Special Meeting December 21, 1972
The meeting was called to order at 7:13 p.m. Roll Call: Land,
Heintz, Nawrocki - present. Norberg, Connor - absent. It was noted
that Councilmen Norberg and Connor were both in the hospital and
therefore unable to be in attendance.
Minutes of Last Regular Meeting.
Motion by Land, seconded by Heintz that the minutes of the
regular meeting be approved as presented in writing and the
reading be dispensed with. Roll Call - All Ayes.

Resolution #72-~Designating Director and Alternate Director to
Suburban Rate Authority.
Offered by Heintz, seconded by Land.
BE IT RESOLVED by the City Council of the City of Columbia Heights,
Minnesota, as follows:
Gayle Norberg is hereby designated as a Director of the Suburban
Rate Authority, and Bruce G. Nawrocki is hereby designated to
serve as Alternate Director of the Suburban Rate Authority for
the year 1973 and until their successors are appointed.

Resolution #72-8~'- Establishing Administrative Procedures for
Collecting Service Availability Charges.
Offered by Land, seconded by Heintz.
WHEREAS, the Metropolitan Sewer Board and the Metropolitan Council
did on October 12, 1972, despite the objections of the City of
Columbia Heights and representatives of over 70% of the population
in the Metropolitan Sewer District, adopt a new cost allocation
system whereby a Service Avaibbility Charge will replace the
previously billed reserve capacity and deferment charges; and
WHEREAS, the City of Columbia Heights along with 15 other
municipalities have filed a complaint in the 4th Judicial
Court in Hennepin County to test the legality of said action by
the said Metropolitan Sewer Board and Metropolitan Council;
and
WHEREAS, there has been an establishment of charges for the
purpose of paying costs of reserve capacity allocated to the
City each year by the Metropolitan Sewer Board, there is hereby
established a charge for:
(a)
(b)
The availability of treatment works and interceptors
comprising the metropolitan disposal system; and
Connections, direct and indirect, to the metropolitan
disposal system.
The charge is imposed on each building or structure in the
City and each connection to the metropolitan disposal system
directly or through the City's system, inside any Sewer Service
Area established by the Metropolitan Sewer Board, construction of
which is commenced on or after January 1, 1973. The charge
shall be payable upon the issuance of a building permit or a
connection permit, as the case may be, but no charge shall be
due upon the issuance of a connection permit if a charge was
paid upon issuance of a building permit.
The charge for each building or structure shall be equal to the
number of units of sewage volume which it will discharge, multipled
by $275 for 1973, $300 for 1974, $325 for 1975, $350 for 1976
and $375 for 1977. A unit of sewage volume shall be
100,000 gallons per year and shall be assigned as follows:
(a)
Single family houses, townhouses and duplex units shall each
comprise one unit;
(b) Condominiums and apartments shall each comprise 80% of a unit;
(c) Mobile homes shall each comprise 80% of a unit;

Other buildings and structures shall be assigned one unit for
each 100,000 gallons of flow or part thereof which it is
estimated they will discharge;
Public housing units and housing units subsidized under
any federal program for low and moderate income housing
shall be counted as 75% of the unit equivalent ~or that
type of housing;
Units existing or for which building permits were issued
prior to January 1, 1973, shall be counted as one-half
the unit equivalent for that type of housing, if connected
to the Metropolitan Disposal System prior to January 1, 1974,
and shall be counted at the full rate thereafter.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Columbia Heights, Minnesota, that the City Manager
establish a special fund to be kept by the City Treasurer
into which all moneys collected as a "sewer availability charge"
shall be deposited and held until such time as a district
court determination is made in respect to the legality of such
a charge by the Metropolitan Sewer Board.

Resolution #72-8~ - Correcting Assessment at 4166 Polk Street.
Offered by Land, seconded by Heintz.
WHEREAS, the property known and described as Lot 1, except
parcel #2280, Block 15, Aud. Sub. of Walton's Second Subdivision,
Anoka County, Plat #33077, Parcel #2270 was assessed
$385.84 for local improvement No. 476 and $305.76 for local
improvement No. 477, and
WHEREAS, there was an error made in the computation of the
footage of this property,
BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights that the City Clerk be and is hereby authorized
and directed to reduce from Local Improvement No. 476 the
amount of $72.08, and from Local Improvement No. 477 the
amount of $57.12.

Human Rights Commission Requests.
Vicki Wilson and Tom Durand, representing the Human Rights
Commission were present and requested two items - on~ that
the Commission be authorized to use part of their 1972 budget
for a trip to Roosevelt City, Alab~na by their chairman, and
the other, that they be allowed to carry over any balances in
their 1972 budget to 1973 for use in connection with 'JHuman
Rights Month" in March of 1973.

