Regular Meeting
September 13, 1971
The meeting was called to order in the City Council Chambers at 8:03 p.m.
Roll Call: Land, Heintz, Jeska, Logacz, Nawrocki - present.
Invocation was given by Rev. Curti s

Minutes of last Regular Meeting.
Motion by Heintz,' seconded by Jeska to approve the minutes of the
last regular Council meeting as presented in writing and the reading
be dispensed with. Roll Call - All Ayes.
Payment of Bills.
Councilman Jeska questioned two of the bills as presented for payment,
one being #13205 to Columbia Heights Agency in the amount of $5,825.00,
and the other #13243 to State Treasurer in the amount of $137.43.
Mr. Barna explained that #13205 was the audit on last year's premium
and #13243 was payment to State Treasurer on a surcharge which is
now levied on all permits as required.

Ordinance #769 Granting Easement for Soo Line Spur Track.
A first reading was held on Ordinance #769 granting an easement for
railroad spur purposes east from Jefferson Street north of and
adjoining the north lot line of Lots 1 through 16, Block I, of the
2nd Subdivision of Block F, Columbia Heights Annex to Minneapolis,
Anoka County. Mayor Nawrocki reported the second reading of the
ordinance constitutes a public hearing and the matter will be
considered at that time.
Consideration of Ordinance #768 Vacating Streets & Alleys West of
California Street.
Mayor Nawrocki said Ordinance #768 related to item 6j. on the agenda,
lease proposal for 3755 Califomia Street, and the two items
should be taken up at the same time. The City Attorney was late
for the meeting and the City Council members expressed the ~X~
desire to withhold consideration until he could be present.
Resolution Regarding Blasting and Crushing on Burlin.gton-Northern
Construction.
After a lengthy discussion with the residents in the vicinity
of the BuXrlington - Northern classification yard construction site,
and Park Construction, the railroad's prime contractor, a resolution
authorizing and establishing limitations on blasting and ~ck crushing
west of California Street N.E. north of 37th Avenue N.E. was
offered by Jeska, seconded by Heintz. BE IT HEREBY RESOLVED
by the City Council of the City of Columbia Heights that
WHEREAS, the City of Columbia Heights and Burlington-Northern, Inc.
entered into an agreement dated February 8, 1971 anticipating
exchanges of properties, relocation of certain utilities and
proposals regarding procedures on construction, and WHEREAS,
Burlington-North.ern and their prime contractor, Park Construction
Company are now prepared to proceed with construction on the site
consisting of earth moving, blasting and rock crushing. NOW,
THEREFORE, BE IT RESOLVED that the City of Columbia Heights
authorizes the proposed construction work to proceed with the
following governing conditions: 1. Nooperations to proceed

before 6:00 a.m. nor after 10:00 p.m. on the site. 2. Blasting to
be done no more than once a day betwee~ 8:00 a.m. and 4:30 p.m.
3. That all structures on Main Street and California Street from
37th to ~Sth Avenue N.E. be inspected prior to any blasting with
the cost of such inspection to be bourne by the contractor.
4. That a mutually acceptable testing firm, ~owledgeable in the
testing of shock and vibration waves, be retained to test all
blasts which are made and submit copies of the test reults to the
City. 5. That any streets 'in the City of Columbia Heights for
hauling of excavated materials shall be properly maintained by the
contractor including necessary surface repairs, watering or spreading
chlorides for dust control and such other maintenance as deemed
necessary due to the usage by the contractor. 6. That the
performance standards of zoning ordinance ~$#462, Section 5.12 shall
be conformed to. BE IT FURTHER RESOLVED that the foregoing
requirements on construction remain in effect for the duration
of the construction work on the Burlington-Northern site and that
the City Manager be authorized to issue a special use permit
which shall include these foregoing requirements. Roll Call -

