The meeting was called to order in the Field House at 8:11 p.m.
Roll Call: Land, Norberg, Jeska, Heintz, Nawrocki - all present.
Invocation was given by Councilman Norberg.
Minutes of last regular and special meetincj.s.
Motion by Heintz, seconded by Land that the minutes of the last
regular and special meetings be approved as presented with the
one correction noted in the minutes of the May 22nd meeting on the
cost of architectural fees for the municipal garage building. Roll

Towing Contract
Bids on the towing contract were received from Shorty's
Towing and Dick's Towing. Motion by Land, seconded by Norberg
that the bids be turned over to the City Manager for tabulation
and report back at the next regular meeting. Roll Call - All Ayes.
Resolution #72-34 - Form and Details on the Bonds.
The City Attorney reported this resolution is quite long and
he suggested the Council waive the reading of the resolution in
full. A copy will be made a part of the official minutes of the
meeting. Motion by Jeska, seconded by Heintz to waive reading
of Resolution #72-34. Roll Call - All Ayes.
Resolution #72-34 authorizing the issuance and prescribing the
form and details, and providing for the payment of $455,000
Permanent Improvement Revolving Fund Bonds and authorizing the issuance,
prescribing the form and details, and providing for the payment of
$510,000 Garage Bonds. Offered by Land, seconded by Jeska.
BE IT RESOLVED by the City Council of the City of Columbia
Heights, Minnesota, as follows:
'l. This Council, by its ordinance adopted .April 24, 1972
entitled "Ordinance Providing for Public Sale of $965,000
General Obligation Bonds", authorized the sale of $455,000
Permanent Improvement Revolving Fund Bonds of the City. Said
bonds have now been duly sold, and shall be preoared and delivered
to the purchaser thereof. All acts, conditions and thinqs required
by the Constitution and laws of the State of Minnesota and
the City Charter to be done, to exist, to happen and to be
performed precedent to the issuance of the bonds herein described
have been done, do exist, have happened and have been performed
as so requi red.
2. The bonds shall be designated as "Permanent Improvement

Revolvinq Fund Bonds", and shall be dated as of July l, 1972,
and shall be 91 in number and numbered from 1 through 91, each in
the denomination of $5,000. The bonds shall mature in order of
serial numbers on January 1 in the years and amounts set forth
below without option of prior payment, and bonds maturing in such
years and amounts shal 1 bear interest from date of issue unti 1
paid at the annual rates set forth opposite such years and amounts,

KNOW ALL MEN BY THESE PRESENTS that the City of Columbia
Heights, a duly organized and existing municipal corporation of
Anoka County, Minnesota, acknowledges itself to be indebted and for
value received promises to pay to bearer the sum of FIVE THOUSAND
DOLLARS on the f~ rst day of January, 19 , without option of prior
payment, and to pay interest on said principal sum at the rate of
per cent ( %) per annum from the date hereof
until said principal sum is paid, payable semiannually on each January 1
and July 1, in accordance with andupon presentation and surrender

This bond is one of an issue in the total principal amount
of $455,000, all of like date and tenor except as to serial number,
maturity date and interest rate, all issued to provide funds for the

construction of public improvements of a lasting character, and is
issued pursuant to an ordinance and resolutions duly adopted by
the City Council and in full conformity with the Charter of said
City and the Constitution and laws of the State of Minnesota
thereunto enabl lng.
IT IS HEREBY CERTIFIED, RECITED, COVENANTED AND AGREED that
all acts, conditions and things required by the Constitution and
laws of the State of Minnesota to be done, to exist, to happen
and to be performed preliminary to and in the issuance of this
bond in order to make it a valid and binding general obligation of
the City in accordance with its terms, have been done, do exist,
have happened and have been performed as so required; that prior
to the issuance hereof the City Council has levied a direct,
an-ual, ad valorem tax on all taxable property in the City for
the years and in amounts sufficient to produce sums not less than
5% in excess of the principal of and interest on the bonds of this
issue when due, and has appropriated taxes 'in such amounts to
the sinking fund established for the payment of said bonds;
that, it necessary to pay principal and interest, the City is
required to levy additional ad valorem taxes on all such property,
wi thout 1 imitation as to rate or amount; and that the issuance
of'this bond does not cause the indebtedness oF the City to
exceed any constitutional, statutory or charter limitation of.