Hrs. Wilson said the Commission met with Hei Aanerud following
his trip to Roosevelt City at which time it was suggested the
City should keep in contact with Roosevelt City and develop some
programs. The commissioners got several ideas together and asked
their chairman, Rev. Carl Caskey, if he would be willing to go
down to Roosevelt City to help get things going. The commission
has $176 left in the Roosevelt City fund collected a few years
ago, but the cost is $150 for just air flight, therefore
Rev. Caskey would need a little more money. The suggestion was
made that the commission use part of their budget for this.
Hrs. Wilson said they would like to use this year's money,
although Rev. Caskey probably won't go until danuary, 1973.
Mayor Nawrocki said the problem is the carry-over of fund
balances. The question is whether or not the City would make an
exception to what has been policy in the past.
Councilman Heintz expressed concern and said he wouldn't object
if the City were requesting someone to go down there, but this is
a project taken on by the Human Rights Commission. By whose
direction is he going to represent the City? The Council never
asked him to go and you are now asking the Council for money for
him to go. Going next year with this year's budget is another
thing. He would sooner see the money come out of next year's
budget. Every department in the City would like to carry over
fund balances, but we cannot start a precedent.
Mayor Na~rocki said the project is certainly worthwhile and
interesting, and part of the reason is the fact that this was a
community-type project where civic groups and organizations
participated and raised money for the program.
Motion by Land, seconded by Heintz that the Human Rights
Commission be authorized to spend up to $100 for expenses to send
one person to Roosevelt City, Alabama. Roll Call - All Ayes
The matter of carrying over the remainder of this year's budget
to next year - Motion by Land, seconded by Heintz that the
request be denied. Roll Call - All Ayes.
A discussion was held on a position and policy statement of the
Human Rights Commission. Mayor Nawrocki noted the commission
was supposed to be advisory to the Council and the Council
should be advised when statements are made.
Housing Authority Request to Purchase City Property.
Tom Sherohman, Chairman of the Housing and Redevelopment Authority,
was present and requested the City grant an option to the Housing
Authority to purchase City property on 40th Avenue east of Central,
for the senior citizen housing project.

A discussion was held on the assessed valuation of the property
in question and how the Authority arrived at a purchase price.
Mr. Sherohman explained what was involved in getting the
property from the City and the private owners.
It was noted this would require an ordinance for sale of
property and the City Attorney was directed to prepare the
proper ordinance for a first reading later in the meeting.
Rumpsa Claim.
It was reported this claim came about when Mr. Rumpsa's
son's car ~ras stolen from the High School parking lot. The
car was later found and the Police told Mr. Rumpsa the car
had been located, but asked if it could be left where it was
as the people who stole it may be back. The police were right,
and the people came back, got in the car and took off before
the Police could catch them. In the chase, they skidded and
smashed into a pole causing damage to the car.
Apparently the insurance company indicated they would not
defend the claim. The Council members felt the City had a
moral responsibility to the individual and suggested
complete restitution. It was suggested that the people who
drove the car ought to be third partied in.
Motion by Heintz, seconded by Land to refer the matter to the
City Attorney. Roll Call - All Ayes.
Recess was called at 8:16 p.m.
The meeting reconvened at 8:30 p.m.
Ordinance #797 - Sale of Property.
A first reading was held on Ordinance #797 for sale of an option
on Lots 14, 15, 16, W½ of Lot 44, and W.½ of Lot 13, Block 5,
Reservoir Hills Addition to the Columbia Heights Housing and
Redevelopment Authority for $18,165.00.
Appointment to Park Board and Recreation Commission.
Motion by Heintz, seconded by Land that Gordon Schelde, who is
on the Recreation Commission, be appointed to the Park Board to
fulfill the unexpired term of Donald Welch. Roll Call -
All Ayes.
Motion by Land, seconded by Heintz that Mike Farrell be appointed
to fulfill the unexpired term of Gordon Schelde on the Recreation
Commission. Roll Call - All Ayes.

Electric Scoreboard for Park Department.
A request was received to purchase an electric scoreboard for
the Park Department, based on three informal bids that were taken.
The Jaycees have indicated their intention to reimburse the
City for this expenditure. Motion by Heintz, seconded by Land
that the City Manager be authorized to spend up to $1,060.75
for the electric scoreboard. Roll Call - All Ayes.
Bids for Legal Publications for 1973.
Motion by Lan], seconded by Heintz that the City Manager be
authorized to advertise for bids on legal publications for 1973,
bids to be opened January 8, 1973. Roll Call - All Ayes.
Public Works Conference.
A request was received to allow George Brown, Mitch DeMars and
Earl Gustafson of the Public Works Department to attend a conference
on engineering and public works February 1-2 sponsored by
the University, to be held at the Holiday Inn Central.
The registration fee is $37.50. Motion by Land, seconded by
Heintz to grant the request. Roll Call - All Ayes.
Minneapolis Water Rates.
The City Ma n~jer reported a letter he received from the Minneapolis
Water Department indicating there will be a rate increase.
He said hopefully he would have a good projection to present
at the next meeting on the status of the funds.
December 26th Council Meeting.
Motion by Land, seconded by Heintz that the December 26, 1972
Council meeting be cancelled because of the apparent lack of a
quorum on that date. Roll Call - All Ayes.
Licenses.
Motion by Heintz, seconded by Land that the licenses as listed
be granted upon payment of proper fees. Roll Call - All Ayes.
Deficit in Recreation ~dget.
Councilman Heintz reported a deficit in the Recreation Budget
and recommended that the Council appropriate from the Contingency
Fund $1,572 as 1/2 share and request the School Board do likewise.
Motion by Land, seconded by Heintz that an encumberance be set
up on the 1972 unallocated general expense in an amount of
$1,572 in anticipation of ultimate passage of a resolution

transferring said amount to the Recreation Budget. Roll Call -
All Ayes.
