Regular Meeting
February 28, 1972
The meeting was called to order by Council President Jeska at
8:16 p.m. Roll Call: Land, Norberg, Jeska, Heintz Present.
It was reported Mayor Nawrocki and Attorney Sokolowski were attending
a Charter Commission meeting this evening and wmld be late for the
Council meeting. It was also reported that City Manager Watson
was attending a Village Council meeting in Hilltop Village and he
too would be late for the Council meeting.
Invocation was given by Rev. Kenneth Stewart of United Community
Methodist Church.
Minutes of last regular and special meetings.
Motion by -~ seconded by l~orberg that the minutes of the
last regular and special meetings be approved as presented in
writing and the reading be dispensed with. Roll Call - All Ayes.
Payment of Bills.
Motion by Land, seconded by Heintz that the bills as listed be
paid out of their proper funds: Roll Call - All Ayes.

Ordinance #777, Sale of Lot 1, ~lock 2, Apache Heights.
A second reading was held on Ordinance #777 - Sale of
Lot 1, Block 2, Apache Heights (2300 - 40th Avenue N.E.) to
Audria Williams Hartry in the amount of $6,005.00. Offered
by Heintz, seconded by Land. Roll Call All Ayes.
Ordinance #777 was adopted.
Ordinance #778 - Sale of Lots 2 and 8 , Block 2, Apache Heights.
A second reading was held on Ordinance #778 - Sale of Lo~ 2 and 8
in Block 2, Apache Heights (2310 40th Avenue and 3945 McKinley
Street N.E.) to Dr. Paul Williams in the amount of $6,000.00
and $5,005.00 respectively. Offered by Land, seconded by Heintz,
Roll Call - All Ayes. Ordinance #778 was adopted.
Ordinance #779 - Sale of Lot 9, Block 2, Apache Heights.
A second reading was held on Ordinance #779 - Sale of Lot 9,
in Block 2, Apache Heights (3955 Mckinley Street N.E.) to
Dr. William J. Carr and Ann H. Carr in the amount of $5,005.00.
Offered by Norberg, seconded by Land. Roll Call - All Ayes.
Ordinance #779 was adopted.
Several residents from the 40th and McKinley area were present
for the second reading of the above t l~ee ordinances. The plans
for the proposed clinic building were reviewed by the residents.
They were told the matter will also be discussed at the next
Traffic Commission meeting on March 6th and the next Planning
and Zoning Commission meeting on March 7th.

Ordinance #780 Rezoning 828 - 40th Avenue to ROC.
A second reading was held on Ordinance #780 which would rezone
Lots 47 and 48, Block 63, Columbia Heights Annex, (828 - 4Oth Avenue)
from C-2 General Commercial to R-O-C Residence Over Commercial.
The ordinance was offered by Land, seconded by Heintz.
Councilman Norberg asked for the definition of "R-O-C Residence
Over Commercial" since Don Markow, the owner of the building,
proposes to convert the east half of the building into a living
~X~tl~Xl~l~(unit. The ordinance talks about an apartment over
commercial, but this is on the side.
Motion by Norberg, ~e¢onded by Heintz to table the matter until
the City Attorney arrives. Roll Call - All Ayes.
Resolution Setting Certain 1972 Salaries.
BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights that the following salaries be established
for 1972, effective January 1, 1972. In addition, the individual
employee's hospitalization and insurance (under the Hennepin
County groupplan) will be paid.
Assessor Trainee ......... $7,000.00
Park-Recreation Secretary ..... 5,366.40
BE IT FURTHER RESOLVED that said salary designations shall
supercede the resolutions referred to the salaries for the
Assessor Trainee and the Park-Recreation Secretary.
Offered by Heintz, seconded by Land. Roll Call - All Ayes.
Request from Park Board for A~thor~zation to Negotiate the Purchase
of Lot 9, Block 2, Walton's First Subdivision of Reservoir Hills.
A request was received fromthe Park Board for authorization from
the Council to negotiate with Carl Sorenson for purchase of
property located south of Ostrander Park. (Lot 9, Block 2 in
Walton's First Subdivision of Reservoir Hill).) This would make
the park a little bigger. Councilman Land asked to see some plans
of what the Park Board wants to do with the property
before purchasing it. Motion by Norberg, seconded by Land
to refer the matter back to the Park Board for more information.

Attorney Sokolowski arrived at 9:05 p.m.
Mayor Nawrocki arrived at 9:10 p.m. at which time Councilman Jeska
relinquished the chair to Mayor Nawrocki.

Ordinance #780 Rezoning 828 - 40th Avenue to ROC.
Motion by Norberg, seconded by Heintz to take Ordinance #780
off the table. Roll Call - All Ayes.
Councilman Jeska said Mr. Markow is requesting the rezoning to
ROC and he plans to remodel the building one side for residential
and one side commercial. ROC reads residential over commercial.
Does this comply with the intent of the ordinance?
The City Attorney said it will comply with the intent of the
ordinance but maybe not in the specific verbal language.
Basically, it is a matter of having residential and commercial
combined.
Mayor Nawrocki said the question he raised at the last meeting was
what was the justification for the recommendation of this
from the Planning Commission. Councilman Jeska said their
indication was that this was going to be a temporary thing
and the intent was to eliminate the building in the near future.
On that basis they felt it was a reasonable request and approved
it.
As indicated earlier, the ordinance was offered by Land, seconded
by Heintz. Roll Call: Land, Heintz - Ayes.
Norberg, Jeska, Nawrocki - Nays. Ordinance #780 was defeated.
Snowmobile Ordinance.
Councilman Norberg suggested an amendment be made to the
snowmobile ordinance that would define when the snowmobile season
begins and ends. The City Attorney said the City is confined
to what the State Law says. If the State doesn't define it,
we shouldn't, and there is no distinction in the state law
defining De season.
City Manager Watson arrived at 9:25 p.m.
Storm Sewer for Gauvitte Park.
The City Manager reported a letter was received from the Park
Board requesting storm sewer installation in Gauvitte Park.
He said it could be handled within the budgetary system set up for
1972. Motion by Land, seconded by deska that the City Manager
be authorized to advertise for bids for storm sewer work,
bids to be opened at lO:00 a.m., Wednesday, March 22, 1972,
with an award of bids on March 27. Roll Call - All Ayes.
Pd ice Training Institute.
A request was received from Police Chief Glader to attend the
1972 Police Chiefs Training Institute March 15-17 in Bloomington.
This Institute is co-sponsored by the Department of Conferences
and Institutes, and the League of Minnesota Municipalities

