Regular Meeting November 22, 1971
The meeting was called to order at 8:14 p.m. Roll Call: Land, Heintz,
Jeska, Logacz, Nawrocki - present.
Invocation was given by Rev. David Skordahl of First Lutheran Church.
Minutes of last Regular & Special Meetings.
Motion by Jeska, seconded by Logacz that the minutes of the last
regular and special meetings be approved as presented in writing
and the reading dispensed with. Roll Call - All Ayes.

Letter from School Board Re: K-Mart.
Mr. William Marshall from the School Board was at the meeting and
presented a letter to the Council members containing a motion passed by
the Board at their meeting on November 9th, regarding the proposed
49th Avenue entrance-exit to the K-Mart development.
He said basically the Board was attempting to state that after the
Council's invitation to participate in an informal discussion on
the matter of the pedestrian traffic a week ago, they became
concerned that the question of the need for the 49th Avenue
entrance-~t still had not been determined. He said the Board
wished that a pedestrian over-pass be established to preclude any
children from going through the traffic pattern should it be shown
the 49th Avenue entrance-exit was essential. He said there were

approximately 700 students who make their way back and forth throughout
the calendar year. He suggested the question on the exit-entrance
be examined by the Traffic Commission or the Planning and Zoning
Commission to have a final judgment.
Mayor Nawrocki said there were several conditions attached to
granting the building permit to K-Mart. One was with regards to
either a pedestrian signal light or a pedestrian over-pass on 49th
Avenue. Because of the grade, it would be more of a ramp-type
arrangement. He said he has talked with the City Engineer and expected
there will be a follow-up through the Traffic Commission on the parts
that are traffic matters.
The City Manager said he intends to use information on projected
traffic volumes in making a presentation to the Highway Department
on the warrants for a light at 47th and Central. The developer would
pay the cost of the signal.
Mayor Nawrocki said he was not sure the type of study m~erial
presented at the last meeting was as comprehensive as the School
felt it should be. The final point stated at that;meeting by the
developer was the access was needed on 49th Avenue and the Council
did concur with that. The concurrance was made that there would be
more attention given to pedestrian access.
Mr. Marshall said the concern lies that if there is a side street
entrance, the Highway Department would be reluctant to warrant
sema-phores on Central. He recommended further studies be made.
Final Payment on Orfei Watermain Contract.
The City Manager reported he traveled all the streets involved with the
watermain installation and considered the contract as complete. He
requested the Council release the $20,000 withheld less $1,439.43
for certain repair work. He said in almost every case, the street
is equivalent to what it would be now had there been no watermain
installation.
Councilman Land said if he lived on Gould Avenue he would not like
the appearance of the street. The City has saved enough money
in maintenance in the last few years and in projects like this we
can't let the people put up with a bad appearing street. The
City should go in and do more of the work to make the street look
better.
The City Manager said a seal coat would give the street a uniform
appearance but a seal coat is not feasible this time of year.
It should be done in hot weather. This could be done for approximately
~,ooo.
Motion by Land, seconded by Heintz that the City Manager be authorized
to proceed with seal coating on Gould Avenue from Central to
Reservoir Boulevard in the 1972 construction season, that the money
to come from the General Fund. Roll Call - All Ayes.

