Roll Invocation was given by City Manager Watson. Minutes of Last Reg_ular Meeting. Counciinan Norberg brought up four additions to the minutes of the last regular meeting, August 14th. There were as follows: On p. 179, at the end of the discussion of Resolution #72-55 on LaBelle Park, let the record show that "Councilman Norberg votes 'Nay' because the resolution will dedicate $57,000 of the 1973 budget and therefore restrict the City's ability to operate within the dollar spending limit imposed by the 1971 legislature and the Minnesota Tax Commissioner". o On p. 180, at the end of the section on Resolution #72-56 on the "Affirmative Action Program", let the record show that "Councilman Norberg votes 'nay' because the matter was resolved earlier by another Council, making this action unnecessary and a waste of time for the Council and the audience, merely to satisfy a minor bureaucrat in St. Paul." On p. 185, the motion by Norberg was to remove the signs on 49th and Washington only until authorization is received from the County. On p. 187 under "liearings on Miscellaneous Work" let the record show that "Counci lmn Norberg votes "nay" because he feels the hearings should be held earlier so their effect upon 1973 budget for the Engineering Department can be determined before those budgets are certified in October". Motion by Heintz, seconded by Norberg to approve the m~nutes as presented in writing with four additions as indicated by Councilman Norberg. Roll Call - All Ayes. Payment of Bills. A second reading was held on Ordinance #789, sale of property to Ganzer Distributors. Offered by Land, seconded by Heintz. Roll Call - All Ayes. Ordinance #789 was adopted. Resolution #72-60 - Deed Restriction Requirement By H.U.D. Offered by Land, seconded by Heintz. WHEREAS, the City of Columbia Heights is desirous of participating in an open space land project, and WHEREAS, H.U.D. requires that a recordable document be prepared placing certain restrictions on property which would be the subject of said project. IT IS HEREBY RESOLVED by the City Council of the City of Columbia Heights that the sale, lease, mortgaging or creation of other indebtedness or other transfer of Lot 7, Block 2, Sheffield's Subdivision, Anoka County, Minnesota, accb~'ding to the plat thereof on file and of record in the office of the i~egister of Deeds in and for Anoka County, Minnesota, is subject to the prior approval of the Secretary of Housing and Urban Development. Roll Call - All Ayes. Resolution #72-62 - Authorizing the Filing. o_f Ap.pl.ication with H.U.D. for Grant. Authorizing Filing of application wi~ the Department of Housing and Urban Development, United States of America, for a grant under P.L. 89-117. Offered by: Heintz, seconded by Land. WHEREAS, pursuant to P.L. 89-117 the United States of America has authorized the making of grants to public bodies to aid in financing the construction of basic water and sewer projects; NOW, THEREFORE, · IT RESOLVED by the City Council of the City of Columbia Heights that Malcolm O. Watson be and he is hereby autho~zed to execute and file an application on behalf of the City of Columbia Heights, Minn. with the Department of Housing and Urban Develol~ment, United States Government, for a grant to aid in financing the construction of sanitary sewer and storm drains and appurtenances, and an assurance of compliance with the Department of Housing and Urban Development, regulations under Title VI of the Civil Rights Act of 1964. o That Malcolm O. Watson, City Manager, be and he is hereby authorized and directed to furnish such information as the Department of Housing and Urban Development may reasonably p. 192 request in connection withthe application which is herein authorized to be filed. Roll Call - All Ayes. Bi-Monthly Report on Burlington-Northern Operations. Art Porter was present and reviewed with the Council his report on the blasting and hauling operations in the area west of Main Street. The procedure to be used in filing damage claims was also reviewed. No action was taken. Report on Embankment Stabilization West of K-Mart. The City Manager reported on his meeting with representatives of K-Mart Thursday afternoon, August 24th. He explained what had been done on the seeding and placing of fertilizer and protective cover on the embankment and the addition of more retaining walls on the lower ends of the slopes. In addition to the extra retaining walls, the developers agreed to plant a row of bushes as a further deterrent to washouts the entire length of the pizza restaurant building. Representatives of Malan Construction Company and ~eir attorney stated that they would be responsible for the maintenance of the embankments and assumed full responsibility for t~m. No further Council action was taken at this time based on the report. Rental Agreement With Peter Tema for House on 38th Avenue. The City Manager