Connor - absent. It was noted that Councilman Connor was continuing convalescence following his open heart surgery. Invocation was given by Councilman Norberg. Minutes of Last Regular Meeting. A correction was noted in the minutes of the last regular meeting, January 8, 1973, on page 3 where the legal description typed into the minutes on the sale of property to the Housing & Redevelopment Authority, Ordinance #797, inadvertently included privately owned land. It should have read as follows: The east forty (40) feet of the South one-half of Lot 16, except the South forty-two (42) feet thereof; the South one-half of Lot 15, except the South forty-two (42) feet thereof; the South twohundred and forty-one (241) feet of Lot 14; that part of the South one-half of Lot 13, lying Northwesterly of the following described line: Beginning at the Northeast corner of the said South one-half of Lot 13; Thence Southwesterly to a point on the South line of said Lot 13, said point being two (2) feet Easterly of the Southwest corner of said Lot 13; the East forty (40) feet of the South forty-two (42) feet of Lot 16; the South forty-two (42) feet of Lot 15; Lot 43; and the West one-half of Lot 44, ~1 in Block 5, Reservoir Hills Addition, Anoka County, Minnesota. Bids on Domestic Animal Control were received as follows: James Dooley in the amount of $4,000.00. Metropolitan Animal Patrol Service, Inc. in the amount of $4,272.00 B & E Patrol, Inc. in the amount of $3,900.00. Motion by Land, seconded by Heintz that the bids be turned over to the City Manager for tabulation and report back later in the meeting. Roll Call - All Ayes. A discussion was held on the service and the president of M.A.P.S.I. suggested the Council let the contract on a different basis than a flat rate. He suggested the bids be let on patrolling, board and disposition of the animal. Bids on Dump Truck. Truck & Coach did not meet specifications and would be disqualified. The net bid of 3ill 3oyer Ford of $6,400 read at the bid opening was accompanied by a i ist of specifications showing exactly what was bid, including an add for Alternator with transistorized voltage regulator for $73.60 and tires for $136.60 to bring their net bid up to a total of $6,610.20. (See letter attached.) Motion by Norberg, seconded by Heintz that the bid be awarded to Bill Boyer ford in the amount of $6,400 with adds of alternator for SS73.60 and tires for $136.60 for a total bid of $6,610.I0, that the Mayor and City Hana~er be authorized to enter into a contract for same. Caterpillar 32,258.80 27,998.00 #]20 It was the recommendation fron the staff to award the bid to Zie?]er on a Caterpillar grader :zith mechanical controls for a net bid of $27,798. The net amount includes a five-year maintenance bid and a deduct for retaining the ripper draw bar ~rom the old grader that would be traded in. Tine City Engineer said the Jraw bar is the exact casting so it could be put rigint on whichwould result in a savings to tine City. A lengthy discussion was held on the bids and the differences between the equipment bid. A representative from Zieg]er Company was present and gave some technical information on tine equicment to the Counci] . Concern was expressed by some of tine Council members that the bids were written for one type of equinment an~ therefore were not competitive. The City Engineer explained he collected many specs., set them side by side, examined ti~em, and wrote something he thought the companies were able to bid on, and three companies did bid on equipment as shown on the bid tabulation. Motion by Norberg to reject al 1 bids . of a second. The motion died for lack p. 13 Motion by No,berg, seconded by Heintz to withhold consideration of the bids on the grader until the next regular meeting. Roll Call: Norberg, Heintz, Nawrocki - Ayes. Land - Nay. Motion carried. Hearing on Mid-Block Lighting, Washington Street, 43rd to 44th Avenue. The City Manager reported this hearing came about on the basis of a petition signed by 74.9% of the property fronting along Washington from 43rd to 44th Avenue in favor of mid-block lighting. The cost will be 10¢ per front foot per year and in accordance with the ordinance which was recently passed by the Council. It was recommended this be set up for a five year period and would amount to approximately $5.00 per property per year. No one was present at the meeting for this hearing. Motion by Norberg, seconded by Heintz that the City Manager be authorized to proceed with the installation of mid-block street lighting on Washington Street, from 43rd to 44th Avenue N.E. Roll Call - All Ayes. Plan Review on Highway 47. C~ty Engineer Brown presented plans from the Highway Department for the beautification of Highway 47 [University Avenue N.E.) from 37th to 53rd Avenue N.E. and requested approval of this plan. Several residents from the area were present to view the landscape plans and expressed concern they would like to see additional work on the east