The residents from Gould Avenue who were ~resent at the meeting said
this would be satis~ctory to them and they would consider the street
to be back to the original condition after a seal coat.
Motion by Jeska, seconded by Land that the final payment of
$20,000 less the amount of $1,439.43 ~ authorized to complete the
Orfei ContraS. Roll Call All Ayes.
Resolution Re: Albert A. Kordiak Part~.
Howard Seim was present with a letter from Gerry Herringer,
A1 Martinsen, Jr., Don Bailey, Dick Johnson and himself asking
the Counci 1 to direct a letter to the Anoka County Board
asking that the name of the County Park located on 49th Avenue
be officially designated as the "Albert A. :(ordiak, Anoka County
Park".
The City Attorney directed the following resolution: Recommending
that the County Park on 49th Avenue and Highland Lake in
Columbia Heights be named "Albert A. Kordiak, Anoka County Park"
Offered by Logacz, seconded by Heintz, WHEREAS, Albert A. Kordiak
has served as a commissioner on the Anoka County Board with
great distinction and excellence, and
WHEREAS, under his dedication and guidance the present Anoka
County Park System has developed into one of the finest park
systems in this State, and
WHEREAS, under his deep and genuine interest in the concepts of
development, continuing improvements, the general well being and
achievement of high standards of this park;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Columbia Heights, that because of the commendable efforts
of Mr. Kordiak, recognition should be given to him by naming
the present County Park in Columbia Heights the "Albert A. Kordiak
Anoka County Park"
BE IT FURTHFR RESOLVED that a copy of this Resolution be presented
to the Anoka County Board at its next regular meeting.
Roll Call - All Ayes.
Park Construction Blasting Permit.
Mayor Nawrocki said at the last special meeting, the City Council
considered re-issuance of Parl~ Construction Company's blasting permit.
At that time the Council asked the City Manager to seek additional
technical advice for the benefit of the Council in an attempt to
see how this matter could be resolved. The name of Alfred Schroeder,
who was formerly wit'.~ the City of St. Paul, and who has had
considerable experience on different blasting situations, came up.
The Contractor agreed to compensate the City for engaging the
services of Mr. Schroeder.

Mayor Nawrock[ propos~ that in the three week period between now and
our next regular Council meeting, Mr. Schroeder come in and investigate
what is going on and make some recommendations.
Motion by Jeska, seconded by Logacz, that the Mayor and City Manager
be authorized to enter into an agreement with A1 Schroeder for
his services on the matter, and an agreement with Park Construction or
their subcontractor to compensate the City for Mr. Schroeder's
services. Roll Call - All Ayes.
Mr. McDonald from Park Construction requested they get a conditional
blasting permit to carry on under the conditions they have been working
on in Fridley inasmuch as they do come in close to Columbia Heights
when blasting in Minneapolis and Fridley. He said they have no
intentions of coming across to Columbia Heights at this time but
on the same count they will be working close to the border and he
would not like to be accused of a shot in Columbia Heights without
a permit.
Mayor Nawrocki suggested this matter be handled on a "Gentlemen's
Understanding" that they will not come into Columbia Heights.
Three weeks from toright at the next regular meeting, a report will
be given by Mr. Schroeder.
Recess was called at 10:00 p.m.
The meeting reconvened at 10:20 p.m.
Letter Re: Traffic Situation on 40th and Jackson.
Miss Dawn Shattuck was present at the meeting with her father and
presented a letter to the Council members regarding a pedestrian
crossing hazard at 40th and Jackson Street.
Councilman Land reported this problem has been brought up many times
at the Traffic Commission meetings. He said surveys have been run,
traffic counts made, and police watches, and so far they feel it is
about as safe as they could make it without actual lights going in.
Mr. Shattuck asked if signs could be placed that said "Automobile
Traffic MustStop for Pedestrian in Cross Walk".
Mr. Land suggested possibly putting out the roll-out stop sign from
the Library for a certain length of time.
After a lengthy discussion, a motion was made by Heintz, seconded
by Jeska, that the letter be referred to the Traffic Commission.
Roll Call - All Ayes.
Mayor Nawrocki said the matter will be brought to the attention of the
Police Department and they will be asked to pay a little extra
attention to this problem on 40th Avenue.

Resolution on Traffic Signals on Highway 47.
The Resolution was offered by Heintz, seconded by Jeska.
BE IT RESOLVED by the City Council of the City of Columbia Heights,
that the City enter into an agreement with the State of Minnesota,
Department of Highways for the following purposes, to wit:
To maintain and provide electric energy for 2 - 400 watt
mercury vap~r lighting units at the intersection of Trunk
Highway No. 47 (University Avenue Northeast at 40th Avenue
Northeast) and 2 - 400 watt mercury v, apor lighting units
at 44th Avenue Northeast in accordance with this Agreement,
a copy of which was before the Council.
BE IT FUffHER RESOLVED that the Mayor and City Manager are hereby
authorized to execute such agreement, and thereby assume for and
on behalf of the City all of the contractural obligations
contained therein.