4. Said bonds shall be prepared under the direction of
the City Manager and attorney, and when so prepared, shall be ex-
ecuted in behalf of the City by the printed facsimile signature of
the Mayor and the manua] signature of the City Manager, and by
printing thereon a facsimile of its official corporate seal. On
the reverse side of each bond shall be printed a copy of the legal
opinion rendered by bond counsel and the certificate of the Mayor
and City Manager relating thereto. The interest coupons attached
to the bonds and the legal opinion certificate appearing on the
reverse side of the bonds shall be executed and authenticated by the
printed facsimile signatures of the Mayor and City Manager. When
the bonds have been executed and authenticated, they shall be de-
livered by the City Treasurer to the purchaser upon receipt of the
purchase price heretofore agreed upon, and the purchaser shall not
be required to see to the application thereof. $450,000 of the
proceeds of said bonds shall be deposited in the Permanent Improve-
ment Revolving Fund of the City and used to pay costs of public
improvements of a lasting character, including interest due on the
bonds prior to the col leciton of the taxes levied in paragraph 6.
5. The bonds herein authorized shall be payable From the
Permanenet Improvement Revolvin9 Fund Account of the General Debt
Service Fund of the City, which the Treasurer shall maintain separ-
ate and apart from all other funds of the City Until the purposes
for its creation have been accomplished. The moneys in said
Account shall be used to only pay principal of and interest on the
bonds payable from said Account. If at any time the moneys in
said Account should be insufficient to pay all principal and

interest due on bonds made payable therefrom, the City Treasurer
shall nevertheless pay the same from any moneys on hand in other
funds of the City and available for such purpose, and the moneys
so used shall be restored to the appropriate funds from the moneys
next received by the City in said Account which are not required
for the payment of additional principal and interest. Into said
Account shall be paid all taxes levied in paragraph 6, unless
canceled according to law prior to their collection, any amount
in excess of $450,000 received from the purchaser on delivery of
the bonds, and all other moneys appropriated to the payment of
said bonds and the interest thereon.
6. For the prompt and full payment of the principal oF
and interest on said bonds as the same respectively become due, the
full faith, credit and taxing powers of the City shall be and
are hereby irrevocably pledged. To provide moneys for the payment
thereof, there is hereby levied upon all of the taxable property
in the City, a direct, annual, ad valorem tax which shall be
soread upon the tax rolls for the years and in the amounts set
forth below, and collected with and as a part oF other general
taxes of the City in the respective ensuing collection years:

Said tax shall be irrepealable as long as any of said bonds are
outstanding and unpaid; provided, that the City reserves the riqht
and power to reduce the levies in the manner and to the extent per-
mitted by Minnesota Statutes, Section 475.61.
7. The City Clerk is hereby authorized and directed to
file with the County Auditor of Anoka County, Minnesota, a
certified copy of this resolution, together with such other
information as the County Auditor may require, and to obtain from
said Auditor prior to the delivery of the bonds herein described
a certificate that said issue has been entered upon his bond register
and that the tax required for the payment thereof has been levied.
8. The officers of the City and the County Auditor of
Anoka County are hereby authorized and directed to prepare and
furnish to the purchaser of said bonds and to the attorneys
approving the legality of the issuance thereof certified CoDies
of all proceedings and records of the City relatinq to said
bonds, and such other affidavits and certificates as may be
required to show the facts relating to the legality and market-
ability of the bonds, as such facts appear from the City's
books and records in their custody and control or as otherwise
known to them, and all such certified copies, certificates and
affidavits, including any heretofore furnished, shall be deemed
representations of the City as to the correctness of all
statements contained therein.

BE IT RESOLVED by the City Council of the City oF Columbia
Heights, Minnesota, as follows:
1. This Council, by its ordinance adopted April 24, 1972
entitled I'Ordinance Providing For Public Sale of $965,000 General
Obligation Bonds", authorized the sale of $510,000 Garage Bonds of
the City. The bonds described in said resolution have now been
duly sold, and shall be prepared and delivered to the purchaser
thereof. All acts, conditions and things required by the Constitution
and laws of the State of Minnesota and the City Charter to be done,
to exist, to happen and to be performed precedent to the issuance of
the bonds herein described have been done, do exist, have happened
and have been performed as so required.
2. The bonds shall be designated as "Garage Bonds", shall
be dated as of July l, 1972, and shall be 102 in number and numbered
from 1 through 102, each in the denomination of $5,000. The bonds
shall mature in order of serial numbers on January in the years
and amounts set forth below, without option of prior payment, and
bonds maturing in such years and amount shall bear interest from
date of issue until paid at the annual rates set forth opposite such
years and amounts, respectively:

the purchase price heretofore agreed upon, and the purchaser shall
not be required to see to the application thereof. $500,000 of
the proceeds of said bonds shall be deposited in a construction

