Regular Meeting
August 23, 197l
The meeting Was called to order in the Columbia Heights Field House,
530 Mill Street N.E. at 8:08 p.m. Roll Call: Land, Heintz, Jes~a,
Logacz, Nawrocki - present.
Minutes of Last Regular Meeting.
One correction was noted on the minutes of the June 28, 1971 meeting.
Motion by Land, seconded by Heintz that the minutes of the June 28th
meeting be corrected to show the cost estimate on the Sullivan Lake
Sanitary Sewer Project at $11.00 per foot instead of $1.00 per foot.
Roll Call - All Ayes,
Motion by Land, seconded by Heintz that the minutes of the last
regular meeting (August 9, 1971) be approved as presented in writing
and the reading be dispensed with. Roll Call - All Ayes.

Bids on Pick-up. Truck.
One bid was received on a 1/2 .ton pick-up truck as 'advertised for' the
Park Department. The bid was from Midway Ford on a 1972 3/4 .ton
F-260 .Ford pick-up, total price $4,0.68.00. with $300 trade-in for
a net price of $3,.768.00 to be delivered 10/23/71. Mr. Murzyn, .Park
Superintendent, was present and said the 3/4 ton is bigger than
we want and recommended rejecting the bid~on the basis it did not
meet sp'ecifications. Motion by Jeska, seconded by Logacz .to reject
the bid. Roll Call - All Ayes.'
Ordinance #763 - Commercial & 'Industrial Garbage Pick-up..
The City Manager presented an amendment to Section 4 in Ordinance
#763 establishing procedures for the maintenance of sa'nitary
rubbish accumulation at c~mmercial and industrial property.
The amendment read "Where it is physically impossible to place
the containers behind the rear line of the main building the
containers shall be placed as inconspicuousl'y as possible along
the side or in front of the building with appropriate sc'reening.~
A second reading was held on Ordinance #763 and it was 'offered
by Heintz,'. seconded by Jeska. Roll Call - All Ayes.' Ordinance #763'
was adopted.
Resolution Ratifying By-Law Changes in Police Pension.
A resolution ratifying by-law changes in the Police Relief Association
as adopted by the membership thereof at their special meeting,
June 17, .1971, was offered by Land, seconded by Jeska, BE IT HEREBY
RESOLVED by the City Council of the City of Columbia Heights that:
WHEREAS, the 1971 Minnesota Legisl'ature in Chapter 11, .provides
that all by-laws or articles of incorporation amendments
affecting the benefits paid by any po. lice or fire association will
not be effective until ratified by the local Council, and
WHEREAS, the Columbia Heights Police Relief Association has
adopted three (3)' by-law changes on June 17, 1971 effecting
the benefits of the pension plan, copies of which are inclUded
herewith~ and WHEREAS, said changes constitute a reduction in
benefits which is 'a necessary and desirable indication of concern
about the actuarial deficit in the pension fund which continues to
increase, and WHEREAS, certain additional by-law changes 'are under
consideration in conjunction with the negotiations now underway
which would also' tend to reduce the pension actuarial deficit.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Columbia Heights does hereby ratify the by-law amendments as approved
by the Association membership and copies of said amendments 'are made
a part of this resolution by reference. Roll Call - A11 Ayes.
Mayor Nawrocki said the changes that have been adopted by the men
~o constitute so'me relief, perhaps not all the relief that is
necessary, but it is a step in the right direction.

Ordinance #768 'Va'Ca'ting Streets and Alleys West of California Street.
A discussi'on was held on a proposed ordinance which would vacate
streets and alleys bordered by lots and blocks owned by Burlington-
Northern Railroad in conjunction with development of Burlington's
classification yard. A representative of the Railroad was present
and said he saw no reason to delay holding a first reading of the
ordinance as it has to be done at some point. He said things were
getting bogged down and the City and the owner of 3755 California
Street wiil have to come to terms on a lease arrangement.
Mayor Nawrocki said he felt holding up action on the vacating might
act as an inducement to clear up the other problems on the land
exchange. The City Attorney said since no agreement has been worked
out between the Ra[lroad and the ~owner of 3755 California on a
land exchange, it would be his recommendation to withhold
consideration of the vacating ordinance.
Lot Subdivision Request for 1434 .- 42nd Avenue.
Motion by Jeska, seconded by Land that the lot subdivision request
to split Lot 1, Block 4, .Reservoir Hills, Anoka County (143.4 -
42nd Avenue) to be described as: 1. The most' N'ly 78' of the most
W'ly 70I and the most W'ly 60' ly. S. of the most n'ly 78I (EX.
Rdwy & Sew. ease.) of Lot l, .Block 4, Reservoir Hills, Anoka Ccuty.
2.. Lot 1, ex. for the most N'Iy 78'. of the most W'ly 70' and the
most ~W'ly 60' ly. S. of the most N'ly 78' (ex. rdway & Sew.
Ease'.) Block 43 Reservoir Hills,' Anoka County, be granted.
Roll Call - All Ayes.
Park Construction Request for Blasting and Crushing Permit.
A request was received from Park Construction for a blast'ing and
crushing permit for excavation work they will be doing in the
Burlington-Northern railroad yard. Mr. Gerald McDonald from Park
Constru¢ion was present with plans 'and Said the blasting will be
sufficiently far from any residences, that a testing company
with a seismograph will register all blasts and the blasting
~~ will be done by a professional.blaster. He sa'id ail
the homes in the area are being checked over as far as conditJons
presently exist and that small shots will be used so' shock waves
will not be too big. He said the rock,formation is pretty much
uniform being 8' to 12' limestone. Mayor Nawrocki suggested'
the City get an expert in on this 'to advise the Council and to
suggest what type of safety program would be necessary. He said
the expert will have to be someone mutually agreeable with
the City of Minneapolis and the City of Fridley. It was decided
to hold an informal public hearing on Wednesday, September 8th at
8:.00 .p.m. in the Field House to give people a chance to ask
any questions. Notices will be sent out to affected property
owners .'

Report on City Garage Site.
Tom Van Housen, Progressive Design Associates, was at the meeting
and presented a report on the sites 'that have been studied for the
City Shop. Only two sites were in his mind worthy of consideration,
those being Site A, .the ~XX~X~ property on 38th Avenue between
~Madison Place and Quincy, and Site B on California Street between
39th and 40. th Avenue. He presented the problems of the site on
California Street being limited acreage for stock piling and
parking, and said it depended on lease arrangements with Burlington-
Northern. He said accessability was not good, that the only
available outlet was 39th Avenue to Main Street. He recommended
the property on 38th Avenue (Site A) be considered.
~.~t¥ Attorney. Reports.
The City Attorney reported receiving notice of a pre-trial hearing
on the Glover case, he reported on the tax freeze situation, and
on claims from residents in the City of Minneapolis as a result of
storm sewer back-ups.' He also reported an agreement was prepared
to supplement a letter from Central Plaza., Inc. on the 45th Avenue
overlay project.

Motion by Heintz,. seconded by Jeska that the license applications
as listed be granted upon payment of proper fees. Roll Call -
All Ayes.