Proposal for Implementing Joint Powers Act.
Councilman-elect Norberg presented a proposal prepared by Mayor Kirkham
of Frid~ey and himself for implementing a joint powers act in
Columbia Heights and Fridley. He said in this area, things have
not happened as much as they could. What has been missing is a
plan of action and a time table people will follow through. He
suggested meetings be set up between the two Councils and turn
the ideas over to the particular City Managers and get estimates
of the advantages.
Mayor Nawrocki said at one time we had a committee composed of
representatives of the different communities in this area, the purpose
of which was to try and determine areas we could work together on
jointly. He said this committee petered out, and toward the end
Fridley and Columbia Heights representatives were the only ones
who continued meeting. The whole idea was to try and find ways
of mutual purchasing and cooperating. He said we ought to be
working together, but the idea of getting both Councils together
might be too big a group. It might be better to have a smaller
group that could at least examine some proposals.
Councilman Land said the hang-up he sees is the whole Council
meeting like this. If someone wants to be a representative on the
committee, that is O.K., but if there are too many people you
wouldn't get things done. He wouldn't want our administrative
people getting involved in this during the day time until we get
something concrete.
Mayor Nawrocki suggested this could be a good thing for Mr. Norberg
to represent the Council on. We have to find out what Fridley's
reaction to this is too. Assuming they have some interest in
persuing it, a small group could better prepare the way.
The City Manager reported he contacted Mr. Guzy, Attorney for
Peter Tema and asked for some indication in response to his letter
of September 23rd at which time he asked if Mr. Tema would consider
selling the lots. He said since Mr. Tema does not wish to
consider selling his lots east of his home, we have three choices:

Condemn the lots.
Enter into an agreement wherein the City would pay Mr. Tema
$30,000 for his house and seven lots, and rent the house back
to Mr. Tema for a certain length of time.
Pay Mr. Tema $35,000 cash and request he move out within a
reasonable period of time.
The Council ~mbers indicated the third possibility of paying
$35,000 cash was too high, and they certainly would hate to condemn.
It was suggested the City Manager and City Attorney continue
negotiations and bring the matter to a head.
Petition to Vacate Street Right-of-way on 39th Avenue, Between McKinley
and Stinson.
A petition was received signed by W. J. Carr, Dr. Paul Williams,
and Gerry Herringer requesting 39th Avenue between McKinley Street
and Stinson Boulevard be vacated. Motion by Jeska, seconded by Heintz
that the request be referred to the Planning and Zoning Commission,
and the Traffic Commission. Roll Call All Ayes.
Assessor Traine~.
Motion by Land, seconded by Logacz that the City Manager be
authorized to hire additional help in the Assessor Department, that
the salary classification be determined by the City Manager, the
salary to be taken out of the proper budget, his starting time
to be at the discretion of the City Manager. Roll Call: Land,
Heintz, Jeska, Logacz - Ayes. Nawrocki - Nay. Motion carried.
Lot Subdivision Request, Lot ll, Block l, Aud. Sub. of Walton's
Second Sub.
The City Attorney said at the last regular meeting, Howard Dumphy
requested a lot subdivision for Lot 11, Block 1, Aud. Sub. of
Walton's Second Sub. He said he could not find any Council
action indicating the subdivision be granted upon payment of
sewer line. He said he will research this problem further.
Licenses.
Motion by Jeska, seconded by Heintz that the licenses as listed be
granted upon payment of proper fees. Roll Call - All Ayes.
4Oth to 45th Avenue should be brought up to those standards. It
is in continious lousy condition. He said regardless of whether
the people want it or not, as a citizen of Columbia Heights, he
uses the street. By the same token, other people use his street
which is kept at a bett~r level.
Motion by Heintz, seconded by Jeska to adjourn at 12:45 a.m.
