Regular Meeting December 13, 1971
The meeting was called to order at 8:05 p.m. Roll Call: Land,
Heintz, Jeska, Logacz, Nawrocki - present.
Motion by Land, seconded by Heintz that the minutes of the last regular
and special meetings be approved as presented in writing, and the reading
be dispensed with. Roll Call - All Ayes.

Certificate of Appreciation.
A Certificate of Appreciation was presented to Lawrence Patsch
in recognition of his service on the Volunteer Fire Depar~nt for
23 years.
Bids on Punch Card Voting Devices.
Bids were received on punch card voting devices from the following:
IBM Corporation - No bid.
Computer Election Systems - Votomatic Vote Recorder. 85 units
@ $135.00 each for a total ~ of $11,475. Ten Demonstrator units
@ $51.00 each for a total of $510.O0. Ten Transfer Cases @ $8;50 each
for a total of $85.00. Total Bid: $12,O70.00. Note: The
units are are new except for their use by the City of Columbia
Heights in the 1971 Primary and General Municipal Elections.
The bid price is the original purchase less rental for previous
use by Columbia Heights.
The City Manager reported money available from our present budget
which anticipated the purchase of such equipment amounts to
$13,000. He recommended the purchase of the machines from Computer
Election Systems.
Motion by Jeska, seconded by Heintz that the bid be awarded to
Computer Election Systems for Punch Card Voting Devices in the
amount of $12,070.00, that the Mayor and City Manager are hereby
authorized to enter into a contract for same. Roll Call - All Ayes.
Side Yard Waiver, 3980 Tyler.
Motion by Heintz, seconded by Land that the request from Robert Bofferding,
3980 Tyler Street, for a side yard waiver for an attached ~rage
be granted upon the recommendation of the Planning and Zoning
Commission. Roll Call - All Ayes
Park Construction Blasting.
Mayor Nawrocki reported at the last meeting, the Council authorized
the hiring of Alfred Schroeder to make an investigation of the blasting
operations in the ~rlington-Northern Railroad yards. Mr. Schroeder
was present and submitted his report and recommendations as follows:
That seismograph readings and a monitoring system be set up
for all blasting operations.
That all seismic readings be taken at a location near or adjacent
to the closest inhabited structure to the blast area.

The readings include three movements, namely: vertical,
horizontal and transverse, and a permanent record be made
of all readings and test taken.

That all blasting operations be so conducted so as not to
produce seismic readings to exceed 0.15 inches per second
average for ten blasts and no single blast to exceed 0.20
inches per second. In the event this is exceeded, immediate
steps be taken to reduce the charges on loading of
explosives and an investigation be made and a report submitted
as to the cause or reason for the excessive readings.
Mr. Schroeder also recommended that pre-splitting be conducted
along the easterly limits of the area adjacent to Columbia
Heights before any rock removal or blasting is conducted, that
care be taken to load all holes in any one blast with the same
amount of explosives, and that operations be carried on between
10:00 a.m. and 4:00 p.m. He suggested in the event anyone
feels a particular blast is extra heavy or objectionable,
that a memo be made of the date, exact time and location, and the memo
be sent to the City Engineer's office and the report will be
checked to allow for corrections.
Several residents present reported that as feared, the insurance
company verbally indicated to them no damage occurred in their
homes as a result of the blasting. It was suggested an
injunction be filed against the railroad to stop all blasting
until some kind of settlement could be worked out.
Ken Hentges suggested a committee of experts be set up to
determine the damage and that Park Construction set up a fund
of money for this committee to work with.
Motion by Jeska, seconded by Heintz to accept the report from
Mr. Schroeder, to instruct the staff to continue
investigation of ways to insure claims are taken care of, and
no permit be issued at this time. Roll Call - All Ayes.
Recess was called at 10:40 p.m.
The meeting reconvened at ll:O0 p.m.
Continued Hearing on S~laitary Sewer Project //662.
Mayor Nawrocki reported at the hearing on this project a
discussion was held on the proposed assessment for St. Timothy's
Lutheran Church. The matter was referred to our City Attorney
to work with the attorney ~r the church to see if a settlement
could be worked out.
The City Attorney said he has proposed addopting middle ground
which would have an assessment as recommended by the City
Manager in a report to the Council at the time of the special
assessment hearing. In the event this parcel would make c6nneo~W

