Roll Call: Land, Joint Powers Agreement. Motion by Jeska, seconded by Heintz that the Mayor and City Manager be authorized to enter into a Joint Powers Agreement with Anoka County relative to Joint Purchasing. Roll Call - All Ayes. Purchase of Police Cars. Motion by Land, seconded by Norberg that the City Manager be authorized to take bids on two squad cars and one .investigator car through the Anoka County Joint Purchasing program. Roll Cal 1 - All Ayes. Advertised Hearings on Curb, Gutter and Bituminous Surfacing] on Various Streets. The City Manager reported all the hearings have been called on the basis of engineering recommendations. The estimated costs for curb, gutter ~d surfacing are estimated at $11.00 a foot. The work is recommended to be done during the 1972 construction season. He suggested if the paving projects proposed tonight are denied, the Council consider the possibility of authorizing ~he reworking which must be done (major maintenance) to be an assessable project so it would not go against general taxes. The cost estimates run from $1.00 to $1.50 depending on how much material has to be added. He said we have to begin recognizing many of the taxpayers in our community have paid a full assessment to get curb and blacktop streets and each year they pay on their taxes additional money to support maintenance on the streets that are not permanently surfaced. Hayes Street, 37th to 39th Avenue. A petition was presented by the property owners on Hayes from 37th to 39th objecting to the proposed work because: 1. The cost of the watermain work that was put in and assessed. 2. The wide frontage of the majority of the lots which make individual costs high. 3. The fact that many of the people are retired and would not be able to pay the assessment. II p. 81 Motion by Land, seconded by Heintz to place the petition on file. The petition was tabulated and it was found that 47% of the owners had signed the petition opposed to the work. No one present from the area at the meeting was in support of the project. Motion by Land, seconded by Jeska that the project be denied. Roll Call All Ayes. Motion by Land, seconded by Norberg that the City Managerbe authorized to proceed with major maintenance on Hayes Street with the cost to be assessed to the property owmrs. Roll Call - All Ayes. 43½ Avenue from Tyler East. Tyler Place, 44th to 43½ Avenue. Pierce Street, 43rd to 43½ Avenue. The City Manager said there have been no assessment for street surfacing on 43½ Avenue and its connecting streets, Tyler Place or Pierce Street. At the time the streets were opened it was deemed advisable to put the base material down and wait until such time as the area was developed to recommend curb, gutter and surfacing. There is now sufficient development to recommend the work be done. A number of residents from the area were present and a lengthy discussion was held concerning the number of cars, the streets are a speedway, many children living in the area who have to cross, parking problems, and the cost of the work. Some residents present were in favor of the project, some opposed, and some gave no indication either way. Motion by Heintz, seconded by Jeska that the City Manager be authorized to proceed with the project. Roll Call - All Ayes. Tyler Street, 40th to 41st Avenue. Curbs on \Vest Side Only. The City Manager said Tyler Street has a good surface and good maintainable condition. The curb exists on the east side by Silver Lake School. It is proposed to construct curb on the west side at a cost of approximately $4.80 a foot. A petition was presented signed by all the property owners in opposition to the curb. Motion by Land, seconded by Norberg to place the petition on file. Roll Call - All Ayes. p. 82 The residents present said they are in opposition because some sewer work should be done in the area before curbs are installed. Under the circumstances, the Council should not consider the project . Motion by Jeska, seconded by Heintz that the project be denied. Roll Call - A11 Ayes. Tyler Street, 41st to 43rd Avenue. Polk Street, 41st to 43rd Avenue. 42nd Avenue, Reservoir to Cleveland. The City Manager reported the situation on each individual street and what assessments were levied in the past. Residents present objected to the project and expressed concern about fast traffic on the streets and bhe cost of the project. It was suggested not to do all the streets at one time because of such a heavy cost to some people who would be involved with both a street and an avenue assessment. The residents said do Tyler and Polk or do 42nd Avenue, but not both. II~ Council asked for a show of hands of those presa~£ on each street. On Tyler, everyone present was opposed. On Polk the majority were opposed. And on 42nd Avenue, several were for surfacing and several were against it. Motion by Jeska, seconded by Land that curb, gutter and surfacing on 42nd Avenue from Reservoir to