Roll Call: Land, Heintz, Connor, Nawrocki - present. Norberg - absent. Mayor Nawrocki reported Councilman Norberg was in the hospital and was unable to be present. Over 100 residents were in attendance. Mayor Nawrocki reported this meeting was called to consider assessments proposed for projects which have been completed this past construction season and to discuss the quality of the work. #476. Asp~lt Mat, 42nd Avenue, University to Central; 42nd Avenue, Reservoir to Cleveland; and 43½ Avenue, including Tyler Place and Pierce Street off 43½ Avenue. Cost estimates given at the time of the hearings ranged from $4.97 to $6.30 on street frontage and $1.99 to $2,10 on avenues. The actual costs came in at $6.36 on street and $2.12 on avenues. #477. Curb and Gutter, 42nd Avenue, University to Central; 42nd Avenue, Reservoir to Cleveland; and 43½ Avenue Including Tyler Place and Pierce Street off '43½ Avenue. Cost estimates on this were from $4.80 to $4.89 on street frontage and $1.60 to $1.63 on avenues. The actual cost came out at $5.04 on street frontage and $1.68 on avenues. A lengthy discussion was held on the above projects. On 42nd, University to Central, a question was raised on whether this street was paved because of the watermain installation and it was explained this was strictly on the basis of a petition from property owners in the area. A resident at 4156 WashingtonlStreet reported curb damage from two years ago and said he was told this was to be fixed. The matter will be checked and a report submitted to the owner and Council members. A number of questions were raised on items such as sidewalks, driveways and boulevards, and on curbs and credit for some curbs on 42nd. Questions were raised on the grades on 43½ Avenue, driveways, curb cuts, and comp|~ints were heard on the length of time this project was under construction, inconvenience to the owners, lack of communication and engineering. Discussions were held on the assessment procedures, the 8% interest, and the amount of the assessments. The City Manager recommended, based on the amount of the assessment, that it be spread over 8 years. p. 256 #606. Bituminous Overlay on Stinson F~ Benj?min, Silver Lane to 45th Avenue (Authorized as major maintenarce.) The City Manager explained it was intended to go in with major maintenance and assess the work which was estimated at $1.50 per foot. But due to the strike and wet weather conditions, we were unable to schedule a complete reworking. In late September it was decided to go in with an overlay of hot asphalt mix covering all the rough areas eliminating the holes and putting the street in good maintainable condition. The recommended assessment on this is 60¢ per front foot and 20¢ per avenue for one year. Residents present expressed concern over the work and questions were raised on the assessments, the church ~operty, and the park property. #657. Concrete Alley Paving, Main to 2nd Street, 42nd to 43rd; 5th to 6th Street, 43rd to 44th; 4th to 5th Street, 42nd to 43rd. It was reported the work came in slightly under the estimates. The assessment is $5.75 for 10' wide alleys and $6.55 for 12' wide alleys. The assessment was recommended to be spread over five years. #666. Sanitary Sewer, 625 - 47th Avenue. This was authorized by an agreement with the owner and the assessment is $500. #667. Storm Sewer in Gauvitte Park. This is strictly a Park Department assessment at $14,000. #668. Seal Coating - Most of the Area Between Central & University, ~5th to 53rd. Cost estimates were 54¢ per foot on street charge and 18¢ per avenue charge. The City Manager explained the seal coat operation along with other projects, was ~layed due to the stri~ and wet weather conditions. He explained what is involved with a seal coat project, why it is done, and that in order to complete the job it was necessary to have temperatures in excess of 50 degrees. The initial sealing was done this fall and held for two to three weeks. Then stripping began to appear. The rock material that came off was swept and stockpiled and he believes we must anticipate going back in the summer of 1973 and resealing those areas where stripping occurred. He said the decision was made to go ahead with the project in October, although the contractor expressed concern about it. Everything seemed to be going well and other communities were seal coating, but for some reason we got this stripping. p. 257 A lengthy discussion was held on the project. Residents present complained about the whole operation and expressed concern over paying the assessment if the streets will have to be redone next year. It was proposed that the City Manager and City Engineer check each street on the project and recommend to the Council what work will have to be redone and the City Attorney was directed to check into the responsibility. It was noted there would be no additional assessment for the work that will be done again next spring. #669. Storm Sewer, Area Between Central and Johnson, 37th to 40th. It was reported this was proposed at 2¢ per square foot to be assessed and the remainder ~ the cost to come from City General Funds. The recommendation was to spread this assessment over a five year period. Questions were raised and a discussion was held on the project. A resident from 39th and Johnson said there should have been a storm sewer on 39th and Johnson. The City ~gineer explained this was the corner where the bus used to park and the curb settled. It does not warrant a storm sewer, the answer is in construction of a cross gutter at the intersection and this can be done under the maintenance program. #684. Delinquent Utility Bills. The delinquent utility bills were as follows: 561 - 51st Avenue (Frieda Anderson) in the amount of $18F.92. 