Agreement on Blasting Permit.
Wyman Smith, attorney for Park Construction, Jerry McDonald of
Park Construction, and Dick Smith representing Barton Contracting
were present. A lengthy discussion was held on an agreement
received from Wyman Smith earlier in the day outlining standards
on the blasting permit. The City Attorney said there were
significant changes on the agreement and recommended no action
be taken on re-issuing the permit. It was suggested by
Councilman Norberg to table any further action on the agreement
until a representative from the insurance company comes in
who can commit them on claims. Possibly a meeting could be
set up later in the week between the Council and City Attorney
and the attorneys representing Barton and Park Construction
to discuss the agreement further.
Ordinance //777 - Sale of Property.
A first reading was held on Ordinance //777 - sale of Lot l, Block 2,
Apache Heights, to Audria Williams Hartry in the amount of
$6,005.00.
Ordinance //778 - Sale of Property.
A first reading was held on Ordinance //778 - Sale of Lots 2 and 8
in Block 2, Apache Heights to Dr. Paul Williams in the amount of
$6,000.00 and $5,005.00 respectively.

Ordinance //779 - Sale of Property.
A first reading was held on Ordinance //779 - Sale of Lot 9,
Block 2, Apache Heights to Dr. William J. Carr and Ann H. Carr
in the amount of $5,005.00.
Ordinance //780 Rezming 828 - 40th Avenue to ROC.
A first reading was held on Ordinance //780 rezoning
Lots 47 and 48 in Block 63 Columbia Heights Annex (828 - 40th Avenue
N.E.) from C-2 General Commercial to R-O-C Residence Over Commercial.
Resolution on N.S.P. Street Lighting Contract.
The City Manager presented a resolution authorizing a street lighting
contract with Northern StatesPower Company. He said this is a
five year contract. It was suggested the City Attorney review
the contract before action is taken.
Consideration of Designating 40th Avenue as State Aid.
The City Manager reported the Traffic Commission recommended the
Council consider ~th Avenue from Reservoir £o Arthur as a state aid
road. He said a public hearing on the matter was held at the last
Traffic Commission meeting at which time questions were raised and
two petitions filed, one from the home owners in the neighborhood
and the other from businessmen in Columbia Heights. The petitions
were both in opposition to designating 40th Avenue as state aid.
Concern was expressed about increased traffic, widening of the
roadway, removal of stop signs, and the flow of traffic being
carried over to Apache Plaza.
Councilman Land reported after the Traffic Commission meeting he
went down and talked with the property owners facing 40th
Avenue. He told them all sides of the problem and suggested
an alternative of making this a residential street. He said he
received favorable responses.
Residents from the area were present and a lengthy discussion
was held. Questions were raised as to what exactly the costs
were for residential vs. state aid, the legality of assessing
the home owners the same as school and park property, since some
of the residents have already been assessed for curb and gutter
will they be assessed the same as others, what happens to the
children do they get cross walks, sidewalks, stop signs, etc.
A request was made that the Council direct a letter to be
sent to the petitioners outlining the points discussed to be
used when circulating another peti tion.

Motion by Norberg, seconded by Jeska that the City Manager be
authorized to advertise for a hearing on curb and gutter under
state aid, or curb, gutter and blakctop under a residential type
project, the hearing to be held on March 27, 1972 at 8:00 p.m.

Motion by Jeska, seconded by Heintz to table the matter of
designating 40th Avenue from Reservoir to Arthur as state aid.
Roll Call - All Ayes.
Recess was called at 9:45 p.m.
The meeting reconvened at 10:07 p.m.
Rear Yard Waiver for 4400 Central.
A request was rece:i, ved for a 4' rear yard waiver to allow
the 7-Eleven Market to be located at 4400 Central Avenue.
The City Manager reported the Planning Commission reviewed the
plan and recommended the waiver to allow them to place the building
4' from the alley. He said the building would be 7' from the
north lot line. This would leave room for a door on the north
end of the building and they would be able to place a refuse
container in the location out of sight from 44th Avenue.
Motion by Land, seconded by Norberg that the waiver be referred
to the Traffic Commission for review of the traffic problems and
report back to the Council. Roll Call - All Ayes.
Home Occupation Permit for 4660 Heights Drive.
A request was received from Henry J. Schmidt for a home occupation
permit to use his house for an office. Mr. Schmidt was present
at the meeting and said his.bUsiness is selling wigs. No
deliveries would be made to his house. A petition was submitted
signed by his neighbors indicating no objections to the operation.
Motion by Heintz, seconded by Jeska that the home occupation
permit be granted as recommended by the Planning Commission.

Bus Shelter, 37th and Central.
A sketch was presented of a proposed bus shelter the M.T.C.
is putting up at 37th and Central Avenue N.E. Mayor Nawrocki
said it will go on public property 10'north of the Lawyers
Building. Motion by Norberg, seconded by Land that the Mayor
and City Manager be authorized to enter into an agreement with
the Metropolitan Transit Commission for placement of a bus
shelter at 37th and Central Avenue N.E. Roll Call - All Ayes.