in cooperation with the Minnesota Chiefs of Police Association.
The registration is $45. Motion by Jeska, seconded by l. and
to authorize the Police Chief to attend the training institute.
Roll Call - All Ayes.
Clerks & Finance Officers Conference.
A request was received from the Acting Clerk-Treasurer and the
Deputy Clerk-Treasurer to attend the Municipal Finance Officers
Conference March 9-11 at the Holiday Inn Central. Concern was
expressed over having both the Clerk and the Deputy Clerk away
from the office at the same time.
Motionby Heintz, seconded by Jeska to grant the request. Roll
Call: Land, Jeska, Heint~ Nawrocki - Ayes. Norberg - Nay.
The request was granted.
42nd Avenue Project.
Ken Hentges presented a petition requesting a public hearing
on curb, gutter and surfacing on 42nd Avenue from Central to
University. Motion by Jeska, seconded by Heintz that the City
Manager be authorized to advertise for a public hearing for
curb, gutter and surfacing on 42nd Avenue from Central to
University Avenue, the hearing to be held April I0, 1972.
Roll Call - All Ayes.
K-Ma rt.
The City Manager reported actions taken by the Village Council
of Hilltop earlier in the evening. He said a resolution was
adopted stating no ~jections by the Village to a standard
signalization at 47th and Central. Ccp ies of the resolution
will be forwarded to the Highway Department and the Columbia
Heights Council.
The City Manager reported on meetings held with representatives
of K-Mart on the items listed in a resolution granting K-Mart a
building permit. Included were traffic patterns, sidewalks on
the north side of 49th Avenue, etc. Mayor Nawrocki expressed
concern over a 50' tall sign separate from the building.
He requested the sign be reviewed if an application for a sign
permit comes in.
Recess was called at lO:O0 p.m.
The meeting reconvened at lO:12 p.m.

Ordinance //781 - Police Officers to Become Members of P.E.R.A.
The City Attorney presented Ordinance //781 based on actions
of the Charter Commission earlier in the evening. Ordinance //781
is an ordinance relating to the Police Department; requiring
newly employed Police to become members of the P.E.R.A. Police
and Fire Fund; amending the City Charter of Columbia Heights
by adding a new section.
A first reading of the ordinance was held. The second reading
at the next regular Council meeting will constitute the public
hearing on Ordinance //781.
Hilltop Police Protection.
A lengthy discussion was held regarding an agreement to supply
police service for the Village of Hilltop. The City Manager
reported that he had attended the Hilltop Village Council meeting
earlier this evening and that they had reached an agreement
regarding the proposal as outlined by the Attorneys. They were
to submit a counter-proposal after reviewing their needs in the
light of the discussions to date. Some disagreements between
Council members were expressed regarding this agreement and
two members of the audience spoke in opDosition to the cost
projection in the contract. No action was taken by the Council
until a report is submitted by the Attorne~ for Columbia
Heights and Hilltop at another meeting.
Engineering Staff.
The City Engineer submitted a report requesting the Council
reconsider the cut-back proposed in the Engineering staff,
leaving them with a minimum working staff. The City Manager
said he felt the Engineer was correct in respect to retaining
the Field Surveyor-Party Chief. He did not think it was
essential to retain fu] 1-time clerk-dispatcher. Councilman
Norberg proposed the acceptance of the City Manager's recommendation.
Councilman Jeska requested a job description for the Clerk-
Dispatcher position before action is taken.
Concrete Pavers Assodation Seminar.
Motion by Jeska, seconded by Heintz to authorize expenses for
one person to attend the Concrete Pavers Seminar at the Pick-
Nicollet Hotel, March 2nd and 3rd. registration of $15. Roll
Call - All Ayes.
Asphaltic Material, Plant Mixed Bituminous, Road Aggregate, and
Equipment Rental.
Motion by Jeska, seconded by Land that the City Manager be
authorized to advertise for bids on asphaltic materials, plant

mixed bituminous, road aggregate and equipment rental, bids to be
opened March 30, 19~ at lO:O0 a.m., bids to be tabulated and
report to the Council April 10, 1972. Roll Call - All Ayes.
Dump Truck.
Motion by Jeska, seconded by Norberg that the City Manager be
authorized to advertise for bids for a dump truck, bids to be
opened March 27th. Roll Call - All Ayes.
Licenses.
Motion by Land, seconded by Heintz that the licenses as listed
be granted upon payment of proper fees. Roll Call - All Ayes.
Insurance Committee Meeting.
A meeting with the Insurance Committee was set up for Wednesday
evening, ~arch Ist, at 9:00 in the City Office.
Water Rates.
Councilman Heintz reported a call he received from a citizen
regarding a water bill. She gave him identical bills from
Fridley, Minneapolis, and New Hope which indicated our rates
are higher than others. The City Manager was instructed to
get a breakdown of rates from other metropolitan comm~ities.
