Ordinance #769 Granting Easementfor Soo Line Railroad.
A second reading was held on Ordinance #769 granting an easement for
railroad spur purposes east from Jefferson Street north of and
adjoining the north lot line of Lots 1 through 16, Block 1, of the
2nd Subdivision of Block F, Columbia Heights Annex to Minneapolis,
Anoka County. The ordinance was offered by Logacz, seconded by
Heintz. Roll Call - Ail Ayes.
Ordinance #768 Vacating Streets and Alleys West of California Street.
A first reading was he~ on Ordinance #768 vacating streets 'and
alleys in Columbia Heights Annex to Minneapolis bordered by
lots and blocks owned by Burlington-Northern Railroad. The
City Attorney recommended no action be taken on the second reading
of the ordinance until the City receives the deed to properties
which the railroad has agreed to transfer to the City.
Ordinance #770- Vacating Public Alley Between 38th and Edgemoor.
A first reading was held on Ordinance #770 vacating the public
alley between 38th Avenue and Edgemoor Place east of 3rd Street,
as petitioned for.
Resolution Directing the County to Levy Delinquent Special Assessments.
The Resolution was offered by Heintz, seconded by Land, BE IT
HEREBY RESOLVED by the City Council of the City of Columbia Heights
that the County Auditor be, and he is hereby directed to levy the
~Xdelinquent special assessments on the properties in the
City of Columbia Heights as submitted on the duplicate statement
forms with the amount to be levied indicated opposite the stamp
"Certified to County Auditor". BE IT FURTHER RESOLVED that the
foregoing amounts shall be included in the individual real estate
tax statements for the current year and identified thereon as
special assessments. Said levies shall be enforced and collected
in the manner provided for the enforcement and collection of state
and county taxes under and in accordance with the provisions of the
general laws of the State. All assessments with penalties 'and
interest as indicated thereon paid to the County Treasurer shall
belong to the City of Columbia Heights and shall be turned over
to the City Treasurer ~Xin the manner provided by City Charter and
ordinances. The City of Columbia Heights shall accept payments
on these levies until the end of the calendar year. Upon receipt
of said payments the County will be notified to remove this levy
from the tax rolls. Roll Call - Ail Ayes.

K-Mart Development, 4701 Central.
Marshall Goldman and Charles Johnson from K-Mart were at the meeting
and presented a plot plan of the proposed K-Mart Discount Store
development to be located between 47th and 49th Avenue east of
Central. The store proposed is to be one story with 115,492 square
feet. It would handle general merchandise, a food market, tire and
auto center, and garden store.
The property is zoned C-2-S and under this zone the 115,492 square
foot b~ilding would require 1,800 parking spaces. Mr. Goldman
requested the parking requirement be waived to permit 856 parking
spaces as recommended by the Planning Commission on September 23rd.
Mr. Goldman said K-Mart has made studies of their other stores
and have found that somewhere between 780 and 800 spaces is
adequate for their operation. He said a green area is proposed around
the entire site and this would make room for additional parking
if it is ever needed.
Mayor Nawrocki said our ordinances provide for screening between
commercial and residential areas. The K-Mart representatives
said a 6' chain link fence is proposed with strips in it. These
strips will be maintained yearly. It was reported a natural
vision ~barrier will be created after grading and landscaping.
Utilities and storm sewers are being worked out with the Engineering
Department and a suggestion was made to have the Traffic
Commission review the parking situation and traffic patterns
for their recommendations.
Motion by Heintz, seconded by Land that the waiver on parking
requirements be granted subject to review by the Traffic Commission
which ~Xwould allow the 780 parking spaces to serve the
115,492 square foot proposed building. Roll Call - All Ayes.

Home Federal Proposal, 4101 Central.
Representatives from Home Federal were presentX~ requesting
necessary waivers to construct a new facility at 4101 Central
Avenue N.E. Mr. George Pelto said they have found it necessary
to upgrade their facility and by putting up this building they
will show our community they have ~confidence in the area.
He said they were attracted to this corner because of the Mini-Park
across the street and said the two will compliment each other.
He said as far as screening is concerned, they propose to put up
a wooden fence that would match the architecture of the building.
The Planning Commission will approve screening at a future date.

