The meeting was called to order at 8:12 p.m. in the City Council
Chambers. Roll Call: Norberg, Heintz, Connor, Nawrocki - present.
Land was attending a Traffic Commission meeting and arrived at
8:18 p.m.

Motion by Norberg, seconded by Heintz that the bids be turned
over to the City Manager for tabulation and report back at the

Open Bids on Sewer Rodder.
Bids on one trailermounted hydraulic model sectional sewer
rodding machine were received as follows:

Motion by Heintz, seconded by Land that the bid be turned over
to the City Manager for tabulation and report back at the next
regular meeting. Roll Call - All Ayes.
Hearing on Rezoning 4000-4020 Third Street to R-3.
A public hearing was held on a request from Art Porter to rezone
his property at 4000-4020 Third Street from R-2 General Residential
to R-3 Multiple Dwelling for construction of 40-unit condomi~um
apartments. Mr. Porter and his architect, Mr. Hoffmeyer, were
present at the meeting. Notices were mailed out to the neighbors
in the area so they would have an opportunity to view the
proposal, but none were at the meeting.
It was reported at the August 14th Council meeting, concern was
expressed over the Thi~ Street right-of-way as only 30' is
dedicated for a street at this time. The City Manager said he
checked on Third Street particularly north of 42nd Avenue and
in that area the City required the developers to dedicate a lO'
strip on either side of the street when the land was developed
to be used for street purposes. With the requirement for an
additional 10' on either side, the City would ultimately end up
with a 50' right-of-way. Mr. Porter indicated he would
include additional street dedications as part of the development.

A lengthy discussion was held on the proposal and the Council
members felt the City should carefully consider this right-of-way
problem before the rezoning is granted.
Motion by Norberg that the rezoning request be denied.
motion died for lack of a second.
The
Motion by Heintz, seconded by Norberg to table the matter and
set a public hearing for Third Street improvement including
necessary easements for same, the hearing to be held
Tuesday, October 10, 1972. Roll Call - All Ayes.
Ordinance #791 - Parking and Storing of Vehicles.
A first reading was held on Ordinance #791, amending #603,
being an ordinance regulating the operating, parking, storing,
repairing, servicing, and maintenance of racing cars, stock
cars, junk cars, busses, motor trucks, tractors or commercial
vehicles, providing penalties for violation thereof.
The City Attorney reported this ordinance was prepared to
clean up the language in Ordinance #603, exduding recreational
vehicles. The second reading constitutes the public hearing
and the ordinance will be discussed at that time.
Resolution #72-61 Authorizing Construction on Drainage Structure,
[9th to 50th Avenue, Jackson to Central.
It was reported at the last Council meeting the Council
authorized a drainage structure between Jackson and Central,
49th to 5Oth, on a 3/1 vote. The motion instructed the
City Manager to proceed with the project. The first step
to proceed is resolution #72-61.

BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights,
WHEREAS, the City Council of the City of Columbia Heights by
motion on the 14th day of August, 1972 oro~red notice of a
hearing to be given to property owners, and
WHEREAS, pursuant to a notice of hearing certain residents
appeared at a Council meeting on the ~9th day of August, 1972,
and
WHEREAS, the Council determines to proceed with this local
improvement, a portion of the cost being defrayed by special
assessments under Charter provisions.

NOW, THEREFORE, BE IT HEREBY RESOLVED:
That the location and extent of such improvements is as
follows: Storm drain curb with 24" drain gutter of
concrete and 3' bituminous apron from 49th to 5Oth Avenue,
from Jackson to Central Avenue N.E.
That the materials to be used are as follows:

That a careful estimate of the cost of the improvement has
been made by the City Manager and the several lots and
parcels of land fronting upon and adjacent to such proposed
improvement, which he deemed benefited thereby, were
properly notified of said hearings, and
That the City Manager shall also list the names and owners
of the several parcels so improved as nearly as can be
ascertained.
That it is the intention of this City Council to divide the
assessment for this improvement on the basis of 60% to
the property owners of commercial properties east of the
drain curb and 40% to the property owners on the west
side of the drain curb.
6. These improvements shall also be known as Project #673.

