Land, Invocation was given by Councilman Norberg. Minutes of last regular and special meetings. One correction was noted. In the minutes of the regular meeting held March 13th, Hearing on Street Construction, the hearing notice should read Stinson Boulevard from Silver Lane to 43rd Avenue, (not Stinson Boulevard from 4Oth to 43rd Avenue) and 43½ Avenue from Tyler to East Cul-De-Sac (not 43½ Avenue from Tyler to Pierce.) Motion by Jeska, seconded by Heintz that the minutes of the last regular meeting be approved as corrected and the minutes of the last special meeting be approved as presented in writing and the reading dispensed with. Mayor Nawrocki read the following Proclamation: WHEREAS, the Athletic Boosters Club of the City of Columbia Heights ~as at all times worked for the Youth of our community in promoting and supporting athletes and athletic events by: Purchase of all types of athletic uniforms and special equipment', Financing various items such as lighted softball fields, entry fees, and banquets, and in a continuing effort making their time and talents available to every worthy youth-oriented activity in our City, NOW, THEREFORE, I, Bruce G. Nawrocki, Mayor of the City of Columbia Heights do hereby proclaim the month of May, 1972 as "ATHLETIC BOOSTERS MONTH" and encourage the citizens of our community to support the unselfish endeavors of our Athletic Boosters Club. Motion by Land, seconded by Norberg that the bids be turned over to the City Manager for tabulation and report back at the next regular Council meeting. Roll Call - All Ayes. It was reported these bids will be reviewed with Councilman Jeska before an award is made. Award of Bids on Storm Sewer Project #7200. It was reported bids were opened on Wednesday, March 22nd at 10:00 a.m., storm sewer project #7200, for Gauvitte Park. A tabulation of the bids was presented to the Council members. p. 58 Motion by Land, seconded by Norberg to accept the tabulation of bids. Roll Call - Ali Ayes. The City Manager recommended the bid be awarded to the low bidder, Northdale Construction on this project. Motion by Jeska, seconded by Heintz to award the bid on storm sewer project #7200 to Northdale Construction, based on low bid, in the amount of $20,816.50. Roll Call - All Ayes. Hearing on 40th Avenue, Reservoir to Arthur. Mayor Nawrocki reported this hearing came about as a result of a previously held hearing to designate 40th Avenue from Reservoir to Arthur as part of the state aid system. At the time of that hea~ng there was opposition from the neighborhood and interest was expressed in proceeding with a paving project on the basis of a normal residential street. The City Manager reported copies of information requested from the neighborhood were sent to all individuals involved in this consideration. This included ten fairly comprehensive questions and answers as brought forth by the people. He said if 40th Avenue is to be designated for municipal state aid, the item that is assessed is only the cost for curb an~l'gutter, whi is $4.50 per front foot and $1.50 for avenue foot. If construction were a standard residential street, the cost would run $12.00 per front foot and $4.00 per avenue foot. The Engineer recommended a 44' width be constructed if this were a residential type street because all projections indicate the traffic volume will require the additional space. In any case, stop signs on Tyler, Ha~es and Arthur will continue to be under the jurisdiction of the Traffic Commission. The City Manager said courses availal~e are designating 40th as municipal state aid and authorize necessary maintenance work to be done during 1972 to build up the street in preparation for surfacing in 1973; deny consideration of state aid and authorize residential type construction; deny consideration of any work on 40th Avenue and set up a maintenance program with an assessment cost to be made for maintenance work; or deny~ con!~truction and maintain roadway from General Fund. The suggestion was made by the residents present that the Council give consideration to blocking off a portion of 40th Avenue between the school and park area. This would eliminate problems for school children crossing 40th, would eliminate maintenance work, and fast traffic. The residents asked why the City would put a heavily traveled street through a residential a rea. p. 59 It was pointed out by the Council in the 701 Plan, 40th Avenue is a necessary cross street. The City does not have a good cross street especially east of Central. It was also noted that 40th is the on.l.y street that crosses from one boundary line to the other ~nd is the quickest route for fire and emergency vehicles. The City Engineer gave the traffic counts on 40th Avenue in two locations. He said the traffic is there now. Regarclless of what happens, the biggest thing to increase safety for school children would be to have sidewalks built around the school. Sidewalks are eligible under state