Special Meeting
November 6, 1972
The meeting was called to order by Council President Heintz at
8:46 p.m. Roll Call: Land, Norberg, Heintz, Connor - present.
Mayor Nawrocki arrived at 8:55 p.m.
Storm Sewer Hearing in Southeast Section of City.
The City Manager explained the purpose of this storm sewer
hearing was to consider clean-up of some drainage problem
areas that exist in the southeast section of the City.
Included in this were Ostrander Park, Prestomen Park,
and 40th Avenue where state aid construction has been
authorized for next year's construction season. It was
proposed to .put some pipe lines in during winter
construction.
The total cost of all the storm sewer work is $102,000 and
if a pond area were included in development of Prestomen Park,
the total cost would be about $114,000. The City Manager
recommended that the Council consider setting up an
assessment program similar to what was done last spring
where the installations were made on 39th, Tyler and Polk,and
would be assessed only 2¢ per square foot with the balance
of the cost to come from general tax levy. The assessment
could be spread over 3-5 years.
It was reported ~e Park Board has gone on record for
developing Prestomen Park without a pond area included.
Many residents from the affected area were present and
a lengthy discussion was held on the proposals. Questionnaires
were handed out to the citizens asking if they would favor
having Prestomen Park developed which would mean necessary
storm drain installations and whether or not they would like
to have it with a pond.
Several residents with extremely deep lots expressed concern
over the amount of the assessment and asked if the Council
would cons[der setting up a limit for these owners.
Several residents indicated they would rather see Ostrander
Park finished before Prestomen Park.
The filled-in and signed questionnaires were returned to the
staff along with a petition in opposition to the project
from Johnson Street, 39th to 40th.
Councilman Land said in 1965 he was on the Council - we
had floods. He saw the problems created by an inadequate
storm sewer system. Money has been spent in the meantime to
improve our system. We set up a system that everyone was
going to pay their fair share and we knew when we put this
into drainage areas that everyone in town would eventually
have to pay.

Motion by Land, seconded by He~ntz that the City Manager be
authorized to proceed with construction of storm sewer as
proposed in the 1972-73 construction season, that the work
eliminate the retention pond in Prestomen Park and that
the Ostrander Park section be done in the 1972 construction
season Roll Call - All Ayes.
Resolution #72-76 - authorizing storm sewer project.
Offered by Land, seconded by Heintz.
BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights,
WHEREAS, the City Council of the City of Columbia Heights
by motion on the 10th day of October, 1972 ordered
notice of a hearing to be given to property owners, and
WHEREAS, pursuant to a notice of hearing certain
residents appeared at a Council meeting on the 6th day
of No~mber, 1972, and
WHEREAS, the Council determines to proceed with this local
improvement, a portion of the cost being defrayed by
special assessments under charter provisions.
NOW, THEREFORE, IT IS HEREBY RESOLVED:

That the location and extent of such improvements
is as follows: Prestomen Park, eliminating the
retention pond, Ostrander Park, and drainage areas
contributing thereto as described in the official
advertisement for said hearing.
That the materials to be used are as follows:
Standard reinforced concrete and corrugated metal pipe
in accordance with the appropriate design criteria
required.

That a careful estimate of the cost of the
improvement has been made by the City Manager and the
several lots and parcels of land fronting upon and
adjacent to such proposed improvement, which he
deemed benefited thereby, were properly notified of
said hearings, and that it is the intent of the
City Council to limit the assessment to 2¢ per square
foot, and

That the City Manager shall also list the names and owners
of the several parcels so improved as nearly as can be
ascertained.
These improvements shall also be known as
Project No. 674.
Roll Call - All Ayes.
The City Manager requested permission to buy materials and
labor to install the Ostrander Park lines within the next few
weeks. He requested authorization to spend up to $5,000 for
the materials and labor.
Motion by Land, seconded by Heintz to authorize the City
Manager to proceed with the storm sewer work on the
Ostrander Park area, subject to using existing competitive bids,
obtaining additional competitive bids as necessary to keep
within our bidding requirements.
The City Attorney reported this item was not on the agenda
for the meeting and therefore no action could be taken.
Resolution #72-73 setting License Fees for 1973.
A list of license fees proposed for 1973 was presented to the
Council. A discussion was held on several of the fees
including garbage and rubbish hauling, auctioneer license,
club beer licenses, cigarette machines, used car lot
licenses, and coin operated washers and dryers.
It was ultimately decided to change garbage and rubbish
hauling to one license and set the fee at $25, and
increase used car lot licenses to $50.
Resolution #72-73 setting the license fees was offered by
Heintz, seconded by Norberg.
BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights that the following list of license fees
(as per attached list) be set for 1973.

Ordinance #768 - Vacating Streets and Alleys West of California
Street.
No action was taken.
Proclamation Supporting Designation of Nicollet Island as
Bi-Centennial Park.
No action was taken.

Lot Subdivisions.
A lot subdivision request was received from George Kordiak, Jr.
to divide Lot 42 [Ex.S.5I) (Ex.W.10') [Subj. to rd. & util.
ease. overN.30'), Block 3, Reservoir Hills. This is on
42nd Avenue and the recommendation is that the assessments be
divided. Motion by Land, seconded by Heintz to grant
the subdivision request, the description to be:
1. North 165' of Lot 42 (Ex.W.10') (Subj. to rd. & util.
eas. over N. 30') Block 3.
2. Lot 42 (Ex.S.5') (Ex. ~.10') (Ex.N.165') Block 3, Reservoir
Hills.
Roll Call All Ayes.
A lot subdivision request was also received from Mark Z.
& Grace E. Jones to divide a lot on 44½ Avenue into two
55' lots for single family dwellings. It was recommended
that the special assessments be divided. Motion by Heintz,
seconded by Connor to grant tile request to split
Lot 38 (Ex.S.130') (Subj.to road & Util.ease. over N.30')
~lock 1, Reservoir Hills into:
I. W.½ of that part of Lot 38 lying north of the south 130'
(Subj.to road & util.ease, over N.30').
2. E.½ of that part of Lot 38 lying North of the south 130'
(Subj. to road and util.ease, over N.30') .

Request to Purchase Sewer Cleaning Chemicals.
No action taken.
Ambu]ance Service.
Chief Glader requested no action be taken at this time as
more data will be needed.
Memorial Park Property.
The City Attorney said a while ago a resolution was adopted
declaring the Memorial Park property [Batson Property)
would be used for park purposes because H.U.D. wanted a
document to this ~fect. Now, H.U.D. wants the City to
file the document. He requested an indication from the Council
as to whether the City should file it. The Council
members all said file it.