Mr. Pelto said they will have a drive-in facility and felt 59 parking
spaces should be adequate although in a C-2-S Shopping Center
zone they would be required to have 85. Home Federal will deed
the City 5' for right-of-way purposes on 41st Avenue so the roadway
can be widened. Wide ~I~il side and front setbacks as required in
the C-2-S would not be logical in thist~~ case as Anderson Furniture
building across' 41st Avenue is built up to the front property line
and Home Federal does not want their building back so as to be
hidden from the north bound traffic on Central. Therefore they
request a waiver to build within 9' of the front property line and
10I of the relocated si'de lot line on 41st Avenue.
Motion by Land, seconded by Logacz .that the front and side yard
waivers be granted and that the parking waiver be granted to
allow the proposed structure to meet parking needs of 59 spaces.

Mr. Brown said this proposal will also be discussed at the
Traffic Commission meeting.
United States Civil Defense Council meeting.
A request was received from the Civil Defense Director to authorize
expenses for the Police Coordinator, Curtis Ramsdell, to attend
the conference of the United States Civil Defense Council to be held
October 17-22.,. 1971 in Las Vegas, Nevada. The expenses would
include travel, registration fees, etc., a part of which will be
reimbursed by the Federal Government. Motion by Logacz, seconded
Xby Heintz, to grant the request. Roll Call - All Ayes.
Meeting Date Changes in October.
The City Manager reported the holiday schedule has established the
2n.d and 4th Mondays in October as legal holidays. Therefore,
our regular meeting dates will have to be changed. Motion by
Heintz, seconded by Logacz .that the two regular meetings be changed
from Monday the llth and 25th, to Monday the 18th, and Tuesday,
the 26th of October at 8:00 p.m. Roll Call - All Ayes.'
Special Meeting to Consider 1972 Budget.
Mayor Nawrocki called for a special City Council meeting to be held
at 8:30 p.m. on Monday, October 4th for purposes of consideration
of adoption of the 1972 budget.
Report on Watermain Restoration.
A number of residents from Gould Avenue and a resident from
1625 - 37th Avenue were i~t~(&~prese'nt wondering when the restoration
work would be completed on the watermain project. The City Manager
reported a meeting was held with representatives 'from Orfei & 'Sons
and the City to go over the list of items. IIHe said there were
strong disagreements on the part of 0rfei on what constituted
items directly ~associated with project work. The City Attorney

said in the contract and bid specifications it talks about street
restoration and indicates the contractor shall restore all ~street
surfaces damaged by the construction. Then it indicates standards by
which it should be restored. In so far as the street restoration is
concerned, if they have worked on a street location, they be required
to restore the street to its original condition. After a lengthy
discussion, Mayor Nawrocki stated: 1. Orfei completes his work and
tells us it is complete. 2. The Engineer~(~inspects it and if he
feels it is done, he tells the Council. 3. Then, it is up to the
Council to make the final ~X~decision~(to let go ~of the money.
He said, before the matter comes back to the City Council, all the
work must be done. The names and addresses of the residents present
were written down and will be contacted when this will be brought up
for final consideration.
Lot Subdivision Request for Lot 6, Block 2, Reservoir Hills.
Motion by Heintz, seconded by Land that the lot subdivision request
from Robert V. Kallstrom for the south 165' of Lot 6, (subj. to rd. &
Util. ease. over S. 30~'), Block 2, Reservoir Hills, be granted.

Request for Black Dirt.
Mr. MurzYn was present and requested 800 yards of black dirt to be
used at McKenna and Huset Parks. Motion by Land, seconded by Heintz
that the City Manager be authorized to purchase an additional 800 yards
more or less of black dirt under the te~ms of the existing contract
with the supplier and that such money will come from within the scope
of the existing budget. Roll Call - All Ayes.

R~e. ques't''Authorization to Attend Bldg. Officials Conference.
Mr. Sonnenberg requested authorization to attend the International
Conference of Building Officials in Honolulu~ Hawaii October 6-13
at an estimated total cost' of $650. Motion by Heintz,. seconded by
Land to deny the request. Roll Call - All Ayes.
Joint Purchasing.
Mr. Barna reported a meeting was going to be held on Tuesday to set
up specifications for new cars. Each municipality would have to
make a commitment if they wanted to be included in the joint
purchasing. The Council members seemed to be in favor of joint
purchasing and suggested the City Mechanic also attend this
meeting.

Motion by Heintz,t seconded by Land to grant the license' applications
as presented upon payment of proper fees. Roll Call - All Ayes.
