Regular Meeting
December 27, 1971
The meeting was called to order at 8:05. Roll call: Nawrocki, Logacz, Jeska,
Heintz, Land, present.
Motion by Heintz seconded by Jeska that Temple Nygaard be appointed Secretary
pro-tern for this meeting. Roll call all ayes.
Motion' by Heintz seconded by Logacz that t he minutes of the last regular and
special meetings be accepted as presented in writing and the reading dSspensed
wi~:h. Ail ayes.
Motion by Jeska seconded by Logacz that the bills totaling $97,835.31 as listed
be paid out of their proper funds. Roll call, all ayes.

.Open bids on legal publications for 1972
Only one bid was received for legal publications for 1972, that of the Sun Newspapers.
A letter was submitted 'itemizing the rate, which is set by Minnesota law. Motion by
Land seconded by Heintz that this bid be accepted, and that the Mayor and City Manager
be authorized to enter into a contract for same. Roll call, all gyes.
ordinance 768 Vacating Streets and alleys West of California St. for Burlington Northern.
~e Uity Attorney reported that he has gooe"through many abstracts and deeds for proper-
ties involved in th~s vac~ting, and that there are many gaps a~ld omissions. To be sure
of getting good title to the properties, the second reading of the ordinance shculd not
be held at this time.

planned Unit Development of To~ Ho,~ses. ordinance offered by Jeska seconded by
Land. All ayes.

Recosnition of "Truck Driver of the Year"
Mr. and Mrs. Clarence Hoffman were present. Mr. Hoffman, 4424 Arthur Place
N.E. has been named the American Trucking Associates national "Driver of the
Year" for 1972. He has driven 2.8 million accident-free miles in 32 years,
has been credited with extinguis~ing two fires a nd with administer, rig first
aid to a critically injured accident victim. Mayor Nawrocki extended to
Mr. Hoffman congratulations for his accomplishment.
Ordinance #772~ Second readin$ ~
A second reading of Ordinance #772 was held, rezoning 4430 ~yler Place, from
R-2 General Residential to R-5 Planned Unit DeveloMnent of Town Houses.
Ordinance offered by Land seconded by Jeska. Roll call, all ayes.

A second reading of Ordinance ~773 was held, vacating 39th A~nue frc~a
McKinley Street to Stinson Blvd. Ordinance offered by Jeska seconded
by Land. Ail ayes.
Ordinance #774~ Amending Ordinance ~684, Second reading
A second reading of Ordinance #774 ws'~ heId, which amends certain sections
of the "Club Liquor License" ordinance #684. Offered by Logacz, seconded by
Jeska. Roll call - Ayes Logacz, Jeska, Land, Nawrocki. Heintz abstained from
voting.
Park Construction Corn any blastin permit

Attorney Wyman 'mith was present representin~ Barton Construction Company, a
sub-contractor doing the rock removal for Dark Construction Co. ~t the
Burlington Northern site. They are very anxious to have their blasting per-
mit renewed. Attorney Smith explained that the Fireman's Insurance Company
who insure Barton Company for damages to private property, are reluctant to
admit to damages at thds time as it is much too early in the construction
project. Nevertheless Barton Company would like to appease the people and
to be allowed to blsst. They suggest establishing a fund gratuitously which
could pay for current damages to priwte property and even make amends for
pain or inconvenience. These small claims would in no way affect any valid
claim which might be made at a later date to t he insurance company. After
the need for the fund is ended, any monies left over would be dot. areal to the
City, possibly for the park fund.
It was impossible at th~ s meeting to set an amount which would be necessary
in this fund, nor to establish a schedule whereby property damages coul~3 be
valued. It w~s suggested that a committee could visit homes, some on Main
Street and at least one on Second Street, to determine the amount of d~u~ge
which may already have occurred. It w as decided that Dick Smith o f Barton
Contracting should be on the Con~aithee, and also Councilmen Heintz and Land.
Before the Janqary 10th meeting the attorney for the contractor, and also
City Attorney °okolowski will meet to prepare a set of .~.~uidelines whereby
this fund would be established aud out of which sm~]l cla~nns cmld be paid.

Call for bids on a traile.~- mounted generator
Mr. Gust~fson of the ~ngineering Depar%ment explained the t}qoe of generator
which is needed, and it was moved by Land seconded by I.ozacz to authorize the
City Manager to advertise for bids on one trailer mounted 30 kilo-watt standby
electrS, c geuerating set, to be opened at the January 10th meeting. All ayes.

Buildin~ 0fficisls Institute
Per~iss~'on wa's re'quested fo'~ ex]~enses whereby the Building Inspector could
take advantage of this school to be held January 17-19 in Minneapolis. Dis-
cussion followed as to ti%ether Mr.Sonnenber~ could be spared for 3 days,
inasmuch ss the inspect, ion load is unusually heavy at this time. It was left
up to the City Manager to determine the feasibility, an5 zrith this stipulation
it was moved by Land seconded by Logacz to ay~prcve the expenditure. Roll call:

Public Works Conference
Motion by Land seconded by Jeska to authorize payment of expenses for 3 men to
attend the Oublic Works Conference to be held ~ n February. Ail ayes.
Call for bids on domestic animal control
Motion by Heintz seconded by Jesks to authorize the City Manager to call for bids
on domestic ani~na! control to be opened at the regular meetin~ on January lOth.

P~:cause of the unusually deep lots which were platted in Columb,la Heights Acres,
parcels have been subdi~,,]ed to front on either 6th Street or ?th Street, in
varying depths. In one particular instance a property ovmer on the 7th Street
side of the alley in this block also has tJ.t!e to ~' of the property on the 6th
Street side cf the alley, resu!tin~ in a situc~.~ion where some owners have
actually paid an assesa.~ent for an alley to w~hdch they have no legal access. To
complicate the situation, the owner of record now wants to be paid for the 3'
strip. This involves ~ property o~mers on 6th Street - James Ertzgaard, Harold
Julkowski, and Arlo Hughes at ~31, ~37, and ~]_ -6th Street respectively.
Fir. Sokolowski suggested two possible sol,]tions (!) the City could condemn the
3' strip anJ then proceed to widen the alley right-of-way thereby siving the
6th street ,ide legal access ~o the alley, or (2) the Councila~ou].~ state thst
the assessment that was made for the alley is not proper, and that it must be
corrected. Inasmuch as the alley would then lie entirely on property owned by
Mrs. Kantola, ~32-?th Street, she would receive an additional assessment. It was
decided that the City' Attorney and/or the City ManaMer would see t~t this letter
is written and report back to the Council when an answer is received.
Ordinance ??~ Amendin.g #?29, Highway Traffic Ee~a!ati~n Act
Upon recommendation by the CityAttorhey, a first reading was held of Ordinance
which w~ald amend Ordinance #?29 so that ColumbJ~ Heights regulstions would be
identical to those of the State of Minnesota.
Ordinance #776, amending #~73, relating to ~eeping of dogs.
A technicality in the wording of one section of the dog ordfnance necessitates an
amendment thereto, as recommended by the Uity Attorney. A first reading of
Ordinance #776 was held at this time.

Mr. Gust~fson, Assistant Engineer, reported that a fence has been erected by the
railroad property near Califo~ia Street, but f t is not at the property locatf on or
grade. We have been assured by the radlroad that in the sprin~ this fence instal-
lation will be corrected. ~or the time being they would ldke to leave it as it is
for protectfon.