Cleveland be approved. Roll Call - All Ayes. Motion by Jeska, seconded by Land that Polk Street from 41st to 43rd Avenue be approved for major maintenance. Roll Call - All Ayes. No work was authorized for Tyler. Recess was called at 9:58 p.m. The meeting reconvened at 10:10 p.m. Tyler Street, 43rd to 45th Avenue. Arthur Place, 44th to 45th Avenue. The City Manager reported Tyler Street from 43rd to 45th Avenue was opened and assessed in 1955. Arthur Place from 44th to 45th was opened in 1960 but there was never a street surfacing assessment. He said lots on the west side face Arthur Place and on the east face Arthur Street and have Arthur Place as their al ley access. His recommendation for assessment would be 1/3 assessment for the houses facing Arthur Street similar to an alley charge. p. 83 The majority of the residents present were opposed to the project. It was suggested to postpone any work until a petition is submitted with 51% of the owners requesting the work be completed. A letter was received from Mr. Amundson, owner of Lot l, in opposition to the work. Motion by Jeska, seconded by Heintz to place this letter on file. Motion by Jeska, seconded by Heintz that the proposal for Tyler Street from 43rd to 45th and Arthur Place from 44th to 45th Avenue be denied. Roll Call - All Ayes. Benjamin Street, 43rd to 45th Avenue. Stinson Boulevard, 40th to 43rd Avenue. A petition was received signed by a number of residents from Benjamin Street and StinsonBoulevard indicating they favored getting the surfacing done on the streets provided a cul-de-sac arrangement was set up as suggested by the City Engineer. The indication was since there is a state aid road two blocks away on Arthur Street, they would like to see the traffic discouraged from using Benjamin S~eet and Stinson. Arthur Street is the state aid street and is designed to take traffic whereas Stinson and Benjamin are curvey and hilly. A lengthy discussion was held on the cul-de-sac suggestion. Residents from Arthur Street present said they had not been notified of the proposal and requested a public hearing be held if a thoroughfare going north and south were closed off. The traffic counts on Arthur Street, Benjamin and Stinson were given which indicated an equal amount of traffic on the roads. Motion by Land, seconded by Jeska that curb, gutter and surfacing on Benjamin Street andStinson Boulevard be denied. Roll Call - All Ayes. Motion by Norberg, seconded by Jeska to authorize major maintenance for Benjamin from 43rd to 45th, and Stinson from 4Oth to 43rd. Rol 1 Cal 1: Land, Norbe~j, Jeska, Hei ntz - Ayes. Nawrocki - Nay. The motion carried. 43rd Avenue, Reservoir to Benjamin. A petition was presented in opposition to surfacing, curb and gutter on 43rd Avenue, Reservoir to Benjamin. Several residents were present and said they did not want the street paved. Motion by Land, seconded by Norberg that the project be denied. Rol 1 Cal 1 - All Ayes. p. 84 Resolution Ordering Improvements. Offered by: Jeska, Seconded by: Heintz. Roll Call: All Ayes. BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, WHEREAS, the City Council of the City of Columbia Heights by motion on t he 13th day of March, 1972 ordered notice of a hearing to be given to property owners, and WHEREAS, pursuant to a notice of hearing certain residents appeared at a Council meeting on the 17th day of April, 1972, and WHEREAS, the Council determines to proceed with this local improvement, a portion of the cost being defrayed by special assessments under Charter provisions. NOW, THEREFORE, IT IS HEREBY RESOLVED: That the location and extent of such improvements is as follows: Curb, Gutter and Bituminous Surfacing: 43½ Avenue, Tyler Place to cul-de-sac Pierce Street, 43rd to 43½ Avenue Tyler Place, 44th to 43½ Avenue 42nd Avenue, Reservoir to Cl~veland Blacktop Reconstruction: Hayes Street, 37th to 39th Averue Polk Street, 41st to 43rd Avenue Benjamin Street, 43rd to 45th Avenue Stinson Boulevard, Silver Lane to 43rd Avenue o That the materials to be used are as follows: materials, aggregate and concrete. Asphaltic That a careful estimate of the cost of the improvement has been made by the City Manager and the several lots and parcels of land fronting upon and adjacent to such proposed improvement, which he deemed benefited thereby, were properly notified of said hearings, and That the City Manager shall also list the names and owners of the several parcels so improved as nearly as can be ascertained. These improvements shall also be known as Project No. 476, Bituminous Surfacing; #477, Curb and Gutter; and #606, Blacktop Reconstruction. p. 85 Bids on Alley Paving. Bids on alley paving project #7202 were received from ten bidders. See attached bid tabulation. Motion by Norberg, seconded by Heintz bat these bids be turned over to the City Manager for tabulation and report back at the next regular Council meeting. Roll Call - All Ayes.