side of Highway 47. Motion by Norberg, seconded by Heintz to table the matter for additio~ information and request the Highway Department give additional consideration as to the screening on the east side of University Avenue from 37th to 45th Avenue N.E. Roll Call - All Ayes. Bids on Domestic Animal Control. The City Manager reported after tabulating the bids on domestic animal control, B & E Patrol, the present contractor is the low bidder at $3,900. He said he is satisfied with the work they have done in the past for the City, they have tried to cooperate with us on animal control matters and he would recommend the award be given to them, although they do clarify an item onthe pet survey and that this would be done as time allows. Motion by Land, seconded by Heintz that the bid be awarded to B & E Patrol in the amount of $3,900, that the Mayor and City Manager be authorized to enter into a contract for same. Resolution #73-02 Authorizing Street Lighting Project. C~f-fered by Norberg, seconded by Heintz. A second reading was held on Ordinance #798, amending #729, regulating the use of highways within the City of Columbia Heights incorporating the provisions of the State High~y Registration Act by reference and imposing a penalty for the violation thereof. Offered by Land, seconded by Norberg. Ordinance #798 was adopted. Roll Call -. All Ayes. Ordinance #799 - Relating to the Keeping of Dogs. A second reading was held on Ordinance #799, amending #473, and #207, relating to the regulation and keeping of dogs within the City of Columbia Heights. Offered by Heintz, seconded by Norberg. Ordinance #799 was adopted. Roll Call - All Ayes. Resolution #73-03 Setting 1973 Municipal Employees Salaries. No action was taken. Resolution #73-04 Authorizing Seal Coating of Reservoir Boulevard from 37th to 4'Oth Avenue N.E. Offered by Heintz, seconded by Norberg. BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, that ~EREAS, the County of Anoka will be letting bids for the seal coating of County State Aid roads during the 1973 construction season including the following: (CSAH #2): 1. Reservoir Boulevard; 40th to 44th Avenue N.E. 2. 40th Avenue; Reservoir to Main Street. WHEREAS, that section of Reservoir Boulevard from 37th to 40th Avenue (MSAS 113-103-010) are under Municioal State Aid, and WHEREAS, it is economically advisable to do the Municipal State Aid section of Reservoir Boulevard at the same time as the County State Aid section, NO¥I, THEREFORE, BE IT RESOLVED that the Mayor and City Manager be and they are hereby authorized and directed to enter into an agreement with Anoka County to seal coat the entire length Reservoir Boulevard in the 1973 construction season. Adonted. Recess was cai]ed at 10:25 n.m. The meetina reconvened at 10:35 p.m. Lot ~?idth and Lot Area ~?aiver for 4909-4~]l Jackson Street. A request was received from Gay]ord Johnson for a lot widti~ and lot area waivers to bui ]d a double bungalow with detached garage at 4~O~/~] I Jackson Street N.E. This waiver was recommended by the Planning Commission as the proposal ~as consistent with the balance of the neighborhood in terms of deve]oprnent. Hotion by Land, seconded by Heintz that the lot size and lot width waivers be granted. Roll Call All Ayes. Soecia] Use Permit for Real Estate Office at 4]8 - Lt~ch Avenue N.E. Mr. John Paone was present. He !nas an oetion to ourchase a small older home at 418 - ~Oth Avenue and he requested a seecial use permit to use the house for a real estate office. It ~as noted Hr. Paone intended to use the house not to exceed three years and then hopefully he ~ould build a new office. p. 17 The Planni~ Commission reviewed the proposal and the matter lost for lack of a majority (the Commission voted 2 to 2). A discussion was held by the Council and the members indicated they would not want the structure remodeled to give it a commercial front such as what happened on Central Avenue in the past. Motion by Heintz, seconded by Norberg permit. Roll Call - All Ayes. to grant the special use Lot Subdivision Request. A lot subdivision request was received from Mary Dennis of 1110 - 43rd Avenue, and James & Irene Waite of 1116 - 43rd Avenue to divide Plate #34416, Parcel #2915, W. ½ of Lot 9 (Ex. N. 5') (Subj. to rd. & Util. ease. over S.30I) and Plat #34416, Parcel #2880, Lot 9 (Ex. W.½) (Ex. N.145' of E.½) and Lot 10 (Ex.N.I~O' of E. 15') (Subj. to rd. & Util. ease. over S. 30I) into three parcels of 74', 73I and 73', the description to be: E.