HomeMy WebLinkAboutOct 24, 1972p. 226 OFFICIAL PROCEEDINGS Regular Meeting October 24, 1972 The meeting was called to order at 8:10 p.m. Roll Call: Norberg, Connor, Nawrocki - Present. Heintz - Absent. Land, Invocation was given by Councilman Norberg. Minutes of Last Regular Meeting. Councilman Norberg noted a typographical error in the minutes of October loth on page 225, where Rubber Hauling License should be Rubbish Hauling License. Motion by Land, seconded by Norberg that the minutes of the last regular meeting be approved as corrected and the reading be dispensed with. Roll Call - All Ayes. Payment of Bills. Councilman Norberg questioned check #3146 in the amount of $1,077.97 issued to Hydraulic Speciality Company. The City Manager reported this was repairs and parts for the Vactor. Councilman Norberg questioned check #3177 to Peterson & Kalina in the amount of $75.00. The C ty Manager reported this was a pre-trial conference on the Glover case and is not covered under the retainer. Councilman Norberg also asked about #3187 to Tasco Aviation Supply in the amount of $11.15. The City Manager said this was purchase of wax for municipal building. No action was taken on Ordinance #768 vacating streets and alleys west of California Street for Burlington -Northern Railroad. Ordinance #796 - Establishing Procedure for Mid-block Lighting. A first reading was held on Ordinance #796. Mayor Nawrocki questioned the procedure if the lights were ever removed? The City Attorney explained it was done the same way as the light is put in, by petition and resolution, or by Council action. The second reading will be held at the next regular Council meeting. Resolution #72-64 Establishing Commission on Science and Engineering. Councilman Norberg asked that the matter be tabled to the next regular meeting in the absence of Councilman Heintz. Resolution #72-74 - Joint Powers Agreement Against Sewer Charges. Resolution was Offered by Norberg, seconded by Land WHEREAS, the City of Brooklyn Center and other municipalities have or will commence legal proceedings to test the validity of the action of the Metropolitan Council in its determination to adopt a new formula for the allocation and collection of certain "current costs" to be borne by municipal governments pursuant to Chapter 473C of Minnesota Statutes; and WHEREAS, the City of Columbia Heights is in agreement with the objective of the aforementioned lawsuit and hereby authorizes the attorneys engaged by the City of Brooklyn Center to act as its attorney for the purpose of joining or intervening as a party litigant to said legal action. p. 229 NOW, THEREFORE, the City of Columbia Heights agrees to share equally with alt other participating municipalities in the costs and expenses of said legal action, including attorneys fees, except that no party other than the City of Brooklyn Center shall be obligated to the extent of more than SI,OOO by this agreement. The pro rata share of the expenses and fees attributable to each municipality shall be ~lculated at 60 day intervals beginning January 2, 1973, and shall be payable on 30 days notice. BE IT FURTHER RESOLVED that the Mayor and City Manager be and they are hereby authorized to enter into an agreement consummating the foregoing and establishing a termination of said agreement as to any partyupon 15 days written notice to each of the other participating municipalities. Roll Call - All Ayes. Expansion of Used Car Lot at 4042 Central. Gerald Sneft was present requested an extension on his special use permit for a used ~r lot at 4042 Central. This was recommended by the Planning Commission with the following stipulations: That the shack at 4042 be removed, the building at 4036 be dressed up, that additional lighting be limited to two additional shielded lights, and a plot plan be submitted showing position of cars. Mr. Sneft presented his plot plan. Motion by Land, seconded by Connor that the special use permit for expanded used car operation at 4042 Central be granted subject to the Planning Commission stipulations and that this is subject to review by the Planning Commission July 1, 1973 and determination that it has met all stipulations. Roll Call: Land, Norberg, Connor Ayes. Nawrocki - Nay. Motion carried. Audi t. Motion by Norberg, seconded by Land that the Mayor and City Manager be authorized to enter into an agreement with George M. Hansen Company for 1973 Audit. Roll Call - All Ayes. Water School. A request was received to send two members of the Sewer & Water Department to a one-day water school in Brooklyn Center on valve and hydrant maintenance, and a safety talk. The registration fee is $3.00 and the examination fee is $5.00 for a total of $8.00. Motion by Land, seconded by Connor to grant the request. Roll Call - All Ayes. p. 230 Sch~ls and Conferences. The Council members requested the staff to determine what schools were coming up for the next year and who would be going to be sure the schools were in order and things were being rotated around. Motion by Norberg that all departments be required to find a training plan for next year by the first of the year. Motion died for lack of a second. Sale of Old Bulldozer. Motion by Land, seconded by Norberg that the City Manager be authorized to advertise for bids for sale of the old D-6 bulldozer, bids to require $50 bidders bond or deposit. Roll Call - All Ayes. Bids on Three Construction Items. Motion by Land, seconded by Norberg that the City Manager be authorized to advertise for bids on the superstructure on the pump house at 44th and Reservoir, the Library basement entrance, and finishing of the industrial building at 3801 California Street, bids to be opened at 2:00 p.m., Thursday, November 9th, for consideration by the Council on November 13th. Special Assessment Hearing. Motion by Land, seconded by Connor that the hearing on special assessments for 1972 work in construction season be hereby set for Wednesday, November 29th at 8:00 p.m. in the Field House. Roll Call - All Ayes. Shell Station, 37th and Central. Concern was expressed by the Council on the clean-up work at the Shell Oil Station at 37th and Central. Many letters have been written, and meetings held with the Shell people and the clean-up work is still not completed as set forth in the agreements. The suggestion was made that the occupancy permit for the project be pulled or something drastic done to get the people to finish the work. Motion by Land, seconded by Norberg to authorize the City Manager to send a notice to the Shell 0il Company alleging the certain complaints that have been made relative to their failure to live up to the promises made in their plot plan and to make this an item of business on the agenda for the regular Council meeting November 13th, to discuss whether or not their occupancy permit stould be pulled and to have them show us why their occupancy permit 9hould not be pulled. Roll Call - All Ayes. p. 231 Traffic Situation on 42nd Avenue. Councilman Norberg suggested the traffic on 42nd Avenue be reviewed, especially with respect to the speed of traffic. Motion by Land, seconded by Connor to refer the matter to the Traffic Commission to review the traffic control on 42nd Avenue, University to Cleveland, with an eye to installing stop signs. Roll Call - All Ayes. Fence on 44½ Avenue. Councilman Norberg said regarding the Villella fence on 44½ Avenue, the fence is still on City property. Action of the Council to have it removed has not been e~orced. This will be checked out by the staff. Resolution #72-75 Appreciation to Lawrence Thompson. Offered by Norberg, seconded by Connor. BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, that WHEREAS, Mr. Lawrence Thompson served the City of Columbia Heights as a reliable, faithful, conscientious worker on the Street Department for over 15 years, and WHEREAS, Mr. Thompson suffered a fatal heart attack at the age of 49 years while in apparent good health. NOW, THEREFORE, BE IT RESOLVED that the City Council o~ the City of Columbia Heights take this means of extending their sympathy to the family of Mr. Lawrence Thompson and express the City's appreciation for his many years of faithful service.
