Regular meeting
Sept. 25, 1972
The meeting was called to order et 8:20 p.M. in the City Council Chambers.
Roll call - Nawrocki, Connor, Norberg, Land present. Heintz absent.
Invocation was given by Father Ince, Immaculate Conception Church.
Motion by Land seconded by Norberg that Temple Nygaard be appointed Secretar~
pro tem for this meeting. Ail ayes.
Oorrections should be made in the minutes of the September llth meeting as
follows: page 197, the date of the meeting should be changed frc~ Sept. 12th~
to Sept llth; page 203,~ the bid opening date on stairway to library basa~ent
should be October 19th, not 17th; page 204, Counc~.Lman l~rbe~g's proposal does
not refer to hiring o$ consultants, but to making use of valuable talent avail-
ab--~e in the city on a volunteer basis by means of a standing commission.
Motion by Norberg .seconded by Land that these corrections be made. Ail ayes.
Motion by Norberg seconded by Connor that-bills totaling $188,457.14 be paid
out of their proper funds. Roll call, all ayes.

Bids on Pick-up Truck
The City Manager had respectfully requested that the Council reject bids received mE
on.one pick-up truck, instead~to readvertise for+~"t~o ,trucks, inasmuch as there
is ~s, ufficient money in the budget, and also in include in th~ specifications an
alternate of a bucket seat with small desk type console nex~ to the driver. So
moved by Land, seconded by Connor. Roll ~call on rejecting the bi~s - Connor and
Land aye, Norberg & Nawrocki nay. Motiou failed.
Motion by Lind seconded by Connor that b~ds for pickup truck be tabeled u~ti!
the next meeting. Roll call~- ayes Connor. Land, Nawrocki, Nay, Norberg. ~The
motion c~rried. ,
Bids on se~er fodder
One bid was received for the sewer rodder, as only the one company is capable
of ~ supplying the type of equipment that is needed. Motion°by Land seconded bY
Norberg to award the bid to Flexible Pipe Tool Co. in the amount of $5,489.00.

WHen the hearing was set on this~mid-block.st~re~t' lighttng' a petition had]been
submitted with signatures of 60.7~ of the~prope~ty ovmers who would be assessed
for it. However two of the signers have,since ~sked that their names be removed
from the petition, therefore slightly less than 50% of the owners remain.
Attorney Kalina said there is some question concerning the legality of the city's
levying an assessment to cover cost of a ~contract with a~private company. Be-
cause of this, and the uncertain status of the petition, it was moved by Eand
seconded by Norberg to continue the hearing until the next regular meeting to
be.held Tuesday Oct. lOth. Roll call, all ayes.

Special Use Permit for Alcoholics Anonymous meeting place
A request has been received from Alcoholics Anonymous to use the basement of
the grocery store at 4301 Fifth St.~.E. for meeting rooms. The Fire Chief
has inspected the promises and approved it providing (1) a second means of
egress fro.~ the basement is built and (2) an approved fire extinguisher be
provided. This Special Use Permit has been recommended by the Planning and
Zoning Commission, and a petition signed by the near neighbors accompanys
the application.
Motion by Norberg seconded by Conner to grant the Special Use Permit to AA
and Mr. Arthur Fischer who is the CT~airman and will be the operator of the
grocery store, providing it meets safety standards and providing cars are not
parked in front of the nearby residences. Roll call a!l ayes.

Ordinance 768~ vacating streets and alleys West of California Street
Attorney Kalina reported that tit"as to the property involved in this vacating
have not been cleared. Motion by Land seconded by Norberg to continue action
on the ordinance until the next meeting. Ail ayes.
Ordinance 792~ rezonin$ for Minneapolis k lectric Steel ~stings Co.
~ first'reading was held on Ordinance 792, rezon"i~t'o'M-2 H~avy Industrial
Lots 9 thru 17 (ex the northerly 22.5 feet of Lors 9 and 17) Block 69,
Colum~ ia Heights Annex, as recommended by the Planning a nd Zoning Commis-
sion.. A hearing will be held at the October lOth meeting, at which time the
expansion plans ofM ESC will be fully explained.
Ordinance 793~ vacatin~ and relocatin~ south section of Lookout Place
~ '~irst resdi'ng w~s held on Ordinance 793 vacating and rel'~'ating the south
section of Lookout Place. This ties in with Ordinance 792, above.
Annual Fire Chief's meeting in Duluth October 1-2.