aid. The residents who actually lived on 40th Avenue indicated their desire to put the street on the state aid system. Those present said they had signed the original petition against this when it went around, but now that they are aware of all the facts they want a street that will take the kind of traffic that is there now. Motion by Land, seconded by Jeska that 40th Avenue from Reservoir to Arthur be designated as Municipal State Aid. An amendment was made by Norberg that the present signing stay in effect after construction on the Street. The amendment died for a lack of a second. Roll Call on first motion: Land, Jeska, Nawrocki - Ayes. Norberg, Heintz - Nays. The motion carried. A discussion was then held on when construction would begin. Motion by Norberg to continue the hearing on curb, gutter and surfacing on 40th Avenue under state aid until the next regular meeting. The motion died for lack of a second. Motion by Land, seconded by Jeska that the City Manager be authorized to proceed with curb, gutter and blacktop surfacing to state aid standards on 40th Avenue from Reservoir to Hayes Street, the work to be done during the 1973 constructionseason, or 1972 comtruction season if state aid funds are available. Roll Call - All Ayes. Recess was called at lO:15 p.m. The meeting reconvened at 10:25 p.m. Ban-the-Can Ordinance. Representatives from the S.C.A.R.E. group from the High School were present asking the Council to consider a proposed ordinance similar to one passed in St. Louis Park and Golden Valley prohibiting the sale of certain non-returnable disposable beverage containers. Mayor Nawrocki said we had a first reading on a so-called "Ban the Can" ordinance with the understanding there would be no second reading until other communities might act similarily. p. 60 The students asked that a hearing be set up on this type of ordinance. Motion by Heintz, seconded by Jeska that the proposed ordinance be referred to the City Attorney for his review with a report back to the next regular Council meeting with anordinance in the form for its first reading, that a second reading and public hearing be held at a special Council meeting to be held Monday, May 1st at 8:00 p.m. in the Field House. Roll Call - All Ayes. Resolution Establishing Municipal State Aid Street. Offered by Land, seconded by Jeska. WHEREAS, it appears to the City Council of the City of Columbia Heights, Minnesota, that the streets hereinafter described should be designated as Municipal State Aid Streets under the provisions of Minnesota Laws of 1967, Chapter 162; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Columbia Heights that the roads described as follows, to wit: 40th Avenue N.E. from Reservoir Boulevard to Arthur Street N.E., an extension of M.S.A.S. 13-112 be and hereby is established, located and designated as Municipal State Aid streets of said City, subject to the approval of the Commissioner of Highways of the State of Minnesota. BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to forward two certified copies of this resolution to the Commissioner of Highways for his consideration, and that upon his approval of the designation of said streets or portion thereof, that same be constructed, imp?oved, and maintained as Municipal State Aid Streets, numbered as shown above. Roll Call - All Ayes. Resolution Ordering Improvements. Offered by geska, seconded by Land. BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, WHEREAS, the City Council of the City of Columbia Heights by motion on the 14th day of February, 1972 ordered notice of a hearing to be given to property owners, and WHEREAS, pursuant to a notice of hearing certain residents appeared at a Council meeting on the 27th day of March, 1972, and p. 61 WHEREAS, the Council determines to proceed with this local improvement, a portion of the cost being defrayed by special assessments under Charter provisions. NOW, THEREFORE, IT IS HEREBY RESOLVED: 1. That the location and extent of such improvements is as fo l lows: 4Oth Avenue from Reservoir I~l~oulevard to Hayes StreW. 2. That the materials to be used are as follows: Base aggregate, asphaltic concrete surfacing and concrete curb and gutter in accordance with State Aid design criteria. 