fund of the City and used to pay costs of the new garage building,
including interest due on the bonds prior to the collection of the
taxes levied in paragraph 6.
5. The bonds herein authorized shall be payable from
the General Obligation Bond Account of the General Debt Service
Fund of the City, which the Treasurer shall maintain separate
and apart from all other funds of the City until the purposes
for its creation have been accomplished. The moneys in said
Account'shall be used to only pay principal of and interest on the
bonds payable from said Account. If at any time the moneys in
said Account should be insufficient to pay all principal and
interest due on bonds made payable therefrom, the City Treasurer
shall nevertheless pay the same from any moneys on hand in other
funds of the City and available for such purpose, and the moneys
so used shall be restored to the appropriate funds from the moneys
next received by the City in said ACcount which are not required
for the payment of additional principal and interest. Into said
Account shall be paid all taxes levied in paragraph 6, unless
canceled according to law prior to their collection, any amount
in excess of $500,000 received from the purchaser on delivery
of the bonds, and all other moneys appropriated to the payment
of said bonds and the interest thereon.
6. For the prompt and full payment of the principal of
and interest on said bonds as the same respectively become due, the
full faith, credit and taxing powers of the City shall be and are
hereby irrevocably pledged. To provide moneys for the payment
thereof, there is hereby levied upon all of the taxable property
in the City, a direct, annual, ad valorem tax which shall be
spread upon the tax rolls for the years and in the amounts set forth
below, and collected with and as a part of other general taxes
of the City in the respective ensuing collection years:

Said tax shall be i rrepealable as long as any of said bonds are
outstanding and unpaid; provided, that the City reserves the right
and power to reduce the levies in the manner and to the extent
permitted by Minnesota Statutes, Section 475.61.
7. The City Clerk is hereby authorized and directed to
file with the County Auditor of Anoka County, Minnesota, a certified
copy of this resolution, together with such other information as
the County Auditor may require, and to obtain from said Auditor
prior to the delivery of the bonds herein described a certificate
that said issue has been entered upon his bond register and that the
tax required for the pay~,t t,~.reof has been levied.

8. The officers of the City and the County Auditor of Anoka
County are hereby authorized and directed to prepare and furnish
to the purchaser of said bonds and to the attorneys approving the
legality of the issuance thereof certified copies of all proceedings
and records of the City relating to said bonds, and such other
affidavits and certif, cates as may be required to show the facts relating
to the legality and marketability of the bonds, as such facts appear
from the City's books and records in their custody and control
or as otherwise known to t~em, and all such certified copies,
certificates and affidavits, including any heretofore furnished,
shall be deemed representations of the City as to the correctness
of all statements contained therein.

Resolution #72-36 Authorizing Loan to Housing Authority
Resolution #72-36 authorizing 90 day loan of $5,000.00 to the
Housing and Redevelopment Authority of the City was presented.
The City Attorney said he had not had a chance to go over the resolution
and the applicable state statutes. He asked that the matter be
tabled. Motion by Jeska, seconded by Norberg that Resolution #72-36
be tabled until the Special Council meeting which has been set up
for 8:00 p.m., Monday, June 19th. Roll Call - All Ayes.
Resolution #72-38 Authorizing Housing Authority Transfers.
Offered by Land, seconded by Norberg.
BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights, that the City Treasurer by and he is hereby authorized
and directed to transfer the balance of funds allocated to the
Columbia Heights Housing Authority's own account. Roll Call - All Ayes.

Ordinance #787 vacating northerly 6' of 47th Avenue east of Central
Second reading held on Ordinance #787. Offered by Jeska,seconded
by Land. This is alongside the K-Mart property. Roll Call - All

Hilltop Police Protection Contract.
Ken Hentges, 4150 Monroe Street, was present. He requested the
Council take appropriate action to adopt a resolution which would
place an item on the ballot for the September Primary Election in
respect to the Hilltop Police protection contract. He said if the
Council did not take action, he was prepared to submit a petition with
800 signatures that would call for a special referendum election on
the contract. HE said there was no public hearing on the contract
and the City has no business entering into a contract such as this
when we don't have the manpower.

He presented figures on the size of police departments in other
communities in the metro area.
A lengthy discussion was held on the contract. Mayor Nawrocki
stated he would rely on the police chief for information on
the service and it is the Chief's opinion that to date the service
provided to the Village does not adversely affect the services
to our own people. He asked for a chance to study the figures
presented by Mr. Hentges in respect to other police departments.
It was suggested to bring this up later in the meeting under
new business.
Fence Height Waiver, 4950 Jefferson Street N.E.
Arequest was received from Myron Horishnyk for a fence height
waiver to construct a 5' chain link fence the entire length of
this north lot line. This waiver was recommended by the Planning
Commission. Mr. Horishnyk's neighbor submitted a letter stating
he has no objections to the fence. Motion by Heintz, seconded
by NOrberg to grant the request. Roll Call - All Ayes.
Side yard waiver for garage at 4148 Quincy Street N.E.
A request was received from Edward Hutterer for a side yard
waiver to build a garage 2' from his side lot line on a 40'
lot. This waiver was recommended by the Planning Commission.
Motion by Heintz, seconded by Jeska to grant the request. Roll