Bids on Custodial Services.
Motion by Logacz, seconded by Land, that the City Manager be
authorized to advertise for bids on custodial service for the
Municipal Building and Library, bids to be opened at a special
meeting which is hereby called for Monday, October 4, 1971 at 8:00 p.m.
Roll Call - All Ayes.
The City Manager and the City Attorney were directed to explore
the Wage-Price Freeze on bids and contracts we might award.
Bids on Garbage Pick-up Service.
The City Manager presented copies of proposed specifications for
garbage pick-up service. The specifications were reviewed by the
Council and changes were recommended. These included a $25,000
Performance Bond,.the hours of the pick-up, and a list of items
that could not be picked up. The owner of 1121 Gould Avenue was
present and asked for clarification on pick-up of lumber and he
also asked if a general spring or fall clean-up was to be held.
Motion by Jeska, seconded by Heintz that the City Manager be
authorized to advertise for bids on garbage pick-up service, bids
to be opened October 4, 1~1 at 8:00 .p.m. Roll Call - All Ayes.
Chiefs of Police Association Meeting.
Motion by Land, seconded by Heintz that the Police Chief be
authorized to attend the Minnesota Police Chiefs Association
meeting at Silver Bay, Minnesota on September 17, 1971. Roll Call -
All Ayes.

Request from Orfei For Final Payment on Contract.
A request was received from Orfei & Sons for final payment on the
watermain contract. In their request it was stated the requirements
on the clean-up list were complied with and that the work was completed.
They asked that the $20,000 being withheld be released immediately
and reminded the Council the Performance Bond was in effect which
guaranteed the work for one full year after final acceptance.
The City Council members did not agree with Orfei that the work was
completed indicating clean-up work must be done in certain areas.
The suggestion was made to negotiate a cash settlement with Orfei
which would allow the City to handle the balance of the restoration
work.
A petition was received from the residents on Gould Avenue requesting
the surfacing job on their street be completed as promised when the
main was put in during the fall of 1970. They indicated if the
contractor would not finish the job, the City appropriate funds to
do the job without additional cost to the residents. Motion by
Heintz, seconded by Jeska that the petition be placed on file.
Roll Call - All Ayes.
The City Manager and the City Attorney were directed to review the
matter of responsibility for the restoration work and report back at
the next Council meeting. Motion by Logacz, seconded by !~eintz that
the City Manager proceed with the completion of the watermain
project with most haste. Roll Call - All Ayes.
Approval of Election Judges.
Motion by Heintz, Seconded by Land that the attached list of
election judges as submitted by the City Clerk-Treasurer, be approved
for the primary and/or general election. Roll Call - All Ayes.
Recess was called at lO:i5 p.m.
The meeting re-convened at 10:30 p.m.
Alley Vacating East of 3rd Street, 38th to Edgemoore.
A petition was received from the property owners on 3rd Street between
38th and Edgemoore Place to vacate the alley east of their property
along University Avenue. Motionby Heintz, seconded by JeslCa that the
City Manager be authorized to prepare an ordinance for the vacation
of the alley north of 38th Avenue west of University to be presented
at the next regular City Council meeting. Roll Call - All Ayes.
Side Yard Waiver, 4517 Fillmore.
A request was received from Mr. David Battig for a side yard waiver
to place a garage 2' from side lot line at 4517 Fillmore Street.
A statement from his neighbor was presented indicating no objections
to the waiver. The waiver was recommended by the Planning and
Zoning Commission. Motion by Land, seconded by Logacz that the
waiver be granted as requested. Roll Call - All Ayes.