3. That a careful estimate of the cost of the improvement has been made by the City Manager and the several lots and parcels of land fronting upon and adjacent to such proposed improvement, which he deemed benefited thereby, were properly notified of said hearings, and 4. That the City Manager shall also list the names and owners of the several parcels so improved as nearly as can t~ ascertai ned. 5. These improvements shall also be known as Project No. 483. Roll Call - A11 Ayes. Ordinance //782 - Issuance of PIR Bond~. A second reading was held on Ordinance #782 - an ordinance providing for the issuance of $450,000 of bonds for maintaining the City's Permanent Improvement Revolving Fund. Offered by Norberg, seconded by Land. Rol 1 Call - All Ayes. Ordinance #~ was adopted. Ordinance #783 - Issuance of City Garage Bonds. A second reading was held on Ordinance #783 - an ordinance providing for the issuance of $500,000 General Obligation City Garage Bonds of the City. Offered by Heintz, seconded by Jeska. Roll Call - All Ayes. Ordinance #783 was adopted. p. 62 N.S.P. Street Lightin~Contract. Warren Johnson from Northern States Power Company was present for a discussion on the street lighting contract. Questions were raised on rate changes and if there was an option to cancel the contract on the part of the municipality if there is a rate increase. Motion by Norberg, to table this matter until the legal staff has had a chance to review it properly. The motion died for lack of a second. It was reported the representatives from N.S.P. and the Engineering Department have gone over this contract and the maps and schedules, and the number of street lights does tally with what N.$.P. has in the contract. The Resolution authorizing the street lighting contract was offered by Land, seconded by Heintz. BE IT HEREBY RESOLVED that the City Cound] of the City of Columbia Heights' Anoka County, Minnesota, hereby accepts the proposal of Northern States Power Company, a Minnesota corporation, to furnish street lighting service with all lights located or to be located in said City, and hereby approves all rates, terms, conditions, and specifications in the street lighting contract made a part of the proposal of said company and the proper officers of the City are hereby authorized and directed to execute the aforesaid contract for and in the name of the City, and to affix the corporate seal thereto. Motion by Norberg to amend the resolution to provide for the right to terminate at any time with 30 days notice. The amendment died for lack of a second. Motion by Norberg, seconded by Jeska to table consideration of this resolution until the next regular meeting and that the City Attorney be instructed to draft language that would give more flexibility to the City in the matter of termination of the contract and or negotiation of lower rates. Resolution Authorizing Joint Use Rental Ag.reement with Metro Sewer Board. The resolution was offered by Jes~ seconded by Heintz. p. 63 BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights lhat the Mayor and City Manager be authorized to enter into a joint use interceptor rental agreement with the Metropolitan Sewer Board for 1972. Roll Call - All Ayes. Hilltop Police Protection Contract. A lengthy discussion was held on the police protection contract for the Village of Hilltop after Ken Hentges questioned a section in the Charter that says resolutions andordinances must be signed, sealed and filed with the Secretary of the Council .'I' '~ within two days after the Council meeting. He said the ', resolution authorizing this contract was adopted March 13th but was not returned to the Secretary until today. He felt the right of the people was violated because they have only 14 days in which to file a petition for referendum instead of 30 days. Because the resolution was not signed properly, it was suggested to reconsider the resolution. Motion by Jeska, seconded by Land to reconsider the resolution. Roll Call: Land, Jeska, Heintz - Ayes. Norberg, Nawrocki - Nay. The motion passed. The resolution authorizing the contract was offered by Land, seconded by Jeska. BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that the Mayor and City Manager be authorized to enter into a contract with the Village of Hilltop to supply police protection for a period of five years in accordance with the agreement prepared by the attorneys of our respective communities. Roll Call - All Ayes. The City Attorney was instructed to research this matter and supply the Council with a written legal opinion. Appointments to Boards and Commissions. Motion by deska, seconded by Heintz to concur in the Mayor's appointment of Kenneth Nygaard to the Police & Fire Civil Service Commission. Roll Call - All Ayes. p. 64 In the Recreation Commission, it was reported the term of JoAnne Mikkola is up for reappointment by the School Board. The Council recommended this reappointment to the Board. Motion by Norberg, seconded by Land that Oliver Jarvenpa be reappointed to the Park Board for a five year term. Roll Call - All Ayes. Motion by Jeska, seconded by Heintz that Mrs. Gilbert Miller be reappointed to the Library Board for a three year term. Roll Call - All Ayes. Motion by Land, seconded by Jeska that Frank Breen be reappointed to the Traffic Commission representing the business district for a four year term. Roll Call - All Ayes. Motion by Heintz, seconded by Jeska that Tom Lucas be reappointed to the Merit Commission for a four year term. Roll Call - All Ayes. It was reported in the Human Rights Commission, James Lien and James Durand ~o not wish to be reappointed, leaving two vacancies. Motion by Norberg, ~conded