Lot Subdivision and Lot Size Waiver for 1201 and 1205 - 44½ Avenue.
Harley Stover was present and requested a lot subdivision and
lot size waiver for 1201 and 1205 - 44½ Avenue N.E. for two
building sites. The request was recommended by the Planning
Commission. Motion by Norberg, seconded by Land to table
the matter until the next regular or special meeting pending
further information from the City Attorney. Roll Call - All Ayes.
Storage Lanes and Traffic Controls on Central Avenue.
City Engineer Brown reported the Traffic Commission approved the
construction plans for the storage lanes and traffic controls
in the vicinity of the K-Mart Development. He said bids for that
work, which will be paid for by K-Mart, will be taken next Monday
to be reported to the Council at their special meeting that evening.
Sign at 40th and Jackson Street.
It was reported the Traffic Commission recommend permanent
stop signs be installed on 40th and Jackson Street by the
Library. Motion by Heintz, seconded by Norberg that the signs be
installed, and that a letter be sent to the County Engineer
authorizing said signs. Roll Call - All Ayes.
Drainage problem at 5015 - 5th Street.
Jim Turcotte, 5015 - 5th Street, was present to discuss a

drainage problem. This was discussed earlier this year at the seal
coat hearing. The City Engineer said the solution would be to put
in curb and gutter. Mr. Turcotte said he tried to circulate a
petition to get the work done but received opposition from his
neighbors. The only part of the street that is bad is the southern
part. Motion by Norberg, that the City Manager be authorized to
advertise for a hearing on curb, gutter and blacktopping the 5th
Street from 50th to 51st Avenue N.E. The motion died for lack of
a second.
It was reported since the neighbors were in opposition to work
of this nature, there is no sense to hold a hearing.
Motion by Norberg, seconded by Land to refer the matter to the
City Engineer for more information and report at the next special
meeting. Roll Call - All Ayes.
Mini Bike situation in the Sullivan Lake Area.
A resident from the Sullivan Lake area was present with a complaint
on Mini-Bikes, high powered motorcycles, and dune buggies on the
Sullivan Lake property. The City Attorney reported we do have a
nuisance ordinance we can follow to stop this situation. The resident
also requested the City force the owner of the property to clean
it up and if he doesn't, have the City clean it up and levy the cost
on the owner's taxes. Motion by Norberg, seconded by Land to refer
the matter to the City Attorney to try and proceed on the nuisance
bit. Roll Call - All Ayes.
Food Stand at Jamboree.
A request was received from several women from the Hain Street
area for a food license to serve Tacos at the Jamboree. Motion by
Jeska, seconded by Norberg that the license be granted to Mrs.
JoAnn Mady, that the fee be waived on the basis that the profits
from the stand will go into the development of a part west of Main
Street. Roll Call - A11 Ayes.
Street Classification System.
Mr. R. W. Hart was present and reported conditions have not
changed on certain streets in the City. He requested the City set up
a street classification system for every street in Columbia Heights
to be determined by the volume of traffic. This would bring the
streets up to standards so one residential street would be equal to
another.
The Council members and staff agreed it would be a good idea, but
how could it be implemented? The Engineering Department makes
recommendations to the Council and when the public hearings are held,
the projects are sometimes turned down or modified.
Planning Commission Appointment.
Three residents expressed a desire-to serve on the Planning
Commission. In view of these additional applications received,
was decided interviews would be held with these people before any
action is taken.

names of the individuals involved by supplied to the City.

A request was received from Progressive Design Association for
a waiver of the license and permit fees with regards to the new

A request was received from the Jaycees for a food license
at the Jamboree. Motion by Heintz, seconded by Norberg to grant

The City Manager presented a map he worked out showing the new
precincts for election after the legislative redistricting. The
Council members suggested several changes and a lengthy discussion
was held. Motion by Norberg, seconded by Heintz that the City Manager

Library Basement.
Councilman Norberg reported he met with the architect on the
new stairway proposal for the Library basement who felt it was
a good design, but couldn't see need for it. Mr. Norberg said

Fencing for Sewer and Water Department Storage Area.
Motion by Jeska, seconded by Heintz that the City Manager be
authorized to obtain quotations on approximately 390 ' of fencing

St. op Signs on 39th and Jefferson and 39th and Quincy.
Ken Hentges requested the Traffic Commission look into the installation
of four-way stop signs on 39th and Jefferson and on 39th and Quincy.

by Mr. Hentges be referred to the Traffic Commission for their consideration,

Licenses.
Motion by Land, seconded by Heintz that the licenses applications

establishment 1 icense for various summer activi ties in Huset Park,

Councilman Heintz presented a letter he received regarding a problem
with dogs. The letter referred to a clinic to be held in New Hop.e
and Crystal to vaccinate dogs and cats. Motion by Heintz, seconded

Blasting.
A discussion was he.id on the blasting report submitted from the
Engineering Inspector. Councilman Norberg expressed concern about the