mission to attend the Minnesota State Fire ~ief's annual meeting in Duluth
October 1 and 2 with expenses authorized. Roll call all a yes
Professional Emergency Care Course
Motion by C'o'nnor seconded by Land that P~trolman Donald French be granted
permission to attend the ~ifth Annual Professional hmergency Care Course at
Unity Hospital Sept. 27-30, with expenses paid. Roll call all a yes.
Ma;~a,~mment Session for police personnel
Request receive~'for permission for ten people frc~ the po!dce department to
attend the Management Session at St.Thomas College Oct. 18th and Oct. 26th.
The original request to send 4 people was revised because of a lowered tuition
rate if 10 people or more attend. Motion by Land seconded by Conner to
grant the req~]est, and that expenses be authorized. Roll call, a 11 ayes.
Lot Subdivision~ Lot 47 Block 3 Reservoir Hills
Moti0'n by Lan'd sec'ended by ~o~berg that a subdivision be approved dividing
the West 75' of Lot 47 lying north of the so~th 140' subject to road and
utilitYFeasem~ents over the north 30', Block 3, ~servoir Hills. The Owner is
Robert ischer, 1235 - 43 Avenue. Roll call all ayes.

Government Purchasing and' Insurance Seminar
Motion by Land seconded by Conner to authorize John Barna to attend the
first annual government purchasing and insurance seminar to be held in
Rochester Minnesota October 18-20 ~lth expenses paid. Roll call all ayes,
Custodial Service
Upon receded-da'ti-on by the City Manager, it was moved by Conner seconded by .
Norberg that the Mayor and City Manager be authorized to renew the contract
with Maintenance Experts on custodial service at the Municipal Building and
the Library for the coming year, Nov. I 1972 to Oct. 31, 1973~ thereby ,exer-
cising the contract option. Roll call all ayes.

A delega~io~' of' pe'ople' we~'e present from' the Prestemon Park area. Mr. Berg
from the Engineering Department' displayed a' draying of the park and eXPlained
the two alterna.te ways in which the ,area could be served with storm sewer
(1) improving the existing pond and installing piping to Hart Lake and Silver
Lake or (2). elimiua~ti.ng ~the pond and using all piping. Cost estimates can
be .figured both ways and this Will be a~"assesSable projeCt.. Mo~i0~ by'.""
Ea~d seconded by Conner that the City Manager be instructed to advertise for
a hearing to be held October :2~th and ~that a piece of storm sewer yet to be done
on Hayes Street be included in the project. Roll call~ all ayes.

Bake~r Flink snow plow
The ~ity Manager asked permission to buy one Baker Flink snow-plow. Two such
plows were in 'the budget: but only one is n~'e'ded' At--tHiS' 'time'. .in'as~mh' as
tn~s is~a Patented-plow and the city is standardized on this type of equip-
ment, he,asked-permission to buy it without the taking Of~bids. An estimate
of ~1630 less $3~5 for hitches not needed~ netting $1305 has been received from
the MacQueen Equipment Inc. M orion b,~ Land seconded by Norberg to authorize
the City Manager to spend up to $1305 f'or Baker Flink snow plOW.... All' a~es.
K-Mart Development
~epresentatives ~of K-mart were present; The,store building is complete and grand
opening scheduled for'Thursday'Sept. 28th. Their attorney Johnson reported that
only 3 items of landscaping are unfinished (1) the fence on the east and north
prooerty lines. Posts are installed 'but many days Of heavy rain have prevented
the' stretdhing of the. fence an~ 'b~e '{ns'e~b{n'g of ~the slats. "They will ru'sh com-
pletion · and it should be done in i week. (2) Grading on. the landscaped part
between the.parking lot and the. fence. T. hey ~¢_tl work on that any day that is
dry. (3) Planting of trees~ . The City M~nager reported,that he wculd prefer to
wait until after a frost when freshly dug trees can be obtained, rather than t°
insist on planting them now and spring dug trees would be used.