submitted a letter to the Council recommending the rental rate on the house Peter Tema rents at 627 - 38th Avenue be lowered from $250 per month to $200 per month based on proximity to industrial area. Motion by Norberg, seconded by Land that the Mayor and City Manager be authorized to enter into an agreement for rental of 627 - 38th Avenue with Peter Tema for a period of one year at a rate of $200 per month. Roll Call - All Ayes. Amendment to Ordinance #603 - weight of Campers. The City Attorney presented an amendment to Ordinance #603 on the weight and storage of campers and other recreational vehicles. It was suggested the Council look over the ordinance and a first reading can be held at the next regular meeting. Damage Claim Payment. The City Manager requested authorization to issue a check for $55, payment on damage claim for a door damaged by the Police at 4438 Central. He said last May a call came to the Police Department from an insurance man who was talking to a client who lives at 4438 Central when suddenly the phone went dead. Fearing the woman was ill, the Police tried to call the house, and tried to get in, and when there was no response, the patrolman opened the door after which the woman came out and said she p. 193 did not want to be bothered. There was damage to the door, and our insurance company said since this was not an accident, they would not pay the claim. The City Manager said the officer acted in a proper manner. Motion by Land, seconded by Heintz that the claim in the amount of $55 be authorized. Roll Call - All Ayes. 1973 Budget Presentation. The City Manager submitted to the Council his draft of the ~73 budget. He said it reflects the limitations by the 1971 legislature and allows some margin to handle emergencies and other expenses. He sa~d this is the initial draft of the budget, subject to review by the Council in more detail, and has been worked down after discussions with City departments. He suggested budget hearings be set for the following week with the various department heads. Recess was called at 9:40 p.m. The meeting reconvened at 9:57 p.m. Solicitors License - Youth Incentive. A solicitors license application was received from Youth Incentive, Inc. to sell ecology bags door to door. Motion by Heintz, seconded by Land to deny the license, b~sed on the police report, that the report be made a part of the file. Roll Call - All Ayes. Supervisory Management Courses. Motion by Norberg, seconded by Heintz that the City Manager be authorized to spend up to $500 for supervisory management courses at the University of Minnesota for various supervisory personnel. Roll Call - All Ayes. Curb and Cement Repair Contract. The Engineering Department reported quotations were received by their department on cement repair work on curbs. The low bidder was Paul Hedquist. Motion by Heintz, seconded by Connor that the City Manager be authorized to spend up to $2,500 for miscellaneous curb and cement repairs, the contractor to be Paul Hedquist, based on low quotations. Roll Call - All Ayes. Mid-Block Street Lighting. A petition was presented, signed by residents on Washington Street, from 43rd to 44th Avenue requesting a mid-block street light. Motion by Norberg, seconded by Heintz that the City Manager be authorized to advertise for a hearing for mid-block street lighting on an assessed basis for Washington Street, 43rd to 44th Avenue, the hearing to be held at the regular meeting September 25th. Roll Call - All Ayes. p. 194 City Inspector Resignation. The City Manager reported Mr. Sonnenberg, Building Inspector, has resigned from the staff to take a position with the Blaine Inspection Department. No action was taken. Stencil Making Machine. Motion by Land, seconded by Heintz that the City Manager be authorized to spend up to $995.00 for a new Gestetner Stencil Maker. Roll Call - All Ayes. Traffic Problems. Robert Hart from 4190 Fillmore was present complaining of traffic and noise from the vicinity of 49th and Fillmore Street. He suggested there be more enforcement of ordinances on unmuffled vehicles and motorbikes. It was suggested the Police be alerted to the situation. Mr. Hart also asked when Stinson and Benjamin Streets were to be repaired under major maintenance program. The City Engineer explained major maintenance work will be done as soon as the seal coating work is completed, which could be in about two weeks. Public Works Conference. Motion by Land, seconded by Heintz that four registrations be authorized for the Public Works Conference to be held in Minneapolis, cost of $35.00 each. Roll Call - All Ayes. Licenses. Motion by Land, seconded by Heintz to approve thelist of licenses upon payment of proper fees. Roll Call - All Ayes. I.C.M.A. Conference. A request was received from the City Manager to attend the Internadonal City Management Association conference in Minneapolis September 17-20.