by Land that Lynette Thomson and Ronald Kalina be appointed to the Human Rights Commission for three year terms. Roll Call - All Ayes. In the Planning Commission, the term of Floyd Hammargren has expired but he has not indicated whether he wants reappointment. It was suggested the staff check the ordinance and find out when an appoin~nt to this commission has to be made. Minnesota State Fi re School . The Fire Chief requests authorization for two members of his department to attend the annual Minnesota State Fire School to be held at the Pick-Nicollet Hotel April 24th through 27th. Expenses include registration of $30 each, travel and meals. Motion by Land, seconded by Heintz to grant the request. Roll Call - All Ayes. Sewer & Water Operators School. Don Jolly requests authorization for two men from the Sewer Department to attend the Annual Sewer School at the Pick-Nicollet April 10-12 and two men from the WaterDepartment to attend the '~Vater Operators School at the Pick-Nicollet April 12-14. Cost for each of these schools is $25.00 per man. Motion by Norberg, seconded by Land to grant the request. Rol 1 Cal 1 - A11 Ayes. p.65 Meeting on State Building Code. Motion by Heintz, seconded by Jeska that expenses for up to ten people be authorized to attend the Metropolitan League meeting on the State Building Code to be held April 26th at the Ambassador Resort Motor Hotel. Roll Call - All Ayes. Hearing on Storm Sewer Installation. Motion by Land, seconded by Jeska that the City Manager be authorized to advertise for a public hearing on storm sew~ installation on 39th and Reservoir, hearing to be held at 8:00 p.m. Ap~l 24th. Roll Call - All Ayes. Joint Meeting With School Board. The City Manager reported on a proposed joint meeting between the Council and School Board to be held April 3rd at 8:00 p.m. to discuss the platting of Fillmore Street south of 49th Avenue. Lot Subdivisbn for Lot 12, Block l, Reservoir Hills. A lot subdivision r e<0est was received from Harley Stover for Lot 12, Block 1, Reser~ci r Hills (subje. to road and util. ease. over S. 30'). The description to be 1. South 143' (Sub. to rd. and Util. ease. over S. 30'), of Lot 12; 2. Lot 12 (ex. S. 143'). Motion by Heintz, seconded by Jeska to grant the request, that the outstanding specials in the amount of $2,997.92 be split. Roll Call - All Ayes. Domestic Animal Control. Councilman Norberg suggested a notice be sent out with the utility bills informing the residents of the license and leashing laws for dogs and cats. The City Manager requested the Council authorize doubling the patrolling for the month of April. He suggested transfering money for the budget to supply this extra patrolling by the domestic animal control contractor. Motion by Jeska, seconded by Heintz to authorize the transfer of $325 from the unallocated general expense account to the animal control poction of the budget. Roll Call - All Ayes. Situation at 5037 Madison Street. Councilman Jeska reported he received a complaint on the unsightly condition at 5037 Madison Street. The complaint was on the unkept condition of the house, the clutter, cars pa~ed in the front yard and other things. The City Attorney was instructed to review the status of the property at 5037 Madison Street and confer with the Building Inspector and the City Manager and advise the Council at the next meeting of what action, if any, can be taken. p. 66 Report on Blasting Operations. A written report from the Engineering Inspector was submitted to the Council on the blasting operations along with a report from the Pollution Control Agency. The City Attorney said his office has been receiving a number of calls from residents regarding the truck traffic. The agreements will again be reviewed. Bids on Concrete Alley Paving. Motion by Jeska, seconded by Heintz that the City Manager be authorized to advertise for bids on concrete alley paving, bids to be opened at a special meeting April 17th with an award on April 24th. Roll Call - All Ayes. Bids on Seal Coat Work. The City Engineer requested authorization to call for bids on seal coating ~rk. He said in the past we have done this ourselves but we are taking a larger segment this time. The City crews will patch and sweep. Motion by Norberg, seconded by Heintz to deny the request to advertise for bids on seal coating work. Roll Call - Norberg, Heintz - Ayes. Land, Jeska, Nawrocki Nay. The motion was defeated. Motion by Land, seconded by Jeska that the City Manager be authorized to advertise for bids on seal coat work, bids to be opened April 24th. Roll Call: Land, Jeska, Heintz, Nawrocki - Ayes. Norberg - Nay. The motion passed. Bids on Mixer. Motion by Heintz, seconded by Land that the City Manager be authorized to advertise for bids on a new mixer, bids to be opened April 24th. Roll Call - All Ayes. Licenses. Motion by Heintz, seconded by Land that the licenses as listed be granted upon payment of proper fees. Roll Call - All Ayes.