Report on Senior Citizen Housing.
Mayor Nawrocki reported the Housing Authority of the City met and
adopted a resolution requesting consideration be given by the
H.U.D. office to the development of low income family units.
He said a meeting was held on Friday last week with the contact
man from H.U.D. and we may hear shortly favorably on this housing.
Request from Activities Committee to hold Jamboree.
A request was received from the Activities Committee to hold the
1972 Jamboree on June 16, 17 and 18. Murphy Shows is the carnival.
It was reported the Activities Committee has obtained the necessary
permission from the Park and Recreation Commissions to hold the
Jamboree in Huset Park. They request closing of Jefferson Street
from 39th to 40th Avenue N.E. as a safety measure. Motion by
Jeska, seconded by Heintz to grant permi~ion for the Activities
Committee to hold the Jamboree subject to filing of proper insurance
certific-ates with the City Manager, as approved by the City
Attorney, and subject to review of closing off Jefferson Street
by the Traffic Commission. Roll Call- All Ayes.
Street Lighting for Superamerica.
Motion by Heintz, seconded by Land that the Mayor and City Manager
be authorized to enter into an agreement with Superamerica
Station for placement and actual charges on a street light
by their station at 50th and Central. Roll Call All Ayes.
Storm Sewer for Gauvitte Park.
The City Manager said in reviewing the budgetary allotments on
P.I.R., we have sufficient funds budgeted for a storm sewer in
Gauvitte Park. The City Attorney said in the state law, if
100% of the property owners are in favor of the assessment,
there is no need for a hearing. The suggestion was made to get
a letter from the Park Board on the matter.
Sound Slide System.
A request was received from the Civil Defense Director to purchase
a 3-M Sound Slide System. This could be used for training
in the Civil Defense Fire Rescue Unit and the Police Reserve,
the Fire Department could use it in their demonstrations, and
it ~ould be used in presentations at City Council meetings.
The cost is $984.20. The Council members expressed concern
on how much the equipment would actually be used. Motion by Jeska,
seconded by Heintz to deny the request. Roll Call: Land, Norberg,
Jeska , Heintz - Ayes. Nawrocki Nay.

Board of Eq~ization Meeting.
The City Manager reported a letter was received from the Anoka
County Assessor proposing May 31, 1972 at 8:00 p.m. be set
for Board of Review or Equal ization. The Council members
concurred with that date.
Public Hearings on Alley Paving and Seal Coating.
Motion by Land, seconded by Jeska that the City Manager be
authorized to advertise for hearings on concrete alley
paving and street and alley seal coating to be held at
7:00 p.m., Thursday, March 16, 1972 in the Field House.
Roll Call: Land, Jeska, Heintz, Nawrocki - Ayes.
Norberg - Nay.
Solicitors License.
A request was received from Rev. John L. Rios of the Latin
American Gospel Mission for a solicitors license. He requests
the license fee be waived on the basis of a charitable
organization. Councilman Norberg asked if Rev. Rios had filed
reports showing financial disclosures, and requested the'
license be contingent upon this. Motion by Jeska, seconded
by Heintz to grant the request for a solicitors license.
Roll Call: Land, Jeska, Heintz, Nawrocki - Ayes.. Norberg
abstained.
Human Rights Commission Appointmen~t.
The suggestion was made that interviews be set up with the
three applicants for appointment to the Human Rights Commission
at 7:00 p.m., Thursday, February 17th.
Lawsuit on Pipe Companies.
It was reported there is an action against nine pipe companies.
A form was received asking if the City wishes to be included
in the suit which would allow the Attorney General to represent
the City's interest. The City Attorney recommended the City
be included. The only cost would be the time involved by the
Engineering Department in figuring how much pipe the City bought.
Motion by Jeska, seconded by Heintz to join in the lawsuit
and have the proper and necessary officials execute the documents
to comply with the No~h District Alabama Court. Roll Call -
All Ayes.
Licenses.
Beer License for JoAnne C. Pastuszak, 500 - 40th Avenue N.E.
Motion by Jeska, seconded by Land that the 3.2 on-sale beer license,
the 3.2 off sale beer license, ~X~X~XXX~K~ ping pong,
pool table, and cigarette licenses be granted for 500 - 40th Avenue
to JoAnne C. Pastuszak. Roll Call - All Ayes.

Motion by Land, secon~d by Heintz that the licenses as listed
be granted upon payment of proper fees, that the special use
permits include all restrictions previously imposed on the
permits. Roll Call - All Ayes.
Brooklyn Center Case on Levy Limitations~
Mayor Nawrocki reported Brooklyn Center won the case on the
ability of the Auditor to levy anything above the so-called
~ levy limitations without the express permission of the
State Tax Commissioner.
Library Situation.
Councilman Norberg explained a discipline problem at the
Library with a group of teenage boys. He also expressed concern
over the exit-entrance to the Library basement. The City
Manager was directed to resurrect the plans that were drawn
up several years ago about another entrance down the back stairs.
Architect for City Garage.
Motion by Heintz, seconded by Norberg that the Mayor and City
Manager be authorized to enter into an agreement with
Architect Tom Van Housen for architect services on the new
City garage. Roll Call - All Ayes.