½ of Lot 9 ~x. A lengthy discuss[on was held on the request. It was noted this would allow three double bungalow sites. Councilman Norberg suggested the neighbors be notifed of this as it may have a bearing on the development there. Motion by Land, seconded by Heintz that the lot subdivision be granted. Roll Call: Land, Heintz, Nawrocki - Ayes. Norberg - Nay. Ordinance #800 Relating to Pin Ball Machines. The City Attorney reported Gene Mady had met with him regarding amending Ordinance #226 regulating the games of skill, to eliminate the requirement of a person being 18 years of age to work pin ball machines. Mr. Mady was unable to be present at the Council meeting, but does plan to be present at the next regular Council meeting to present his proposal. The City Attorney had in the meantime prepared Ordinance #800 on this matter and a first reading was held. p. Tax Forfeit Properties. The City Manager reported receiving the deeds from the County for various parcels of tax forfeit land which the Council authorized the purchase of and paid for last fall. Two of these ~arcels are anticipated to be sold by ordinance in one case to the railroad, and is included in the land exchange agreement worked out with them, and the other is property behind theapartments on 47th and Tyler to be used for off-street r_..arking for the aoartment. tie said the sale of property ordinances will be ore~ared For presentation at tlne next Council meeting. The City Attorney reported the case of John g]over has been called for trial on March 5, 1973. Minneapolis E]ectric Steel Castings. The City Engineer reported on two letters received from Minneaool[s Electric Steel Castings - one requesting a fo] iow-up on their request for reduction of sanitary sewer disposal charges, and the other requesting the City imolement construction of Lookout Place in its ne;.z ]ocat ion. On the Sewer charge reduction, he reported they have installed certain va]ves and meters by which we can read ~d document the flow into the system. Fie said ~ must document the flow before we give them a reduction, and it could be made effective as of the first of the year or the last bi 11 lng period. It does not take Council action apoarent]y. On ti~e construction of Lookout Place, the agreements wi ll be checked by the City Attorney and he wi] ] inform the City Manager of ~vhat action, if any, is required. Public Hearings. The City Engineer presented a map s:'}o'..zing ]ocatians of where he would recommend hearings be held on curb, gutter and ~aving p~ojects. Motion by Heintz, seconded by Land that the City Hanager be auttnorized to advertise for a hearing on curb, gutter and surfacin9 on 4Eh Street from ~2nd to ~th Avenue, and on Summit Street, hearin9 to be held at a special Council meeting hereby called for 7:30 p.m., Tuesday, February 27, 1973 in the City Council Chambers. Motion by Heintz, seconded by Land that the licenses as listed, including home occupation permits and special use permits, be granted upon payment of proper fees and that the stipulations and conditions on home occupation permits and special use permits be continued. Roll Call - All Ayes. Private Patrol Service on 39th Avenue. Ken Hentges reported a private patrol service, the Minnesota Rangers, had been h~red to patrol a certain area on 39th Avenue because the businessmen didn't feel they were getting enough protection from the City Police Department. He said since they carried shot guns and pistols, are they required to notify the Police Department of what they are doing? The Council members indicated they were unaware of the situation and it was suggestedthe City Attorney review this for any legal requirements ~d the matter will be discussed with the Police Chief. Fire Lanes at Zayres-Shoppers City. Ken Hentges noted at Zayres-Shoppers City, people are parking their cars tn the fire lanes. He asked what would hapoen if there was a fire there? The matter will be checked as there is an ordinance on the books covering the situation. Recreation Budget. Ken Hentges inquired if any changes had been made in the Recreation budget by the ~creation Commission. Councilman Heintz explained how the budget ~s set up md noted the budget is basi~lly in line with what was discussed during the budget sessions. Revenue Sharing. Mr. Hentges asked if the money the City would be getting from the federal government under revenue sharing would be used for the sewer on 37th and 5th Street. Mayor Nawrocki said at this point there was no commitment for the money. He said the money goes into a special account and there are restrictions on how it could be spent. Old City Garage. Mr. Hentges asked what the status was on the old City Garage. knew of two people who had expressed an interest in using it. The City Manager said there were no formal proposals as yet. He o. 20 City Owned ~3uilding at BSth and California. Hr. I-lentges asked what the status was on the City owned building at 38th and California Street. The City Manager reported on the bids on comoleting this building sere let last fall, but rejected as it came out to $60,000. He said Carl Hansen has taken it upon himself to be of assistance to the City and has informal proposals on the work to complete the building. A report will be made to the Council soon. Congressional City Conference. Motion by Heintz, seconded by Land that expenses be authorized for Mayor Nawrocki to attend the Congressional City Conference to be held in Washington, D.