the balance of $1,539.22 be re-assessed on the property.
A resolution adopting an assessment roll for local improvement //662,
and determining that said improvement has been made and ratifying
and confirming all other proceedings, heretofore had, for
special assessment //662 was offered by Land, seconded by Jeska.
WHEREAS, the City Council of the City of Columbia Heights,
Minnesota, met at 8 o'clock p.m. on the 30th day of November, 1971,
at the City Hall Council Chambers in Columbia Heights, being the time
and place set when and where all persons interested could appear
and be heard by the Council with respect to benefits, and to the
proportion of the cost of making the local improvement above
described, a notice of such hearing having been heretofore duly
published as required by law, and a notice mailed to each
property owner of record, stating the proposed amount of the
assessment; and the assessment hearing for //662 was adjourned to
8 o'clock p.m., December 13, 1971 when this assessment hearing
for #662 was to be continued.
WHEREAS, this Council has heretofore estimated and fixed the cost
of such local improvement and has prepared an assessment roll
therefore.
THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS HEREBY RESOLVES:
Section 1. That this Council does hereby adopt the aforesaid
assessment roll known and described as "Assessment Roll for Local
Improvement //662':'.
Section 2. That this Council hereby finds and determines that each
of the lots and parcels of land enumerated in said assessment roll
was and is ~pecially benefitted by such improvement in an amount
not less than the amount set opposite in the column headed
"Total Assessment" And this Council further finds and
determines that the proper proportion of the cost of such
improvement to be especially assessed against such lot or parcel
of land is the amount set opposite the description of each such
lot or parcel of land respectively in said assessment roll.
Section 3. That said assessment may be paid in part of in full
without interest on or before January 12, 1972, or in annual
installments for a period of ten years as designated on the
assessment roll, payable on or before the 3Otb day of September
annually, with 8% interest thereon. Failure to pay the
annual installment renders the same delinquent and thereafter a
10% penalty is added and the said delinquent special assessment
is certified to the County for collection with the real estate tax.
Section 4. That plat //32682, parcel #1990 upon connection to the
sanitary sewer installed by this project shall be re-assessed the
sum of $1,539.22 so that the parcel shall be totally assessed the
sum of $6,446.00.

Section 5. That this Council did hereby determine and re-determine
to proceed with said improvement #662, does ratify and confirm
all other proceedings heretofore had in regard to this
improvement, and said improvement shall hereafter be known
and numbered as 'lLocal Improvement #662I'
Section 6. That this resolution shall take effect
immediately upon its passage.
Roll Call - All Ayes.
Purchase and Rental Agreement for Tema Property.
The City Attorney reported he met with Peter Tema and his Attorney,
Robert Guzy, re: negotiations for purchase of Peter Tema
property on 38th Avenue for use as a City Garage site.
They agreed to the following: That the City purchase all the
property (Lots 37 _to 43 in Block 84, Columbia H~ghts Annex)
for the sum of $3~,~00 on January 15, 1972, with a tenancy
to Mr. Tema until July 15, 1972, the rental to be $250 per
month. That Mr. Tema would pay the oustanding special assessments
and maintenance and insurance on the property. The City to pay
the taxes. Motion by Jeska, seconded by Heintz, that the
Mayor and City Manager be authorized to enter into a purchase
agreement and a rental agreement with Peter Tema for the
property on the basis of the terms as outlined by the City
Attorney. Roll Call - All Ayes.
Resolution Authorizing Agreement with Hennepin County Relative
to Joint Purchasing.
Offered by Land, seconded by Logac~, BE IT RESOLVED by the
City Council of the City of Columbia Heights that the Mayor
and City Manager are hereby authorized to execute on behalf
of the City the proposed agreement with Hennepin County
relative to joint purchases of selected items of good%
materials, supplies, and equipment cooperatively with
Bloomington, Edina, Brooklyn Center, Richfield, Golden Valley,
St. Louis Park, and Columbia Heights with Hennepin County
to be the purchasing agent. Roll Call - All Ayes.
Wiring LaBelle Hockey Rink. Lights.
Motion by Heintz, seconded by Jeska that the City Manager be
authorized to spend an amount not to exceed $600 to provide
wiring at the LaBelle Hockey Rink. Roll Call - All Ayes.
Ordinance #771 - R-5 Zone.
A first reading was held on Ordinance #771 creating an R-5 zone
to allow Planned Unit Development of Town Houses in the City,
as recommended by the Planning and Zoning Commission.