Home Occupation Permit for Photograp~ Study, 4219 Monroe.
A request was received from Chet Janas, 4219 Monroe, for a
home occupation permit to operate his photography studio out of
his home. He has lost his lease on the property on 4Oth Avenue.
Motion by Land, seconded by Heintz to grant the request, based
upon the recommendation of the Planning Commission.
Roll Call - All Ayes.
Lot Subdivision and Lot Area Waiver, 4308 and 4312 Washington.
Donald Crispin, owner of 4308 and 4312 Washington requested
a lot subdivision and lot area waiver to divide his property
into a 48' and a 50' lot. The 48' lot would need 2' size waiver.
The Planning Commission unanimously recommended the waiver
be granted. Motion by Heintz, seconded by Norberg that the
subdivision and 2' width waiver be granted. Roll Call - All
Ayes.
Side Yard Waiver, 3937 Main Street.
Myron Getter was present requesting a side yard waiver to place
a 32' Capp Home at 3937 Main Street. After reviewing existing
conditions and building locations, the Planning Commission
recommended this waiver be granted to allow the house to be
built 4.8' from the south lot line and 3.2' from the north lot

line. Motion by Norbemj, seconded by Heintz to grant the request
based on the recommendation from the Planning Commission, and
a signed statement from the neighbors indicating ~ objections
to the 3.2' side yard. Roll Call - All Ayes.
Appeal to Keep Rail Fence on Boulevard at 959 - 44½ Avenue.
Victor Villella, 959 - 44½ Avenue was present appealing the Planning
Commission denial to keep a rail fence he constructed without
a permit 10' on public right-of-way.
A discussion was held on the City's liability and insurance if
the fence were to remain on the boulevard. Councilman Norberg
suggested the fence be left on the condition that Mr. Vill~la
enter into an agreement with the City to get a rider on his
home owners insurance policy to save the City harmless from
any damages that might result because of the fence and that
the fence be removed within ten daysnotice from the City to do
so in the future. It was noted this property is for sale
and anyone who buys it would have to enter into the same kind
of agreement.
Councilman Connor said there were too many liabilities involved
with this and moved, seconded by Heintz to deny the appeal.
Roll Call: Land, Heintz, Connor, Nawrocki - Ayes. Norberg - Nay.
Home Occupation Permit for Beauty Shop at 4226 Polk Street.
Mrs. Ruth Grupa requested a home occupation permit for a beauty
shop in the basement of her home at 4226 Polk Street. This
permit was unanimously recommended by the Planning Commission.
Motion by Land, seconded by Heintz that the request be granted
subject to the approval of the Fire Department. Roll Call
All Ayes.
It was noted Mrs. Grupa's neighbors have signed a petition
stating no objections to this.
Home Occupation Permit for Architectural Drafting, 3864 Polk Street.
Richard Lenzmeier was present requesting a home occupation permit
for an architectural office at 3864 Polk Street. There will
be no exterior signs and the request was recommended by the Planning
Commission. Motion by Heintz, seconded by Norberg that the
request be granted. Roll Call - All Ayes.
Recess was called at 10:55 p.m.
The meeting reconvened at 11:10 p.m.

Traffic Commission Actions.
Councilman Land reported actions of the Traffic Commission at
their meeting earlier this evening. He explained why stop signs
were placed at the intersections of 49th and Washington and
at 44th and Arthur, and he reported the Commission gave
their sanction of cutting off Lookout Place for
development at Minneapolis Electric Steel Castings.
Bids on Stairway to Library Basement.
Motion by Norberg, seconded by Heintz that the City Manager
be authoHzed to prepare specifications and advertise for bids
to be opened at 2':00 p.m. Thursday, October l~th on the
addition stairway to the Library basement. Roll Call -
All Ayes.
Chiefs of Police Association Meeting.
A request was received for the ~lice Chief to attend the
State Chiefs of Police Association meeting in Blue Earth, on
September 22, 1972. Motion by Land, seconded by Norberg to
grant the request and authorize expenses. Roll Call - All Ayes.
Dog Control Procedures.
The City Manager reported Judge Keyes was going to be present
at the meeting this evening to discuss the dog control procedures.
He was not present. The Manager said the Judge specifically
asked that the Council consider a procedure similar to Anoka's.
A letter has been sent to the City of Anoka for information
on their control and until we have a response from Anoka,
we presently have nothing to report at this time.
Purchase of Forfeited Properties.
The City Manager said he has received a request from Thomas H.
Ohlenkamp to purchase some tax forfeit property in the vicinity
of 46th and Central. We have several forfeited properties and
he will accumulate information on these and will have a
recommendation for the Council.
Licenses.
Motion by Heintz, seconded by Connor that the licenses as
listed be granted upon payment of proper fees. Roll Call -
All Ayes.

Tree Situation in Huset Park.
Ken Hentges expressed concern over the trees in the picnic area
in Huset Park. The City Manager was instructed to investigate
what has happened, why and what will happen. A report will be
forthcoming.
Resolution on Consultants for Technical Matters.
Councilman Norbero presented a resolution he prepared to hire
consultants to perform in an advisory'capacity on some of the
highly technical matters. He suggested the Council members
look the resolution over and the matter will be on the agenda
for a meeting some time in the near future.
Set Meeting Dates in October.
Motion by Land, seconded by Connor that the regular meetings in
October be set for Tuesday, October 10th and Tuesday,
October 24th at 8 :00 p.m. in the City Council Chambers
because the 9th and the 23rd are legal holidays. Roll Call -
All Ayes.