The Mayor expressed concern about the embankment between Shakey's Pdzza
and K-Mart. Second-hand railroad ties have been installed to stabilize
the bank, and Attorney Johnson reported that this was done by Tom Sullivan,
owner of Shakey's Pizza, to enlarge their parking lot. I;~en K-mart plans
were originally submitted they showed slopes and no retainin~ wall. The
question was raised a~ to whether we have any police power in re~ards to
the stabilization of the bank. The City I~na~erwill follow up on this.
Walk-way into K-mart from the north
A verbal request has been made by a resident north of K-Mart for a ~.ate in
the fence and a walkway, so that shoppers on foot and employees might get
to the store without going way around to the Central Avenue entrance. Mr.
Norberg recomuended that this be brought first before the Planning Conmtission
and them to the council with something definite in the way of a plan.
Sidewalk alon$ 37th AVenUe
A request has been received frc~ an area resident for a sidewalk on 3?th
Avenue between Central Avenue and Polk Street. Councilr. an Land concurred
with this request, in fact he is of the opinion that sidewalks should be
installed along 3?th Avenue all the way from Central to Hart Blvd. It was
mentioned that.~ perhaps State Aid funds could be obtained to cover part of
the cost. ~ihere would be no rush about a definite plan. Possibly the City
Manager and the Engineering Department could work on it over the winter
months with cost estimates and layout. Motion by Land seconded by Norberg
that this be done before the 1973 construction season, about May l, 1973.

Ordinance 791~ amendin$ Ordinance #603 ("J~mk Car" ordinance)
DiscussiOn f'ollowed as to the terminolog-~ to be use'~ in the amendment in
order to clarify the status of recreational vehicles. Motion by Connor
seconded by Norberg that the phrase "camping purposes exclusively" be
added to the definition of a Bus. Ail ayes.
Motion by Norberg seconded by Land that the phrase "exclusively for
recreation purposes" be substituted for "primarily for recreation purposes"
in the definition of Motor truck, truck tractor, or commercial vehicle.
All ayes.
It was decided to add another paragraph in Section 3, as follows: "It is
similarly unlawful for any person owning, driving, or in charge of any bus,
motor truck, truck tractor, or co~nercial vehicle excluded above as being
designed exclusively for recreation purposes or camping purposes to cause
or permit more than ~.zo of the s~.~e to stand longer thsn 24 hours continuously
on, in front of, or beside any property in a residence district except for
the purpmose of loading or unloading."

Rice Creek watershed district
Motion by N~rberg seconded by Land that the City Manager be authorized to
repre:~ent the city and make a presentation in respect to the justification
of keeping Columbia Heights out of the Rice Creek watershed district. Roll
call, all ayes.
Joint meeting with Planning and Zoning Commission
The Planning Commission has nearly finished studying the zoni:~g ordinance
proposed by A~*i~.-;est Planning and Research, and they have asked for an informal
neeting with the City Council. It was decided t hat tomorrow evening, Sept. 26
would be satisfactory.

Proclamation On Cleaner Air Week~ beginning Oct.

WHEREAS: the purpose of Cleaner Air ~Ieek is to promote a united educational
program for cleaner a ir and. to help build a better, Stronger America;and
~KqEREAS: air pollution is a serious cormnunit¥ problem brought about through
industrial e~ansion a~d increasing population~ and since industry and
. populations give every i~cation of continuing to increase at
~ressive rate; soot, smoke, slyash and noxious f~es and gasses
promise to become a greater hazard to ~e health and-welfare of-the
people of our Co~uni~, as well as a source of gr~ve ec°~omice waste; and
W~: in these d&ys when the Nation's security is t~eatened, air pollutio~
~ abat~e~t assumes increasing ~portauce in its preventio~ of waste of
materials a~d e~ergy, its cutting the cost of ~el, factory upkeep and
.mai~tenanc% and its reaction of illness and absenteei~;-and
~AS: the hazard of air Ro~ution can be greatly d~inished ~rough intellig~t
action i~vol~ng, e~'eeriug.equipment, research, education and_Personal
conscience~ and
W~P~AS: with some of the mechanical means a~eadyavailable combined with the
enli~te~ed a%titude of industry~ air pollution control is forging'
ahead, but ~ese measures must be continued and ~r~er measures insti-
tuted to win the race~ainst air pollution; and
~f~RE~: tobacco ~oke is a major contributor to pollution of the-indoor en~ron-
merit causing Erave 'discomfort to the non-smoker and resulting in a
significant hazard to th~ health of both smoker and non-~oker alike$ and
%~RE~: for these reasons the abatement of air pollution in all its va~ous
foms is of utmost conce~ to American cit~zens$.

Council request that all citizens cooperate fully in ~e obse~ance of
t~s week and undertake a year-round c~pai~ to abate dest~ctive air
polhtion fr~ all sources.