Ordinance #772 - rezoning 4430 Tyler Place to R-5.
A first reading was held on Ordinance #772 rezoning 4430 Tyler
Place from R-2 General Residential to R-5 Planned Unit
development of Town Houses, as recommended by the Planning and
Zoning Commission.
Ordinance #773 Vacating 39th Avenue from McKinley to Stinson.
A first reading was held on Ordinance #773 vacating 39th Avenue
from McKinley Street to Stinson Boulevard, as recommended
by the Planning Commission, and Traffic Commission.
Ordinance #774 Amending Club Liquor License Ordinance.
A first reading was held on Ordinance #774 which amends Ord. #684
providing for the issuance of On-sale Intoxicating liquor licenses
to certain clubs and provid.~ng the regulation thereof.
Bids on Legal Publications.
Motion by Land, seconded by Heintz that the City Manager be
authorized to advertise for bids on legal publications for 1972,
bids to be opened at the next regular Council meeting, December 27,
1971. Roll Call - All Ayes.
Chairs for Council Chambers.
Motion by Land, seconded by Jeska that the City Manager be
authorized to purchase 1OO stacking chairs from the Hank Carney
Company in an amount not to exceed $995.00. The chairs are
to be used in the City Council Chambers. Roll Call - All Ayes.
Purchase of Two Sand Spreaders.
Motion by Heintz, seconded by Jeska that the City Manager be
authorized to purchase two Swenson Company sand spreaders
at a price not to exceed $743.20 each, based on informal
competitive bids. Roll Call - All Ayes.
Resolution Setting Salaries for Members of the Police Department
for 1971.
The Resolution was offered by Heintz, seconded by Jeska,
BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights, that WHEREAS, negotiations have proceeded prior
to January, 1971 for the year 1971 between Local 149 Teamsters
representing members of the Police Department and the City
Council's Labor Consultant, and in recognition of the accelerating
financial burden of the private pension plan the City of
Columbia Heights Police Department and the City Council of the
City of Columbia Heights agrees to the following terms and
conditions of employment:

NOW, THEREFORE, BE IT RESOLVED that the following salary and
fringe benefit program be instituted for members of the
Columbia Heights Police Department:
Salary adjustment of $29 per month to be granted to all
patrolmen and sergeants.
An additional $36 to be paid as a 'lpension inequity'l
adjustment payment (not to be considered as ~lary for
pension purposes) to personnel in the Columbia Heights
Relief Association.
3. Personnel under P.E.R.A. to receive $65 per month adjustment.

Time and one-half to be paid for overtime on call backs
and hold-overs, authorized by the supervising officer, said
overtime to be based on salary including pension
inequity"

Residency requirement to be waived and a time requirement
to reach the Police Station from their residence of no more
than 15 minutes be established.
o
That any life insurance program granted for Columbia Heights
City employees include all members of the Police Department
and a representative of the Police Department to be a
member of the Insurance Committee to review proposals on
such insurance coverage.

That a false arrest insurance program be granted for
department members.
Clothing allowance of $140 per year to be granted payable
by voucher.
That any new patrolman hired after November l, 1971 shall
be placed under the Public Salty P.E.R.A. pension plan and
the Columbia Heights Police Relief Association agrees not
to oppose any action by the City that would place new
patrolmen under said Public Safety P.E.R.A. program either
through legislative action or otherwise.
BE IT FURTHER RESOLVED That items numbered 1, 2, 3, and 8 be
made rets-active to ~nuary 1, 1971 and that the applicable
authorization for salary adjustments during the "freeze"
period under appropriate federal and state regulations be used
for the members of the Department as justification for a salary
increase during the period for August 15, 1971 to November 13, 1971.
Provided said employees;qualify under this Act.

This resolution shall become effective upon acceptance by Local
149 representing the Columbia Heights Police Department, and a
legal opin~n of the City Attorney which indicates that the above
resolution does not violate any of the wage and price freeze guidelines.
Roll Call - All Ayes.
Forms on Low Income Senior Citizen Utility Rates.
A discussion was held on the reason it was required that the
forms on the low income senior citizen utility rate be notarized
as it does cause a few problems for some people. It was decided
this requirement does keep the forms honest and will be used
only on the new applications.
C~ce~ Checks.
Motion by Land, seconded by Jeska that checks #13562 and 13969
in the amounts of $14.50 and $6.00 respectively be cancelled
as both were issued in an incorrect amount. Roll Call - All
Ayes.
Sale of Property.
Dr. Paul Williams from the clinic at 3900 Stinson Boulevard was
present asking if the City would consider selling the lots
in the block adjoining his medical center. (Block 2, Apache
Heights, along 40th and McKinley.) No action was taken at
this time.
Licenses.
Motion by Heintz, seconded by Jeska, that the licenses, and
special use permits as listed be granted upon payment of proper
fees and include all original conditions and requirements.

Roosevelt Cit~, Alabama.
Mayor Nawrocki reported he received a cardfrom Roosevelt City,
Alabama inviting somecne ~ attend Ribbon Cutting Ceremonies for
their new neighborhood facilities building and Fourth Anniversary
Program. It was suggested a telegram of congratulations be
sent.