4040 Quincy Street (Emma Dupre) in the amount of $71.30. 4654 Heights Drive (Ed LeVoir) in the amount of $46.59. #607. Building Removal, 561 - 51st Avenue. The cost on this building removal was $806.30 to he assessed for one year. #672. Storm Sewer, California Street, 37th to 40th Avenue. It was reported this assessment was between the City and Burlington- Northern Railroad and the cost was $6,417.00 to be assessed for one year. #682. Delinquent Licenses. The delinquent multiple dwelling licenses were as follows: 980 - 44th Avenue (Ed Chies)in the amount of $51.70. 970 - 44th Avenue (Donald Chies) in the amount of $22.00. 4353 Tyler Place (Donald Chies) in the amount of $11.00. 4347 Tyler Place (Ed Chies) in the amount of $51.70 p. 258 #683. Weed Control. The City Manager presented a list on weed control bills to the Council. Mayor Nawrocki brought up a discussion he had with the owner of 3984 Reservoir who could not be at the meeting and who was concerned about her assessment for storm sewer based on square footage. A letter from Leslie F. Kotval, 4205 Stinson, was read regarding street surfacing assessment. A letter from an attorney representing Emma Gilbert,property at 1336-38 43½ Avenue was also read. Resolution #72-83 Adopting Assessment Rolls. Offered by Land, seconded by Heintz. A d~pting assessment rolls for the following local improvements and determining that said improvements have been made and ratifying and confirming all other proceedings, heretofore had: Special Assessments numbered 476, 477, 606,657, 668, 669, 670, 672, 682, 683, and 684. WHEREAS, the City Council of the City of Columbia Heights, Minnesota met at 8:00 p.m. on the 29th day of November, 1972, at the Field House, 530 Mill Street, in Columbia Heights, being the time and place set when and where all persons interested could appear and be heard by the Council with respect to benefits, and to the proportion of the cost making the local improvements above described, a notice of such hearing h~ing been heretofore duly published as required by law, and a notice mailed to each property owner of record, stating the proposed amount of the assessment; and WHEREAS, this Council has heretofore estimated and fixed the cost of such local improvements and has prepared an assessment roll therefore. THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS HEREBY RESOLVES: Section 1. That this Council does hereby adopt the aforesaid assessment rolls known and described as "Assessment Roll for Local Improvements numbered 476, 477, 606, 657, 666, 667, 668, 669, 670, 672, 682, 683, and 684. Section 2. That thi6 Council hereby finds and determines that each of the lots and parcels of land enumerated in said assessment rolls was and is especially benefited by such improvement in an amount not less than the amount set opposite in the column headed "Total Assessment" And this Council further finds and determines that the proper assessed pro pcrtion of the cost of such improvements to be especially assessed against such lot or parcel of land is p. 259 the amount set opposite the description of each such lot or parcel of land respectively in s~id assessment rolls. Section 3. That said assessments may be paid in part of in full without interest on or before December 29, ]972, or in annual installments for a period of from one to ten years as designated on each assessment roll, payable on or before the 30th day of September, annually, with 8% interest thereon. Failure to pay the annual installment renders the same delinquent and thereafter a 10% penalty is a d~d and the said delinquent special assessment is certified to the County for collection with the real estate tax. Section 4. That this Council did hereby determine and re-determine to proceed with said improvements, does ratify and confirm all other proceedings heretofore had in regard to these improvements and said improvements shall hereafter be known and numbered as "local improvements numbered 476, 477, 606, 657, 666, 667, 668, 669, 670, 672, 682, 683, 684. Section 5. This resolution shall take effect immediately upon its passage. Roll Call - All Ayes. Human Rights Commission Statement. Mayor Nawrocki brought up a statement the Human Rights Commission was presenting before the State on Saturday, December 2nd. He felt the Commission was to be advisory to the Council and matters like this should come before the Council before the Commission represents the City of Columbia Heights.