Front Yard Waiver, 5150 Matterhorn Drive.
A request was received from Mr. Edward Berryman for a front yard
waiver to construct a room addition 15' from~ front ~property
line. Signed statements from both neighbom indicating no objections
were presented. This waiver was recommended by the Planning and
Zoning Commissi'on. Motion by Land, seconded by Heintz to grant
the waiver. Roll Call - All Ayes '
Lot Subdivision Request, 349 - 42nd Avenue.
A lot subdivision request' was received from Mrs. Irene Jolly for
349 - 42nd Avenue. The Planning and X~n~X~ZoningX~K~Commissi°n
recommended the subdivision making thelot with the old house at
349 - 42nd Avenue 60 .x 82.42'~ (5,262.2 square feet) and the
new site at 333'- 42nd Avenue 74..3 x 87.42' (6,495 square feet)
which is as close as possible to a legal size building site for a
new home, with the old home remaining on a lot with the same square
footage as a standard 40 .x 130' lot. Motion by Jeska,
seconded by Heintz that the lot area waivers be granted to allow
the subdivision, that the outstanding special assessments be divided.
Roll Call - Ail Ayes.
Lease Proposal for 375~ California Street.
Mr. John Curtiss of Burlington-Northern Railroad was present with
a lease proposal for the Artistic Screening building at 3755
California Street. The proposal is to lease the front portion
of the building to the Bjugans 'for one year with the option to
renew for two additional one year periods' The lease rental would
be $225. per month and the Bjugan's would be resl)onsible for normal
maintenance on the portion leased by them together with paying
water bills for the entire building and electricity furnished to
their portion of the building together with electricity furnished
to the rest rooms. They would have four parking spaces in the
front of the building. The City could lease the back ½ of the
building to Century Tool for ~1527.5 per month and Century would
have the right to ten parking spaces along the side and rear of
the building. The City would cover taxes and insurance on the
building itself. Motion by Jeska, seconded by Heintz to accept
the proposed lease terms as .presented for the property at
3755 California Street.
Ordinance #768 Vacating Streets and Alle~_~ West of California.
In conjunction with the lease proposal for 3755 Califor.nia Street,
Mr. Curtiss of Burlington-Northern ~l~Xasked for a first reading
of Ordinance #768 vacating certain streets and alleys west of
California Street. The City Attorney advised no reading be held
until a signed agreement is reached on the property transfers.

Rental of Votomatics.
The City Manager reported after investigating all angles on the
electronic voting devices that we ~cannot purchase economically
used equipment. He contacted Computer Election Systems which
is the equipment being used in other communities in Anoka County.
They have offered to rent to us all necessary equipment for both
our elections and handle the training and instructions for our
Judges. The County has agreed to work with us on tabulation
of the elections. The total cost of renting would be $30 per
unit. The total outlay of money which included all necessary
training and instructional advice would be $2,610. We would
purchase the ballots ourselves. He said if after the election
these are desirable, we could then call for bids on equipment.
Motion by Jeska, seconded by Heintz to rent 85 machines plus the
demonstration units from Computer Election Systems for the upcoming
primary and general municipal elections in an amount not to exceed
$2,610. Roll Call - Ali Ayes.
Resolution Condemning 561 - 51st Avenue.
A Resolution ordering ce~ain buildings located at 561 - 51st Avenue
Northeast, Columbia Heights, Minnesota, to be razed and removed,
was offered by Jeska, seconded by Heintz, WHEREAS, Paul L. and
Frieda I. Anderson are the owners of a certain building located
at 561 - 51st Avenue Northeast, Columbia Heights, Minnesota,,
on the below legally described property, and WHEREAS, that
building is best described as a house, and WHEREAS, after the
receipt of numerous complaints, the City Council of the City of
Columbia Heights ordered an inspection to be made of the above
described premises, which described premises was found to be
inadequately maintained, dilapidated, abandoned and in a state
of disrepair, and that children are attrac~d to the building and that
the building does ~ constitute a ~hazard to the public safety
and health and that it does not conform to the building code
of the City of Columbia Heights. NOW, THEREFORE, BE IT
RESOLVED that Paul L. and Frieda I.Anderson shall be ordered
to raze and remove the building on the property legally
described as: The East 74.33 feet of the West 144.33 feet of
Lot Ten (10), Auditor's Subdivision ~ Number 51, Anoka County,
Minnesota. This action is taken pursuant to Minnesota Statutes
Annotated, 463.15 though 463.26 on the §rounds that the said
building is a hazardous building within the meaning of that
statute. Roll Call - All Ayes.
Licenses .
Motion by Jeska, seconded by Heintz that the list of licenses
as attached be approved upon payment of proper fees. Roll Call -
All Ayes.

Repair of Boiler.
Motion by Land, seconded by Jeska that the City Manager be authorized
to spend an amount not to exceed $1,250 for repair of the boiler in
the Field House. Roll Call - All Ayes.'
