for 48 hours
without plates. He then drove into Minneapolis and parked
the car and the Minneapolis Police Department had the car towed
away for no plates. Mr. Junker wants to be reimbursed for this
towing charge. He was proper in reporting the stolen plates to
the Police, and he was taking a chance for driving without plates,
but he was assured by the Columbia Heights civilian dispatcher
that he could dr~ve.
Motion by Heintz, seconded by Land that the request be tabled for
additional information. Mr. Junker will be notified by the

Request to Alter Penalty Procedures for Cpi lectin Fines at Library.
A request was received from the Library 3pard to eliminate fines
on books classified as chi )drens books and raise the fines on
books ¢]assified as adu]t books from ]¢ per day to 2¢ per day.
The reasons for this request are as follows:
The expense of collecting fines for chi ldren's books far
exceeds the income.

The objective of the Library is to encourage the use of the
Library and children with long overdue books are reluctant
to come and return then.
The Library should be in the business of promoting self-
education and not in a bind about co] ]ecting sma] i penal ties.
Motion by Land, seconded by Heintz to authorize this change in
penatty procedures and that a report be submitted to the Counci 1
from the Library after one year's experience, Roll Call -

Surety Bond for City Assessor.
The City i~anager reported on the status of the surety bond for
the City Assessor. No action was necessary by the Counci] .

Addiction Workshop.
A request was received for the Police Chief to attend a two-day
Addiction Workshop at Majestic Oaks in Anoka County on February 21
md 22. Motion by Heintz, seconded by Connor that the request
be granted and expenses be authorized. Roll Call - All Ayes.
Softball Tournament Beer License.
Motion by Norberg, seconded by Heintz that the license request
from Lowell DeMars for the benefit of the Fire Department auxiliary
be granted and that the fee be waived. Roll Call - All Ayes.
Clerks-Finance Officers Conference.
Motion by Land, seconded by Heintz that expenses be authorized
for one person to attend annual Clerks-Finanme Officers Conference
March 7,8 and 9 at Holiday Inn Central, sponsored by the

for one person to attend the Construction Industry Safety
Day. Roll Call - All Ayes.
Resolution #73-11 in Appreciation to Art Porter.
Offered by Norberg, seconded by Heintz.
BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights, that
WHEREAS, Mr. Arthur Porter has served the City of Columbia Heights
as a reliable, faithful, conscientious worker for over 25 years;
and
WHEREAS, Mr. Porter passed away on January 13, 1973 at the
age of 60 years,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Columbia Heights takes this means of extending their
sympathy to the family of Mr. Arthur Porter and express the
City's appreciation for his many years of faithful service.

Licenses.
Motion by Land, seconded by Norberg that the licenses as listed
be granted upon payment of proper fees, and that the special
use permit renewals be granted with the same stipulations as
were originally attached to the granting of such applications.

Councilman F~eintz brought up a letter from 122] - 45½ Avenue
on a garbage como]aint. The City Manager was directed to
check on the situation.
